WASHINGTON MONDAY AUGUST 18. 1969 The regular meeting of the City Council of the City of Auburn convened at 8:00 P.M. in the Council Chambers of the City Hal I. The meeting was cal led to order by Mayor Gaines. Councilmen present: Kline, Sonnemann, Bailey, Fitzsimmons, Blakeney, Darl ing and Nickson. APPROVAL OF MINUTES The following correction should be made in Council Minutes, August 4, 1969 Council Meeting, Page 7, under Finance Committee Reports, to cal I for bids to be opened 2:00 P.M., August 14, 1969, should read August 15, 1969. It was moved by Blakeney, seconded by Darl ing, that the Minutes of the Council Meeting of August 4, 1969 be approved as corrected and mailed. MOTl ON CARR I ED PUBLIC HEARINGS Mayor Gaines declared Publ ic Hearing open on request of Virgil H. and Clarence S. Swanson to rezone from R-2 to NS and R-4, approximately 20 acres of land lying East of "M" Street N.E. and South of 22nd Street N. E. The Planning Commission recommend to the City Council that this request be denied because it does not conform to the Comprehensive Land Use Plan of the City of Auburn. Mr. Archie Keever, Developer for petitioners, spoke in behalf of the rezone request and explained that al I requirements had been met. Dennis Andrews, from audience, spoke in opposition to this request, stating the rezoning of this land would not be in the best interest of the residents of this area. Mr. Sidney Hendrick, 2004 Pike Street N.E., from audience, presently developing the property immediately east of the property in question, spoke in opposition to the rezone request. City Clerk Wi I Iiams read petition from eleven residents of the area in question, stating they do not oppose the rezone request and asked the request be given favorable consider- ation. It was moved by Blakeney, seconded by Nickson, that the Public Hearing be closed. MOTl ON CARR I ED It was moved by Nickson, seconded by Blakeney, that the recommendations of the Planning Commission be concurred with and the request be denied. It was moved by KI ine, seconded by Fitzsimmons, that request of Virgil H. and Clarence S. Swanson be tabled for two weeks unti I 8:00 P.M., September 2, 1969. ROLL CALL VOTE: Councilman KI ine, Sonnemann, Fitzsimmons and Darling voting YES. Councilman Bailey, Blakeney and Nickson voting NO. MOTl ON CARR lED CORRESPONDENCE City Clerk Wil I iams read letter from Boundary Review Board of King County regarding City of Auburn proposed annexation (Green River) Boundary Review Board File #198. Mayor Gaines requested that Councilman Sonnemann make a report on proposed annexation and letter under Council Committee Reports. City Clerk Wil I iams read letter from Mrs. Joseph A. Stone regarding underground and overhead wiring. Mr. Jack Hawkins, attorney representing Mr. and Mrs. Stone, stated that the Stones were now applying for a delay in installation of underground wiring. It was moved by KI ine, seconded by Fitzsimmons, that the request of the petitioners be den i ed. ROLL CALL VOTE: Councilman Kline, Fitzsimmons and Nickson voting YES. Councilman Sonnemann, Bailey, Blakeney and Darl ing voting NO. MOTION FAILED 115 AUBURN, WASHINGTON NON DAY AUGUST 18. 1969 It was moved by Blakeney, seconded by Darling, the delay be granted the petitioners, provided the petitioners sign a covenant stating they wi II underground the existing two units at the time of construction of the next unit, and the City Attorney be instructed to prepare necessary covenant agreement and the signed covenant be returned at the time of the next Counci 1 Meeting, September 2, 1969. Counci Iman Kline and Sonnemann voting NO. MOT I ON CARR I ED City Clerk Wi Iliams read letter from Seattle Flight Service regarding facilities of Auburn Municipal Airport. I Mayor Gaines requested the letter be referred to the Airport Conmittee. City Clerk Wil Iiams read letter from Chateau Enterprises regarding food service operation at the Auburn Municipat Airport. Mayor Gaines requested the letter be referred to the Airport Conmittee. AUDIENCE PARTICIPATION Mr. Charles F. Hough gave report on Urban Transportation Committee and on House Bi I I 641. RECOHMENDATIONS PLANNING COHMISSION RECOMMENDATIONS The Planning Commission request Public Hearing be scheduled on the fol lowing requests: I. The request of Toshio Nishimura to rezone from R-2 to C-3 a parcel of land on the East side of Auburn Way North in the 3100 Block. CApplication No. 22-69) 2. The request of Douglas K. Feazel to rezone from R-2to M-I a parcel of land on Clay Street, 230 feet north of West Main Street. CApplication No. 23-69) 3. The request of Robert L. Warburton to rezone from M-2 to R-5 a parcel of land lying 234 feet west of "Mil Street S.E. in the 3100 block. CApplication No. 24-69) I It was moved by Blakeney, seconded by Sonnemann, that Public Hearing be held on items I, 2 and 3 above, at 8:00 P.M., September 2, 1969. MOTION CARRIED ENGINEERING RECOMMENDATIONS The following items were submitted by Fred W. Poe, Director of Public Works, for Council approval and cons~ration: I. Segregat ion of assesllments L.I .D. No. 201, Assessment No. I, tota I '2,365.80. It was moved by Nickson, seconded by Darling, that segregation of assessments L.I.D. No. 201, Assessment No. I, for the total sum of $2,365.80 be approved. MOTION CARRIED 2. Authorize Mayor and City Clerk to sign agreement with Lewis-Redford Engineers for engineering on 21st Street S.E. CU.A.B. Project No. 8-1105 (09). It was moved by Blakeney, seconded by;~ickson, that the Mayor and City Clerk I be authorized to sign agreement with Lewis-Redford Engineers for engineering on 21st Street S.E. CU.A.B. Project No. 8-1105 (09). MOTION CARR I ED 3. Authorize hiring R. P. McKiddy & Associates to do surveying for design of L. I .D. No. 236. It was moved by Kline, seconded by Blakeney, that R. P. McKiddy & Associates be hired to do surveying for ~esign for L.I.D. No. 236. MOTION CARRIED I I I 16 AUBURN. WASHINGTON MONDAY AUGUST 18. 1969 4. Progress Estimate No.3 (Final) to Signal Electric, Inc. for St. Imp. No. 100 (Signal at Peasley Canyon and West Val ley) for $4,536.00. It was moved by Blakeney, seconded by Kline, that Progress Estimate No.3 (Final) to Signal Electric, Inc. for St. Imp. No. 100 (Signal at Peasley Canyon and West Val ley) for $4,536.00 be paid, and the project be accepted by the City as completed and that the retained percentage amounting to $1,680.00, including sales tax, be paid in thirty days provided no liens or claims are fi led and clearance is secured from the State Tax Commission and the Department of Labor and Industries. It was moved by Kline, seconded by Blakeney, that Progress Estimate No.6 (Final) to Signal Electric, Inc. for St. Imp. It was moved by Kline, seconded by Sonnemann, that Public Hearings on final assessment rolls for L.I .D. 219 and L.I.D. 223 be held on September 15, 1969, at 8:00 P.M. MOTION CARRIED PROCLAMATIONS. APPOINTMENTS AND ANNOUNCEMENTS Mayor Gaines announced that the preliminary budget for t~e year 1970 is expected to be ready after the 1st of September. COUNCIL COMMITTEE REPORTS AIRPORT COMMITTEE - Kline Councilman Kline reporting for Airport Committee stated it was the recommendation of the Committee that Standard Oi I Company be awarded the bid for providing aviation petroleum products to the Municipal Airport per bid proposal submitted. It was moved by Kline, seconded by Sonnemann, that the City Attorney be instructed to prepare necessary contract for providing fuel to the Municipal Airport per bid pro- posal submitted by Standard Oi I Company. and the Mayor and City Clerk be authorized to sign the contract. MOTION CARRIED The Airport Committee has considered and discussed the proposal presented by Frye and Merriman, Architects, for hangar design and supervision of construction for a fee of $3,300.00 for the first hangar and $1,100.00 for subsequent hangars, and development of an airport site plan for a fee of $1,500.00 or $15.00 per hour, whichever is the lesser figure. It was moved by Kline, seconded by Bailey, that the City Attorney be instructed to draw up necessary contract to retain the firm of Frye and Merriman, Architects, for Municipal Airport Design for hangar and supervision of construction per agreement, and the Mayor and City Clerk be authorized to sign the contract. MOTION CARRIED It was moved by KI ine, seconded by Blakeney, that the City Attorney be instructed to draw up necessary contract with Frye and Merriman, Architects, to develop an Airport Site Plan for a fee of $1500.00 maximum or $15.00 per hour, whichever is the lesser, and the Mayor and City Clerk be authorized to sign the contract. MOT ION CARR I ED 117 AUBURN, WASHINGTON MONDAY AUGUST 18. 1969 FINANCE COMMITTEE - KI ine Counci Iman Kline, reporting for Finance Committee, stated the committee had discussed the request for a new animal facil ity to be constructed at a cost of approximately $4,200.00 and the plans and proposals-have been referred to the~ Pol ice Committee for review and recommendation. Councilman KI ine reported that on cal I for bids for sale of Water-Sewer Construction Finance Warrants on August 15, 1969, there were no bids received. It was moved by Kline, seconded by Sonnemann, that the Finance Director be authorized to obtain a figure for the sale of the finance warrants and bring back to the Council the best figure for consideration by the Council. MOTION CARRIED I ANNEXATION COMMITTEE - Sonnemann Councilman Sonnemann explained the action on the proposed annexation (Green River) with regard to letter received from King County Review Board. It was moved by Sonnemann, seconded by Blakeney, that the City Attorney be directed to draw up the necessary ordinance to final ize the annexation of the John Reddington Road property. MOTION CARRIED UTILITIES COMMITTEE - Fitzsimmons It was moved by Fitzsimmons, seconded by Blakeney, that the bid for surface aerators for existing oxidation pond be awarded to Ashbrook Corporation for the sum of $21,850.00. MOTION CARRIED STREET, ENGINEERING AND PLANNING COMMITTEE - Blakeney Councilman Blakeney read letter from Fred W. Poe, advising of resignation from employment with the City of Auburn. Mr. Blakeney expressed his regrets and also "Thanks, Fred, it has indeed been a great pleasure to work with you and you shall be missed". I Mayor Gaines expressed his pleasure to have been associated with Mr. Poe and that he wi I I be missed. CODE AND ORDINANCE COMMITTEE.- Nickson Counci Iman Nickson reporting for Code and Ordinance Committee stated the Committee recommends adoption of Ordinances No. 2380 and 2381 which were introduced at the Council Meeting held August 4, 1969. DEPARTMENT HEAD REPORTS Mr. John Kelly, Finance Director, reported on the congressional tax reform package with respect to the threatened removal of the tax exemption feature from muniCipal securities and urged the Council to go on record in opposition to this proposal. It was moved by Kline, seconded by Blakeney, that the City Attorney be instructed to prepare necessary resolution tn opposition to the removal of the tax exemption from municipal obligations and the City Clerk be directed to send copies of the resolution to Senators and Representatives. MOTl ON CARR lED Mr. Poe reporting on detour and preparations being made for commencement of work on R Street bridge. Mr. Poe stated that Mr. Segale wil I pave a road to his pròperty for access and wil I not be using the route now used. I Jerry Keesee reported he had attended a Civil Defense School at Battlecreek, Michigan, and the knowledge would be useful in our local Civil Defense program. Mr. Ken Calkins, Fire Chief, reported that everything was working out wel I for cooking the salmon for the Cynthia McCoy Salmon Bake and the Kent Fire Department would be assisting in the preparation of the dinner. It was moved by Bai ley, seconded by Blakeney, thet the bid be awarded to Holt Const. Co., dba King Const. Co., for the total bid submitted of $19,907.60. MOTION CARRIED Bids were opened at 11:00 A.M. on Cal I for Bids on Street Improvement No. 106, Phase I I, with submitted bids as fol lows: BIDDER CASCADE ASPHALT PAVING LLOYDS OF WASHINGTON FRED HINTZ CONST. CO. LDL LAND DEVELOP. CO., INC. It is the recommendation of Fred W. Poe, City E~gineer, that the contract be awarded to Cascade Asphalt Paving, and the City have the option to exercise the alternate which is the difference between class of gravel used. It was moved by Blakeney, seconded by Nickson, that recommendation of! the City Engineer be accepted and the bid awarded to Cascade Asphalt Paving for $114,530.25 or alternate bid of SI18,850.25. MOTION CARRIED MISCELLANEOUS BUSINESS It was moved by Kline, seconded by Darling, that the Council Meeting be continued until 8:00 P.M. the 25th day of August, 1969. MOTION CARRI ED August 25, 1969, 8:00 P.M., the continued regular meeting of the City Council of Auburn convened in the Council, Chambers of the City Hall. Mayor Gaines called the meeting to order at 8:00 P.M. Councilmen present: Kline, Sonnemann, Bailey, Fitzsimmons, Blakeney and Nickson. City Clerk Williams, City Attorney and City Engineer were also present. Fred Þoe, City Engineer, presented the following information on bid opening on Call for Bids for storm sewers, gravel base, crushed rock and paving for hangar area at Auburn Municipal Airport, which bids submitted as follows on August 22, 1969 at 11:00 A.M. The City Engineer recommends the bid be awarded to Fred Hintz Construction for the basic bid of $78,502.60, not including sales tax. MOTION CARRIED It was moved by Kline, seconded by Blakeney, that the City Attorney prepare necessary contract with Fred Hintz Construction for storm sewers, gravel base, crushed rock and paving for hanger area at Auburn Municipal Airport, and the Mayor and City Clerk be authorized to sign contract with Fred Hintz Construction. MOTION CARRIED There being no further business, it was moved by Blakeney, seconded by Fitzsmmmons that the meeting be adjourned.
