Councilmen present: Kline, Sonnemann, Bailey, Fitzsimmons, Blakeney, Darling and Nickson. APPROVAL OF MINUTES The following correction should be made on Page 10, Sept. 15, 1969 Council Minutes, second paragraph from bottom of page shoul d be removed and corrected as fo 11 ows: lilt was moved by Bailey, seconded by Fitzsimmons, the contract for four hanger buil dings be awarded to General Builders, Inc., Tacoma, Washington. MOTION CARRI ED It was moved by Kline, seconded by Bailey, the Mayor and City Clerk be authorized to sign contract with General Builders, Inc., Tacoma, Washington, subject to approval of the Ci ty Attorney. II MOTION CARRIED It was moved by Balkeney, seconded by Bailey, the Minutes of Sept. 15, 1969 Council Meeting be approved as corredted and mailed. MOTION CARRI ED PUBLIC HEARINGS Mayor Gaines declared Public Hearing open on Final Assessment Roll for L.I.D. No. 423 (water mains, 37th St. S.E., 41st St. S.E. and 0 St. S.E.) Continued from September 15, 1969 Council Meeting. Warren Gray, Assistant City Engineer, explained the change in the assessment roll for L.I.D. No. 223 and the property owners would now be charged for water main on one side and charge in lieu of assessment on the other side, and the assessment roll has been changed accordingly. Mr. George Muttart, from audience, stated he was opposed to the L.I.D. for the reason the City did not provide him with a connection on the water line. Mr. Muttart resides at 406 37th St. S.E. Mrs. Lester Olsen, 204 37th St. S.E., from audience, asked about her assessment and advised she had not received a notice of the amended assessment. Discussion followed with regard to hook-up water mains, water meters, and charges. It was moved by Kline, seconded by Blakeney, that the Public Hearing be closed. MOTION CARRI ED It was moved by Blakeney, seconded by Kline, that Public Hearing on Final Assessment Roll for L.I.D. No. 223 be tabled for two weeks. MOTI ON CARR I ED It was moved by Bailey, seconded by Darling, that Final Assessment Roll Public Hearing on L.I.D. No. 223 be brought from the table. MOTION CARRIED It was moved by Kline, seconded by Blakeney, that new Public Hearing be held on November 3, 1969 at 8:00 P.M., on amended Final Assessment Roll for L.I.D. No. 223. MOTIONCARRI ED Mayor Gaines declared Public Hearing open on request of Wells B. McCurdy to rezone from A-l;to M-l, a parcel of land lying East of the West Valley Highway and North of Boyd Road (17th St. S.W.). The Planning Commission recommend to the City Council that the request of Wells B. McCurdy be granted as outlined in the sketch furnished by the State Highway Commission with the following provision: 1. That the Southerly 30 feet of this property be dedicated to the City of Auburn for right-of-way purposes enabling Boyd Road (17th St. S.W.) to have a 60 feat right-of-way. 139 AUBURN, WASHINGTON MONDAY OCTOBER 6, 1969 The Planning Director recommends concurring with the Planning Commission recommendations on the request of Wells B. McCurdy because it conforms to the Comprehensive Land Use Plan and is a portion of the planned industrial park proposed by the Auburn 400 Group. The State Highway Department indicate this zoning would have no effect on their negotia- tions of the right-of~way for the Valley Freeway. Consideration should be given to the dedication of the South 30 feet of the property requesting rezoning to provide for a 60 foot right-of-way for Boyd Road (17th St. S.W.). Mr. Paul Iverson, representing Wells ~1cCurdy, from audience, stated that he was present in the event there was any questions regarding the rezone request. It was moved by Kline, seconded by Nickson, that the Public Hearing be closed. MOTION CARRIED It was moved by Kline, seconded by Blakeney, that the request of Wells B. McCurdy to rezone from A-l to M-l, a parcel of land lying East of the West Valley Highway and North of Boyd Road (17th St. S.W.), be approved by the City Council, subject to the dedication of the Southerly 30 feet fOÐ right-of-way purposes, and the City Attorney be instructed to prepare necessary ordinance granting rezone. MOTION CARRIED CORRESPONDENCE City Clerk Williams read request from Dean M. Rockey, M.D., requesting Special Use Permit for property located at 1115 Harvey Road for professional use. It was moved by Blakeney, seconded by Sonnemann, that request of Dean M. Rockey, M.D. for Special Use Permit be referred to the Planning Commission. MOTION CARRIED City Clerk Williams read application for Pool Hall License from Joseph L. Maiuri, Route 1, Box 93, Sumner, Washington. Mayor Gaines requested the appliaation be referred to the License Committee. City Clerk Williams read letter from Mrs. Joyce Henning, Secreiary, Parent-Teachers Association, Washington Elementary School, regarding patrolman at the intersection of East Main Street and M Street during the hours of school cros$ing. Mayor Gaines requested the letter be referred to the Street Committee with the Chairman of the Police Committee sitting in on the meeting regarding this request. City Clerk Williams read letter from Joe Koch, Parade Chairman, requesting permission for parade for Veterans Day to be held on November 8, 1969, Saturday. Mayor Gaines requested the letter be referred to the Police Department. City Clerk Williams read letters from Water Pollution Control Commission and State Department of Health, regarding approval of project plans and specifications for L.I.D. No. 235, 15th St. S.E. between "A" and "B" Streets, Sanitary sewers. Mayor Gaines requested the letters be filed with copies to the Engineering Department. City Clerk Williams read letter from Warren G. Magnuson, U.S.S., Washington, D.C., regarding tax-exempt status of state and municipal bonds. Mayor Gaines requested the letter be filed. City Clerk Williams read letter from Mr. and Mrs. Robert E. Eastling, 203 M St. S.E., Auburn, Washington, regarding truck traffic due to gravel removal. Mayor Gaines requested the letter be referred to the City Attorney to be included with the gravel removal issue, presently being processed by the Legal Department. City Clerk Williams read letter petition signed by 21 persons r~garding removal of gravel from Old Auburn Airport, being residents of Wayland Arms Apartments. Coûmcilman Kline commented that when Wayland Arms was in the process of planning the people wanted to be in a busy place and the Council wanted to put them in a quiet area. Mayor Gaines requested the letter be referred to the City Attorney to be included with gravel removal issue presently being processed by the Legal Department. I I I I I I 140 AUBURN, WASHINGTON MONDAY OCTOBER 6, 1969 City Clerk Williams read letter request from Fred M. Schuerman, United Homes Corp. requesting approval of preliminary plat of Forest Knoll. It was moved by Blakeney, seconded by Kline, that the preliminary plat of Forest Knoll be referred to the Planning Commission, Utility Committee, Street Committee, Fire Committee and Police Committee for recommendation. MOTION CARRIED AUDIENCE PARTICIPATION Mayor Gaines introduced the new Public Works Director, Keith Patrick Nevins, and welcomed him to the City of Auburn. Mr. Chas. Hough, Urban Transportation Committee, reported on meeting he had attended on Highways and transportation systems and hoped to have a further report on a feasible plan on an over-all transportation system. RECOMMENDATIONS The following items were submitted by Warren H. Gray, Assistant City Engineer, for Council approval: Pay Estimate No.1 to Fred Hintz Const. Co. for $40,642.35 for hanger area construction at Auburn Municipal Airport. It was moved by Kline, seconded by Bailey, that Pay Estimite No.1 to Fred Hintz Const. Co. for $40,642.35 for hanger area construction at Auburn Municipal Airport be paid. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Pay Estimate No.2 to Frank Coluccio Const. Co. for $18,219.56 for water Imp. No. 70 PH II, Sch I, Water line K St. N.E. to 14th St. N.E. It was moved by Sonnemann, seconded by Blakeney, that Pay Estimate No.2 to Frank Coluccio Const. for $18,219.56 be paid. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Pay Estimate No.3 to Slead-Tbnnesen Const. Co. for $16,590.98 for L.I.D. 227, water mains Academy Area. It was moved by Blakeney, seconded by Nickson, that Pay Estimate No.3 to Slead- Tonnesen Const. Co. for $16,590.98 be paid. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Pay Estimate No.1 to Cascade Asphalt Paving Co. for $50,704.42 for St. Imp. 106, PH II, 37th St. N.E. and N.W. MOTION CARRIED Pay Estimate No.3 to Valley Cement Const. Co., Inc., for $19,298.61 for L.I.D. 224, street construction 9th and lOth N.E. and I St. N.E. It was moved by Sonnemann, seconded by Nickson, that Pay Estimate No.3 to Valley Cement Const. Co., Inc., for $19,298.61 for L.I.D. 224 be paid. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Pay Estimate No.2, (final) to L.D.L. Land Development Co. for $7,643.01 for L.I.D. 232, 28th St. N.E., East of I St. It was moved by Kline, seconded by Sonnemann, that Pay Estimate No.2 (final) to L.D.L. Land Development Co., for $7,643.01 and the City accept the project as completed and that the retained percentage amounting to $2,367.86, including sales tax, be paid in thirty days provided no liens or claims are filed and clearance is secured from the State Tax Commission and the Department of Labor and Industries. Auburn Way So. to M St. S.E. I It was moved by Sonnemann, seconded by Blakeney, that Change Order No.1 to Morris Construction Co. for St. Imp. 113 for increase of $2,007.25 be approved. MOTION CARRIED Change Order No.1 to Dale M. Madden Const. Inc. for St. Imp. 104 PH I, R St. Bridge, increase of $436.10 adding Pozzolith to concrete mix for rear web walls. It was moved by Nickson, seconded by Blakeney, that Change Order No.1 to Dale M. Madden Const. Inc. for St. Imp. 104 PH I, R St. Bridge be approved. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Authorization for Pat Nevins, Warren Gray and Jack Lange to attend American Public Works fall meeting in Spokane on October 15, 16 and 17, 1969. I It was moved by Sonnemann, seconded by Blakeney that two of the three men be authorized to attend American Public Works fall meeting in Spokane on October 15, 16 and 17, 1969. It was moved by Sonnemann, seconded by Blakeney, that the motion be amended that the three men be authorized to attend American Public Works fall meeting in Spokane on October 15, 16 and 17, 1969, but worked out between them that only one or two are gomeg and not all three. MOTION CARRIED Authorization for Mayor and City Clerk to sign agreement with Northern Pacific Railroad Company for easement and maintenance of easement for railroad crossing 37th St. N. W. It was moved by Sonnemann, seconded by Blakeney, that the Mayor and City Clerk be authorized to sign agreement with Northern Pacific Råilroad Company for easement and maintenance of easement for railroad crossing 37th St. N.i. MOTION CARRIED COUNCIL COMMITTEE REPORTS FINANCE COMMITTEE - KLINE Finance Committee Chairman and Committee held a meeting of the Finance Committee on October I 2, 1969 at which time the budget was discussed. LICENSE COMMITTEE - SONNEMANN The License Committee met last week, however, we do not have any recommendations at this time. UTILITY COMMITTEE - FITZSIMMONS Councilman Fitzsimmons reported that work is being done in preparation of the aerators. STREET, ENGINEERING, PLANNING & EQUIPMENT RENTAL COMMITTEE - BLAKENEY The Committee will meet on Wednesday evening, 7:30 P.M., October 7, 1969. I I I 142 AUBURN, WASHINGTON MONDAY OCTOBER 6, 1969 MUNICIPAL BUILDING COMMITTEE - DARLING Councilman Darling reported the Municipal Building Committee met on Sept. 30, 1969 and that on October 28, there will be a meeting for the candidates in the coming election and at that time a brief presentation concerning the Municipal Building will be presented on the agenda. Mr. Darling presented an invoice for payment from Shorett, Heidemann, Lecair, Architects for the sum of $1,058.75, for professional services pursuant to new civic center, including site study and cost estimate, from Sept. 1968 through July 31, 1969, and recommended approval for payment. CODE AND ORDINANCE COMMITTEE - NICKSON Councilman Nickson, reporting for Code and Ordinance Committee, stated the Committee will have a report on the Council Rules of Order. OLD BUSINESS Councilman Blakeney brought up the matter of the adjustment pay for the Firemen and it was moved by Blakeney, seconded by Kline, that the City Attorney be directed to prepare necesary resolution to pay the firemen the adjustment pay from January 1 to February 5, 1969. MOTION CARRIED NEW BUSINESS It was moved by Kline, seconded by Nickson, that the aty Engineer be authorized to call for bids for surface roads for approach at the Municipal Airport. MOTION CARRIED It was moved by Kline, seconded by Blakeney, that the City Engineer, in conjunction with Gordon Crosse to call for bids for materials only for runway lights. MOTION CARRIED It was moved by Blakeney, seconded by Sonnemann, that the Utility Committee and Code and Ordinance Committee review the copies of affidavit and ordinances from the City of Renton for special rates for water, sewer and garbage for the benefit of those in fixed income bracket and return to the ~uncil Meeting November 3, 1969 with a document for introduction and adoptœon. MOTION CARRIED RESOLUTION NO. 384 It was moved by Nickson, seconded by Sonnemann, that Resolution No. 384 entitled II RESOLUTION OF THE CITY OF AUBURN, WASHINGTON, DECLARING THE ~TENT AND INTEREST OF THE CITY OF AUBURN IN THE SOLUTION OF URBAN TRANSPORTATION PROBLEMS IN THE PUGET SOUND AREA. MOTION CARRIED RESOLUTION NO. 385 I It was moved by Blakeney, seconded by Kline, that Resolution No. 385 entitled "A RESOLUTION OF THE CITY OF AUBURN, WASHINGTON, APPROVING A RETROACTIVE WAGE ADJUSTMENT FOR MUNICIPAL FIREMEN AGe THE PERIOD FROM JANUARY 1, 1969 TO FEBRUARY 5, 1969, AND AUTHORIZING AND DIRECTING THE FINANCE DEPARTMENT TO IMPLEMENT SAID ADJUSTMENT.~ be introduced and adopted. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED APPROVAL OF VOUCHERS AND TRANSFERS It was moved by Darling, seconded by Sonnemann, that transfers and vouchers as listed in the sum of $427,110.09 be approved for payment. (Warrants Nos. 1558 through 1839) and Payroll Warrants in the amount of $128,269.09 (Warrant Nos. 2420 through 2830). It was moved by Bâtling, seconded by Sonnemann, that Purchase Order 1184 to Shorett- Heideman LeCair, Architects-Engineers, in the sum of $1,058.75 for professional services rendered pursuant to new Civic Center, be added to the voucher approval list for approval and payment. Councilman Kline and Blakeney vot NO. MOTION CARRIED It was moved by Fitzsimmons, seconded by Kline, that Purchase Order 556 to Spragues for I '12,246.34 be stricken from the voucher approval list as this was not submitted on date for payment to be made. ROLL CALL VOTE: All Councilmen voting YES for approval of transfers and vouchers as listed and amended. MOTION CARRIED MISCELLANEOUS BUSINESS City Clerk Williams read application for cabnret license from Willis J. Quinlivan and Shirley Ann Quinlivan, Renton, Washington. Mayor Gaines requested the request be referred to the License Committee. Councilman Kline moved that the interest rate on petition type L.I.D.~s should be increased to 8% interest for an interim measure. Seconded by Sonnemann.
