Mayor Gaines called the meeting to order. Councilmen present: Kline, Sonnemann, Bailey, Fitzsimmons, Blakeney, Darling and Nickson. APPROVAL OF MINUTES Item 9 under "Public Hearings" was shown in error and should be listed on April 15th Agenda. Item a under "Correspondence" letter dated 3-8-68 from Nyles Van Hoosen, D.V.M. and Charles L. Jinnemann, D.V.M. was deleted. It was moved by Blakeney, seconded by Kline, that the Minutes of the March 18, 1968 Council Meeting be approved with the date corrected to read "March 18, 1968". I MOTl ON CARR lED PUBLIC HEARINGS Mayor Gaines declared the Public Hearing open on Final Assessment Rol I of L.I.D. No. 206 providing water mains on 28th St. N.E. and on "I" St. N.E. continued from March 18, 1968. It was moved by Blakeney, seconded by Sonnemann, that public hearing be closed. MOTl ON CARR I ED It was moved by Kline, seconded by Blakeney, that the Final Assessment Roll of LID 206 be accepted with the exception of the recommendation made by City Engineer Fred Poe to delete 120 feet of J.R. McLean's assessment, and the City Attorney be instructed to draw up the necessary ordinance to implement LID 206. MOTION CARRIED Mayor Gaines declared Public Hearing open on request of James Strecker to rezone a parcel of land on the S.E. corner of 9th and D St. S.E. from R-2 to C-I. (request No. 3-68) The Planning Commission recommends to the City Council that the request be granted as this parcel abuts the Enumclaw Highway to the north and there is an existing service station across "D" St. to the west and is in keeping with the Comprehensive Development Plan for the area. I It was moved by Fitzsimmons, seconded by Blakeney, that public hearing be closed. NO TI ON CARR I ED It was moved by Nickson, seconded by Blakeney, that the recommendations of the Planning Commission be concurred with and that the City Attorney be instructed to draw up the necessary ordinance granting this rezone. MOTION CARRIED Mayor Gaines declared Public Hearing open on request of Joseph and Betty Crain to rezone a parcel of land on the south side of Enumclaw Highway in the 3400 block from R-2 to R-4. (rezone request No. 4-68) The Planning Commission recommends to the City Counci I that the request be granted with consideration being given to the dedication of the Northerly five feet for future widening of PSH '5, as it fits in with the Comprehensive Plan for the area. It was moved by Blakeney, seconded by Kline, that public hearing be closed. MOTI ON CARR I ED It was moved by Kline, seconded by Blakeney, that the City Attorney be instructed to draw up the necessary ordinance to implement Rezone Request No. 4-68. . NOTION CARRIED Mayor Gaines declared Public Hearing open on request of Eric Van Haartman to rezone 8 parcel of land on the north side of 29th St. S.E. in the 900 block from R-2 to SPU. (rezone request No. 6-68) I The Planning Commission recommends to the City Council that the request be denied and that this property be recommended for R-3 transitional zoning. It was moved by Bailey, seconded by Darling, that publ ic hearing be closed. MOT I ON CARR I ED It was moved by KI ine, seconded by Nickson, that Request No. 6-68 be granted to rezone property from R-2 to R-3, and the City Attorney be instructed to draw up the necessary ordinance to implement same. The Planning Commission recommends to the City Council that the request be granted with consideration being given to the dedication of the Northerly 30 feet and such dedication on the south as may be needed for a 60 foot right-of-way, and should be subject to sub- dividing in accordance with the Subdivision Ordinance of the City of Auburn, as this fal Is In with the Comprehensive Plan for the area. It was moved by Blakeney, seconded by Kline, that Public Hearing be closed. MOTION CARR lED It was moved by Blakeney, seconded by Fitzsimmons, that subject rezone request be held in abeyance until plot plan has been submitted. Councilman Blakeney withdrew the motion with the approval of Counci (man Fitzsimmons. MOTION NOT CARRIED I It was moved by Kline, seconded by Blakeney, that Rezone Request No. 7-68 be granted and that the City Attorney be instructed to draw up the necessary ordinance to implement same. MOTION CARRIED Mayor Gaines declared Public Hearing open on request of L. J. Hildebrand to rezone property located at 1315 29th St. S.E. from R-2 to SPU (apartments). (rezone request No. 55-67) The Planning Commission recommends to the City Council that the request of L. J. Hilde- brand to rezone from R-2 to SPU be denied and this property be recommended for R-3 transitional zoning. The following audience represented their pros and cons in regard to the above-mentioned rezone request: Bill Donat on behalf of Property Owners Association, Gretchen Browning, Horace E. Pierce on behalf of L. J. Hildebrand and Lloyd Burnsten. It was moved by Nickson, seconded by Blakeney, that public hearing be closed. MOT I ON CARR I ED It was moved by Nickson, seconded by Darling, that Request No. 55-67 be granted to rezone from R-2 to R-3 property located at 1315 29th St. S.E. and that the City Attorney be instructed to draw up the necessary ordinance to implement same. MOT! ON CARR I ED I Mayor Gaines declared Public Hearing open òn Final Assessment Rol I of LID 197 providing curb and gutter, storm drain and asphalt concrete paving on. 17th St. S.E. between A St. and M Sf. S.E. City Clerk Wil Iiams read letters of protest from Mrs. Frona A. Haworth and Mrs. Armena Vuga against assessment of liD 197. Harold Pressler (audience) inquired about title to his property after purchase of property dedication to City. Lynn Morrell (audience) requested the length of time for payments to be made on LID's and was informed that the minimum period would be 10 years with interest at 6% on the unpaid balance. It was moved by Bailey, seconded by Blakeney, that publ ic hearing be closed. MOT I ON CARR I ED It was moved by Sonnemann, seconded by Blakeney, that Final Assessment Roll of liD 197 be accepted and that the City Attorney be instructed to draw up the necessary ordinance to implement same. MOTION CARRIED CORRESPONDENCE I Councilman Sonnemann announced there would be no recommendation from the Annexation Committee to the Council at this meeting regarding the Lea Hill annexation. More information is required before a recommendation can be made. City Clerk Wil I iams read a letter from Andrew S. Hess, Director of Federal Housing Administration, dated 3-25-68 concerning lea Hill Vii lage Choice Pilot Project. Mayor Gaines recommended that the letter from Mr. Andrew S. Hess be referred to the Utility Committee. City Clerk Wil Iiams read an application for Amusement Device license submitted by Colacurcio Bros. Co., Inc. dated 3-18-68. Mayor Gaines recommended that the application be turned over to the license Committee. Zone I . It was moved by Blakeney, seconded by Sonnemann, that Zone Change Applications Nos. I through 3 be submitted to the Planning Commission for recommendation. MOTION CARRIED AUDIENCE PARTICIPATION Mr. Eby objected to the fact that no consideration was given to the Lea Hil I annexation at this Council Meeting. Councilman Sonnemann explained that additional information and facts were needed before a recommendation could be rendered. RECOMMENDATIONS I The fol lowing items were submitted by City Engineer Fred Poe for approval: (I) Award contract for street flusher to Cox Machinery Co. for $12,737.35 plus tax. MOTION CARRIED (5) Agreement with King County for Green River Flood Control Zone District to set monuments for aerial survey within the City Limits of Auburn. It was moved by Sonnemann, seconded by Blakeney, that the City of Auburn concur with the agreement with King County for Green River Flood Control Zone District to set monuments for aerial survey within the City limits of Auburn. MOTION CARRIED (6) Approve attendance of George Schuler to Washington Planners Ass'n. meeting in Wenatchee on April 5th & 6th and Joe Kempston, Jack lange and Fred Poe to American Public Works Assn. meeting in Longview on April 10, II and 12. It was moved by Nickson, seconded by Sonnemann, 'that attendance of the above-mentioned men to the respective meetings be approved. It was moved by Blakeney, seconded by Darling, that contract be awarded to Warren Pugh to design Equipment Rental Bui ¡ding for the Public Works Department. MOT ION CARR I ED (9) A resolution LID for sanitary sewers for an area described as fol lows: Gov't. Lot 4 in the sw-l¡ of Section 30, Twp. 21 North, Range 5 East, W.M. and a strip of land 150 feet wide and adjacent to all sides of Gov't. Lot 4 is generally bounded on the North by 37th St. S.E. and on the 'Nest by HAil St. S.E. It was moved by Kline, seconded by Fitzsimmons, that City Attorney be instructed to draw up necessary resolution to implement LID for sanitary sewers for an area as described above. MOTION CARRIED (10) Progress Payment No.7, EDA Street Phase II, to M. A. Segale, Inc., for $36,185.33. It was moved by Blakeney, seconded by Sonnemann, that Progress Payment No.7, EDA Street Phase II, to M. A. Segale, Inc. for $36,185.33 be made. MOT I ON CARR I ED The fol lowing Zone Change Requests were submitted by Auburn Planning Commission: (a) Request of G. Speerstra, N. M. Fleming, F. Bartholomew and W. Schmidtman to rezone from C-I to C-3, R-3 to C-3 and R-3 to C-I, property on the north side of Enumclaw Highway between "D" and "F" Streets S.E. (b) Request of Robert Kuzmer to rezone from R-2 to R-4 a parcel of land on the east side of Harvey Road in the 600 block. (c) Request of Klontz, Hansen and Knickerbocker for consideration of the modified uses for parcels I, 2 and 3. I t was moved by Kline, seconded by Nickson, that Zone Change Requests from (a) to (e) be submitted for public hearing on Apri I 15, 1968 at 8 p.m. MOTION CARRIED COUNCI L COMA¡\.ITTEE REPORTS FINANCE COMMITTEE - Chairman Kline Requests of the Finance Committee presented at the Finance Committee Meeting on March 27, 1968 were read as follows: (I) City Engineer Fred Poe requested the use of a portion of the money which was provided in the 1968 Budget for the purpose of salary adjustments, for adjust- ing the salary of a building inspector. (2) John Kelly, City Treasurer, requested authorization be granted to reinvest $300,000.00 from the Water-Sewer Construction Fund in Treasury Obi igations. (3) John Kelly, City Treasurer, requested that authorization be granted to purchase Finance Warrants for LID Guaranty Fund, Fire Department Cumulative Reserve, Water Fund, Current Expense Fund, Sewer Cumulative Reserve and Fire Rei ief and Pension Fund in given amounts. (4) City Attorney requests the provision of funds in the amount of $972.47 for the purchase of a complete set of RCWA; same request supported by John Kelly, City Treasurer. (5) Gene Wi I Iiams requested that the Statewide Employees Retirement System be paid the amount of $23,881.55 as required by same. (6) John Kelly, City Treasurer, requested the authorization to engage the services of an additional person in the Finance Department, although budget makes no provision for such new hire. It was moved by Kline, seconded by Fitzsimmons, that the recommendations of the Finance Committee be approved with the exception of the request from the City Attorney to provide funds in the amount of $972.47 for the purchase of a complete set of RCWA, and the request of John Kelly, City Treasurer, for the new hire of an additional person in the Finance Department to assist in meeting increasing obligations. WASHINGTON MONDAY APRIL 1, 1965 Mayor Gaines and Council Members were of the general consensus to reiterate certain Finance Committee's requests for approval singly as listed in the Fi- nance Committee's minutes. Request No.4 - It was moved by Kline, seconded by Sonnemann, that the City Attorney be authorized to purchase needed RCWA's for his office library. MOTION CARRIED Request No. 6 - It was moved by Kline, seconded by Sonnemann, that the City Treasurer be authorized to hire an additional employee in his department. I MOTION NOT CARRIED It was moved by Kline, seconded by Bailey, that the request be tabled until the next Council Meeting to be held on April 15, 1965. MOTION CARRIED LlCERSE..CMfiTl'EE - Chairman Sonnemann Sonnemann recommended the issuance of Amusement Device License to Colacurcio Bros. Co., Inc. It was moved by Sonnemann, seconded by Blakeney, that license be granted. MOTION CARRIED GOLF COURSE COMMITTEE - Chairman Fitzsimmons The final offer on the contract services to be furnished by Peluso will be forthcoming in about one week from today. I STREET COMMITl'EE - Chairman Blakeney The proposed agreement with King County for maintenance and report of traffic signals was accepted by the committee. It was moved by Blakeney, seconded by Nickson, that the Mayor and City Clerk be authorized to sign the agreement. MOTION CARRIED CODE AND ORDINANCE COMMITl'EE - Chairman Nickson The vacation ordinance is not completed as yet and the committee desires to hold it in abeyance for a while. It was moved by Sonnemann, seconded by Nickson, that Ordinance No. 2202 be adopted. ROLL CALL VOTE: All Councilmen voting YES MOTION CARRIED RESOLUTION NO. 306 - A RESOLUTION OF THE CITY OF AUBURN, WASHINGTON, APPROVING THE SUBURBAN MAYORS ASSOCIATION RESOLUTION RELATIVE TO PROVIDING FOR PUBLIC HEALTH SERVICES FOR CITIES AND TO\VNS IN KING COUNTY. It was moved by Kline, seconded by Bailey, that Resolution No. 306 be amended to read: "A resolution of the City of Auburn, Washington, ~approving the Suburban Mayors Association Resolution relative to providing for public health services for cities and towns in King County." Kline further recommended that the City Council of the City of Auburn go on record as disapproving the Suburban Mayors Association Resolution for the following reasons: (1) Formula for cost participation is not equitable. (2) The scope of the services is not in keeping with the needs of the City of Auburn. (3) Cost of the program is not specific nor does the City know what its cost would be. Councilman Nickson rendered further reasons: The cities have not been consulted in regards to costs as charged; amounts depict taxation without adequate representation. Councilman Sonnemann added t he following: The House Bill, setting up the Health Services, should be referred back to the next legislative session for re-study. MOTION CARRIED RESOLUTION NO. 307 - A RESOLUTION OF THE CITY OF AUBURN, WASHINGTON, RELATING TO THE CONSTRUCTION OF SANITARY SEWERS BY LID, AND CALLING FOO A PUBLIC HEARING ON MAY 6, 196B TO CONSIDER THE ESTABLISHMENT OF AN LID FOR SUCH PURPOSES. It was moved by Fitzsimmons, seconded by Blakeney, that Resolution No. 307 be introduced and adopted. MOTION CARRIED RESOLUTION NO. 30B - A RESOLUTION OF THE CITY OF AUBURN, WASHINGTON, URGING THE CITY COUNCIL TO FAVORABLY CONSIDER THE SUBURBAN SITE FOR THE STADIUM RATHER THAN AN URBAN SITE. It was moved by Bailey, seconded by Fitzsimmons, that a resolution be proposed to urge the County Commissioners to give favorable consideration to a suburban site for the forthcoming sta.dium as opposed to an urban site. WASHINGTON MONDAY APRIL 1. 1968 Councilman Sonnemann opposed the resolution stating the Council does not have all of the information available which is necessary in order to render a decision. It was his opinion that it would be more favorable if the stadium was located. within the city. Councilman Kline stated. that additional cost would be involved. if the stadium was to be located on an urban site.
