" ,r", .L.'J AUBLRN, WASH I NGTON NDNDAY FEBRUARY 5. 1968 The Regular Meeting of the City Council of the City of Auburn convened at 8:00 p.m. in the Council Chambers at the City Hall. Mayor Gaines called the meeting to order. Councilmen present: Kline, Sonnemann, Bailey, Fitzsimmons, Blakeney, Darling and Nickson. I lit was moved by Blakeney, seconded by Sonnemann, that the Minutes of the January 15, 1968 Council Meeting be approved with the following amendments: Page 4 - second item - should read as follows: "Ci ty Engineer Fred Poe recommended approval of Change Order No. I, EDA Street ....1 Page 4 - Audience Participation - first item should read as follows: "$450.00 were presented to City Council by Junior Chamber of Commerce for recreation equipment at the GSA Park. The Auburn Jaycee Auxiliary presented $100.00 toward the purchase of a light pole at the GSA Park." Page 5 - Street Cörrmittee - should read as fol+ows: ..... for a I year period. Mrs. Davis, Chinook Motel, stated she did not know about the name change until last week. They have spent..." NDTION CARRIED PUBLIC HEARINGS Mayor Gaines declared the public hearing open on the request of Klontz, Hanson and Knickerbocker to rezone from R-2 to C-I, C-3, and P-I property located on all four conners of the intersection of 8th and Harvey Road N.E. (Rezone Request No. 58-67) The Auburn Planning Commission recommended, that Parcel 4 of Rezone Request No. 58-67 be granted approval, and be subject to the submission of detailed development plan showing uses to be approved by the Planning Commission prior to the issuance of a Building Permit, and that the park area be developed to the Bark Board's specification pr$ør to dedication to the City and if the City does not want to accept the petitioners shall develop and maintain said park and covenant same and also dedications as suggested by the Public Works Department be dedicated by the petitioners. Consider- ation should also be given to the installation of a traffic signal at the corner of 8th and Harvey Road with the petitioners paying their pro-rated share as determined by the Street Committee of the City Counci I. I Discussion on Parcel 4 only commenced: Dennl. White (audience) asked about possible provisions concerning traffic problems. Mr. Snyder, representing the property owners, presented a plan of proposed development. Mr. Bills of Albertsons (Boise) explained plan of development for his store and the shopping area. Mike Lohrer (audience), whose property backs the proposed building site, wanted to know what type of industries could move in if the rezoning takes place and if legally the City of Auburn would bave any control over the type of business and industry that might come in if the rezoning takes place. Bob Klaus (audience) stated that, when Mr. Lohrer bought the property, there was a City Sewage Disposal Plant in the area. C. L. Goudwlth (audience) agreed with Mr. Lohrer, that any new industry (light manu- facturing, all-night drtve-in, etc.) could create unnecessary noise and traffic. Dennis White (audience) again asked about traffic controls and Mr. George Schuler, Planning Director, stated that traffic counts had been taken in the past, but new coints would be taken again, so that the Street Committee can determine the need for a traffic control signal. He further mentioned, that 8th Street is considered to be a street arterial. Mr. Schuler reported, that about a year ago the traffic amounted to 5,000 cars a day. It was moved by Blakeney, seconded by Sonnemann, that public hearing be closed. I MOTION CARRIED It was moved by Kline, seconded by Fitzsimmons, that Parcel 4 of Rezone Request No. 58-67 be granted for rezone and the City Attorney be authorized to draw up the necessary ordinance implementing this rezone subject to the following: "That on the corner of the C-3 property a 25 foot radius and the need for a traffic signal be worked out between the Street Committee and the Petitioners, and that the C-I land be subject to the requirements of a 50 foot buffer strip on the property that is adjacent to Massey's first addition and further, that the property owners and/or assignees shall be required to maintain the green belt in perpetutty and that they shall plant and cause to grow screening type shrubs and/or trees in confonmance with the requirements of the Park Board and further the Park Board shal I detenmine the need i Ie.. AUBURN. WASH I NGTON NONDA Y FEBR UARY 5. 1968 for a screen fence along the Massey addition due to the existing fences. The Park Board to coordinate the requirements between the developer and the adjacent property owners, and that the C-3 portion be restricted to service stations e.ly and that said service stations shall be located and of the size in accordance with the plans sub- mitted by the Petitioners. MOT ION CARR I ED Mayor Gaines declared Public Hearing on petition by Otis E. and Opal A. Love to vacate a street situate at the North 5' of 110" Street S.E. lying North of 29th Street S.E. (Reso I ut i on No. 297). In the meeting of the Auburn Planning Commission held on January 18, 1968, it was moved by Burgeson, seconded by Lea, that the request of Otis Love for the va- cation of the North five feet of "0" Street lying North of 29th Street S.E. be denied. Motion was carried. I It was moved by Sonnemann, seconded by Blakeney, that public heaing be closed. NDT I ON CARR I ED It was moved by Bai ley, seconded by Blakeney, that petition be denied. MOTION CARRIED Mayor Gaines declared Public Hearing on the request of Mrs. Reuben Gaenz to rezone from Unclassified to R-4. (Rezone Request No. 61-67) The Auburn Planning Commission recommended to the City Council that on this request R-3 be considered in lieu of R-4, upon condition the þetitioner grant the necessary dedication for the future development of 24th St. N.E. Ernest Folam (audience} opposed the reclassification because a High-Rise apartment house would cut off the view. Mrs. Buckner (audience) and Mr. Robert Colson (audience) opposed for the same reason. I It was moved by Nickson, seconded by Blakeney, that public hearing be closed. NDTION CARRIED It was moved by Nickson, seconded by Bailey, that the recommendations of the PlanBing Commission be concurred with, that the City Attorney be authorized to draw up the necessary ordinance implementing this rezone, property be rezoned R-3 instead of R-4, as this is a large area. MOT ION CARR I ED Mayor Gaines declared Public Hearing on Petition of F. E. Hammons and John T. Schweiger for annexation of area of real property lying adjacent to the easterly marginal line of the existing City limits of the City of Auburn to the City of Auburn. Mr. Hammons' requested annexation seems a natural boundary. It was moved by Sonnemann, seconded by Nickson, that public hearing be closed. MOTION CARRIED It was moved by Sonnemann, seconded by Nickson, that the City accept this annexation to I the City and that application be made to Boundary Review Board for waiver of théir approval on this and that City Attorney be instructed to draw up the necessary ord i nance. MOTION CARRIED Mayor Gaines declared Public Hearing on Petition to annex area of real property lying adjacent to the easterlŸ marginal line of the existing City Limits of the City of Auburn to the City of Auburn. Joe Stone (audience) stated ~is objection to the annexation in that some of the property owners desired to maintain country air and keep animals. AUB~N. WASH I NGTON NONDAY FEBRUARY 5. 1968 .~)7 Mr. Jenkins (audience) stated that there had been a number of burglaries in the past weeks and wondered if police protection would be increased. ~t was moved by Sonnemann, seconded by Blakeney, that public hearing be closed. MOTION CARRIED It was moved by Sonnemann, seconded by Nickson, that the annexation be accepted and submitted to the Boundary Review Board for their approval and upon approve I to instruct City Attorney to draw up the necessary ordinance. I MOTION CARRIED CORRESPONDENCE The following recommendations of Requests for Zone Changes were submitted: (I) The Auburn Planning Commission recommends that Rezone Request No. 62-67 be granted with consideraflon being given to the dedication of the westerly five feet for the highway expansion as it fits in with the Comprehensive Plan of the City for Enumclaw Highway. (Request of James C. Downey to rezone from R-3 to C-I, a parcel of land on the east side of the Enumclaw Highway in the 900 block.) (2) The Auburn Planning Commission recommends that Rezone Request No. 63-61 be granted providing the applicant remove the garage to front of the building thereby addiÀ9 extra customer parking space. (Request of W. J. Horn to rezone from SPU for Apartments to SPU for Professional Offices, a parcel of land on the east side of Harvey Road in the 1100 block.) (3) The Auburn Planning Commission recommends that the Rezone Request No. 64-67 be granted with consideration being given to the dedication of the easterly 30' for Street purposes, as this is adjacent to C-I to the North and across Howard Road from C-I and C-3 and is on a ~ajor arterial and fits in the Comprehensive Plan of the City. (Request of N. Van Hoosen, C. Jinneman to rezone from R-2 to C-I, a parcel of land at the N.E. corner of 21st St. S.E. and Howard Road.) I (4) The Auburn Planning Commission recommends that Rezone Request No. 59-67 be granted, as it is between the Commercial on the West and Residential to the East, and falls within the Comprehensive Development Plan for the area. (Request of George McLaughlin to r:ezone from Unclassified to R-4 property located at 2335 "I'· St. N.E.) (5) The Auburn Planning Commission recommends that Rezone Request No. 60-67 be granted on condition that the building is buil' as submitted, and in accordance with the requirements of the Public Works in the dedication of the southerly five feet for Street purposes, as it falls in with the overall Comprehensive Plan of the City. (Request of M. L. Bland from Unclassified to R-4 property located at the N.E. corner of 22nd and "III St. N.E.) The following applications for Zone Changes were submitted: (I) Seaport Development Company property zone changed from R-2 to R-3, located N.W. corner 22nd Avenue N.E. and "M" Street. (2) Haartman zone changed from R-2 to IPU, located 909 - 29th St. S.E. (3) Kuzmer zone changed from R-2 to R-4, located 630 "M" St. N.E. Request to call for ~ublic Hearing on the Final Assessment Roll of LID 186, Final Assessment Roll of LID 199, Final Asses~ent Roll of LID 201 and Final Assessment Roll of LID 187. I It was moved by Kline, seconded by Blakeney, that the reading of the correspondence be omitted, that Public Hearings for rezone requests no. 62-67, 63-67,64-67, 59-'7 and 60-67 be held at 8 p.m. on February 19, 1968, Zone Change Applications be referred to the Plamiting Conmission for recommendation, Pub I ic Hearings on LID's No. 186, 199, 201 and 187 be held on March 4, 1968, 8 p.m. MOTION CARRIED AUDIENCE PARTICIPATION Jim Ewing (audience) noted, that Auburn's development is changing and, in order to main- tain the neighborhood character of the City, a study should be made on the method of de- creasing traffic. He recommended i.e., that as streets are repaved, bumps could be placed at regular intervals, which in turn would slow down the fraffic flow. 19 AUB~N, WASH I NGTON NDNDA¥ FEBRUARY 5. 1968 RECOMYIENDAT/ONS City Clerk Williams read the program submitted by AI Rossi, President, Park and Recreation Board for the City of Auburn Park Department's Six-Year Expenditure Program. It was moved by Nickson, seconded by Blakeney, that the program be approved. MOTION CARRIED Petition for annexation to City of Auburn of area South of 37th St. S.E. and Stuck River to the Pierce County Line. I Engineer's CertIfication - Proposed Annexation to City of Auburn that property owners representing 13.19% of the value of property according to the assessed valuation for general taxation of the property for which annexation to the City of Auburn is petitioned. It was recommended, that property owners be notified of a meeting on Thursday, February 15, 1968, 7:30 p.m., regarding proposed annexation to City of Auburn. City Engineer Fred Poe requested approval for formation of LID No. 212, sanitary sewers on Harvey Road from 6th St. N.E. to point approxi.ately 300 ft. north. It was moved by Kline, seconded by Sonnemann, that City Attorney be instructed to draw up the necessary ordinance creating LID 212. IKJTION CARRIED City Engineer Fred Poe requested that approval be given to create a resolution authorizing the signing of a contract with Puget Sound Power & Light per action taken by City Counci I January 15, 1968. It was moved by Kline, seconded by Sonnemann, that authorization be given City Attorney to create a resolution authorizing the signing of contract with Puget Sound Power & Li gh t. IKJTION CARRIED I City Engineer Fred Poe requested permission to advertise for a street flusher for the Equipment Rental Fund. It was moved by Blakeney, seconded by Kline, that bids be called for a street flusher. I n the amount of $40,557.70, EDA Street, Phase I I, Progress Estimate No.5, was removed due to an error in computation and wi II be resubmitted at a later date. It was moved by Kline, seconded by Nickson, that King Construction Co. be paid $100.63 for Progress Estimate No.2 (final) for LID No. 205. FEBRUARY 5. 1968 TOTAL BID $ 2,433.07 $ 2,485.16 $ 2,569.31 City Engineer Fred Poe recommends, that bid be awarded to Bothell-Chevrolet-Cadillac in the amount of $2,433.07. It was moved by Nickson, seconded by Blakeney, that bid be awarded to Bothell-Chevrolet Cadillac in the amount of $2,433.07. I MOTION CARRIED Mr. AI Rossi, Chairman, Park and Recreation Board, requests that the City Council call for bids OR tractor and front loader. Specifications are available at the City Clerk's Off ice. It was moved by Nickson, seconded by Darling, that Call for Bids be made on tractor and front loader, Bid Opening to be held February 23, 1968. MOTION CARRIED PROCLAMATIONS, APPOINTMENTS AND ANNOUNCEMENTS I t was moved by KI i ne, seconded by Sonnemann, that Ron Brannon\,be appoi nted Defense Director upon assignment bt Mayor Gaines. NDTION CARRIED Mayor Gaines appointed Council Committee to work out information regarding the new City Hall and to recomeend an architect, to hold public meetings, etc. and to learn what the Public would like to see. Gordon Darling was appointed Chairman along with members Kline and Sonnemann of same I corrrn i tt ee. Mayor Gaines proclaimed the week of February 12, 1968 throu~h February 19, 1968 as "Better Housing Week". Proclamation was read by City Clerk Williams. Mayor Gaines proclaimed the week of February II, 1968 through February 17, 1968 as "Vocational Education Week". Proclamation was read by City Clerk Willians. Mayor Gaines reminded that dog licenses are due on February I, 1968. COUNCIL COMMITTEE REPORTS FINANCE COMMITTEE - Kline Cemetery Board requested that the salary of the Cemetery Foreman be changed from $548.50 per month to $575.00 per month, effective February I, 1968. It was moved by Kline, seconded by Sonnemann, that this request be tabled and Mr. Smythe's comments be made a matter of record. Mr. Smythe (City Attorney) stated that the salary of the Cemetery Foreman cannot be changed from $548.50 per month to $575.00 per month, as salary increase has Dot been provided for. N(JT ION CARR I ED The Superintendent of Public Works requested to hire an Equipment Rental Fund man by March I, 1968 at a salary of $650.00 per month. I It was moved by Kline, seconded by Blakeney, that the request from Superintendent of of Public WOrks to hire an Equipment Rental Fund man by March I, 1968 at a salary of $650.00 per month be granted, to be budgeted into the Equ;pment Rental Fund. NDTION CARRIED Proposal from Golf Course Committee for interim financing of the golf course construction was considered. The proposal is, that $300,000.00 be loaned from the Street Construction Fund, and that additional funds be loaned from the Water-Sewer Construction Fund in sufficient amount to bring the total loaned from the Water-Sewer Construction Fund to $100,000.00 ':'0 ~ . INJTJON CARRIED I Mayor Gaines requested that $1,200.00 be authorized for Civil Defense, to be taken from Money in the budget under Special Events Section of the General Administration D~part- ment, Current Expense Fund. FINANCE COMMITTEE - Kline It was moved by Kline, seconded öy Blakeftêy, that Mayor Gaines be granted authority to authorize $1,200.00 for Civil Defense, the money to be taken from the bUdget under Special Events Section of the General Administration Department, Current Expense Fund. NOTION CARRIED Engineering Department reported completion of remodeling of the second floor and that remodeling of the first floor of City Hall wi II commence shortly. The report on remodeling upstairs in the Engineering Department was for information only; the summary of adjustments necessary to close out 1967 Budget was for infoMmation only and the need for additional employee authorization was alÅ¡o for information only. POLICE ANDLLICENSE COMMITTEE - Sonnemann It was recommended by the Committee, that at this time a franchise be granted to I Electronic Tech TV with same terms and provisions as granted KNT-TV and be limited to Seaport Development area. It was moved by Sonnemann, seconded by Blakeney, fhat franchise be granted. MOT ION CARR I ED HOUSING ADVISORY COMMITTEE - Bailey Chairman Bai ley reported that next meeting will be February 29, 1968. FIRE COMMITTEE - Darling It was the consensus of the committee, that Ordinance No. 2180 be adopted. No action taken. WASH I NGTON NONDA Y FEBRUARY 5. 1968 Inspector, stated that fees are based on 1964 code and there has been no change since 1958. It was moved by Nickson, seconded by Kline, that ordinance be amended to read: "The fee schedule shall be as presently used." NDTION CARRIED Nickson stated, that Housing Advisory Committee should study this problem and see if costs have gone up to warrant increase in fees and if it is found to be self-supporting, necessary increases wi II be made. The motion as amended was then voted on. Donais, attorney representing property owners in are~desires that no action be taken at the present time and the matter be referred back to the Planning Commission, so property owners Can bring out certain aspects of the petition. It was moved by Darling, seconded by Nickson, that action be deferred at this time and the matter be referred back to Planning Commission for further study. It was moved by Nickson, seconded by Darling, that Resolution No. 299 be introduced and adopted.
