The meeting was cal led to order by Mayor Gaines. Counci Imen present: Kline, Sonnemann, Bai ley, Fitzsimmons, Blakeney, Darl ing and Nickson. APPROVAL OF MINUTES I t was moved by Blakeney, seconded by Oar ling, that the Mi nutes of Apr i I 7, 1969 be approved as mai led. MOT I ON CARR I ED It was moved by Nickson, seconded by Sonnemann, to reconsider Approval of Minutes. MOTION CARIRIED It was moved by Nickson, seconded by Sonnemann, that the fol lowing correction should be made on the Counci 1 Minutes of Apri I 7, 1969 under FINANCE COMMITTEE - on second item regarding Manson Drug, should read as fol lows: "It was moved by Sonnemann, seconded by Fitzsimmons, that request of Manson Drug for reimbursement for collection of uti lity bi I Is for the City of Auburn be referred to the Uti I ity Committee." MOTION CARRIED It was moved by Bai ley, seconded by Blakeney, that the Counci I Minutes of Apri I 7, 1969 be approved as amended. MOTION CARRIED PUBLI C HEAR I NGS Mayor Gaines declared Public Hearing open on request of C. Jovich to rezone from R-2 to R-3 a parcel of land on the N.E. corner of 27th and "0" Street S.E. The Planning Commission recommends denial because of fai lure of the applicant to appear. It was moved by Blakeney, seconded by Sonnemann, that Pub I ic Hearing be closed. MOT I ON CARR I ED It was moved by Kline, seconded by Blakeney, that the request of C. Jovich to rezone from R-2 to R-3 a parcel of land on the N. E. corner of 27th and "0" St. S.E. be re- turned to the Planning Commission for the reason that it is not a public record that the petitioner be present before action be taken on request. MOTION CARRIED Mayor Gaines declared Public Hearing open on request of Auburn Development Co. to rezone from R-2 to SPU for 48 units to R-4 a parcel of land lying between 13th and 14th Street N.E. east of Harvey Road. The Planning Commission recommends approval, provided the units are constructed in conformance with the plot plans on fi Ie in the Planning Department. This is necessary to keep the density of 25 units per acre, and that the owner agree to participate in their pro-rated share of a local improvement district on 14th St. N.E. for the development of said street to a neighborhood co I lector standard and the extension of the necessary uti lities. It was moved by Blakeney, seconded by Kline, that the Public Hearing be closed. MOTION CARRIED It was moved by Kline, seconded by Sonnemann, that we table action on request of Auburn Development Co. to rezone from R-2 to SPU for 48 units to R-4 a parcel of land lying between 13th and 14th St. N.E., east of Harvey Road unti I Old Business. It was moved by Sonnemann, seconded by Nickson, that the City Attorney be instructed to draw up the necessary resolution call ing for Public Hearing on May 19, 1969 at B:OO P.M. on petition for vacation of street for portion of property abutting "C" Street S.E. Mayor Gaines requested the appl ication for massage operator or massage parlor attendant I icense from Charlotte Marie Fernandez be referred to the license Committee. AUDIENCE PARTICIPATION Mr. Ralph Beers, 1123 4th N.E., Auburn, Washington, from audience complained about a fence that was to have been built in accordance with rezone of Gregg property at I lOI 4th N.E., Auburn, Washington. It was moved by Nickson, seconded by Blakeney, that the Bui Iding Inspector be instructed to discuss this matter with the owner and to advise the owner to complete the fence, in accordance with the rezone conditions. I MOTION CARRIED RECOMMENDATIONS The for lowing applications were submitted by the Auburn Planning Commission: a. The request of Archie Meade & Don-Mar, Inc. for a SPU for gravel removal on property located east of R Street and north of Auburn Way South (on East Hill). (Application No. 6-69) The Planning Commission recommends to the City Counci I that this request to rezone from R-I to SPU be granted with the fol lowing provisions: l~~hat before any gravel removal is commenced on Parcel B-3 and the easterly portion of B-2, grading Plans for this area shal I be submitted and approved by the City Engineer to insure conformity with the development on adjacent properties and for the future extension of "Z" Street to coordinate with' that portion of HZ" Street to be constructed south of Parcel B-3 and to leave a strip of land adjacent to the entire east boundary of parcel B-3 suitable for residential development. 2. That a 6 foot high cyclone type screen fence with redwood inserts as approved I by the City Engineer and shown on the plans on file be constructed prior to removal of any material covered by this permit. 3. That the Air Pollution Control Standards shal I be in accordance with the King County Air Pollution Control requirements. 4. That the Industrial Standards for noise shal I conform to those for M-I Light Industrial, as contained in Article 6, Section 32 of the City of Auburn Zoning Ordinance No. 1702. I I I 54 AUBURN. No processing of material shal I be al lowed on the site covered by this permit. 6. That haul ing to and from the permit area to be confined to routes south and west of the permit area. AI I haul roads shal I be oiled or watered to control dust as required by the City Engineer. 7. That al I access points to publ ic streets shal I be approved by the City Engineer to insure adequate traffic control. 8. That the appl icant cross-sect ion the permit area once a year and submit the cross- sections to the City Engineer to indicate conformance with the permit. 9. That this special property use permit be reviewed by the Planning Commission and recommendations made to the City Council every three years to determine if any modifi- cations or termination in the plans and profiles on file are necessary for the pro- tection and/or coordination of development on adjacent properties and to review the special conditions to determine if they are sufficient to provide adequate protection to the adjacent properties and/or general publ ic. 10. That the vegetation and trees shal I not be removed from more than ten acres of the area proposed for excavation at one time. II. That the appl icant post with the City of Auburn a performance bond in the amount of $10,000.00 to insure compliance with the above provisions. 12. That the owners dedicate the south 30 feet of that portion of the property abutting the Indian Reservation for the future extension of 17th St. S.E. b. The request of Wil I Andre to rezone from A-I to M-I (light industrial) a parcel of land located at the N.E. corner of "C" St. and 30fh St. N.E. (Application No. 8-69) The Planning Commission recommends to the City Council the approval of Wi I I Andre's application to rezone from A-I to M-I as it is surrounded by industry and conforms to the Comprehensive Plan of the City of Auburn with consideration being given to the easterly 30 feet for the continuation of "D" St. N.E. c. The request of Robert G. Malek to rezone from R-2 to M-I (light industrial) a parcel of land located at 320 WestErn St. N.W. (Appl icat ion No. 9-69) The Planning Commission recommends to the City Council that the request of Robert Malek to rezone from R-2 to M-I be granted inasmuch as this request conforms to the overal I Comprehensive Plan of theCity of Auburn under M-I with the following pro- visions included: I. No open storage should be al lowed on the property, unless it is completely fenced by a 6 foot screen fence. 2. That this condition should prevail until such a time as the abutting property obtain a M-I zoning to conform to our comprehensive development plan. 3. Consideration should be given to the dedication of the westerly 10 feet for the future widening of Western Street. It was moved by Blakeney, seconded by Nickson, that appl ications a, b, and c be scheduled for Public Hearing at 8:00 P.M. on May 5, 1969. MOTION CARRIED The fol lowing items were submitted by Fred Poe, City Engineer, for approval: a. Pay Estimate No.2 for Golf Course construction to Spragues, Inc. for $12,0'9.78. It was moved by Blakeney, seconded by Sonnemann, that Pay Estimate No.2 for Golf Course construction to Spragues, Inc. for $12,019.78 be paid. ROLL CALL VOTE: All Counci Imen voting YES. MOTION CARRIED b. Authorization to advertise for Wel I No.2 pump and accessories per specifications prepared by Stevens, Thompson & Runyan, consulting engineers. It was moved by Blakeney, seconded by Nickson, that Change Order No.3 on St. Imp. 105 (West Val ley Hwy.) for removal, correction and protection of slide area for $3,695.70 be approved. MOT I ON CARR I ED PROC LAMA TI ONS, ANNOONCEMENTS AND APPO I NTMENTS Mayor Gaines proclaimed Friday, May 23 and Saturday, May 24 to be Poppy Days in the City of Auburn as tribute to our disabled veterans. CooNC I L COMMI TTEE REPORTS AIRPORT COMMITTEE - KLINE I Counci Iman Kline, reporting for Airport Committee, stated the committee had discussed the proposal by Puget Power to underground the power I ines to the sewage lagoon pump·s. The committee proposes that the airport pay for the undergrounding and that the uti lity pay for the transformer rental and changeover of service connections at the end of the underground primary line. The.cost to be from the airport construction fund in the sum of $7,311.53. Discussion was given to consideration to the hangar doors that wi II be instal fed on the airp4ane storage hangar units, which wi I I amount to 32 doors and the Airport Committee requested permission to travel to Salt lake City to look at this particular type of door, and they would leave on April 25, 1969. L1CENSE COMMITTEE - SONNEMANN Counc i ¡man Sonnemann, report ing for Li cense Corrrni t tee, stated j t was the reconrnendat ion of the Committee that the ordinance regarding licensing of taxicabs be changed somewhat and that changes will be recommended by the I icensè committee. Councilman Sonnemann stated the committee did not wish to make any recommendation for granting any additional I icenses for taxicabs unti I amendments have been made to the city ordinance. GOLF COURSE COMMITTEE - FITZSI^~ONS Councilman Fitzsimmons, reporting for the Golf Course Committee, stated there were two leases to be considered with regard to the Golf Course. It was moved by Fitzsimmons, seconded by Blakeney, that the Mayor and City Clerk be authorized to sign the general lease for the Golf Course with and subject to the approval of the City Attorney and the Golf Course Committee. I MOTION CARRIED It waS moved by Fitzsimmons, seconded by Blakeney, that the Mayor and City Clerk be authorized to sign the interim agreement with the Golf Course subject to approval of the City Attorney and the Golf Course Committee. MOTION CA.RRIED 56 AUBURN, WASHINGTON MONDAY A PR I L 2 I, I 969 STREET, ENGINEERING AND PLANNING Cæ~dTTEE - BLAKENEY Councilman Blakeney, reporting for Street Committee, announced there would be a meeting on Wednesday evening, April 23, 1969, at 7:30 P.M. FIRE COMMITTEE - DARLING Councilman Darl ing, reporting for Fire Committee, stated the bids that were opened on April 21,1969 on aerial lift platform for the Fire Department would be,referred to Fire Committee for study. I MUNICIPAL BUILDING COMMITTEE - DARLING Councilman Darling, reporting for Municipal Building Committee, stated the committee had met with a committee from the Chamber of Commerce, and they are behind the idea of the need for a new City Hal I and there would be further study conducted with regard to the Municipal Building Committee. CODE AND ORDI~~NCE COMMITTEE - NICKSON Councilman Nickson, reporting for Code and Ordinance Committee, reported the Committee recommends no action on Ordinance No. 2338 on overtime compensation. OLD BUSINESS The matter of request of Auburn Development Co. Publ ic Hearing to rezone from R-2 to SPU for 48 units to R-4, a parcel of land lying between 13th and 14th St. N.E., east of Harvey Road, was taken up again at this time. It was moved by Nickson, seconded by Blakeney, that request of Auburn Development Co. to rezone from R-2 to SPU for 48 units to R-4 a parcel of land lying between 13th and 14th St. N.E., east of Harvey Road, be tabled to al low the developer time to prepare plans that would meet the elements of our SPU for zoned property. MOTION CARRIED I It was moved by Nickson, seconded by Sonnemann, that Ordinance No. 2338, tabled on April 7, 1969, be deferred for action until May 5, 1969 Council Meeting. rv'.OT I ON CARR I ED NEW BUSINESS It was moved by Kline, seconded by Fitzsimmons, that the Mayor and City Clerk be authorized to sign an agreement with puget Sound Power and Light Company to remove overhead system and replace with underground service, cost to be borne by Airport Construction Fund and balance by utility, agreement subject to approval of the City Attorney and Airport Committee. City Clerk Williams read letter from Fred W. Poe, Director of Public Works, regarding percentage objections to L.I.D. No. 231 (sanitary sewers on 3rd st. S. E. and N st. S.E.) established by Resolution No. 353, total 21.8%, therefore L.I.D. is in effect and plans will be continued with design for the construction. Mayor Gaines requested the letter be filed. City Engineer Fred Poe requested permission to call for Public Hearing on tþe Assess- ment Roll for Local Improvement District No. 207, 208B and 221, providing for the water mains on 37th St. N. E. from Auburn Way to B st. N. E. & cst. N. E. from 35th St. N. E. to 37th st. N. E.; sanitary sewers in the nortb section of the City on 37th st. N. E. and on Auburn Way North; and curb and gutter, storm sewers, water mains and street construction on J St. N. E. from 4th N. E. to point 307 ft. north, respectively. It was moved by Nickson, seconded by Blakeney, that Public Hearing be held on the Assessment Roll for Local Improvement District No. 207, water mains on 37th st. N. E. from Auburn Way to B St. N. E. & CSt. N. E. from 35th N. E. to 37th St. N. E.; Local Improvement District No. 208B, sanitary sewers in the North section of the City on 37th St. N. E. and on Auburn Way North; and Local Improvement District No. 221, water mains and street construction on J St. N. E. from 4th st. N. E. to a point 307 ft. North, at 8:00 P.M., May 19, 1969. MOTION CARRIED Bids were opened at 3:00 P.M. on Call for Bids for aerial lift platform for the Fire Department on April 21, 1969, with bids submitted as follows: BIDDER Mack Trucks, Inc. Mayor Gaines requested the bids be referred to the Fire Committee and Fire Department for recommendation.
