HomeMy WebLinkAbout07-07-1969 91 AUBURN. WASHImTON MONDAY JULY 7, 1969 The regular meeting of the City Council of the City of Auburn convened at 8:00 P.M. in the Council Chambers of the City Hall. The meeting was called to order by Mayor Gaines. Councilmen present: Kline, Sonnemann, Bailey, Fitzsimmons, Blakeney, Darling and Nickson. APPROVAL OF MINUTES It was moved by Sonnemann, seconded by Blakeney, that the Minutes of the Council Meeting of June 16, 1969 be approved as mailed. MOTION CARRIED I PUBLIC HEARINGS Mayor Gaines declared Public Hearing open on request of F. H. Shaughnessy to rezone from A-I to M-l, parcels of land lying at the S. E. and S. W. corners of the intersection of 37th and "C" Streets N.E. (Application No. 13-69) The Planning Gommission recommend to the City Council that this request be granted inas- much as it convorms to the Comprehensive Land Use Plan of the City of Auburn. It was moved by Sonnemann, seconded by Nickson, that the Public Hearing be closed. MOTION CARRIED It was moved by Sonnemann, seconded by Nickson, that the recommendations of the Planning Commission be concurred with and the City Attorney be instructed to draw up the necessary ordinance granting rezone. MOTION GARRIED Mayor Gaines declared Public Hearing open on request of Alice B. Melton to rezone from R-3 to C-3 a parcel of land on the South side of East Main street, 117 feet East of "M" Street S. E. (Application No. 15-69) The Planning Commission recommend to the City Council that this request be granted inas- much as it conforms to the Comprehensive Land Use Plan of the City of Auburn. It was moved by Blakeney, seconded by Sonnemann, that the Public Hearing be closed. I MOTION CARRIED It was moved by Blakeney, seconded by Sonnemann, that the recommendations of the Planning Commission be concurred with and the City Attorney be instructed to draw up the necessary ordinance granting rezone. MOTION CARRIED Mayor Gaines declared Public Hearing open on request of Dorothy Leeman to rezone from R-3 to C-3 a parcel of land on "M" Street S. E., 90 feet South of East Main Street. (Application No. 16-69) The Planning Commission recommend that this request be granted inasmuch as it conforms to the Comprehensive Land Use Plan of the City of Auburn. Mrs. Dorothy Leeman was present in the audience with regard to rezone request. It was moved by Blakeney, seconded by Sonnemann, that the Public Hearing be closed. MOTION CARRIED It was moved by Blakeney, seconded by Sonnemann, that the recommendations of the Planning Commission be concurred with and the City Attorney be instructed to draw up the necessary I ordinance granting rezone. It was moved by Kline, seconded by Nickson, that the rezone have a restriction that a 6-foot high cyclone type screen fence with redwood inserts be constructed and lighting on the South property line be reflected to the North and the restriction apply only so long as the property adjacent to the South is used for its original usage. Councilman Sonnemann and Blakeney voting NO. MOTION CARRIED MOTION AS AMENDED CARRIED Mayor Gaines declared Public Hearing open on Division #1 - Great Western Addition. The Planning Commission recommend the plat be signed by the Secretary and Chairman of the Planning Commission, and that the plat be referred to the City Council for their I I I 92 AUBURN, WASHINGTON MONDAY JULY 7, 1969 final approval, upon receiving approval from the City Engineer that the improvements have been installed to city specifications or the necessary performance bond has been submitted. It was moved by Sonnemann, seconded by Blakeney, that the Public Hearing be closed. MOTION CARRIED It was moved by Sonnemann, seconded by Blakeney, that action be tabled on Final Plat on Division #1 - Great Western Addition, until requirements recommended by the Planning Commission have been complied with. MOTION CARRIED Mayor Gaines declared Public Hearing open on final petition for annexation of the Auburn Academy area East of the present City Limits, said petitions containing signatures of owners of 84 percent of the value of land and improvements in favor of annexation. It was moved by Sonnemann, seconded by Bailey, that the Public Hearing be closed. MOTION CARRIED It was moved by Sonnemann, seconded by Nickson, that the annexation request be approved and referred to the King County Boundary Review Board, and the City Attorney be instructed to draw up the necessary ordinance. MOTION CARRIED Mayor Gaines declared Public Hearing open on Resolution No. 366, for proposed L.I.D. for construction and installation of excavation, ballasting, asphalt concrete paving and curb and gutter where non-existing along First Street Northeast between "J" and "L" Streets Northeast. Mr. Earl Norman, from audience, asked who originated the L.I.D. Resolution. Mr. Fred Poe, City Engineer, replied the matter originates from a resolution by the City Council. Mr. Norman then inquired with regard to how assessments are determined. Mr. Poe explained the process of estimated costs and assessments and the term of assessment. Mr. Bill Hartman, Mr. Forest Kimmerle, and Mr. David Reiten, from audience, stated they were opposed to paying for the improvements twice, inasmuch as gutters had been installed in 1951 and widening and straightening of the street had been done in 1959. Question was raised as to what rights the property owners have in this instance. Mr. Robert Smythe, City Attorney, explained the process of LID resolutions and the stoppage of same. It was moved by Blakeney, seconded by Sonnemann, that the Public Hearing be closed. MOTION CARRIED It was moved by Blakeney, seconded by Nickson, that the City Attorney be instructed to prepare necessary ordinance to create resolution L.I.D. as authorized by Resolution No. 366. It was moved by Fitzsimmons, seconded by Blakeney, that action be tabled until July 21st. MOTION CARRIED CORRESPONDENCE City Clerk Williams read letter from Hawkins and Ingalls, attorneys for Rescue Ambulanee Service, regarding request for emergency parking zone on South Division Street in front of 12 South Division street, Auburn, Washington. Mayor Gaines requested the letter be referred to the Street Committee for discussion with the applicants. City Clerk Williams read Zone Change Application from Toshio Nishimura and Kiyako Nishimura, to rezone from A-I to C-3, property located between 3104 and 3204 Auburn Way North. It was moved by Blakeney, seconded by Fitzsimmons, that Zone Change Application from Toshio Nishimura and Kiyako Nishimura, to rezone from A-I to C-3, be referred to the Planning Commission. 93 AUBURN, WASHINGTON MONDAY JULY 7, 1969 City Clerk Williams read Zone Change Application from Douglas K. Feazel, to rezone from R-2 to M-l, property located at 147 Clay st. N. W. It was moved by Blakeney, seconded by Fitzsimmons, that Zone Change Application from Douglas K. Feazel, to rezone from R-2 to M-l, be referred to the Planning Commission. MOTION CARRIED City Clerk Williams read letter from Evelyn Bowen,regarding Ordinance No. 2361. Ma~ Gaines requested the letter be filed. RECOMMENDATIONS I PLANNING Cm1MISSION RECOMMENDATIONS The following items were submitted by the Planning Commission to Call for Public Hearing: 1. The request of Clair Sabo to rezone from R-2 to R-4, property located at the S. W. corner of 22nd and "D" St. S.E. (Application No. 17-69) 2. The request of White River Valley Veterans of Foreign Wars to rezone from Unclassified to a S.P.U. for lodge facilities property located at "M" St. S. E. and 37th st. S.E. (Application No. 20-69) 3. The request of Howard W. Boddy to rezone from A-I to M-l property located at 55 30th St. N. W. (Application No. 18-69) 4. The request of Clay M. Potter to rezone from R-2 to S.P.U. for proDerty located at 515 "M" St. N. E. for the purpose of professional offices. (Application No. 19-69) 5. The request of Myron Toler íor consideration of the preliminary plat of Lundstrom's First Addition. (Application No. p-3-69) 6. The request of Herbert Elving for consideration of the preliminary plat of Robin Wood Addition. (Application No. P-4-69) It was moved by Kline, seconded by Blakeney, that items 1 through 6, submitted by the I Planning Commission to Call for Public Hearing, be scheduled for Public Hearing on July 21, 1969 at 8:00 P.M. MOTION CARRIED ENGINEERING RECOMMENDATIONS The following items were submitted by Fred Poe, City Engineer, for approval: 1. Progress Payment No. 3 (Final) to Slead-Tonneson Construction Co. for L.I.D. No. 219 (Sanitary Sewers & Lift Station, A St. S. E., 37th St. S. E. and vicinity) for $ 26 , 947.08. It was moved by Kline, seconded by Blakeney, that Progress Payment No.3, final, to Slead-Tonneson Construction Co. for $26,947.08 for L.I.D. No. 219 (Sanitary sewers & Lift Station, A St. S. E., 37th St. S.E. and vicinity) be paid and that the project be accepted by the City as completed, and that the retained percentage amounting to $13,303.49, in- cluding sales tax, be paid in 30 days provided no liens or claims are filed and clearance is secured from the State Tax Commission and the Department of Labor and Industries. It was moved by Blakeney, seconded by Bailey, that Progress Payment No. 1 to Leonard Construction Co. for the Public Works building for $21,258.97 be paid. MOTION CARRIED 12. Proposed L.I.D. No. 233 per Resolution No. 357 and Ordinance No. 2350 be dropped as signatures of 65 percent of the adjacent property owners opposing the L.I.D. have been received by the City Clerk. Mayor Gaines asked City Attorney, Robert Smythe to outline what has been done on this L.LD. City Clerk Williams read letters from Howard M. Smith, Duncan A. Bonjorni and Ernest Crane, requesting their names be removed from the petition which was signed against the L.I.D. No. 233. 95 AUBURN, WASHINGTON MONDAY JULY 7 , 1969 Mr. Duncan A. Bonjorni, from audience, spoke in favor of the L.I.D. No. 233 and that he felt the City is within the restrictions of the statute to go ahead with the L.I.D. It was moved by Fitzsimmons, seconded by Kline, that the City Engineer be authorized to call for bids for L.I.D. No. 233. MarION CARRIED Mr. Jim Weese, from audience, stated he would like to thank the City and elected officials and cœrunend the Engineering Department for their cooperation in this matter. APPOINTMENTS, PROCLAMATIONS AND ANNOUNCENENTS Mayor Gaines announced the appointment of Dr. Robert McLean as Healt~ Officer to replace Dr. Gordon Thomas. I It was moved by Kline, seconded by Nickson, that the appointment of Dr. Robert McLean as Health Officer for the City of Auburn be confirmed. MOTION CARRIED Mayor Gaines announced the appointment of Dr. Art Hoisington as Library Trustee to replace Ted Schutte who resigned when he was transferred. It was moved by Blakeney, seconded by Sonnemann, that the appointment of Dr. Art Hoising- ton as Library Trustee be oonfirmed. COUNCIL COW1ITTEE REPORTS FINANCE COMMITTEE - KLINE Councilman Kline, reporting for Finance Committee, stated the Finance Committee met in the office of the Mayor at 4:30 P.M. on July 7, 1969, at which time a proposal of Blythe & Co., relative to the issue of Water Sewer Revenue Bonds for a fee of $2.50 per thousand and guarantee a bid on the bonds, with the recommendation of the Finance Committee that the proposal be accepted. It was moved by Kline, seconded by Blakeney, that the proposal of Blythe & Co. relative to the issue of Water Sewer Revenue Bonds be accepted. MOTION CARRIED I Councilman Kline, reporting further for Finance Committee, reported the Finance Committee recommends to the City Council the construction of additional space at the dog kennels in the approximate sum of $1,700.00, and that appropriate budget action be taken at the end of the year to adjust the expenditure which was not budgeted. It was moved by Kline, seconded by Nickson, that the sum of $1,700.00 be authorized to be expended for the construction of additional space at the dog kennels. MOTION CARRIED AIRPORT COMMITTEE - KLINE Councilman Kline, reporting for the Airport Committee, reported the Committee had met July 2, 1969 and discussed the lease agreement to cover usage of the utility and the Committee is agreeable to the agreement as drafted by the attorney. STREET COMl1ITTEE - BLAKENEY Councilman Blakeney, reporting for Street Committee, stated it was the recommendation of the Committee that Ordinance No. 2291 be adopted and Ordinance No. 2359 was ready for adoption. Councilman Blakeney reported the Street Committee will meet at 7=30 P.M. on Wednesday, I July 9, 1969. CODE AND ORDINANCE COMMITTEE - NICKSON Councilman Nickson, reporting for Code and Ordinance Committee, reported the Committee has added and made modifications to Ordinance No. 2361 and recommend introduction only. Councilman Nickson stated the Committee will continue to review and study the animal control ordinance. DEPARTMENT HEAD REPORTS Mr. George Schuler, reported the official population figure for the City of Auburn is 21,300 as of April 1, 1969. I I I 96 AUBURN, WASHINGTON MONDAY JULY 7, 1969 George Schuler, Planning Director, announced a Community Service Panel will be held at 9:00 A. M., July 23, in the Auditorium of the School Administration Building, where the City of Auburn Workable Program will be reviewed and discussed by members and staff of the City of Auburn and representatives from the Seattle and San Francisco offices of the Department of Housing and Urban Development. The City will review goals outlined in the Workable Program that they desire to undertake during the next two years certification program and a question and answer series will follow where representatives of HUD will review with the City what funds are available and what assistance HUD will give to the City to carry out the aforesaid goals. Bridge) Phase I, to Dale M. Madden Construction Co. for $353,958.00 for the basic bid, subject to the approval of the State Highway Department and the Urban Arterial Board. It is recommended that the overlay of Howard Road contained in the alternate bid not be con- sidered as the addendum covering same was not sent to Madden Construction. It is requested that authorization be given at this time to advertise for bids for the overlay separately. It was moved by Kline, seconded by Sonnemann, that the bid for st. Imp. No. 104 (R Street Bridge) be awarded to Dale M. Madden for the sum of $353,958.00 for the basic bid subject to approval of the State Highway Department and the Urban Arterial Board. MOTION CARRIED Mr. John C. Hovver, of Short, Cressman & Cable, representing Excavators, Inc., from audience urged the Council to award the bid for st. Imp. No. 104 ( R Street Bridge) to Excavators, Inc., and stated it would be wrong to award the bid and advertise for bids for the overlay separately. Mr. Hoover suggested the bids all be rejected. It was moved by Nickson, seconded by Blakeney, that the City Engineer be authorized to advertise for bids for the overlay separately. It was moved by Fitzsimmons, seconded by Blakeney, that the recommendation of the City Eng- ineer be accepted and approved.
