The regular meeting of the City Council of the City of Auburn convened at S:OO P.M. in the Council Chambers at the City Hall. Mayor Gaines called the meeting to order. Councii1..men present: Kline, Sonnemann, Bailey, Fitzsimmons, Blakeney, Darling and Nickson. APPROVAL OF MINUTES The following corrections shmíld be made to the April 15, 1965 Council minutes: Page 9, Ordinance No. 2211 should read as follows: "AN ORDINANCE OF THE CITY OF AUBURN, ì-ASHINGTON, PROVIDING FOR THE REZONING OF CERTAIN PROPERTY IN THE CITY OF AUBURN, CHANGING THE ZONING CLASSIFICATION THEREOF FROM R-2 TO R-3." Page 9, Ordinance No. 2217 should read as follows: It was moved by Blakeney, seconded by Fitzsimmons, that Ordinance No. 2217 entitled "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, APPROVING AND CONFIRMING THE ASSESS- MENTS AND ASSESSMENT ROLL OF LOCAL IMPROVEMENT DISTRICT NO. 195, WHICH DISTRICT HAS BEEN CREATED AND ESTABLISHED FOR THE CONSTRUCTION AND INSTALLATION OF CURB, GUTTER, AND STOOM SEWERS, AS PROVIDED BY ORDINANCE NO. 2076 OF THE CITY OF AUBURN AND LEVYING AND ASSESSING THE AMOUNTS THEREOF AGAINST THE SEVERAL LOTS, TRACTS, P lŒCELS OF LAND AND OTHER PROPERTY UPON SAID ROLL." be introduced and adopted. It was moved by Blakeney, seconded by Sonnemann, that the minutes of April 15, 1965 Council meeting be approved as correèted. MOTION CARRIED PUBLIC HEARINGS Mayor Gaines declared the public hearing open on Final Assessment Roll for LID lS2 on S" lateral sanitary sewer line together with 6" side sewers therefrom along portions of the West side of Dogwood Street S. W. between Enumclaw Highway and 16th Street S. E. It was moved by Blakeney, s~conded by Sonnemann, that the public hearing be closed. MOTION CARRIED It was moved by Blakeney, seconded by Sonnemann, that the City Attorney be instructed to draw up the necessary ordinance to implement the Final Assessment Roll for LID IS2. MOTION CARRIED Mayor Gaines declared the public hearing open on Final Assessment Roll for LID 203 providing 6" cast iron mains and fire h;ydrants on 315th Pl., 314th PI., and on 10Sth Street Southeast from Lea Hill Road to 320th S. E. It was moved by Blakeney, seconded by Fitzsimmons, that the public hearing be closed. MOTION CARRIED Mayor Gaines declared the public hearing open on Resolution 307 creating LID 219 providing for the construction and installation of an SIt sanitary sewer line with appurtenances along 37th Street S. E. from A to D; D Street S. E. from 37th to 41st; 41st Street S. E. from D to A; and from A StreetS. E. 41st to 37th. It was moved by Blakeney, seconded by Sonnemann, that the public hearing be closed. MOTION CARRIED It was moved by Fitzsimmons, seconded by Bailey, that the City Attorney be instructed to draw up the necessary ordinance to implement LID 219. MOTION CARRnt> CœRESPONDENCE City Clerk Williams read Zone Change Applications as follows: (1) Request of Acorn Investments, Inc., to rezone from SPU to R-4, property located at 23rd S. E. lying between D and F Streets. (2) Request of J. R. McLean to rezone from R-2 to C-3, property located at S. E. Corner 28th and Auburn Way North. 55 AUBURN, WASHINGTON MONDAY MAY 6, 1965 .' (3) Reque st of David F. Morgan and Assigns, to rezone from H-2 to SPU, proper- ty located at Corner of 37th and A street S. E. (4) Request of Robert C. Klontz to rezone from R-4 to SPU, property located on the Northwest corner of the intersection of Eighth street Northeast and Harvey Road. (5) Request of Ruth Claudon to rezone from R-2 to R-3, property located at S.E. Corner of K street and 14th N. E. It was moved by Nickson, seconded by Blakeney, that the above Zone Change Applications be referred to the Planning Conunission for recommendation. MOTION CARRIED I City Clerk Williams read the following license applications: Application for a massage operator's license from Valerie Jane Gibson. Inves- tigation by Health Officer, Gordon G. Thomas, and Police Department indicate no health· or police record. Application for Cabaret License by Gordon D. Nelson and Gerald G. White, owners of Mecca Tavern, 39 West Hain street, Auburn. The Mayor requested that the above applications be referred to the License Committee. City Clerk Williams read letter from Roy M. Harris, Director of Water Pollution Con- trol Commission, approving Green River Gardens No.2, Sewer Extensions and letter from A. G. Koch, District<Engineer, Sanitary Engineering Section, state of Washing- ton Department of Health, approving Green River Gardens No.2, Sewer Extensions. The Mayor instructed the above letters be filed and made available to the Engineer- ing Department. City Clerk Williams read letter from Interagency Committee for Outdoor Recreation, . regarding Auburn Green River Golf Course. Mayor Gaines stated recommendations would be made later. I City Clerk Williams read letter from Gerden J. Clark, Manager, Investment Exchange Realty, Inc., requesting time extension on the approval and recordation of the final plat of Auburn East Hill. Mayor Gaines stated action would be taken at a later time in the Council Meeting. City Clerk Williams read petition to condemn house at 620 Fifth Street S. E., be- cause it is a health hazard. Mayor Gaines instruc'ted that the petition be turned over to the Health Officer, City Attorney and Building Inspector. City Clerk Williams read a petition for unloading zone in front of the Auburn Woman1s Clubhouse at 215 North Division st. Mayor Gaines instructed that the petition be turned over to the Street Committee. City Clerk Williams read letter from Archie J. Fry regarding an administration build- ing for Auburn School District No. 4GS and permission to connect with an existing sewer line on city property. Mayor Gaines instructed that the letter be turned over to the Utilities Committee. AUDIENCE PARTICIPATION I City Clerk Williams read letter from Harold Y. Hopkins, Executive Director, The Housing Authority of the County of King, regarding re-certification of Workable Program. Mr. Hopkins presented his plan in person and gave a brief history of the Workable Program and the advantages that could be gained. Mr. Richmond from City of Seattle gave a brief resume on hO\v it is used in the City of Seattle and helped housing plans by eliminating deteriorating buildings or re- storing them to usefulness. The approach is to make a building by building, block by block inspection in designated neighborhoods, bringing to the attention of the owners where deficiencies exist and where they would benefit by compliance. I I I AUBURN t WASHINGTON MONDAY MAY 6, 1968 "I, f' c:: 7 .... Hobar Meade gave a brief account of the Workable Program. Councilman Blakeney asked how they could go into private homes and tell owners their homes did not come up to standards. He was told it was a matter of policy and helpful to the owners. Councilman Sonnemann asked about the requirement that every room have a window and was told that if it was necessary for health, welfare and safety it would be necessary. Councilman Kline asked how many older hotels resided in by elderly people in Seattle had been closed and was told that about 135 were in bad condition and over one-half have been improved. Audience participation continued with Mr. Gerden J. Clark representing Auburn Airport property requesting an extension of six months for the completion of the plat. Mr. Lea stated that the rezoning had taken into consideration a school site, although no definite commitment was made it was the feeling of the school that the matter could be worked out. Councilman Darling asked a bout the fire problem. Fire Chief CalkL~s stated that a site had been provided for a fire station. Richard Martinez, President of Chapter 26, Experimental Aircraft Owners Association, stated that in the event the extension was not granted it will revert to unclassified and the association would like to come in and operate an airport. Councilman Kline stated that the Auburn Airport Committee have investigated the usage of the old Auburn Airport and it was their belief it would not be suitable to be used as an airport due to the residences that have been built and would present a hazard. Councilman Fitzsimmons stated the hillside had been planned to be held for residences. It was moved by Fitzsimmons, seconded by Blakeney, that the extension of time be denied. Councilman Nickson abstained from voting. MOTION CARRIED Roger Crosby representing Western Council of NPRR asked that the recent appeal action by the City of Auburn be withdrawn. Attorney, Alva Long, from audience, requested a point of order. It was moved by Kline, seconded by Nickson, that various persons interested in the matter be permitted to speak pro and con. Mr. Roger Crosby then presented his views, Mr. Paul Tjossen of the GNRR presented his views; Attorney Long presented his case and views on the matter; Mr. Don Wilhelm of the Brotherhood of RR Clerks Union Presented comments in favor of the action; Larry Frey and Frank Norman of NPRR gave their views. It was moved by Kline, seconded by Blakeney, that further discussion on the subject be limited to ten more minutes. MOTION CARRIED Mr. Tjossen of GNRR stated further he felt confident that the merger .~uld stand the scrutiny of the panel and that the delay would be a matter of one to one and one-half year s. RECOMMENDATIONS The following items were submitted by City Engineer, Fred W. Poe, for approval: Progress EstL~te No. 2 (Final) to Argentieri Construction Co. for L.I.D. No. 210 for $1,393.53. It was moved by Blakeney, seconded by Fitzsimmons, that Progress Estimate No. 2 (Final) to Argentieri Construction Co. for L.I.D. No. 210 for $1,393.53 be paid, and that the retained percentage amounting to $1,796.31 including sales tax, be paid in 30 days provided no liens or claims are filed and clearance is secured from the State Tax Commission and the Dept. of Labor & Industries. ROLL CALL VOTE: All Councilmen voting YES. MarION CARRIED Progress Estimate No.2 to Morris Construction Inc, ,for L.I.D. No. 213 for $22,449.27 be paid. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Progress Estimate No. 9 (Final) for "C" St. S. "v'l. and 15th st. S. 1,'Ì. (EDA Street Project No. 07-1-00107) to Select ~ontractors, Inc. for $679.3S. It was moved by Kline, seconded by Nickson, that the City accept Progress Estimate No.9 (final), that the retained percentage amounting to $17,659.75, including sales tax, be paid in 30 days provided no liens or claims are filed and clearance is se- cured from the state Tax Commission and the Department of Labor & Industries, and that the City Attorney be instructed to draw up the necessary resolution indicating council acceptance. MOTION CARRIED City Engineer Poe requested all bids be rejected and bid bonds be returned for the following phase of the Green River Golf Course Construction: (1) Irrigation System, (2) Equipment Rental for Grading and Shaping, (3) Grass Seed, (4) Fertilizer and (5) Soil Loading and Mixing. It was moved by Nickson, seconded by Blakeney, that all bids be rejected and bid bonds be returned for the following phase of the Green River Golf Course Construction: (I) Irrigation System, (2) Equipment Rental for Grading and Shaping, (3) Grass Seed, (4) Fertilizer and (5) Soil Loading and Mixing. MOTION CARRIED City Engineer Poe requested that the temporary crossing agreement for Boyd Road and the Chicago, Milwaukee, St. Paul and Pacific Railroad Co. be signed and a resolution passed for same. It was moved Kline, seconded by Blakeney, that the Mayor and City Clerk be author- ized to sign an agreement for a temporary crossing for Bo;yd Road and Chicago, Mil- I waukee, St. Paul and Pacific Railroad Co., and the City Attorney be instructed to draw up the necessary resolution to implement this. MOTION CARRIED City Engineer Poe requested a call for Public Hearings for Final Assessment Rolls for L.I.D. No. 205 and L.I.D. No. 212. It was moved by Blakeney, seconded by Nickson that Public Hearing on Final Assess- ment Rolls for L.I.D. No. 205 and L.I.D. No. 212 be held on June 3, 1968. MOTION CARRIED City Engineer Poe requested approval of L. I. D. No. 218 (petition type), for water mains on A st. S. E. from 29th st. S.E. to a point 1/4 mile North thereof. It was moved by Sonnemann, seconded by Blakeney that D.I.D. No. 21S be approved and the City Attorney be instructed to draw up the necessary ordinance creating L.I.D. 21S. MOTION CARRIED The following zone requests were submitted by the Auburn Planning Conunission: a. Request of Don J. Scalara to rezone from M-l to M-2, property is S acres directly behind 3321 Auburn Avenue. (Application No. 9-68) I b. Request of Charles K. Conner to rezone from R-2 to SPU for Apartments, located at 936 lOth N. E. (Application No. 11-68) c.., Request of W. Cashman & M. Schaff to rezone from R-2 to R-4 the property at 421 & 501 21st S. E. (Application No. 12-68) It was moved by Nickson, seconded by Sonnemann, that the above zone requests be set for public hearing at the City Council Meeting on May 20, 1968 at S:OO P.M. Mayor Gaines announced the appointment of Robert Van Siclen, Jack Burgeson and David Van Hoose to t he Valley Regional Planning Conunission. COUNCIL COMMITTEE REPORTS FINANCE COl>1MITTEE - Kline Councilman Kline reported on list of Finance Warrants presented by Mr. Kelly for the following funds: Water Fund $13,669.51, Cemetery Endowed Care Fund $5,289.52, Fire- men1s R & P Flmd $64,820.60, Fire Department Cumulative Reserve $5,381.53, Sewer Cum- ulative Reserve $20,004.98, and L.I-D. Guaranty Fund $10,319.96. It was moved by Kline, seconded by Fitzsimmons that Mr. Kelly be authorized to purchase the warrants as listed. MOTION CARRIED LICENSE COHMITTEE - Sonnemann Councilman Sonnemann reporting for License Committee: There was no recommendation on the Billiard Parlor this date and asked that requests for massage operator's license from Valerie Jane Gibson, Gail Comer, and LaVonne Harle Frank be granted as requested and the application for Cabaret License by Gordon D. Nelson and Gerald G. White, owners of Mecca Tavern, be granted. It was moved by Sonnemann, seconded by Blakeney that license requestsc"be granted. MOTION CARRIED PARK AND RECREATION BOARD - Bà.i.lä,. Councilman Bailey reporting for Park and Recreation Board stated that for $1.00 per year property had been obtained for a soccer field from Myron Massey. GOLF COURSE COMMITTEE - Fitzsimmons Councilman Fitzsimmons reporting for Golf Course Committee moved that purchase be made of Green River Golf Course for $118,000.00 seconded by Blakeney. MOTION CARRIED UTILITIES COMMITTEE - Fitzsimmons Councilman Fitzsimmons moved that the Mayor and City Clerk sign the lease agreement between Myron Massey and City of Auburn for a soccer field, seconded bÕ Kline Councilman Fitzsirrmons moved, seconded by Blakeney, that the Mayor & ~tt~O~I~~~R~~D authorized to sign an application to HUD for matching funds for the raising & covering of the East Hill Reservoir. MOTION CARRIED Councilman Fitzsimmons moved that the Mayor and City Clerk be authorized to sign the special purchase agreement for the expansion of the Sewer Lagoon Site on 30th N. E., seconded by Darling. MOTION CARRIED OLD BUSINESS It was moved by Blakeney, seconded by Nickson, that the City Attorney draw up necessary ordinance authorizing Mayor Gaines and Attorney Alva Long to pursue the Court action at this time in the railroad merger.
