M., in the Council Chambers at the City Hall. Mayor Gaines called the meeting to order. Councilmen present: Kline, Sonnemann, Bailey, Fitzsimmons, Blakeney, Darling and Nickson. APPROVAL OF MINUTES The following Planning Commission recommendations were omitted from the April 1, 1968 Council Minutes under "PUBLIC HEARINGS" and shotlld be added: Rezone Request No. 3-68: The Planning Commission recommends to the City Council that the request be granted as this parcel abuts the Enumclaw Highway to the North and there is an existing service station across "D" st. to the West and is in keeping with the Comprehensive Development Plan for the area. Rezone Request No. 4-68: The Planning Commission recommends to the City Council that the request be granted with consideration being given to the dedication of the Northerly five feet for future widening of PSH #5, as it fits in with the Com- prehensive Plan for the area. Rezone Request No. 6-68: The Planning ~ommission recommends to the City Council that the request be denied and that this property be recommended for R-3 transitional zooing . Rezone Request No. 7-68: The Planning Commission recommends to t he City Council that the request be granted with consideration being given to the dedication of the Northerly 30 feet and such dedication on the South as may be needed for a 60 foot right-of-way, and should be subject to subdividing in accordance with the Sub- division Ordinance of the City of Auburn, as this falls in with the Comprehensive Plan for the area. Rezone Request No. 55-67: The Planning Commission recommends to the City Council that the request of L. J. Hildebrand to rezone from R-2 to SPU be denied and this property be recommended for R-3 transitional zoning. It was moved by Blakeney, seconded by Darling, that the minutes of the April 1, 1968 Council meeting be approved as corrected. MOTION CARRIED PUBLIC HEARINGS Mayor Gaines declared the public hearing open on Final Assessment Roll for L.I.D. 183 on 8" trunk sewer line along a portion of the Enwnclaw Highway between the West boundary of Chinook School and East City limits. Correction front footage on LID Assessment No. 11. It was moved by Blakeney, seconded by Nickson, that the public hearing be closed. MOTION CARRIED It was moved by Kline, seconded by Blakeney, that the City Attorney be instructed to draw up the necessary ordinance on the final assessment roll of L.I.D. No. 183. MOTION CARRIED Mayor Gaines declared the public hearing open on Final Assessment Roll for LID 195 providing curb, gutter, and storm sewers on Enumclaw Highway from C Street S. E., and Enumclaw Highway between the Northern Pacific RR right-of-way and M Street S. E. ( ~-, 4 f) L.. J AUBURN. WASHINGTON MONDAY APRIL 15, 1965 City Clerk Williams read letter from W. A. McMasters objecting to the assessment; also a letter from W. D. Schmidtman objecting to the assessment. Mr. Schmidtman, from audience, confirmed his letter. He stated he felt owners should be notified prior to the assessment. It was moved by Kline, seconded by Blakeney, that the public hearing be closed. MOTION CARRIED It was moved by Sonnemann, seconded by Nickson that the assessment of W. A. McMasters be revised and that the City Attorney be instructed to draw up the necessary ordinance on the corrected Final Assessment Roll of L.I.D. 195. MOTION CARRIED I Mayor Gaines declared the public hearing open on request of G. Speerstra, N. M. nëMi"g, F. Bartholmew and W. Schmidtman to reraone from C-l to C-3, R-3 to C-3 and R-3 to C-l, property on the north side of Enumclaw Highway between "DIt and "Fit streets S. E. (Rezone Request No. 8-68) The Planning Commission recommends to the City Council that the request of G. Speerstra, N. M. Fleming, F. Bartholmew and W. Schmidtman to rezone from C-l to C-3, R-3 to C-3 and R-3 to C-l be granted, as it conforms to the comprehensive development plan for the area. It was moved by Blakeney, seconded by Darling, that the public hearing be closed. MOTION CARRIED It was moved by Sonnemann, seconded by Blakeney, that we concur with the recom- mendations of the Planning Commission and that the City Attorney be instructed to draw up the necessary ordinance implementing this rezoning request. MOTION CARRIED Mayor Gaines declared the public hearing open on request of Robert Kuzmer to rezone from R-2 to R-4 a parcel of land on the east side of Harvey Road in the 600 block. I (Rezone Request No. 5-68) The IHanning Commission recommends to the City Council that the request of Robert Kuzmer to rezone from R-2 to R-4 be granted with a legal agreement to the City of Auburn that the 301 buffer zone be maintained with fences, lawns and shrubs by the owners and that the 6-unit complex be built in compliance with the plot plans and exterior elevations as submitted to the Planning Commission, as this conforms to the comprehensive deve10pnent plan for the area. It was moved by Blakeney, seconded by Kline that public hearing be closed. MOTION CARRIED It was moved by Kline, seconded by Fitzsimmons, that the City Attorney be instructed to draw up necessaPY ordinance to implement the rezone request and said rezone be subject to the owners of the property ere cting and maintaining a six. foot cyclone fence with redwood inserts along the east boundary of the property. MOTION CARRIED It was moved by Blakeney, seconded by Sonnemann, that the motion be amended to comply with the Planning Commission's recommendation. MOTION AS AMENDED CARRIED I Mayor Gaines declared the public hearing open on request of Klontz, Hansen and Knickerbocker for consideration of the modified uses for Parcels 1, 2, and 3. (Rezone Request No. 58-67) The Planning Commission recommends to the City Council that the request of Klontz, Hansen and Knickerbocker for consideration of the modified uses of Parcell, from R-2 to R-4 and R-2 to C-3 (see legal description for breakdown), Parcel 2 from R-2 to R-4 (see legal description for breakdown), and Parcel 3 from R-2 to R-4 and R-2 to C-l (see legal description for breakdown) be granted with consideration being given to the dedications; Parcell, sufficient Right- of-way on the corner to provide for a 501 turning radius, Parcel 2, the South 30' together with sufficient Right-of-way to provide for a 25' turning radius and Parcel 3, the North 30' together with sufficient Right-of-way to provide for a 501 turning radius. Mr. A Baker (audience) asked about the traffic problem. It was moved by Blakeney, seconded by Sonnemann, that public hearing be closed. MOTION CARRIED It was moved by Kline, seconded by Blakeney, that discussion be held previous to the motion. MOTION CARRIED Regarding the traffic problem, Mr. Poe stated that traffic signals would be installed as needed. Mr. Schneider, representing Klontz, Hansen and Knickerbocker mentioned the traffic problem that already exists. It was moved by Kline, seconded by Nickson, that the request of Klontz, Hansen ani Knickerbocker be approved and the City Attorney be instructed to draw up the necessary ordinance to rezone Parcels 1, 2 and 3 from R-2 to R-4 and that said rezoning be sub- ject to the granting of the right-of-way on Sth street and turning radius as recormnended by the City Engineer and that ingress and egress be limited to 8th Street. MOTION CARRIED Blakeney amended the motion, seconded by Sonnemann, that the recommendations of the Planning Commission be concurred with. MOTION CARRIED Kline, with approval of Nickson, removed portion of previous motion that dealt with ingress a.n:i egress. It was moved by Blakeney, seconded by Sonnemann, that as a condition of the rezone re- quest it be submitted to the Public Works Department for approval of their access arrangement. MOTION CARRIED CŒRESPONDENCE Petition from group of residents asking the City to enforce Ordinance No. 1500 regard- ing public nuisance created by noise of Metropolitan Transit Corporation buses was read by City Clerk Williams. Mayor Gaines requested that the matter be turned over to the City Attorney. City Clerk Williams read Zone Change Applications as follows: (1) Charles E. Anderson to rezone from R-l to R-4, property located on S. E. corner of I and 22nd. (2) Request of Bernice R. Hart, Floyd E. Solak and Bernice Solak to rezone from R-2 to C-l, property located at intersection of J St. S. E. And Auburn Way South. It was moved by Blakeney, seconded by Sonnemann, that the above Zone Change Application be turned over to the Planning Commission for recommendation. MOTION CARRIED City Clerk Williams read letter from Joe Koch, Diamond Jubilee Parade Chairman, asking permission to hold pioneer type parade on July 20, 1968 at 11:00 A.M., with theme of "Old Transportation." It was moved by Kline, seconded by Blakeney, that permission be granted. MOTION CARRIED Monthly progress report by Val Rupeiks regarding work accomplished on Auburn '701' planning program was mentioned by City Clerk Williams. ,.- .t"' ... Mayor- Gaines asked that the letter- be r-efer-r-ed to the Planning Commission. AUDIENCE PARTICIPATION Mayor Gaines congr-atulated twe employees fr-om the Sewer- Depar-tment who had completed special training and pr-esented them with a cer-tificate fr-om the Depar-tment of Health; the two young men wer-e John Kenneth Mor-r-ison and Robert M. Kinder-knecht. Mayor- Gaines cal led the meeting back to order. I Mayor- Gaines then declared a ten minute r-ecess. It was moved by Blakeney that the prel iminary plat be referr-ed to the Planning Commission. MOTION LOST FOR LACK OF SECOND Mr. Ted Lea fr-om audience refer-r-ed to May, 1966 Minutes of the City Counci I meeting r-egarding plans for the pr-oper-ty to accommodate fir-e station and schools, etc. Mr. Briggs, r-epresenting Monar-ch Investment Co., r-eviewed need of the extension of time on p I at. Councilman Nickson briefly reviewed the problem, Councilman Kline asked about street widths, etc., and Mayor Gaines asked City Attorney Smythe about legal ity of Ordinance No. 1900. It was suggested by Sonnemann that preliminary plat be submitted to the Planning Commission and reserve final acceptance by the City Council. John Kelly stated a commitment for school site should be considered. Councilman Kline asked that inasmuch as public hearings were held to implement the rezone it was requested that plats be submitted within two years from date. Can Council extend the two years without going back through public hearings? Mr. Smythe answered yes. I It was moved by Kline, seconded by Fitzsimmons that the proposed plat be referred to the Planning Commission for action. MOTION CARRIED Roger Gillette from audience submitted petition regarding lea Hill Annexation re- questing that area be deleted from the annexation (40 signatures). Mayor Gaines requested that the petition be filed with City Clerk. RECGYMENDATIONS The following items were submitted by Ass't. City Engineer Warren Gray for approval. Engineer's certification for creatión of l.I.D., water mains and fire hydrants on West Valley Hwy. from West Main St., to South City limits, l.I.D. No. 217. It was moved by Fitzsimmons, seconded by Nickson, that the City Attorney be in- structed to draw up the necessary ordinance creating l.I.D. No. 217. MOTION CARRIED Payment to Hill, Ingman, Chase & Co. of $12,000.00 for engineering services on Sanitary Sewer Study. It was moved by Fitzsimmons, seconded by Sonnemann, that payment to Hill, Ingman, Chase & Co. of $12,000.00 be made. ROll CAll VOTE: All Councilmen voting YES. I MOT! It was moved by Kline, seconded by Sonnemann, that Counci Imen F~tz:immons and.Blakeney be designated as the City's voting representatives at the ASsociation of Washington CiHes Convention in Spokane, Washington, on May 14, 15 and 16, 1968. It was moved by Kline, seconded by Blakeney, that the resignation be accepted and that the City Clerk draft a letter to Mr. Weese thanking him for his services. MOTION CARRIED COUNCIL COMMITTEE REPORTS I Chairman Kline reporting for Finance Committee on invoice from Puget Sound Governmental Conference. This invoice provides that 1968 dues at the rate of 7.5 cents per capita, a total of $1,282.50 be provided as agreed. It was moved by Kline, seconded by Blakeney, that the payment of $1,282.50 be paid to Puget Sound Governmental Conference. ROLL CALL VOTE: AI I Counci Imen voting YES. MOTION CARR I ED Chairman Sonnemann reporting for License Committee on request for Massage Parlor and Bathhouse License to International Sauna operating in Auburn under the name of Imperial Sauna. It was moved by Sonnemann, seconded by Nickson, that the I icense be approved for International Sauna operating under the name of Imperial Sauna. MOTION CARRIED Chairman Sonnemann reporting for Annexation Committee recommended that a petition be circulated in the Lea Hi I I area deleting that area from annexation previously men- tioned in the petition submitted by Roger Gi Ilette. It was moved by Sonnemann, seconded by Darling, that a second petition be al lowed to circulate on area bounded on the North by 312th Street and Lea Hi I I Road on the West and South by Green River and on the East of the Tacoma-North Bend FreewaylPSH #2). MOTION was opposed by Blakeney. I MOTION CARRIED Chairman Bai ley for Housing Advisory Committee, no report. Chairman Fitzsimmons reported for Uti I ity Committee that the committee has met with the Engineers for the Choice Housing Development on Lea Hi I I and indicated the committee's recommendation is that al I water, sewer and uti lities would have to meet the existing City of Auburn standards. Chairman Blakeney reported for Street Committee that one sidewalk delay had been granted and there was a revision to the restricted time limit parking ordinance and which ordinance would be before the counci I. Chairman Nickson reporting for Code and Ordinance Committee reported a final draft of Ordinance No. 2203 on employee vacations and recommended that it be passed at this meeting. OLD BUS I NESS It was moved by Kline, seconded by Nickson, that the request for the new hire in the City Treasurer's Office be brought off the table. MOTION CARRIED The need for a new employee was discussed due to the growth of the city and the amount of work that has resulted. It was. brought out that it would add $3,200.00 to the budget. II It was moved by Kline, seconded by Nickson, that request be granted. MOTION CARRIED NEW BUS I NESS Mayor Gaines recommended name of David Van Hoose to fi I I vacancy created by the resig- nation of Jim Weese from Auburn Civi I Service Commission.
