The meeting was cal led to order by Mayor Gaines. Councilmen present: KI ine, Sonnemann, Bailey, Fitzsimmons, Blakeney, Darl ing and Nickson. APPROVAL OF MINUTES It was moved by Bailey, seconded by Fitzsimmons, that the Minutes of March 3, 1969 Council Meeting be approved as mailed. MOTl ON CARR lED PUBLIC HEARINGS Mayor Gaines declared Publ ic Hearing open on request of Halvard & Pearl Thormod to rezone from A-I to M-I a parcel of land approximately 75 acres in size lying between the Chicago Milwaukee Railway right-of-way and the west line of Section 13, Township 21 N., Range 4, EWM. The Planning Commission recommends to the City Council that this request to rezone from A-I to M-I be granted as it conforms to the Comprehensive Plan for the City of Auburn with consideration being given to the dedication of a 60 ft. right-of-way for the extension of Clay St. northerly on the present al ignment and also the north 30 ft. of that portion of the property lying in the NE~ of the NW~ of Section 13-21-4 be dedicated for the future development of 8th St. N.W. It was moved by KI ine, seconded by Nickson, that the request of Halvard & Pearl Thormod be tabled. MOTION CARRIED Mayor Gaines declared Publ ic Hearing open on request of M. C. Clark to rezone from R-2 to R-3 property located on the N.E. corner of 29th and "M" St. S.E. The Planning Commission recommend to the City Council that the request be granted with consideration being given to the dedication of 10 ft. on the easterly boundary as it conforms to the Comprehensive Plan of the City of Auburn. Walter Heck, 801 12th Street N.E., speaking for the Church of Nazarene, from audience, stated that at the last meeting of the Planning Commission the Church of Nazarene had voted against the rezone request and at this time wish to withdraw their objection to the rezone request. It was moved by Blakeney, seconded by Sonnemann, that the Pub I ic Hearing be closed. MOTION CARRIED It was moved by Blakeney, seconded by Sonnemann, that the recommendations of the Planning Commission be concurred with and the City Attorney be instructed to draw up the necessary ordinance granting rezone. MOTION CARRIED Mayor Gaines declared Public Hearing open on request of Commonwealth Investors Group/ Investment Exchange for a special property use on a parcel of land in the 1900 Block on the West side of Dogwood St. S.E. The Planning Commission recommends to the City Council the approval of this request because it would conform to the City Council's intent to create a transitional zone between the R-4 and R-2 classification. It was moved by Sonnemann, seconded by Bailey, that Pub I ic Hearing be closed. MOTION CARRIED It waS moved by Sonnemann, seconded by Darling, that the recommendations of the Planning Commission be concurred with and the City Attorney be instructed to draw up the necessary ordinànce granting rezone request. MOT I ON CARR I ED There was discussion with regard to driveways and the uses for same in the future acquisition by new owners. It was moved by Nickson, seconded by Darl ing, that the previous motion have added that the property owners sign a restrictive covenant with regard to the driveway use of the property to run with the land. MOT I ON CARR I ED 38 AUBURN, WASHINGTON MONDAY MARCH 17, 1969 Mayor Gaines declared Pub! ic Hearing open on Comprehensive Airport Zoning Ordinance. It was moved by Bailey, seconded by Fitzsimmons, that the Publ ic Hearing be closed. MOTION CARRIED It was moved by Kline, seconded by Nickson, that the City Attorney be instructed to draft the ordinance as presented to the Counci I by the Airport Commission with the fol lowing changes: That Section 8 a(2), Page Five, the last sentence "In addition al! permits within a horizontal distance of not less than 1000 feet nor more than 4200 feet from each I end of the runways sha! I be processed through the Building Department of the City of Auburn." be deleted. I would propose Section 8a fourth I ine should read "a permit therefor shal I have been applied for and granted by the Buildinq Department of the City of Auburn." Section 8b Existinq Uses. should read: "II) Before any non conforming structure or tree may be replaced, substantially altered or repaired, rebuilt, allowed tö grow higher or replanted, a permit must be secured from the Administrative Agency." Section9. ENFORCEMENT, I ine three, after Administrative Agency, add "£[ Sui Idinq Department". MOTION CARRIED Mayor Gaines declared Publ ic Hearing open on Preliminary Assessment Rol I, Resolution L.I.D. No. 353, sanitary sewers 3rd St. S.E., M St. to R St. Mrs. Dorothea Flansburgh, 2812 Pike Street S.E., from audience, asked about the address of the L.I .0. and if the City asked for this petition L.I .0. Mr. Poe, City Engineer, advised this was true, and described what the L.I .0. would include. Mr. John F!ansburgh, 2812 Pike Street S.E., from audience, asked if the costs quoted of $10.00 would be the rate. I Mr. Poe advised that it would not be over $10.00, that at the time estimates are made they are figured high. Mrs. Cecel ia Kane, 1107 3rd St. S.E. from audience, asked if all property ownerS were assessed. Mr. Poe advised that the property owners were all assessed and that those who have paid an assessment previously wi I I not be assessed at this time. Mr. Thomas James, representing the Free Methodist Church, asked if there was a possibility the L.I.D. would fail to go through. Mr. Poe advised that within a thirty day period of enacting this L.I .0. the property owners have the right to object and if 60% or more abject the L.I .D. does not pass. Mr. Fred Schneider, 1212 3rd St. S.E., from audience, asked if the present faci I ity is sufficient for the added capacity. Counci Iman Fitzsimmons advised the faci I ¡ties are adequate. It was moved by Blakeney, seconded by Nickson, that the Public Hearing be closed. MOT I ON CARR I ED I It was moved by Blakeney, seconded by Fitzsimmons, that the City Attorney be instructed to prepare the necessary ordinance implementing the L.I .0. No. 353. MOTION CARRIED CORRESPONDENCE City Clerk Wi Iliams read letter from George L. Nei I, Acting Regitnal Administrator, General Services Administration, regarding proposed acquisition by the City of the Government Reservoir property north of the GSA Center Bui Iding~ I I I 39 AUBUHN, WASHINGTON MONDAY MARCH 17, 1969 It was moved by Kline, seconded by Blakeney, that the City Attorney be instructed to draft necessary ordinance to purchase the property from Forward Thrust Funds. MOTION CARRIED City Clerk Williams read letter from Department of Health, regarding Water Main Extensions College Heights Plat. Mayor Gaines requested the letter be referred to the Engineering Department. City Clerk Williams read letter from Department of Health regarding seminar on Cross- Connection Control in Water Supplies, April 17 and 18, 1969, Seattle City Light Auditorium. Mayor Gaines requested the letter be referred to the Engineering Department. City Clerk Williams read application for Master Juke Box License from County Amusement Co. Mayor Gaines requested the application be referred to License Committee. AUDIENCE PARTICIPATION Mayor Gaines introduced Chas. Sonnernann and steve Gurr, representatives of Edward James Chapter of DeMolay and advised they would tour City Hall on March 19, 1969 at 1:00 P.H. ~x. Gene Colburn, Member of the Park and Recreation Board, from audience, introduced Leonard Chapman, the new Director of Parks and Recreation for the City of Auburn. Gerald Brown, manager from S & M Electronics, asked about underground cable installation and stated a letter had been submitted relative to underground cable installation. He was advised the letter would be considered under Miscellaneous Business. RECOMMENDATIONS The following application was submitted by the Auburn Planning Commission: Plat of Great Western Addition submitted by Alex Sonnichsen, Sonnichsen & Hayden, Engineers, Inc. The Planning Commission recommends to the City Council approval of the Preliminary Plat of Great Western Addition, with the following provisions: 1. Final Plat shall conform to Subdivision Ordinance. 2. Prior to vacation of the John Redington Road said road shall be located by actual survey and tied into the survey for subject plat. 3. The fishing easement and dike maintenance easement be shown accurately on the final plat. It was moved by Kline, seconded by Sonnemann, that Public Hearing be held on Plat of Great Western Addition submitted by Alex Sonnichsen, Sonnichsen & Hayden, Engineers, Inc. on April 7, 1969 at 8:00 P.M. MOTION CARRIED The following items were submitted by Fred Poe, City Engineer for approval: Progress Estimate No.3 (Final) for L.I.D. No. 221 (J st. N.E.) to Morris Construction, Inc. for $2,730.39. It was moved by Kline, seconded by Blakeney, that Progress Estimate No. 3 (Final) for L.I.D. No. 221 (J st. N. E.) to Morris Construction Co., Inc. for $2,730.39 be paid, and that the project be accepted by the City as completed and that the retained percentage amounting to $1,003.55, including sales tax, be paid in 30 days provided no liens or claims are filed and clearance is secured from the state Tax Commission and the Department of Labor and Industries. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Authorization to advertise for bids for Street Improvement No. 114 (C street s. w. from West Main to 3rd Street 5. W.) U.A.B. Project No. 8-1105 (4). It was moved by Blakeney, seconded by Nickson, that the City Engineer be authorized to advertise for bids for street Improvement No. 114 (C street S.W. from West Main to 3rd Street S. W.) U.A.B. Project No. 8-1105 (4). MOTION CARRIED 40 AUBURN. WASHINGTON 40 MONDAY MARCH 17, 1969 Authorization to advertise for bids for backhoe-loader for Water Division. It was moved by Fitzsirrunons, seconded by Blakeney, that the City Engineer be authorized to advertise for bids for backhoe-loader for Water Division, advertising March 19 and March 26, with bid opening April 2, 1969 at 11:00 A.H. MarION CARRIED Authorization to advertise for bids for the Maintenance Building for the Public Works Department. It was moved by Blakeney, seconded by Nickson, that the City Engineer be authorized to advertise for bids for the Maintenance Buildi.ng for the Public Works Department. MOTION CARRIED I Councilman Kline opposed the vote. Award contract to Bothell Chevrolet Cadillac for a one-ton truck for the Street Division for $3,503.46 (only other bidder was Brewer Motors at $3,586.39. It was moved by Blakeney, seconded by Nickson, that the contract for a one-ton truck for the Street Division for $3,503.46 be awarded to Bothell Chevrolet Cadillac. MarION CARRIED PROCLAMATIONS, APPOINTMENTS AND ANNOUNCEMENTS Mayor Gaines proclaimed March 16 - 23 as "INTERNATIONAL DEMOLAY Ì'JEEK" and called upon all our citizens to join in saluting the young men of the Order of DeMolay. COUNCIL CO~~rrTTEE REPORTS FINANCE COMNITTEE - KLINE Councilman Kline, reporting for Finance Committee, stated the conunittee discussed the purchase of property for park purposes from the General Services Administration for the sum of $3,500.00 and it is the recowmendation of the Committee that the Council author- ize an emergency appropriation for the purchase of property from General Services Administration from monies of the Park Construction Fund. I Councilman Kline reporting further for the Finance Committee, stated that the City Treasurer had requested authority to make investments in L.I.D. Warrants of the City of Auburn as follows: Cemetery Endowed Care Þtmd Fire Relief & Pension Fund $13,967.21 8,000.00 It was moved by Kline, seconded by Nickson, that the City Treasurer be authorized to make investments in L.I.D. Warrants of the City of Auburn as listed. MOTION CARRIED AIRPORT CO¡~TTEE - KLINE Counci1rnan Kline, reporting for the Airport Commi.ttee, stated there were 23 sets of plans to bid on the Airport Project and bids will be opened on the 26th day of March. LICENSE COMMITTEE - SONNEMANN Councilman Sonnemann reporting for the License Committee, stated the License Committee had received a memorandum from the City Clerk with regard to complaints received on the taxi service and it is hoped we will have additional service in the area in the near future. I PARK BOARD - BAILEY Councilman Bailey, reporting for the Park Board, said he wished to commend the Park and Recreation Board for their efforts in obtaining a new Director of Parks and Recreation. HOUSING ADVISORY CO~~ITTEE - BAILEY STREET, ENGINEERING AND PLANNING COMMITTEE - BLAKENEY Councilman Bailey, reporting for the Housing Advisory Committee, gave a brief report on the trip taken to Salem, Oregon with George Schuler and Chuck Smith on the study of the Workable Program, which \ßS an extremely interesting meeting. They were very impressed with the cleanliness. Councilman Blàke~8y, reporting for' the Street, Engineering and Planning Committee, AUBURN~ WASHINGTON MONDAY 41 MARCH 17, 1969 requested the bids for the truck-mounted h~gh-velocity sewer cleaner and the tractor- backhoe-loader be referred to the street, Engineering and Planning Committee for study. MUNICIPAL BUILDING COill·UTTEE - DARLING Councilman Darling, reporting for Municipal Building Committee, reported that a Public Meeting will be held in the Council Chambers on March 31 at 8:00 P.M. FIRE COMI\lITTEE - DARLING Councilman Darling, reporting for Fire Committee, requested authority to call for bids for an aerial-lift platform vehicle. I It was moved by Darling, seconded by Sonnemann, that the Fire Department be authorized to call for bids with bid opening to be April 21 at 3:00 p.m. MOTION CARRIED CODE AND ORDINANCE CO~n{[TTEE - NICKSON Councilman Nickson, reporting for Code and Ordinance Committee, stated the committee had discussed Ordinance No. 2337 on longevity and Ordinance No. 2338 on overtime compensation and recommend introduction only of these two ordinances. E. It was moved by Blakeney, seconded by Fitzsimmons, that Zone Change Application of Will Andre be referred to the Planning Commission. MOTION CARRIED City Clerk Williams read Rezone Application from Robert G. Malek, to rezone from R-2 to M-l, property located at 320 Western street N. W. It was moved by Blakeney, seconded by Nickson, that Rezone Application from Robert G. Malek be referred to the Planning Commission. MOTION CARRIED City Clerk Williams read letter from Green River Cablevision with regard to placing cable on utility poles where utilities are not underground. Mayor Gaines requested the matter be referred to the Utilities Committee and advised Gerald L. Brown, General Manager, who was present in the audience, that the matter would be considered at the Utilities Heeting on March 26th. City Clerk Williams read bids for Street Improvement No. 113, UAB Project No. 8-1105 (3) 4th st. S. E., with reco®nendation of Fred W. Poe to award contract to Morris Construction Co., Inc., subject to approval by the Urban Arterial Board, with bids submitted as follows: BIDDER TOTAL BID MORRIS CONSTRUCTION CO., INC. MOTION CARRIED City Clerk Williams read Summons and Complaint which was served on the City of Auburn l~rch 17, 1969 at 3:30 P.H. by Palma B. Tucker vs. City of Auburn for personal injury. Mayor Gaines requested thp. matter be referred to the City Attorney and City Insurance Agent. City Clerk Williams read letter from C. A. Bailey, requesting a taxi-cab franchise in the City of Auburn. Mayor Gaines requested the letter be referred to the License Committee. City Clerk Williams read memorandum from National League of Cities regarding Congressional City Conference to be held in Washington, D. C. on March 30 - April 1, 1969. It was moved by Kline, seconded by Bailey, that the City have representatives at this meeting. MOTION CARRIED 44 AUBURN, WASHINGTON HONDAY MARCH 17, 1969 There being no further business to come before the Council it was moved by Nickson, sec- onded by Darling, that the meeting be adjourned at 10:15 P.i-I.
