HomeMy WebLinkAbout02-16-1970 22 AUBURN, WASH I NGTON MONDAY FEBRUARY 16, 1970 The regular meeting of the City Council of the City of Auburn, convened at 8:00 P.M. in the Council Chambers of the City Hall. The meeting was called to order by Mayor Kersey. Councilmen present: Kline, Sonnemann, Fitzsimmons, Holman, Fiedler and Nickson. APPROVAL OF MINUTES It was moved by Kline, seconded by Sonnemann, that the Council Minutes of February 2, 1970 be approved as mailed. MOTION CARRIED CORRESPONDENCE I a. Letter from State Department of Health, regarding Sanitary Sewer Improvement No. 10, Sewer Lagoon Surface Aerators. b. Letter from Water Pollution Control Commission, regarding Sanitary Sewer Improvement No. 10, Sewer Lagoon Surface Aerators. M~yor Kersey requested the letters listed above, items a. and b., be filed with copy to Engineering Department. c. Zoning Change Application of Corporation of the Catholic Archbishop of Seattle, from R-2 Residential to C-l Light Commercial, property located at Auburn Way North and 12th. It was moved by Sonnemann, seconded by Kline, that Zoning Change Application of Corpora- tion of Catholic Archbishop of Seattle, be referred to the Planning Commission. MOTION CARRI ED d. Blackney, 23829 39th So., Kent I Mayor Kersey requested the application for For-Hire Driver's License listed above be referred to the License Committee. City Clerk Williams read letter from Al Rossi. It was moved by Fiedler, seconded by Fitzsimmons, that the Mayor write a letter of appreciation to Al Rossi for the work on the Park Board. MOTION CARRIED It was moved by Kline, seconded by Fitzsimmons, that the letter of resignation of Al Rossi be accepted. MOTION CARRIED AUDIENCE PARTICIPATION Mayor Kersey at this time introduced Representative A. H. Bud Shinpoch to the Council and audience, and thanked him for attending our Council Meeting. BID OPENING Bids were opened at 11:00 A.M. February 6, 1970 on Call for Bids for LID 237, Water Main B Street S.E., between 29th and 31st Streets S.E., between 29th and 31st Streets, Bids submitted as follows: BIDDER Bigstone Corporation Bert Robison Construction C. J. Rockey, Inc. B & G Septic Tank Service McDonough Construction Company S & S Construction Co. BASIC BID $3,466.65 3,876.00 4,427.60 4,512.63 4,616.00 4,999.20 I The above bids were accompanied by Bid Bonds, the bids did not include sales tax. It was moved by Fitzsimmons, seconded by Nickson, that the contract be awarded to Bigstone Corporation for LID 237, on their low bid of $3,466.65 plus sales tax. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED RECOMMENDATIONS The following items were submitted for approval by Pat Nevins, Director of Public Works: Pay Estimate No.6 to Dale Madden Construction Company for Street Improvement 104 (R Street Bridge) for $83,096.10. It was moved by Sonnemann, seconded by Nickson, that Pay Estimate No.6 to Dale Madden Construction Company for $83,096.10 be paid. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Pay Estimate No.1 to DiOrio Construction Company for LID 233 (Water Mains on Knickerbocker & Hi Crest Drives) for $8,352.38. It was moved by Fitzsimmons, seconded by Sonnemann, that Pay Estimate No.1 to DiOrio Construction Company for $8,352.38 be paid. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Pay Estimate No.1 to AllisóD, Inc., for LID 239 (Sanitary Sewers on Scenic Drive) for $2,486.84. It was moved by Nickson, seconded by Holman, that Pay Estimate No.1 to AllisóD, Inc. for $2,486.84 be paid. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Pay Estimate No.5 to Venture Construction Company (Well No.2 Pumphouse Construction~ Water Improvement 70 for $7,632.15. It was moved by Fitzsimmons, seconded by Sonnemann, that Pay Estimate No.5 to Venture Construction Company for $7,632.15 be paid. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Pay Estimate No.1 (final) to Ashbrook Corporation, C/O The Instrument Laboratory, for Sanitary Sewer Improvement #10 (Aerators for sewage treatment Lagoon) for $20,648.25. It was moved by Fitzsimmons, seconded by Nickson, that Pay Estimate No.1 (final) to Ashbrook Corporation for $20,648.25 be paid, and the project be accepted by the City as completed and that the retained percentage amounting to $2,185.00 including sales tax, be paid in thirty days provided no liens or claims are filed and clearance is secured from the State Tax Commission and the Department of Labor and Industries. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Pay Estimate No.4 to General Builders, for Auburn Municipal Airport Hangar Buildings (final estimate) for $16,547.90. It was moved by Kline, seconded by Nickson, that the City accept the Airport Hangar Construction and that General Builders be paid Pay Estimate No.4 in sum of $16,547.90, and that upon the expiration of thirty days this matter be brought back to the Council for release of the retainer. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Acceptance of construction of Airport Hangar Area by Fred Hintz Construction Company. It was moved by Kline, seconded by Nickson, that the City accept the Airport Hangar Area contract as complete and upon the expiration of thirty days if no liens or claims are filed and clearance is secured from the State Tax Commission and the Department of Labor and Industries the retained percentage of $9,341.32 be paid, to Fred Hintz Construction Company. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED ~~ AUBURN, WASHINGTON MONDAY FEBRUARY 16, 1970 Authorization for City Attorney to draw up resolution that it is planned to utilize two sanitary sewer crossings of SR 167 and one of SR 18 from 15th St. S.W. to West Main Street being installed in conjunction with the construction of the Valley Freeway (SR 167) as part of the City of Auburn's Sanitary Sewer System not later than 1976. It was moved by Nickson, seconded by Holman, that the City Attorney be authorized to draw up resolution. MOTION CARRIED Authorization to call for Public Hearing on assessment roll for LID 230 (Sanitary Sewer construction in Lea Hill area), public hearing to be held April 6, 1970. It was moved by Holman, seconded by Fitzsimmons, that the Public Works Director be I authorized to call for public hearing on assessment roll for LID 230 for April 6, 1970 at 8:00 P.M. MOTION CARRI ED The following items were submitted to Call for Public Hearing by the Planning Commission: The request of Walter Schlumpf to rezone from A-l to M-l, a parcel of land lying at the Northwest corner of the intersection of 30th Street N.E. and Auburn Way North. (Application No. 2-70) The request of Henry Dubigh to rezone from R-3 to M-l, a parcel of land located between 16th Street S.E. and 17th Street S.E. on the east side of A Street S.E. (Application No. 3-70) It was moved ~y Kline, seconded by Fiedler, that Public Hearing be held on the request of Walter Schlumpf, application No. 2-70 and request of Henry Oubigh, application No. 3-70, at 8:00 P.M., March 2, 1970. MOTION CARRIED COUNCIL COMMITTEE REPORTS AIRPORT COMMITTEE - KLINE Councilman Kline, reporting for the Airport Committee, stated the committee had I discussed installation of underground service to replace temporary electrical service to be done by Auburn Electrical at an approximate cost of $100.00 and the committee directed this work be done. The Committee is conducting a thorough investigation of applicants to establish a maintenance and service facility at the airport and no selection or determination will be made until completion of the investigation. The Committee discussed the problems and possible problems due to lack of security fencing and it was the recommendation the security fencing should be installed. The next meeting of the Airport Committee will be held at 7:30 P.M., February 19,1970. FINANCE COMMITTEE - KLINE Councilman Kline reporting for the Finance Committee, stated the Finance Director had requested approval to purchase the following L.I.D. finance Warrants: L. I. D. # 229 L. I. D. # 231 L.I.D. # 235 L.I.D. #239 L.I.D. # 230 $11,518.28 Fire Relief & Pension Fund 1,857.80 Fire Relief & Pension Fund 286.92 Sewer Cu. Reserve Fund 26.40 Fire Relief & Pension Fund 112.00 Arterial Street Fund $13,801.40 I It was moved by Kline, seconded by Holman, that the Finance Director be authorized to purchase L.I.D. Finance Warrants as listed in the total sum of $13,801.40. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED The Committee discussed the request of the Street Department to purchase a concrete saw and diamond tipped blade for use by that department, to be purchased from funds budgeted under capital outlay in the approximate sum of $2,500.00. .It was moved by Kline, seconded by Sonnemann, that the Street Department be authorized to purchase a concrete saw and diamond tipped blade for approximately not to exceed $2,500.00. ROLL CALL VOTE:: All Councilmen voting YES. MOTION CARRIED AUBURN, WASHINGTON FIRE COMMITTEE - SONNEMANN MONDAY FEBRUARY 16, 1970 25 Councilman Sonnemann, reporting for Chairman Shaughnessy, stated the Fire Committee would not meet on Feb. 17, 1970. Councilman Sonnemann, stated the Washington surveying Bureau is gathering information for a new revised rating for the City of Auburn and it is expected a detailed report will be forthcoming in the near future. STREET, ENGINEERING, PLANNING & EQUIPMENT RENTAL COMMITTEE - SONNEMANN I Councilman Sonnemann, reporting for the Street, Engineering, P~anning and Equipment Rental Committee stated the purchase of a concrete saw and diamond tipped blade was in lieu of sign truck which was budgeted and these funds will be utilized for the purchase. The Committee had reviewed revisions of parking restrictions on 1st Street N.E. from Auburn Way North to E Street N.E., and the Committee recommended approval of the ordinance on parking restrictions. The Committee will meet Feb. 18, 1970 at 7:30 P.M. UTILITY COMMITTEE - FITZSIMMONS It was moved by Fitzsimmons, seconded by Holman, that the Mayor and City Clerk be authorized to sign Chlorinator Maintenance Agreement subject to approval of the City Attorney. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED The meeting with Metro is scheduled for March 4, 1970 at 7:30 P.M. GOLF COURSE COMMITTEE - FITZSIMMONS Councilman Fitzsimmons reported the golf course is progressing on schedule and 9 hole will be in operation the 1st of April and 18 hole about the 1st of Mayor June. I POLICE AND LICENSE COMMITTEE - FIEDLER Councilman Fiedler stated the Committee will meet Feb. 19, 1970 at 7:30 P.M. for the express purpose of reviewing licenses that have been issued. ORDINANCES AND RESOLUTIONS ORDINANCE NO. 2436 ORDINANCE NO. 2436 entitled "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR THE REZONING OF CERTAIN PROPERTY IN THE CITY OF AUBURN, CHANGING THE ZONING CLASSIFICATION THEREOF FROM R-5 TO M-2." (John D. Wadkins) It was moved by Kline, seconded by Nickson, that Ordinance No. 2436 be introduced and adopted. ROLL CALL VOTE: All Councilmen voting yes. MOTION CARRIED ORDINANCE NO. 2437 Ordinance No. 2437 entitled "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR THE REZONING OF CERTAIN PROPERTY IN THE CITY OF AUBURN, CHANGING THE ZONING CLASSIFICATION THEREOF FROM A-l TO M-l" (S.M. & George Murakami) I It was moved by Fiedler, seconded by Sonnemann, that Ordinance No. 2437 be introduced and adopted. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED ORDINANCE NO. 2438 Ordinance No. 2438 entitled "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, GRANTING A SPECIAL PERMIT FOR THE USE OF CERTAIN PROPERTY SITUATE WITHIN THE CORPORATE LIMITS OF THE CITY OF AUBURN, FOR PROFESSIONAL OFFICES. MOTION CARRIED 26 AUBURN, WASHINGTON MONDAY ORDINANCE NO. 2439 FEBRUARY 16, 1970 Ordinance No. 2439 entitled "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR THE CONSTRUCTION AND INSTALLATION OF SANITARY SEWERS AND MANHOLES, ALONG R STREET S.E. BETWEEN 17TH AND 21ST STREETS S.E. AND ON 17TH STREET S.E. BETWEEN AUBURN WAY SOUTH AND R STREET S.E. INSIDE THE CORPORATE LIMITS OF THE CITY; CREATING AND ESTABLISH- ING LOCAL IMPROVEMENT DISTRICT NO. 241; PROVIDING THE METHOD OF ASSESSMENT IN SAID DISTRICT AND THE MODE OF PAYMENT THEREOF, AND CREATING A LOCAL IMPROVEMENT FUND THEREFOR. MOTION CARRIED Q~DINANCE NO. 2440 Ordinance No. 2440 entitled "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, AMENDING CERTAIN SECTIONS OF AUBURN CODIFIED CITY ORDINANCE CHAPTER 9.22 REVISING PARKING RESTRICTIONS, PASSENGER LOADING ZONES, AND TWO HOUR NON-METERED PARKING ZONES AS MORE SPECIFICALLY SET FORTH HEREIN. II It was moved by Sonnemann, seconded by Fiedler, that Ordinance No. 2440 be introduced and adopted. ROLL CALL VOTE: All Councilmen voting UYES. MOTION CARRIED RESOLUTION NO. 394 It was moved by Fitzsimmons, seconded by Kline, that Resolution No. 394 entitled "A RESOLUTION OF THE CITY OF AUBURN, WASHINGTON, AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE, ON BEHALF OF THE CITY, AN AGREEMENT BETWEEN THE CITY AND MANSON IS REXALL DRUG STORE !DR THE COLLECTION OF MUNICIPAL UTI LITY BILLS. II be introduced and adopted. MOTION CARRIED MISCELLANEOUS BUSINESS City Clerk Williams read letter from the City of Issaquah with regard to the proposed freeway east of Lake Sammanish. Mayor Kersey requested theletter be referred to the Public Workss and Street Department. City Clerk Williams read Zone Change Application from James W. Warren to rezone from A-l to M-l, property located at 3400 Auburn Way North. It was moved by Sonnemann, seconded by Kline, that Zone Change Application from James W. Warren be referred to the Planning Commission. MOTION CARRIED City Clerk Williams read Zone Change Application from Dr. John B. Carpenter for addition to existing dental clinic. It was moved by Kline, seconded by Nickson, that the request of John B. Carpenter be referred to the Planning Commiss~on. MOTION CARRIED City Clerk Williams read letter from White River Valley Historical Society, Inc., requesting funds for the society. Mayor Kersey requested the letter be referred to the Finance Committee. City Clerk Williams read letter from Washington Wing, Civil Air Patrol, requesting authorization to conduct Effectiveness Test for the Washington Wing CAP at the Auburn Municipal Airport. Mayor Kersey requested the letter be referred to the Airport Committee. G~ty-Gte~ Councilman Kline, Chairman of the Airport Committee, requested that Lt. Col. Keesee be present at the Airport Committee Meeting on February 19, at 7:30 P.M., if at all possible, with regard to this request. It was moved by Nickson, seconded by Fitzsimmons, that there being no further business to come before theCouncil, the meeting be adjourned at 8:42 P1M.
