WASHINGTON JUNE 16, 1969 MONDAY The regular meeting of the City Council of the City of Auburn cODVened at 13:00 P.M. in the Council Chambers of the City Hall. The meeting was called to order by Mayor Gaines. Councilmen present: Kline, Sonnemann, Bailey, Fitzsimmons, Blakeney, Darling and Nickson. APPROVAL OF MINUTES It was moved by Blakeney, seconded by Darling, that the Minutes of June 2, 1969 Council Meeting be approved as mailed. PUBLIC HEARINGS Mayor Gaines declared Public Hearing open on request of Charles Jovich to rezone from R-2 to R-3 a parcel of land lying on the N. E. corner of 27th and liD" St. S. E. (Application No. 4-69) The Planning Commission recommend to the City Council the request be approved with the following provisions: 1. That a five foot easement for sidewalk be given along the west side of the property along liD" St. S. E. 2. That the unit be restricted to single story construction. 3. That all setback requirements of the R-2 classification be met. It was moved by Blakeney, seconded by Nickson, that the Public Hearing be closed. MOT ION CARRIED It was moved by Blakeney, seconded by Bailey, that the recommendations of the Planning Commission be concurred with and the City Attorney be instructed to draw up the necessary ordinance granting rezone. Mayor Gaines declared Public Hearing open on request of Roland A. Crabtree to rezone from Unclassified to R-2, R-3, R-4, C-l and C-3 property located South of Oravetz Road area. (Application No. 11-69) The Planning Commission recommend to the City Council the request be approved with the following provisions and alterations: 1. That the C-l and C-3, as submitted, be approved because they conform to our Comprehen- sive Land Use Plan and are bounded by a major collector street and a proposed secondary arterial street. 2. That the R-4 classification be modified to conform to the boundaries, as shown on our Comprehensive Land Use Plan. 3. That the balance of the R-4 and R-3 property be rezoned to R-2 at this time until adequate development plans are submitted containing street patterns, lot layout, and topography. If, at that time, it is determined that this property cannot be econ- omically developed as single family dwelling areas because of topography, the indivi- dual areas could be considered uner our special property use section of our zoning ordinance. This would provide us with the control to insure that the proposed developments would not be detrimental to adjacent properties. 4. That the maximum density on the R-4 property be set at 25 units per acre to conform to our Comprehensive Plan. 5. That the R-2 area be restricted to a maximum density of 4 dwelling units per acre to conform with our Comprehensive Plan for low density single family areas. 6. That all necessary right-of-ways will be included in the subdivisions as they are submitted and will be reviewed by the Department of Public Works at that time. Mr. Jensen, appearing for Mr. Crabtree, asked for an explanation of the Planning Commissiwn recommendations. Mr. Weehler, Assistant Planning Director, explained the recommendations of the Planning Commission. It was moved by Nickson, seconded by Blakeney, that the Public Hearing be closed. MOTION CARRIED 135 AUBURN. WASHINGTON MONDAY JUNE 16, 1969 It was moved by Nickson, seconded by Fitzsimmons, that the Planning Commission recommen- dations be concurred with, and the City Attorney be instructed to draw up necessary ordinance granting rezone. MOTION CARRIED It was moved by Kline, seconded by Blakeney, that the Planning Commissions recommendations be amended in Paragraph 5 to read: "That the R-2 area be restricted to an average maxi- mum density not to exceed 5 dwelling units on any given acre". MOTION CARRIED Mayor Gaines declared Public Hearing open on request of Al Morrison to rezone from R-2 to NS and C-3 a parcel of land lying at the S. Vi. corner of "R" and 29th st. S. E. (Application No. 40-613) I The Planning Commission recommend to the City Council the request be approved with the following provisions: 1. The requested C-3 zoning be denied. 2. That the uses allowed in the NS zone be restricted to those as shown on the prelim- 'inary plot plan. Any deviation from the proposed uses to include additional uses allowed in the NS classification of our zoning ordinance will be approved or denied by the Planning Commission after Public Hearing thereon. 3. That the proposed buildings and the location of same, which shall include driveway location, parking and landscaping, shall conform to the preliminary plot plans and elevations approved by the Planning Commission and shall be made a part of said agreement. 4. That sufficiant right-of-way be dedicated to the City of Auburn for the purpose of straightening out the intersection of 29th and "R" st. S. E. It was moved by Blakeney, seconded by Nickson, that Public Hearing be closed. MOTION CARRIED It was moved by Nickson, seconded by Kline, that the request of Al Morrison to rezone I from R-2 to NS a parcel of land lying at the S.W. corner of "R" and 29th St. S. E. be approved per submitted plot plan and recommendation 2, 3, and 4 of the Planning Commis- sion be subject to this rezone, and the City Attorney prepare necessary ordinance granting rezone. MOTION CARRIED Mayor Gaines declared Public Hearing open on request of John R. Hurt to rezone from R-2 to SPU for a dental clinic a parcel of land located at 620 IIM" St. N.E. (Application No. 12-69) The Planning Commission recommend to the City Council the request be approved with the following provisions: 1. That a sidewalk should be constructed on this property at the time of remodeling. It was moved by Nickson, seconded by Kline, that Public Hearing be closed. MOTION CARRIED It was moved by Blakeney, seconded by Kline, that the Planning Commission recommendations be concurred with and the City Attorney be instructed to prepare the necessary ordinance granting rezone. MOTION CARRIED RECOMMENDATIONS The following items were submitted by the Planning Commission to Call for Public Hearing: I 1. The request of F. H. Shaughnessy to rezone from A-I to M-l parcels of land lying at, the S.E. and S.W. corners of the intersection of 37th and IIC" Streets N.E. (Application No. 13-69) 2. The request of Alice B. Melton to rezone from R-3 to C-3 a parcel of land on the South side of East Main Street, 117 feet east of "Mil Street S. E. (Application No. 15-69) 3. The request of Dorothy Leeman to rezone from R-3 to C-3 a parcel of land on "Mil Street S.E., 90 feet South of East Main Street. (Application No. 16-69) 4. Division #1 - Great Western Addition It was moved by Blakeney, seconded by Sonnemann, that items 1, 2, 3, 4 under Planning Commission recommendations above be called for Public Hearing July 7, 1969 at 13:00 P.M. MOTION CARRIED I I I AUBURN, WASHINGTON ENGINEERING RECOMMENDATIONS 136 JUNE 16, 1969 MONDAY The following items were submitted by Fred Poe, City Engineer, for approval: 1. Progress Payment No.3 to Sprague's Inc. for the landscaping at the Auburn Municipal Golf Course for $41,733.135. It was moved by Sonnemann, seconded by Fitzsimmons, that Progress Payment No. 3 to Sprague's Inc. for the landscaping at the Municipal Golf Course for $41,733.135 be paid. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED 2. Progress Payment No.2 to Sprague's Inc., for the irrigation system for Auburn Municipal Golf Course for $12,526.29. It was moved by Kline, seconded by Blakeney, that Progress Payment No.2 to Sprague's Inc ., for the irrigation system for Auburn Municipal Golf Course for $12,526.29 be paid. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED 3. Progress Payment No.1 to Service Electric Co., Inc. for Street Improvement No. 107 (Signals at West Valley Division, 12th S. E. and Fir Streets) for $26,757.00. It was moved by Nickson, seconded by Sonnemann, that Progress Payment No. 1 to Service Electric Co., Inc. for Street Improvement No. 107 (Signals at West Valley Division, 12th st. S.E. and Fir Streets) for $12,757.00 be paid. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED 4. Pass a resolution authorizing the Mayor and City Clerk to sign a Supplement to Permit No. 100397 with Northern Pacific Railway Company permitting the installation of a 12-inch storm sewer on NPRR right-of-way at 37th St. N. W. It was moved by Blakeney, seconded by Kline, that the City Attorney be instructed to prepare necessary resolution authorizing the Mayor and City Clerk to sign a supplement to Permit No. 100397 with Northern Pacific Railway Company permitting the installation of a l2-inch storm sewer on NPRR right-of-way at 37th Street N. W. MOTION CARRIED 5. Pass a resolution authorizing the Mayor and City Clerk to sign an agreement with Green River Cablevision, Inc. in accordance with the recommendation of the Utility Committee in their meeting of April 16, 1969. It was moved by Sonnemann, seconded by Blakeney, that the City Attorney be instructed to prepare necessary resolution authorizing the Mayor and City Clerk to sign an agreement with Green River Cablevision, Inc. MOTION CARRIED 6. The final petitions for annexation of the Auburn Academy area East of the present City Limits, said petitions containing signatures of owners of 134 percent of the value of land and improvements. It was moved by Sonnemann, seconded by Blakeney, that Public Hearing be held July 7, at 13:00 P.M. on final petitions for annexation of the Auburn Academy area East of the present City Limits. MOTION CARRIED PROCLAMATIONS. ANNOUNCEMENTS AND APPOINTMENTS Mayor Gaines announced the appointment of Robert E. Chipper field to the position of Airport Supervisor and requested Council conformation. It was moved by Blakeney, seconded by Sonnemann, that the appointment of Robert E. Chipperfield to the position of Airport Supervisor be confirmed. MOTION CARRIED COUNCIL COMMITTEE REPQR$S FINANCE COMMITTEE - KLINE Councilman Kline, reporting for Finance Committee, stated the Finance Committee had met at 9:00 A.M., June 16, and the Finance Director is in receipt of the annual report of the water-sewer utility from the Division of Municipal Corporations and is on file. The City Treasurer requested authority to purchase City of Auburn LID Warrants from the following funds: 137 AUBURN. MOTION CARRIED I It Was the recommendation of the Finance Committee that the Park Construction Fund make a temporary loan to the Golf Course Construction Fund in the sum of $913,276.92. It was moved by Kline, seconded by Blakeney, that the Finance Director be authorized to make a temporary loan to the Golf Course Construction Fund from the Park Construction Fund the sum of $913,276.92. MOTION CARRIED AIRPORT COMMITTEE - KLINE Councilman Kline, reporting for the Airport Gommittee, reported the construction seems to be on schedule and it would appear no unsuitable conditions have been involved. LICENSE COMMITTEE - SONNEMANN Councilman Sonnemann, reporting for the License Committee, stated it was the recommen- dation of the committee that the ordinance on taxicabs be adopted. UTILITY COMMITTEE - FITZSIMMONS Councilman Fitzsimmons, reporting for Utility Committee stated stevens, Thompson and Runyan, Inc., have provided the City of Auburn with a rough draft of the Comprehensive Water Study. STREET COMMITTEE - BLAKENEY I Councilman Blakeney, reporting for Street Committee, stated the Committee will hold a meeting at 7:30 P.M., Wednesday, June 113, 1969. MUNICIPAL BUILDING COMMITTEE - DARLING Councilman Darling, reporting for Municipal Building Committee, stated Dames & Moore, Consulting Engineers in the applied Earth Sciences, have provided a report of Prelimin- ary Site Evaluation for proposed new city hall building for the City of Auburn. Council- man Darling recommended introduction and adoption of Resolution No. 367. FIRE COMMITTEE - DARLING Councilman Darling, reporting for Fire Committee, stated the committee is reviewing the Budget request submitted by Chief Calkins for 1970. CODE AND ORDINANCE COMMITTEE - NICKSON Councilman Nickson, reporting for Code and Ordinance Committee, reported the Committee has discussed the Optional Municipal Code. It is the recommendatiol!ll of the Committee to intro- duce and adopt an ordinance changing the office of the City Attorney from an elective to an appointive office, and recommend introduction only of the ordinance describing the duties and functions of the Office of the Mayor. DEPARTMENT HEAD REPORTS I Jerry Keesee, Sewer Supervisor, reported that Ken Morrison, Everett Effland, and Bernard Vinther, completed eighteen week course in Waste-Water Treatment Plant Operation from the Tacoma Vocational Institute. Jerry Keesee, further reported that Ken Morrison, Gary Shay, Ron McGaughey and Bernard Vinther and Jerry Keesee attended a Sewer Maintenance Seminar in Tacoma ~or one day. Jerry Keesee completed a thirty hour sourse entitled Water from the Air University Extension Course Institute. Mayor Gaines stated he would like to express his appreciation and that of the City and asked Jerry Keesee to extend his appreciation and that of the City to the five employees I I I B8 AUBURN , WASHINGTON MONDAY JUNE 16, 1969 named above. Mr. Kline reported he':;,had attenced the meeting at FAA Control Center on the 6th of June and was present at the time Jerry Keesee was presented an award of appreciation for the work he has done and outstanding service to the Aeronautics Commission. Mr. Kline further reported the FAA has contributed the sum of $3,990.97 to the Auburn Airport from unused funds for 19613-1969 budget. They are now participating in our Airport and we would be eligible for further participation on their part. OLD BUSINESS Replat of Lot 4, Block 1, Knickerbocker Heights Addition. (Tabled June 2, 1969) The Planning Commission recommend that the final plat of "replat of Lot 4, Block 1, Knickerbocker Heights Addition" be approved because it conforms to the preliminary plat on file. It was moved by Kline, seconded by Blakeney, the replat of Lot 4, Block 1, Knickerbocker Heights Addition be removed from the table for consideration. MOTION CARRIED It was moved by Kline, seconded by Nickson, that the Replat of Lot 4, Block 1, Knickerbocker Heights Addition be approved and the City Attorney be instructed to draw up the necessary ordinance for same. MOTION t;ARRIED NEW BUSINESS It was moved by Blakeney, seconded by Kline, that Chapter 6.04 concerning dogs be amended and include a dog control law, and the City Attorney be instructed to prepare necessary ordinance for consideration by the council. MOTION CARRIED BID OPENINGS Bids were opened at 11:00 A.M., June 11, 1969 on Call for Bids for L.I.D. 224 (Streets, 10th N.E., "I" N.E., and 9th N.E.) with bids submitted as follows: Valley Cement Construction Co. Morris Construction Co. Moss Construction Co., Inc. $66,460.00 74,999.00 131,647.50 The above bids were accompanied by Bid Bonds, and did not include sales tax. The City Engineer recommends the contract be awarded to Valley Cement for $66,460.00. It was moved by Kline, seconded by Blakeney, that the bid for L.I.D. 224 ,be awarded to Valley Cement Construction Co., and the Mayor and City Clerk qe authorized to sign the contract and upon signing of contract the bid bonds of the unsuccessful bidders be re- turned. MOTION CARRIED Bids were opened at 11:00 A.M., June 12, 1969 on Call for Bids for chain link fence for the Auburn Municipal Golf Course, with bids submitted as follows: United States êteel Corporation Tor Nado Fence'-Co., Inc. $ 4,1325.00 5,332.00 The above bids were accompanied by Bid Bonds, and did not include sales tax. A bid by American Fence Co., Inc., was rejected because they did not furnish a bid bond or acknowledge Addendum No. 1. It is recommended by the City Engineer the contract be awarded to United States Steel Corporation for $4,1325.00 plus sales tax. It was moved by Blakeney, seconded by Fitzsimmons, that the bid be awarded to United States Steel Corporation for chain link fence for the Auburn Municipal Golf Course and the Mayor and City Clerk be authorized to sign necessary contract and after the contract , is signed the bid bond of the unsuccessful bidder be returned, and the bid of American Fence Co., Inc., be rejected. MOTION CARRIED ORDINANCES AND RESOLUTIONS ORDINANCE NO. 2291 entitled "AN ORDINANCE OF THE CITY OF AUIDRN, WASHINf~TON, AMENDING SECTION 23 OF ORDINANCE NO. 1429 OF THE CITY OF AUBURN, SAID SECTION RELATING TO THE 139 /iUBURN t WASHINGTON MONDAY JUNE 16, 1969 SPEED LIMITS ESTABLISHED FOR CERTAIN STREETS SITUATE WITHIN THE CORPORATE LIMITS OF THE CITY OF AUBURN, AND FURTHER AMENDING ORDINANCE NO. 1429 OF THE CITY OF AUBURN BY ADDING THERETO AND INSERTING THEREIN FOLLOWING SECTION 23 THEREOF TWO NEW SECTIONS 23{A) AND 23 (B)". MOTION CARRIED ORDINANCE NO. 2356 entitled "AN ORDINANCE OF THE CITY OF AUBURN, RELATING TO AND RIDULATING THE OPERATION OF AND RATES CHARGED BY TAXICABS LICENSED BY THE CITY OF AUBURN AND REPEAL- ING ORDINANCE NOS. 9132, 16139, 1200, and 20513 OF THE ORDINANCES OF THE CITY OF AUBURN AND ALL AMENDMENTS THERETO AND ALL OTHER ORDINANCES AND SECTIONS OF ORDINANCES IN CONFLICT HEREWITH". MOTION CARRIED ORDINANCE NO. 2357 entitled "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, CHANGING THE OFFICE OF THE CITY ATTORNEY, FROM AN ELECTIVE TO AN APPOINTIVE OFFICE PURSUANT TO RCW 35.24.020. It was moved by Nickson, seconded by Darling, that Ordinance No. 2357 be introduced and adopted. Mr. Kline requested permission to be heard on an amendment to Ordinance No. 2357. It was moved by Blakeney, seconded by Sonnemann, to consider Mr. Kline's suggested amendment. It was moved by Kline, seconded by Blakbney, that after City Council, in Section 1 the following should be added: "the individual so appointed shall solely represent the City of Auburn and have no other clients as an attorney". ROLL CALL VOTE ON AMENDMENT: Councilmen Kline and Blakeney voting YES. Councilmen Sonnemann, Bailey, Fitzsimmons, Darling and I Nickson voting NO. MOTION CARRIED ORDINANCE NO. 23513 entitled "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, AMENDING SECTIONS 1.42.020, -1.42.040, 1.42.0130, 1.42.090, 1.42.100, 1.42.110, 1.42.120, 1.42.130, 1.42.140, 1.42.150, 1.42.190, 1.42.210, 1.42.2130, 1.42.3130, 1.42.390, 1.42.400, 1.42.410, 1.42.450 and 1.42.460, OF THE AUBURN CITY CODE, SAID SECTIONS AMF-EDED RELATING TO THE DESIGNATION OF THE ELECTION PRECINCTS WITHIN THE CORPORATE LIMITS OF THE CITY OF AUBURN, AND DELETING THEREFROM SEC. 1.42.030 AND 1.42.070. It was moved by Blakeney, seconded by Sonnemann, that Ordinance No. 23513 be introduced and adopted. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED ORDINANCE NO. 2359 entitled "AN ORDINANCE OF THE CITY OF AUBURN, WASHINm'ON, ESTABLISHING REGULATIONS FOR THE NUMBERING OF COMMERCIAL AND RESIDENTIAL BUILDINGS WITHIN THE CORPORATE LIMITS OF THE CITY OF AUBURN; AND PRESCRIBING PENALTIES FOR THE VIOLATIONS THEREOF". It was moved by Sonnemann, seconded by Blakeney, that Ordinance No. 2359 be introduced only. I MOTION CARRIED ORDINANCE NO. 2360 entitled "AN ORDINANCE OF' THE CITY OF AUBURN, WASHINGTON, AMENDING SECTIONS 9.22.133, 9.22.1130 AND 9.22.190 OF THE AUBURN CITY CODE; SAID SECTIONS AMENDED RELATING TO PROHIBITED PARKING AREAS, FIFTEEN MINUTE PARKING AND ONE-HOUR NON-METERED PARKING WITHIN THE CORPORATE LIMITS OF THE CITY OF AUBURN". It was moved by Blakeney, seconded by Sonnemann, that Ordinance No. 2360 be introduced only. MOTION CARRIED ORDINANCE NO. 2361 entitled "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, ESTABLISH- ING THE DUTIES AND FUNCTIONS OF THE OFFICE OF THE MAYOR". 90 AUBURN, WASHINGTON MONDAY JUNE 16, 1969 It was moved by Nickson, seconded by Darling, that Ordinance No. 2361 be introduced only. MOTION CARRIED RESOLUTION NO. 367 It was moved by Darling, seconded by Nickson, that Resolution No. 367 entitled "A RESOLUTION OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR THE ACQUISITION OF CERTAIN REAL PROPERTY FOR A NEW MUNICIPAL BUILDING" be introduced and adopted. MOTION CARRIED I RESOLUTION NO. 3613 It was moved by Kline, seconded by Blakeney, that Resolution No. 3613 entitled "A RESOLUTION OF THE CITY OF AUBURN, WASHINGTON, PROVIDING Fæ THE PAYMENT BY THE CITY OF THE COSTS OF LOWERING THE 230 KV TRANSMISSION LINE AND CIRCUITS OF THE BONNEVILLE POWER ADMINISTRATION SITUATED NORTH OF THE MUNICIPAL AIRPORT FACILITY OF THE CITY, SUBJECT TO THE APPROVAL OF THE FINANCE COMMITTEE AND CONSULTING AIRPORT ENGINEERS" be introduced and adopted. MOTION CARRIED APPROVAL OF VOUCHERS AND TRANSFERS It was moved by Kline, seconded by Blakeney, that the transfers and vouchers as listed in the sum of $1513,9131.05 be approved for payment. (Warrant Nos. 785 through 946) ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED MISCELLANEOUS BUSINESS City Clerk Williams read letter from Thomas E. Dupar, President, Northwest Homes, Incorporated, saying "thanks". Mayor Gaines requested the letter be filed. I City Clerk Williams read letter from Gordon G. Thomas, M.D. advising of resignation as Auburn Health Officer. It was moved by Blakeney, seconded by Nickson, that the Mayor and City Clerk write a letter of thanks for the years of service from the Mayor and Council and City of Auburn. MOTION CARRIED City Clerk Williams read letter from Sandra ~. Knott, R.N., Shirley F. Carpenter, R.N., and Helen P. Hronec, R.N. Mayor Gaines requested the letter be filed. City Clerk Williams read letter from the Auburn City Employees Association, advising the Mayor and Council that the Association voted to dissolve the union bargaining unit of the ACEA and remain a social group only. Mayor Gaines requested the letter filed. There being no further business to come before the Council, it was moved by Blakeney, seconded by Darling, the meeting adjourn at 10:35 P.M.
