MONDAY DECEMBER 2, 1968 The regular meeting of the City Council of the City of Auburn convened at 8:00 P.M., in the Council Chambers of the City Hal I. The meeting was called to order by Mayor Gaines. Counc i I men present: K line', Sonnemann, Ba i ley, Fit zs i mmons, Blakeney, Oar ling and Nickson. APPROVAL OF MINUTES The fol lowing correction should be made to the November 18, 1968 Council Minutes: Page 2 on request of A. Bergh, I. Treiger and P. Friedlander should read as fol lows: "I t was moved by K line, seconded by Ba i ley, that t he request of A. Bergh, I. Tre i ger and p. Friedlander to rezone from R-2 to C-3 property located on Auburn Way South, west of M Street S.E., be tabled for further study." MOTION CARRIED PUBLIC HEARINGS Mayor Gaines declared Public Hearing open on Final Assessment Rol I for L.I .0. No. 204 (street and sanitary sewers, R St. N.E., Main to 8th N.E.). It was moved by Blakeney, seconded by Sonnemann, that the Public Hearing be closed. MOTION CARRIED It was moved by Kline, seconded by Bailey, that Final Assessment Rol I for L.I.D. ,Woo 204,!street and sanitary sewers, R St. N.E., Main to 8th N.E., be approved, and the City Attorney be instructed to draw up the necessary ordinance approving and con~ firming the assessments and assessment rol I. MOTl ON CARR lED Mayor Gaines declared Publ ic Hearing open on request of Richard O. Fordice to rezone from R-2 to R-3 property located on the Northeast corner of 21st St. and "F" St. S.E. The Planning Commission recommend the request of Rich ard O. Fordice to rezone I from R-2 to R-3, property located on the Northeast co~ner of 21st St. and F St. S.E., Application No. 34-68, be granted. It was moved by Blakeney, seconded by Nickson, that Public Hearing be closed. MOTl ON CARR I ED It was moved by Blakeney, seconded by KI ine, that the recommendation of the Planning Commission be concurred with and the City Attorney be instructed to draw up the necessary ordinance granting rezone. It was moved by Nickson, seconded by Kline, that a restriction be added that the setback I ine along 21st St. be 25 feet rather than 20 feet. MOTION CARRIED CORRESPONDENCE City Clerk Wi I Iiams read letter from Ken R. White Company, legistative report for the proposed East Side Freeway, Auburn to Bothell. Mayor Gaines requested that the letter be turned over to the Street Committee, and requested the Engineering Department keep the Council advised. Mayor Gaines requested that Summons and Complaint for Damages, King County Cause No. 702578, be turned over to the legal Department. The request of Commonwealth Investors Group and Auburn East Hil I Development Co. to rezone from C-I to C-3; L-F to R-2 & R-4; R-I to R-3 & R-2 property lying north of Auburn Way South and west of Dogwood St. S.E. (Application No. 39-68) The Planning Commission recommend to the City Council that this request be granted according to the petition filed, subject to the restrictive covenant running with the land which has been suggested by the departments of Public Works and Planning recommendations which are as fol lows: I. FINANCE C~#^'TTEE - KLINE Councilman Kline reporting for Finance Committee stated a meeting of the Finance Committee was held December 2, 1968 and the Finance Director had requested authority to purchase the fol lowing L.I.D. warrants: L.I.D. MOTION CARRIED Counci I man 1<1 ine reported further that the Finance Director had requested permission to loan from the Arterial Street Fund to the Water Sewer Construction Fund and from the Street Construction Fund to the Water Sewer Construction Fund the total sum of $100,000.00 at 5% interest. It was moved by Kline, seconded by Sonnemann, that $100,000.00 be loaned to the Water Sewer Construction Fund at 5% interest. MOT I ON CARR I ED LICENSE COfAMITTEE - SONNENANN Councilman Sonnemann reporting for the License Committee reported that the License Committee would hold a meeting at 7:30 P.,,\. on December 3,1968. UTILITIES COMMITTEE - FITZSlfNAONS Councilman Fitzsimmons reporting for Utilities Committee, moved that the City Attorney enter into friendly discussion with Jeffs Home regarding property adjoining that owned by the City which has becoma a matter of concern. Motion was seconded by Darling. MOTION CARRIED STREET C~\ITTEE - BLAKENEY Councilman Blakeney, reporting for Street Committee, stated the NPRR letter regarding crosswalk at 6th and A Street be denied. OLD BUSINESS It was moved by Kline, seconded by Fitzsimmons, that the request of A. Bergh, I. Treiger, and p. Friedlander to rezone from R-2 to C-3, property located on Auburn Way South, west of M Street S.E., be brought off the table. MOTl ON CARR I ED Mr. Bergh, from audience, stated that no plans had been made at this time for specific development of the property; they just wished to have it zoned C-3 for maximum develop- ment. Councilman Kline, with approval of the second, Bailey, withdrew his motion made at the City Council Meeting on November 18, 1968. It was moved by Kline, seconded by Nickson, that the rezone request of A. Bergh, I. Treiger, and P. Friedlander to rezone from R-2 to C-3 be granted in accordance with the Planning Commission recommendation and that in addition the C-3 zoning be res- tricted to exclude used car lots and service stations. After discussion, it was moved by Sonnemann, seconded by Fitzsimmons, to amend the motion to remove the exclusion and rezone C-3. ROLL CALL VOTE: Councilmen Sonnemann, Fitzsimmons and Blakeney voting YES. Councilmen Kline, Bailey, Darling and Nickson voting NO. It was moved by Kline, seconded by Nickson, that rezone request of A. Bergh, I. Treiger and P. Friedlander to rezone be granted from R-3 to C-2. Councilman Sonnemann, Fitzsimmons and Blakeney voting NO. Councilman Kline, Bailey, Darling and Nickson voting YES. MOT ION CARR lED NEW BUSINESS Gordon Darling brought up the traffic problems and the trouble that would be encountered I by the Fire Department in case of an emergency as a result of the newly instal led traffic lights in front' of the Fire Station. The matter is being considered and soon to be remedied by the ~ity Engineer. MO TI ON CARR I ED Mrs. Longston, from audience, stated she had an apartment house at 21st and D Street with a list of elderly people awaiting decision of City Counci I. She has been keeping vacant awaiting action with low rent dwelling plans. APPROVAL OF VOUCHERS AND TRANSFERS It was moved by Blakeney, seconded by Nickson, that the vouchers and transfers as listed in the sum of $489,632.46, be approved for payment. It was moved by Blakeney, seconded by Kline, that the Zone Change Application of Michael and Susan Kramer be referred to the Planning Commission for Public Hearing. Botting, requesting another Public Hearing on his request which he was advised would probably be held at the December 2, 196B meeting and it was held at November 18, 1968 meeting. It was moved by fitzsimmons, seconded by Sonnemann, that another Public Hearing on request of David A. Botting be held on December 16, 1968 at 8:30 P.M.
