The regular meGting of the City Counci I of the City of Auburn convened at 8:00 p.m.
in the Counci I Chambers at the City Hal I.
Mayor Gaines cal led the meeting to order.
Councilmen present: Kline, Sonnemann, Bailey, Fitzsimmons, Blakeney, Darling and
Nickson.
APPROVAL OF MINUTES
The fol lowing correction should be made on pase 6 of June 17, 1968 Counci I

PUBLI C HEAR I NGS
Mayor Gaines declared the Public Hearing open o~ the request of Corner Pocket to lower
the age limit from 18 to 16 years in pool and bi I liard rooms where liquor is not sold.
Alva Cw Long, representing Corner Pocket stated that a representative of the
Auburn Eagles would be present and had not yet arrived.
It was moved by Kline, seconded by Blakeney, that the public hearing be postponed
unti I later in the meeting to allow time for the representative from the Eagles
Club t.o be present.
MOTION CARRIED
Mayor Gaines declared the Public Hearing open on annexation of area South of Stuck
River.
Mr. Schuler described the area boundaries involved.
Rosa Bebbins from audience asked several questions:
(I) Does Auburn have a dog leash law and if area annexed would the dog
leash law be put into effect?
(2) Can she keep rabbits inside city limits if annexation takes place?
(3) Will she be taxed additionally for Auburn water and sewer districts?
(41 Will there be an assessment for the additional police protection that
will be provided if the annexation takes place?
Answers from City Attorney Robert Smythe were:
(II No dog leash law in Auburn.
(2) Property will be unclassified and rabbits may be kept.
(31 No general assessment for water and sewer. If there are none' in
the area, there will be no tax.
(41 No additional tax for pol ice protection as elsewhere in the city.
It will be the same rate 8S other citizens pay.
Don Delienti from audience asked if any property East of West Valley Highway would
be affected.
Mr. Schuler replied that the area to be annexed is east of the West Val ley Highway
adjacent to the Pacific City limits.
It was moved by Sonnemann, seconded by Nickson, that the Public Hearing be closed.
MOTION CARRIED
It was moved by Sonnemann, seconded by Nickson, that the annexation request be
referred to the Boundary Review Board and the City Attorney be instructed to draw
up the necessary ordinance.
MOT I ON CARR I ED
Mayor Gaines declared Public Hearing open on request of David F. Morgan to rezone
from M-2 to SPU a parcel of land on the corner of 37th and "A" St. S. E.
The Auburn Planning Commission recommends to the City Council that this
request be granted subject to the attached agreement.

William Murphy asked from audience about the location of the property.
David Morgan from audience spoke in favor of the rezone and stated he would abide by any
restrictions the city may want and it would.be in support of car business.

It was moved by Sonnemann, seconded by Blakeney, that the recommendations of the
Planning Commission be concurred with and the City Attorney be authorized to draw
up necessary ordinance granting rezone. MOTION CARRIED

Counci Iman Sonnemann asked about the agreement to include fenced cyclone fence at least
8 ft. and not more than 10 ft. high with redwood insets, 10 ft. of landscaping on
street sides to be established and maintained by owner; no stacking of automot¡ les
above fence; no automobiles outside fence for sale; no mechanical equipment to crush
or make noise.
It was moved by Sonnemann, seconded by Blakeney, that the recommendations of the Planning
Commission be concurred with. MOTION CARRIED
Councilman Nickson asked about old cars being used outside of fence to advertise.
It was moved by Kline, secDnded by Blakeney, that the motion be amended to read:
Owner shal I be prohibited from affixing to cyclone fence any object and owner shal I be
restricted to one sign.concurring with the City Sign Ordinance in size, but in no
event shal I be affixed to fence. MOTION CARRIED
Mayor Gaines declared the Public Hearing open on request of J.R. McLean to rezone
from R-2 to C-3 a parcel of land on the SE corner of 28th and Auburn Way North.
The Auburn Planning Commission recommends to the City Council that this request
be granted as it has C-3 zoning to the East and North and M-I across the highway
and conforms to the Comprehensive Plan.
It was moved by 8lakeney, seconded by Nickson, that the Public Hearing be closed.

It was moved by Blakeney, seconded by Kline, that the Planning Commission recommendation
be concurred with and the City Attorney be authorized to draw up necessary ordinance
granting rezone. MOTION CARRIED
Mayor Gaines declared the Public Hearing open on request of W.E. Peters to rezone
from R--3 to R-4 a parcel of land on the SW corner of 19th and M St. S.E.
The Auburn Planning Commission recommends to the City Council that the request be
denied as it does not fal I within the Comprehensive Plan of the City of Auburn.
W.E. Pet>ers, from audience and owner of the property, showed elevation plan of
proposed building.
It was moved by Blakeney, seconøed by Kline, that the Public Hearing be closed.
MOT ION CARR I ED
Councilman Kline asked Mr. Peters if he would like to resubmit his request and rezone
as SPU, He also reminded Mr. Peters that if the petition were denied it would not be
permissible to apply for rezone for six months. Mr. Peters stated he would withdraw
his petition.
It was moved by Kline, seconded by Bai ley, that the City Council accept the withdrawal
and refer back to Planning Commission as SPU. MOTION CARRIED

Mayor Gaines declared the Public Hearing open on request of Gary A. Yost to rezone
from R-3 to R-4, property located between 5th & 6th on L Street.
The Auburn Planning Commission recommends to the City Counci I that this request be
denied because it is surrounded by R-3.
It was moved by Blakeney, seconded by Nickson, that the Public Hearing be closed.

It was moved by Bai ley, seconded by Nickson, that the recommendation of the Planning
Commission be concurred with and deny this request.
Councilman Fitzsimmons asked about the reason for denial. Mr. Schuler explained that
al I the area is R-3 for duplex and single residence and this would put multiple dwel ling
in middle of it.
It was moved by Kline, seconded by Fitzsimmons that the motion be amended to read:
Request of Gary A. Yost be granted.

study.

Mayor Gaines declared the Public Hearing open on request of Robert G. Malek to rezone
from R-2 to M-I a parcel of land on Western Avenue approximately 700 ft. north of West
Main St.
The Planning Commission recommends to the City Counci I that this request be granted
with a restrictive covenant covering the fencing of the area to be utilized for non-
residential uses with a suitable screen fence and with consideration being given to
the dedication' of' the westerly 10" for future widening of Western Avenue to a 60'
right-of-way as th·is request fal Is within the overal I Comprehensive Plan of the City
of Auburn.
Myra Campbel I, from audience, asked why the request for rezoning?
It was explained that M-I would be light manufacturing.
Mrs. Wi lIard, from audience, wanted to know what type of business was going in?
It was moved by Sonnemann, seconded by Nickson, that the Public Hearing be closed.

I
Councilman Fitzsimmons asked about industry going in and was told there were rumors
it was a welding shop. Mr. Schuler stated area had scattered residences.
Mrs. Wi lIard, from audience, spoke in behalf of the petitioners who had submitted a
petition against the zoning change.
It was moved by Sonnemann, seconded by Nickson, that re~uest be denied.
Opposed by Counci Iman Blakeney. MOTION CARRIED
Mayor Gaines then declared the Public Hearing reopened on request of Corner Pocket.
Mr. Campbell representing the Eagles Club from audience requested that the age limit
be raised to 21 years those permitted to be in pool and billiard rooms of Corner
Pocket and that the 10:00 P.M. curfew be enforced, that lights be installed in the
alley behind which is the parking lot. The Eegles Club have had a lot of looting of
automobiles by the youths coming from the pool hall.
Alva C. Long, representing Corner Pocket, stated that the owner had agreed to light
up the parking area and enforce the curfew laws.
Police Chief Darby stated that when the age limit was lowered to 16 the Police Dept.
had numerous cal Is and had to make frequent trips to the area to curb noice, fights,
etc., and that it was al I caused after youths left the pool hall. Since the age
limit had been raised to 18 there had been practi~ally no trouble.

Mrs. Barthol, from audience, stated it was a good place for youths to go and they
should be home by 10:00 p.m. The Corner Pocket is a good place and something Auburn
has needed for a long time.
It was moved by Sonnemann, seconded by Fitzsimmons, that the Public Hearing be closed.
MOTION CARRIED
There was considerable discussion about lack of supervision and enforcement of curfew
previously when trouble was experienced.
It was moved by Fitzsimmons, seconded by Kline, that the matter be referred back
to Committee for further study.
ROLL CALL VOTE: Kline, Fitzsimmons, Blakeney and Kline voting YES.
Darling, Sonnemann and Bailey voting NO.

City-Clerk Will~ms read letter from John R. Walker, Supervisor of Population and
Research Division, State of Washingto~ Planning and Community Affairs Agency, Olympia,
Washington, regarding population figures and stating Auburn is 16th largest city in the
State.
Mayor Gaines requested that the letter be fi led.
City Clerk Wi Iliams read petition from White River Presbyterian Church on Open Occupancy
Ordinance.
Mayor Gaines requested the petition be referred to the Housing Committee.
City Clerk Wi Iliams read letter from Duane Steinle, Robed Kuzmer Realty, regarding I
property located at H St. N.W., known as "Pumping Station".
Mayor Gaines request~d that it be referred to the Utitit!es Committee.
City Clerk Wi I Iiams read letter from John R. Davies, President of Auburn City EmRloyees
Association, requesting recognition as bargaining representative of Auburn City Employees.
Mayor Gaines stated that action would be taken later in the meeting on this request.
City Clerk Williams read letter from 12 residents in vicinity of "F" St. S.E. and 21st
St. S.E. with regard to speeding and reckless driving in this vicinity.
Mayor Gaines requested that letter be referred to Street Committee and the Police Dept.
City Clerk Wi Iliams read letter from R. S. Phi Ilips, Advisor to the Gearlords Car Club
of Auburn, requesting permission t? hold a Car Show in the City of Auburn on July 14,
1968.
It was moved by Blakeney, seconded by Nickson, that the request be granted for Car Show
in the City of Auburn on July 14, 1968 at the Auburn Sr. High School Parking Lot.

City Clerk Wi I Iiams read letter from Ralph R. Stender, Board of County Commissioners,
regarding annexation and Ordinance No. 2229, being approved.

Mayor Gaines requested Mr. Lange to see that the City Limit sign is moved.
AUDIENCE PARTICIPATION
Lydia Jackson, from audience, stated that neighbors parked in front of her place at
629 9th St. S.E., making it impossible for nurses and doctors to park in front of her house
when they come to give her medical attention.
Mayor Gaines stated that the Director of Public Works and Chief of Police wi II ~.-~ent
to check the problem.
Mr. Murphy from audience stated he wished to objeçt to the moving of an old house
into the area. All of the homes in the neighborhood are nice homes and this will be
an eyesore.
Counci Iman Kline stated that nothing could be done about moving it in but it would have
to meet building standards of the City of Auburn.
City Bui Iding Inspector, John R. Davies, from aUdience, stated that the owner of the
house has placed a $10,000.00 bond on the house and the house wi I I have to be brought
up to the City Building Code standards.
RECOMMENDATIONS

City Clerk Wi I Iiams read the following zone change applications:
(I) The request of Mr. & Mrs. Robert Klontz to rezone from R-4 to SPU for
Professional Offices, a parcel of land lying on the N.W. corner of intersection
of 8th St. N.E. and Harvey Road. (Application No. 23Y68)
The Planning Commission recommended to the City Counci I that this request be
granted subject to the submittal of a suitable plot plan showmng!parking and
ingress and egress acceptable by the Planning and Engineering Departments,
as this request conforms to the overall development plan of the area.
(2) The request of Acorn Investment Inc., to rezone from APU to R-4 a parcel of
land on 23rd St. SE lying between "D" and "F" Streets. (Application No. 29-68)

The Planning Commission recommend to the City Council that the re~uest be
granted as it conforms to the comprehensive land use plan for the area.
(3) The request of Ruth Claudon to rezone from R-2 to R-3, a parcel of land on the
S.E. corner of "kit and 14th St. N.E. (Application No. 21-68).
The Planning Commission recommend to the City Council that this request be granted
subject to the dedication of the westerly 51 for the following reasons:

1. School lies directly to the North and has an unusually high density foot
traffic pattern immediately adjoining to and surrounding the particular lot in
question.
2. That 14th St. N. E. and "K" st. N. E. of and in themselves are presently and are
projected to be unusually high density vehicular traffic thoroughfares.
3. Particular corner lot in question under the R-3 zoning lends itself to the best
and highest use of the land without injurious effects to the existing zoned
property to the south, to the east and to the north.
4. Said zoning limited to single story plan as submitted provided all the required
yard set backs are provided.
It was moved by Nickson, seconded by Sonnemann, that zone change applications (1) through
(3) be set for Public Hearing at 8:00 P.M. on July 15, 1968.

The following items were submitted by City Engineer Fred Poe for approval:
Award of contract for L.I.D. No. 220 to R. L. Moss & Company for $43,591.10.
It was moved by Sonnemann, seconded by Fitzsimmons, that award of contract for L.I.D. No.
220 to R. L. Moss & Company for $43,591.10 be made and that the Mayor and City Clerk be
authorized to sign the contract and that the bid bonds of the unsuccessful bidder be
returned.

Mayor Gaines announced that next Friday is Auburn Diamond Jubilee Day at the races and
tickets are $4.00 which includes dinner. All Councilmen are invited to Longacres at
4:00 P.M. and to bring their friends.

Councilman Bailey reported there was no report for Park Board.

Councilman Fitzsimmons reported there was no report for Utility Committee.
STREET COlJIMITTEE - Blakeney
Councilman Blakeney reported there was no report for Street Committee but announced
that the Street Committee will meet the first Wednesday after the first Council Meeting.
CIVIC CENTER COMMITTEE - Darling
Counci1man Darling reported there was no report for Civic Center Committee.
ORDINANCE AND CODE COMMITTEE - Nickson
Councilman Nickson reported on the proposed ordinance setting up an administrative depart-
ment to be known as the Public Works Department and the Ordinance Committee recommend
its introduction and adoption, and reported on the Auburn Employees Association as
bargaining agent.
It was moved by Nickson, seconded by Darling, that the City Attorney be instructed to
draw up the necessary resolution acknowledging and recognizing the Auburn City Employees
Association as the bargaining agent for city employees.
