Mayor Gaines called the meeting to order. Councilmen present: Kline, Sonnemann, Bailey, Fitzsirr~ons, Blakeney and Nickson. APPROVAL OF MINUTES The following correction should be made on Page 2, July 1, 1968 Council Minutes with regard to rezone request of David F. Morgan: "It "\\fas moved by Sonnemann, seconded by Blakeney, that the recommendations of the I Planning Commission be concurred with and the City Attorney be authorized to draw up necessary ordinance granting rezone.n The following correction should be made on Page 3, July 1, 1968 Council Minutes with regard to rezone request of J. R. McLean: "It was moved by Blakeney, seconded by Kline, that the Planning Commission recom- mendation be concurred with and the Cìty Attorney be authorized to draw up necess- ary ordinance granting rezone." The following correction should be made on Page 5, July 1, 1968 Council Minutes regard- ing request of Corner Pocket: "It was moved by Fitzsimmons, seconded by Kline, that the matter be referred back to Committee for further study." The following correction should be made on Page 10, July 1, 1968 Council Minutes with regard to bids on L.I.D. No. 208B: nIt was moved by Kline, seconded by Blakeney, that bid be awarded to F. Coluccio Construction Co. in the amount of $130,878.50, and the other two bids be rejected, and that the Mayor and City Clerk be authorized to sign the contract and the Bid Bonds of the unsuccessful bidders be returned, and that if F. Coluccio Construc- tion Co. does not accept the contract they shall forfeit their Bid Bond and the City Engineer is authorized to readvertise for bids." I It was moved by Blakeney, seconded by Fitzsimmons, that the Minutes of the City Council Meeting held July 1, 1968 be approved as mailed and corrected. PUBLIC HEARINGS Mayor Gaines declared the Public Hearing open on Open Housing and Ordinances No. 2248 and No. 2249. Arthur Gifford, 2735 Alpine, Auburn, Washington stated he appreciated the consid- eration that the City Council was giving to open housing and providing leadership to the community. Mrs. Helen Griffin, 1701 3rd St. N. E., Auburn, Washington expressed appreèiation for the consideration that the City Council was giving to the open housing ordin- ance which meets her approval of ordinance as written up and presented with the exception of Section 5 which was not acceptable to her. Rev. Wesley Arms, 1415 2nd St. S. E., Auburn, Washington stated that a group of Christian Churches in the area were interested in the housing ordinance. Caroline Calhoon, 35111 46th Avenue South, Auburn, Washington representing a local women's voting group, stated that they were in favor of open housing ordin- ance with the exception of Section 5. I Councilman Nickson explained various parts of Section 4. Councilman Kline stated that the ordinance was the same as the Federal Law and contained same provisions including Section 5. Councilman Bailey, Chairman of Housing Advisory Committee, stated that he yQshed to have the matter tabled to give the committee the opportunity for Dlrther study. It was moved by Blakeney, seconded by Nickson, that Public Hearing be closed. MOTION CARRIED It was moved by Bailey, seconded by Nickson, that Ordinance No. 2248 and 2249 be referred back to the Housing Advisory Committee for ft1rther study. MOTION CARRIED I I I ;¡.. '~j 5 -. AUBURN t WASHINGTON MONDAY JULY 15, 1968 Mayor Gaines declared the Public Hearing open on request of Mr. and Mrs. Robert Klontz to rezone from R-4 to SPU for Professional Office, a parcel of land lying on the NW corner of intersection of 8th st. N. E. and Harvey Road. The Auburn Planning ColIunission recommend to the City Council that this request be granted, subject to the submittal of a suitable plot plan showing parking and ingress and egress acceptable by the Planning and Engineering Departments, as this request conforms to the overall development plan of the area. It was moved by Blakeney, seconded by Nickson, that Public Hearing be closed. MOTION CARRIED It was moved by Nickson, seconded by Blakeney, that the recowfiendation of the Planning Commission be concUItred ,'lith and the City Attorney be instructed to draw up the necessary ordinance granting rezone. MOT ION CARRIED Mayor Gaines declared the Public Hearing open on request of Acorn Investments, Inc., to rezone from SPU to R-l¡. a parcel of land on 23rd st. S. E. lying between liD" and "F" Streets. The Auburn Planning Commission recommend to the City Council that the request be granted as it conforms to the comprehensive land use plan for the area. It was moved by Kline, seconded by Nickson, that Public Hearing be closed. HOTION CARRIED It was moved by Kline, seconded by Blakeney, that the request of Acorn Investments, Inc. be denied. Motion was opposed by Bailey. MOTION CARRIED Mayor Gaines declared the Public Hearing open on request of Ruth Claudon to rezone from R-2 to R-3, a parcel of land on the SE corner of "K" and 14th st. NE. The Auburn Planning Commission recommend to the City Council that this request be granted subject to the dedication of the Westerly 5' for the following reasons: 1. School lies directly to the north and has an unusually high density foot traffic pattern immediately adjoining to and surrounding the particular lot in question. 2. That 15th st. N. E. and ilK" St. N. E. of and in themselves are presently and are projected to be unusually high density vehicular traffic thoroughfares. 3. Particular corner lot in question under the R-3 zoning lends itself to the best and highest use of the land without injurious effects to the existing zoned property to the south, to the east and to the north. 4. Said zoning limited to single story plan as submitted provided all the required yard set backs are provided. It was moved by Bailey, seconded by Blakeney, that Public Hearing be closed. MOTION CARRIED It was moved by Bailey, seconded by Nickson, that the recommendations of the Planning Commission be concurred with and the City Attorney be instructed to draw up the necessary ordinance granting rezone. MOTION CARRIED CORRESPONDENCE City Clerk Williams read letter from Mrs. D. R. Gordon, Recording Secretary of the Auburn Women's Club regarding parking in front of the Auburn Women's Club Building. Betty Roberson spoke on behalf of the Auburn Women's Club stating that the parking space was needed for older members and a loading and unloading zone. Councilman Blakeney, Chairman of street Committee, stated that all parking space had to be used to the best advantage for parking. It was suggested tha.t a dri vewa'j'" to the rear planned parking area would be the best solution. City Clerk Williams read letter from Jack Vanderpool, President of Auburn Softball '36 AUBURNt WASHINGTON MONDAY JULY 15, 1968 League, expressing gratitude for installation of wing fences at tþe 5th and ilK" Street Ball Park. Mayor Gaines instructed that the letter be filed with a copy to the Park Board. City Clerk Williams read zone change application of stanton I. Tsujikawa, Mary Tsujikawa, Kazuo Tsujikawa and Harumi Tsujikawa, for change of zoning classification from Agricultual to R-5, property located at 932 40th N. E. It was moved by Blakeney, seconded by Nickson, that the zone request be referred to the Planning Commission for recommendation. \10TION CARRIED I City Clerk Williams read letter from Sonnichsen & Hayden Engineers, Inc., submitting for approval Preliminary Plat of Lone's 2nd Addition. It was moved by Blakeney, seconded by Bailey, that the request be referred to the Planning Commission. MOTION CARRIED City Clerk Williams read letter from James P. Behike, Acting Director of Water Pollution Control Commission regarding L.I.D. No. 211 and L.I.D. No. 216. Mayor Gaines requested that the letter be filed with a copy to Engineering Department. AUDIENCE PARTICIPATION Clements Baker, 11054 s. E. 304th, Auburn, Washington, stated that 8th street was rough. Mr. Poe explained that part of the street is being removed for sewer construction and will be replaced within a week or so. Mr. Jim Reed from audience stated that bus service into Renton and within the City is badly needed. Mayor Gaines replied that better roads into Seattle are being planned and should be taken care of by the Highway Department. RECOMMENDATIONS I The Planning Commission recommend to the City Council that the Comprehensive Land Use Plan of the City of Auburn and vicinity be accepted as presented and that the City Council hold another Public Hearing and publish the map in the local newspaper if at all feasible for the benefit of the public. It was moved by Blakeney, seconded by Bailey, that a Public Hearing be held August 5, 1968 at 8:00 P.M. to consider the Comprehensive Land Use Plan. MOTION CARRIED The following items were submitted by City Engineer Fred Pee..:'6!or approval: Adopt a resolution authorizing the Mqyor and City Clerk to sign an agreement with the State Highway Department for the State's portion of financing for Auburn Way North. It was moved by Nickson, seconded by Blakeney, that the City Attorney be instructed to draw up the necessary resolution authorizing the Mayor and City Clerk to sign an agreement with the State Highway Department for the state's portion of financing for Auburn Way North. MOTION CARRIED I Progress Estimate No.1 to Morris Construction for L.I.D. No. 215 (17th St. N. E.) for $24,619.38. It was moved by Nickson, seconded by Blakeney, that Progress Estimate No. 2 to Morris Construction for L.I.D. No. 209 for $11,103.84 be paid. No. 208A for Morris Construction Co. for $5,094.30 for additional work required for lift station installation. It was moved by Fitzsimmons, seconded by Blakeney, that approval of Change Order No.1 for L.I.D. MOTION CARRIED Progress Estimate No.6 (final) for L.I.D. No. 208A (North End Sewers) to Morris Construction Co. for $11,557.49. It was moved by Kline, seconded by Nickson that Progress Estimate No. 6 (final) for L.I.D. No. 208A (North End Sewers) to Horris Construction Co. for $11,557.49 be paid as completed, and that the retained percentage amounting to $19,719.14 including sales tax be paid in 30 days provided no liens or claims are filed and clearance is secured from the State Tax Conunission am the Department of Labor and Industries. No. 213 to Morris Construction Co. for $21,615.85 be paid as completed and that the retained percentage amounting to $8,899.10, including sales tax be paid in 30 days provided no liens or claims are filed and clearance is secured from the state Tax Commission and the Department of Labor & Industries. MOTION CARRIED A resolution authorizing the merchants to place merchandise, racks, tables, etc. on the sidewalks during the sidewalk promotion sale on July 19, 20, 25, 26, and 27, 1968. MOTION CARRIED PROCLAMATIONS, APPOINTMENTS & ANNOUNCENENTS Mayor Gaines announced that this week end will be the Diamond Jubilee Parade at 11:00 A.M. with a picnic in the park and all City Councilmen and friends are invited to attend and participate. That the City Treasurer be authorized to purchase Finance Warrants in the sum of $23,411.41 as follows: L.I.D. Guaranty Fund $ 5,042.02 Fire Relief & Pension 17,827.78 Current Expense Fund 108.32 Sewer Cum. Reserve Fund 75.90 General Cum. Reserve 357.39 $ 23,411.41 It was moved by Kline, seconded by Nickson, that the City Treasurer be authorized to purchase Finance Warrants as listed above. HOTION CARRIED 2. HOTI ON CARRIED I LICENSE COI~TTEE ~ Sonnemann Councilman Sonnemann reporting for License CŒrunittee, moved that a Cabaret License be issued to Roy's Tavern, seconded by Blakeney. MOTION CARRIED Councilman Sonnemann reporting for License Committee regarding request of Corner Pocket to lower age limit stated that the ComTIittee recommended that the ordinance be changed to state as follows: "That no one under 18 years of age be permitted to enter unless accompanied by parent or guardian and that the place would be closed between 2:00 A. 11. and 8:00 A.M. daily. There would be no loitering on the premises. That the owner of the building v~uld provide adquate lighting in the rear of the building and in the parking lot, and that mesh screens would be installed over the rest room windows into the alley." It was moved by Sonnemann, seconded by Nickson, that the City Attorney be instructed to prepare necessary ordinance to implement these changes as outlined. Bailey opposed the motion. HOUSING ADVISORY CO~~1ITTEE - Bailey Councilman Bailey reported that the Housing Advisory Committee would meet on next Thursday evening, July 18th. GOLF COURSE COÞWITTEE - Fitzsimmons Councilman Fitzsliillllons reporting for Golf Course Committee stated that a general bid on golf course construction would be called for.
