WASHINGTON 23 FEBR UARY 17, 1969 MONDAY The regular meeting of the City Council of the City of Auburn convened at 8:00 P.M. in the Council Chambers of the City Hall. The meeting was called to order by Mayor Gaines. Councilmen present: Kline, Sonnemann, Fitzsimmons, Blakeney, Darling and Nickson APPROVAL OF MINUTES It was moved by Kline, seconded by Blakeney, that the Minutes of February 3, 1969 Council Meeting be approved as mailed. MOTION CARRIED PUBLIC HEARINGS Mayor Gaines declared Public Hearing open on request of Glen Vig to rezone from A-I to M-l, property located on the corner of 37th st. N. E. and Auburn Way North. The Planning Commission recommends to the City Council the denial of the request change from A-I to M-l and suggests to the City Council that this zoning be changed from A-I to c- 3 for the following reasons: 1. The C-3 zoning meets with the overall Comprehensive Plan of the City of Auburn. 2. Continues the continuity of C-3 zoning abutting Auburn Way North With;thedo¡Llo}í!ling provisions: 1. The dedication of the Easterly 5 ft. on Auburn Way North for street purposes. 2. The dedication of a 20 ft. radius on the SE corner for street purposes. The Planning Director was instructed by the Planning Commission to contact the Detitioner and explain the zoning change from M-l to C-3. It was moved by Blakeney, seconded by Nickson, that the Public Hearing be closed. MOTION CARRIED It was moved by Kline, seconded by FitzsLTImons, that the recommendations of the Planning Commission be concurred with and the City Attorney be instructed to draw up the necessary ordinance granting rezone. MOTION CARRIED Mayor Gaines declared Public Hearing open on request of Fred Brannan to rezone from A-I to R-4 and R-2 property located on 24th st. N.E. adjacent to Cascade Jr. High School. The Planning Commission recommends to the City Council this request for approval with the provision that the petitioner dedicate to the City of Auburn a 60 ft. right-of-way for the relocation of 28th st. N.E., on the alignment of the existing 28th st. between Auburn Way North and "I" st. N.E. on that portion requesting R-4 and the South 30 ft. of that portion requesting R-4 be dedicated for the future development of 26th st. N.E. These dedications to be improved in conjunction with the improvements to be installed within the proposed plat of Great Western Addition that has been submitted covering that area requesting R-2 zoning. Also, the density of the R-4 zoning should be limited to a maximum of 25 units per acre and the multiple family dwellings adjacent to the single- family area be limited to single story construction. The request conforms to our Comprehensive Plan for the City of Auburn. It was moved by Kline, seconded by Blakeney, that the Public Hearing be closed. MOTION CARRIED It was moved by Blakeney, seconded by Kline, that the recommendations of the Planning Commission be concurred with and the City Attorney be instructed to draw up the necessary ordinance granting rezone. MOTION CARRIED CŒRESPONDENCE City Clerk Williams read letter and contract from George D. Wyse, Director of King County Park and Recreation Department for joint recreational program between King County and the City of Auburn. Mr. Al Rossi, Chairman of the Park Board, recommended the Council take favorable action on this contract. It was moved by Blakeney, seconded by Darling, that the Mayor and City Clerk be authorized to sign the contract between King County Park and Recreation Department and the City of Auburn for joint recreational program. V'¡ASHINGTON MONDAY FEmUARY 17, 1969 City Clerk Williams read application for Master License for Juke Box Machine from Pastime Tavern, 102 West Main street, Auburn, Washington. Mayor Gaines requested application be referred to License Committee. City Clerk Williams read application of Brenda D. Nerbovig, for Massage Operator or Massage Parlor Attendant License. Mayor Gaines requested application be referred to License Committee. City Clerk Williams read aDplication of Sharon D. Jones, for Massage Operator or Massage Parlor Attendant License. I Mayor Gaines requested application be referred to License Committee. AUDIENCE Mr. Al Rossi., Chairman of the Park Board, presented letter from Park and Recreation Board regarding Cedar Lanes Neighborhood Park, and advised our option for acquisition of this property will expire on March 5, 1969, and recorrunended we exercise our option to purchase same, and that correspondence from the Interagency for Outdoor Recreation indicating authorization to acquire land prior to receiving authorization to proceed. It was moved by Blakeney, seconded by Nickson, that the City of Auburn exercise option to purchase Cedar Lanes Neighborhood Park. MOTION CARRIED Mr. Al Rossi, reporting further for the Park Board, stated the Park and Recreation Board are interviewing applicants for the position of Director of Parks and Recreation and applications are being accepted for the position. RECOMMENDATIONS AND BID OPENINGS The following applications were submitted by the Auburn Planning Commission: A. The request of the First Christian Church of Auburn to rezone from R-2 to SPU for housing for the elderly on property located on "F" st. S. E. between 17th and 19th I st. S. E. (Application No. 1-69) The Plannihg Commission recorrunends to the City Council that this request be granted as it conforms to the Comprehensive Plan for the City of Auburn with the following provi- sions: 1. An additional twenty off-street parking spaces should be provided on site or committed from the Church property lying immediately north. 2. An agreement should be signed with the City including the following: a. The development shall be restricted to housing for the elderly and/or handicapped. b. The development shall pay in lieu of taxes, at the same rate as private development. c. The development agree to participate in their prorated share of a local improve- ment district for the improvement of "F" St. S. E. between 17th and 19th st. S.E. 3. A 20 ft. fire lane be provided along the south am west side of the development. 4. The water main located at 17th and "F" St. be extended north to provide a fire hydrant in front of the development. 5. The dedication of the necessary right-of-way for "F" St. S.E. between 17th and 19th St. S. E. I It was moved by Blakeney, seconded by Nickson, that Public Hearing be held on request of the First Christian Church of Auburn to rezone from R-2 to SPU for housing for the elder- ly on property located on "F" St. S.E. between 17th and 19th St. S. E. (Application No. 1-69) March 3, 1969 at 8:00 P.M. MOTION CARRIED B. The request of Halvard & Pearl Thermod to rezone from A-I to M-l a parcel of land, approximately 75 acres in size, lying between the Chicago, Milwaukee Railway Right- of-way and the west line of Section 13, TWP 21 N., R 4, EWM. The Planning Commission recommends to the City Council that this request to rezone from A-I to M-l be granted as it conforms to the Comprehensive Plan for the City of Auburn with consideration being given to the dedication of a 60 ft. right-of-way for the exten- sion of Clay st. northerly on the present align~ent and also the north 30 ft. of that portion of the property lying in the NE~ of Section 13-21-4 be dedicated for the future I I I 25 AUBURN, HASHING TON MONDAY FEBRUARY 17, 1969 development of 8th st. MOTION CARRIED The following items were submitted by City Engineer, Fred Poe for approval: 1. Contract with the Boeing Company for sewage disposal for 1969. It was moved by Kline, seconded by Darling, that the City Attorney draw up necessary resolution authorizing the Mayor and City Clerk to sign contract with the Boeing ComDany for sewage disposal for 1969. MOTION GARRIED 2. Advertise for bids for the construction of the runway and taxiways for the Auburn Municipal Airport on March 5 and March 12, 1969 with bid opening on March 26, 1969. It was moved by Blakeney, seconded by Fitzsimmons, that the City Engineer be authorized to advertise for bids for the construction of the runway and taxiways for the Auburn Municipal Airport on March 5 and March 12, 1969, \rith bid opening on March 26, 1969 at 11:00 A.M. MOTION CARRIED 3. Advertise for bids for a truck-mounted high-velocity sewer cleaner for the Sewer Division. It was moved by Fitzsimmons, seconded by Blakeney, that the City Engineer be authorized to advertise for bids for a truck-mounted high-velocity sewer cleaner for the Sewer Division on February 26 and March 5, 1969 with bid opening on March 12, 1969 at 11:00 A.M. MOTION ~AH.RIED 4. Award contract for traffic signals at Division & Main; West Main & West Valley; 12th st. S. E. & Auburn Way South; and Fir Street & Auburn Way ~outh, all included in street Improvement No. 107, to Service Electric Company, Inc. for $41,700.00. 5. Refer bids 1"or street sweeper to the street Committee for recommendation. 6. Pass a resolution authorizing the Mayor and City Clerk to sign ~he agreement with Sea-Port Development Co., inc., for repayment of utility costs on 22nd Street N. ~. 7. Progress Estimate No.2 on L.I.D. No. 223 (water on 37th st. S.E., V St. S.E., etc.) to Argentieri Gonstruction Co. for $15,209.17. it was moved by Nickson, seconded by Blakeney, that Progress Estimate No. 2 on L.I.D. No. 223 (water on 37th st. S.E., D st. S.E., etc.) be paid to Argentieri Construction Co. in the sum of $15,209.17. ROLL CALL vOTE: All Councilmen voting rES. MOTION ~ARRIED 8. Progress Estimate No.4 (final) on st. Imp. No. 106, Phase 1, ,37th st. N. E. & N.W.) to Frank Coluccio Construction Co. for ~3,O'3.65. It was moved by Kline, seconded by Blakeney, ~hat Progress ~stimate No.4 (final) on st. Imp. No. 106, Phase 1, (J7th st. N .E. & N .1:1.) to Frank Coluccio Construction Co. for $4,053.65 be paid, and that the project be accepted by the City as complete and that the retained percentage amounting to $27,046.29, including sales tax, be paid in 30 days provided no liens or claims are filed and clearance is secured from the State Tax CorrillÜssion and the Department of Labor and Industries. It was moved by Kline, seconded by Fitzsimmons, that Change Order No. 1 on L.I.D. No. 208, Phase II (Sewers on Auburn Way North & 37th St. N. E. & N. W.) to Frank Coluccio Construc- tion Co. for $5,267.00 be approved. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED 10. Progress Estimate No.3 (Final) on L.r.D. No. 208, Phase II, to Frank Coluccio Con- struction Co. for $5,472.~9. 26 AUBURN, WASHINGTON MONDAY FEBRUARY 17, 1969 It was moved by Nickson, seconded by Darling, that Progress Estimate No.3 (final) on L.r.D. No. 208, Phase II, to Frank Colucci.o Construction Co. for $5,472.49 be paid, and that the project be accepted by the City as completed and that the retained Dercentage amount- ing to $17,960.04, including sales tax, be paid in 30 days provided no liens or claims are filed and clearance is secured from the state Tax Commission and the Department of Labor and Industries. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED 11. Change Order No.1 on L.I.D. No. 207 (Water on 37th St. N. E. & N. W.) to Frank Coluccio Construction Co. for $424.00 for additional pipe and fittings. It was moved by Fitzsimmons, seconded by Blakeney, that Change Order No.1 on L.I.D. No. I 207(water on 37th st. N. E. & N. W.) to Frank Coluccio Construction Co. for $424.00 for additional pipe and fittings be approved. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED 12. Progress Estimate No.2 (Final) on L.I.D. No. 207 to Frank Coluccio Construction Co. for $691. 83. It was moved by Nickson, seconded by Fitzsimmons, that Progress Estimate No. 2 (Final) on L.I.D. No. 207 to Frank Coluccio Construction Co. for $691.83 be paid, and that the pro~ ject be accepted by the City as completed and that the retained percentage amounting to $3,360.38, including sales tax, be paid in 30 days provided no liens or claims are filed and clearance is secured from the State Tax Commission and the Depa.rtment of Labor and Industries. MOTION CARRIED PROCLAMATIONS, APPOINTHENTS AND ANNOUNCEI1ENTS Mayor Gaines announced the appointment of Councilman Ernest Bailey as Liaison between the Library and the City Council. COUNCIL CO!1MITTEE REPORTS FINANCE COMMITTEE - KLINE I Councilman Kline, reporting for Finance Committee, stated the State Auditor has just com- pleted auditing the City of Auburn and Mr. Kelly, Finance Director, will have a report on this for the next Council Meeting. AIRPORT COMMITTEE - KLINE Councilman Kline, reporting for Annexation Committee, stated the meeting held last Monday evening, February 10, 1969 in the Council Chambers on the proposed annexation (Auburn Academy area) was well attended and it was moved by Sonnemann, seconded by Nickson, that a second petition be approved for the proposed annexation. MOTION CARRIED Councilman Sonnemann, reporting on letter from Valley Regional Planning Commission re- garding Annexation Law, moved that the City Council go on record as endorsing the Leg- islative Council Committee on Local Government Recommendation No. 10, seconded by Darling. MOTION CARRIED UTILITY COMMITTEE - FITZSIMMONS It was moved by Fitzsimmons, seconded by Blakeney, that the City Attorney be instructed to draw up necessary resolution for L.I.D. for sanitary sewers on 3rd st. S. E. from M St. S. E. to 180 ft. West boundary of R st. S. E. and on N. Street S. E. from 2nd St. S.E. to 3rd St. S. E. MOTION CARRIED I It was moved by Fitzsimmons, seconded by Blakeney, that the bid of Valley Motors, for $11,638.13 including sales tax, for five pickups for the Water, street and Sewer Division, be accepted. MOTION CARRIED STREET COHMITTEE - BLAKENEY Councilman Blakeney, reporting lor the Street Cærunittee, moved that we award the contract to Service .c.lectric Co., Inc. for St. Imp. 107, complete signalization of four inter- sections including traffic controllers, complete with detectors, conduit junction boxes, signal heads, strain poles and wiring for the sum of $41,700.00 as bid, and the Mayor and City Clerk be authorized to sign the contract. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED I I I 27 AUBURN, WASHINGTON MONDAY FEBRUARY 17, 1969 Councilman Blakeney, reporting further for the Street Committee, stated the Committee felt that the firm of Lewis-Redford Engineers, Inc., should be engaged to complete the 15th st. N. E. and N. W. Project Study. It was moved by Blakeney, seconded by Nickson, that the Mayor and City Clerk be authorized to sign an agreement engaging the firm of Lewis-Redford Engineers, Inc. to complete the 15th st. N. E. and N. W. Study. MOTION CARRIED Councilman Blakeney reporting for street Committee recommended that the bids on the Street Sweeper be referred to Street Coænittee for study, and that no action be taken at this time until study by committee is complete. FIRE COHí:lITTEE - DARLING Councilman Darling, reporting for Fire Committee, recommended that the bid on the Station Wagon for the Fire Department from Valley Motors be rejected and call for new bids. It was moved by Darling, seconded by Blakeney, that the Fire Department be authorized to call for bids for a station wagon for the Fire Department, advertising February 21st and 23rd, 1969 with bid opening at 11:00 A.M. February 27, 1969. MOTION CARRIED It was moved by Sonnemann, seconded by Fitzsimmons, that the City Attorney prepare the necessary resolution authorizing the Mayor and City Clerk to sign the agreement with Sea-Port Development Co., Inc., for repayment of utility costs on 22nd Street N. E. MOTION CARRIED DEPARTl~NT HEAD REPORTS Chief of Police Darby reported that four new police officers had graduated from Olympic Junior College. NEW BUSINESS Councilman Kline reported that the Airport Zoning Commission had met on February 5th and 13th and moved that the City Council hold a Public Hearing on March 17, 1969 at 8:00 P.M. on the Airport Zoning Ordinance, seconded by Nickson. MOTION CARRIED BID OPENINGS Bids were opened at 11:00 A.M. on February 12, 1969, on Call for Bids for Station Wagon for Fire Department. One bid was submitted by Tom Matson, Valley Motors, as follows: With Trade-in Without Trade-in $2,671. 56 2,871.56 The above bid included sales tax. Bids were opened at 11:00 A.M. for st. Imp. MOTION CARRIED RESOLUTION NO. 353 It was moved by Fitzsimmons, seconded by Blakeney, that Resolution No. 353 entitled itA RESOLUTION OF THE CITY OF AUBURN, WASHINGTON, DECLARING THE INTENT OF THE CITY TO IMPROVE A PORTION OF A STREET SITUATE \1ITHIN THE CORPORATE LIMITS OF THE CITY OF AUBURN, BY THE CONSTRUCTION AND INSTALLATION OF SANITARY SEWERS, PURSUANT TO LOCAL IMPROVE}ŒNT DISTRICT TO BE CREATED FOR SUCH PURPOSE" be introduced and adopted. MOTION CARRIED APPROVAL OF VOUCHERS AND TRANSFERS It was moved by Blakeney, seconded by Nickson, that the transfers and vouchers as listed in the sum of $98,122.37 (Claims Warrants No. 2886 through No. 3020) be aDproved for payment.
