The regular meeting of the City Council of the City of Auburn convened at 8:00 P.M. in the
Council Chambers of the City Hall.
The meeting was called to order by Mayor Kersey.
Councilmen present: Kline, Sonnemann, Shaughnessy, Fitzsimmons, Holman, Fiedler, and
Nickson.
APPROVAL OF M:lliUTES
It was moved by Kline, seconded by Nickson, that Page 5, paragraph 3, Council Minutes
of March 2, 1970 be corrected that the motion read as follows after the word "and" that
concurrently the City Council repeal the B & 0 Tax on electrical, natural gas and
telephone services, said repeal to become effective July 1, 1970.

Councilman Fiedler opposed the motion.

Mayor Kersey declared Public Hearing open on final assessment roll for L.I.D. 231
(sanitary sewer installation on 3rd Street S.E. from M Street S.E. to R Street S.E. and
on N Street S.E. North of 3rd street S.E.)
City Clerk Williams read letters from Louis P. Bader, Ruth L. Susnar, Cecelia Kane
and Fred Schneider, in objection to LID 231.
Mayor Kersey informed the Council and audience that the Public Works Department had
advised him that the contractor has agreed to repair the sidewalks that have been
broken in this project.
Dorothy Flansburg, 1200 3rd st. S. E., appearing from audience questioned regarding
assessment.
Roger Pickens, 1123 3rd st. S. E., from audience spoke about LID assessment.

Ruth Susnar, 17210 Lk. Moneysmith Road, Auburn, washington, from audience, asked
about the prices of the assessment, as compared to the LID in the past.
Dewey Flansburg, from audience, stated that he did not believe payment should be made
until sidewalks are restored to as good condition as originally were.
It was moved by Nickson, seconded by Sonnemann, that the Public Hearing be closed.
MOTION CARRIED
Discussion followed by Councilmen, Public Works Director, Warren Gray and Joe Kempston
from Public Works Department regarding the LID being considered.
It was moved by Kline, seconded by Sonnemann, that the Final Assessment Roll for LID
No. 231 be approved and confirmed and the City Attorney be instructed to draw up the
necessary ordinance approving and confirming the assessment and assessment roll.
MOTION CARRIED
ROLL CALL VOTE: All Councilmen voting YES.
Mayor Kersey declared Public Hearing open on proposed North Auburn Annexation to the
City of Auburn.
Mrs. Thelma McAlexander, Kent, Washington, inquired regarding who can legally sign
a petition.

Mrs. McAlexander was advised by the Mayor and the City Attorney that the record owner
can sign a petition.
It was moved by Sonnemann, seconded by Shaughnessy, that the Public Hearing be closed.
MOTION CARRIED
It was moved by Sonnemann, seconded by Fiedler, that the annexation as proposed be
accepted and submitted to the Boundary Review Board.

Mayor Kersey requested the letters be filed with copy to Engineering Department.
Letter and copy of motion of County Council relating to imposition of sales tax and
use tax.
Mayor Kersey requested the letter and copy of motion be filed.
Application for Massage Parlor or Public Bathhouse License and Application for
Massage Operator or Massage Parlor Attendant License, from Erika N. Norman.
Mayor Kersey requested the applications be referred to the License Committee.
Application for For Hire Driver's License for Lyle Edward Criscione and Patrick M.
Sanders.

AUDIENCE PARTICIPATION
Jim Dick, 1410 25th S. W. appearing on behalf of Committee from the High School on
Ecology, and requestèd the Mayor make a proclamation for the period of April 15 through
April 22nd, for an ecology period in line with National Proclamations for the local
school district and community.
It was moved by Nickson, seconded by Holman, that the Mayor proclaim an ecology period
in line with the National Proclamations and da~es be set aside for ecology week.
MOTION CARRIED
Mayor Kersey thanked Jim Dick for attending the Council Meeting.
BID OPENINGS
Bids were opened at 11:00 A.M. on March 16, 1970 on Call for Bids on two dump trucks,
with bids submitted as follows:

It was moved by Holman, seconded by Shaughnessy, that the bids be rejected and
referred back to committee and authorization be given the committee to call for new bids.

RECOMMENDATIONS
PLANNING COMMISSION
The following items were submitted by the Planning Director to Call for Public Hearing:
Requast of St. Vincent de Paul (Corporation of the Catholic Archbishop of Seattle) to
rezone from R-2 (Single Family Dwelling) to C-l (Light Commercial) a parcel of land
on the South side of lOth Street N. E. approximately 100 feet East of Auburn Way North.
(Application No. 5-70)
Request of James W. Warren to rezone from A-I (Agricultural) to M-l (Light Industrial) I
a parcel of land in the 3400 block on the West side of Auburn Way North.
(Application No. 6-70.)
It was moved by Sonnemann, seconded by Nickson, that Public Hearing be held at 8:00 P.M.,
April 6, 1970, on Applications No. 5-70 and 6-70.
Request of Johnny and Juanita Vicente to rezone from A-I (Agricultural to M-l (Light
Industrial), a parcel of land on the East side of the proposed extension of "I" Street
N. E. in the 3100 block.
It was moved by Nickson, seconded by Holman, that Public Hearing be held at 8:00 P.M.

The following items were submitted by Pat Nevins, Director of Public Works for Council
approval:
Pay Estimate No. 7 to Dale M. Madden Construction Co. for St. Imp. 104 (R st. Bridge)
for $58,584.20.
It was moved by Sonnemann, seconded by Nickson, that Pay Estimate No. 7 to Dale M. Madden
Construction Co. for $58,584.30 be paid.
ROLL CALL VOTE: All Councilmen voting YES.
MOTION CARRIED
Change Order No. 1 to Lloyds of Washington for Airport Service Road for
increase of $557.34.
It was moved by Kline, seconded by Nickson, that Change Order No.1 for $557.34 be
approvßd subject to approval by the Airport Committee.
ROLL CALL VOTE: All Councilmen voting YES.
MOT ION CARRIED
Pay Estimate No. 1 (final) to Lloyds of Washington for Airport Service Road for
$15,228.13.
It was moved by Kline, seconded by Holman, that Pay Estimate No. 1 (final) to Lloyds
of Washington for Airport Service Road for $15,228.13 be paid, and the City accept the
project as complete and that the retained percentage amounting to $1,692.01, including
sales tax, be paid in thirty days provided no liens or claims are filed and clearance
is secured from the State Tax Commission and the Department of Labor and Industries,
subject to approval by the Airport Committee.
ROLL CALL VOTE: All Councilmen voting YES.

Acceptance of the Golf Course Utility Building, constructed by Kurle Construction Co.
It was moved by Fitzsimmons, seconded by Nickson, that the City accept the Golf Course
Utility Building project as complete and that the retained percentage amounting to
$543.13, including sales tax, be paid in thirty d~ys provided no liens or claims are
filed and clearance is secured from the State Tax Commission and the Department of
Labor and Industries.
ROLL CALL VOTE: All Councilmen voting YES.

Pay Estimate No.2 (final) to Allison, Inc. for LID 239 (sanitary sewer
construction on Scenic Drive) for $1,595.02.
It was moved by Fitzsimmons, seconded by Nickson, that Pay Estimate No. 2 (final)
to Allison, Inc. for $1,595.02 be paid, and the City accept the project as complete
and that the retained percentage amounting to $431.94 including sales tax, be paid
in thirty days provided no liens or claims are filed and clearance is secured from the
State Tax Commission and the Department of Labor and Industries.

Authorization for Mayor and City Clerk to sign Agreement between State Highway
Department and the City of Auburn for an overlay along Auburn Way South between
Dogwood and Fir Street.
It was moved by Holman, seconded by Sonnemann, that the Mayor and City Clerk be
authorized to sign agreement with State Highway Department for an overlay along
Auburn Way South between Dogwood and Fir Street and authorize payment not to exceed
the sum of $7,000.00

Authorization to call for Public Hearing on final assessment roll for LID 233
for May 4, 1970.
It was moved by Nickson, seconded by Kline, that Public Hearing be held on final
assessment roll for LID No. 233 at 8:00 P.M., May 4, 1970.

It was moved by Holman, seconded by Shaughnessy, that the City Attorney be authorized
to prepare resolution authorizing contract with Puget Sound Power and Light Company
to supply power to Well No.2 at 5th and K St. N. E.

PROCLAMATIONS, APPOINTMENTS
AND ANNOUNCEMENTS
City Clerk Williams read proclamation of Mayor Kersey declaring the period of March 15
through 21st, 1970 as the 32nd annual observance of National Wildlife Week.

Mayor Kersey announced the Knights of Columbus will hold a St. Patrick's Day Dance
on March 21 and is for the benefit of those who will pursue the study of priesthood.
Mayor Kersey announced the period of March 15 through 22nd as Campfire week and offered
his best wishes to this hard working group of girls.
COUNCIL COMMITTEE REPORTS
AIRPORT COMMITTEE - KLINE
Councilman Kline, reporting for Airport Committee, stated the committee had discussed
a proposal from Auburn Electric to replace two 500 watt ramp lights with two 1500 watt
lights at the airport which met with the approval of the Airport Committee.
It was moved by Kline, seconded by Fitzsimmons, that Airport be authorized to replace
two 500 watt ramp lights with 1500 watt lights at the approximate sum of $110.00.
ROLL CALL VOTE: All Councilmen voting YES.
MOTION CARRIED
Councilman Kline reported the Airport Committee had discussed the purchase on a lease-
purchase agreement, a coffee machine in the sum of $754.00, and the matter will be
referred to the Finance Committee.
Councilman Kline, reporting for Finance Committee, stated the Committee had considered
request of City Treasurer to purchase Finance Warrants as follows:

It was moved by Kline, seconded by Nickson, that the City Treasurer be authorized to
purchase finance warrants as listed.

Councilman Kline reported the letter from Mayor Kersey and City Attorney Bereiter would
be considered and discussed at the next meeting of the Finance Committee, and the
Committee directed the Finance Director prepare a report as to the costs of the
Municipal Court for consideration and study at the next meeting.
The purchase of a coffee maker for use at the airport was discussed and considered and
it was moved by Kline, seconded by Shaughnessy, that the Mayor and City Clerk be
authorized to sign the purchase ag~eement for purchase of a coffee maker.

Councilman Kline reported the Police Chief had met with the Finance Committee and
the committee learned a great deal of the indications of the needs to be met for the
year 1971 and in line with the budget Chief Darby's request for approval to expend
money from within his budget to do some remodeling he was advised to proceed through
committee.

Chief Calkins was invited to meet with the Finance Committee on April 16, 1970 to
discuss needs of the Fire Department for budget preparation in 1971.
GOLF COURSE COMMITTEE - FITZSIMMONS
Councilman Fitzsimmons announced the Golf Course will open on April 1, 1970 with 9
holes and dedication on the 6th of June, 1970 for 18 holes.
BUILDING COMMITTEE - HOLMAN

and had agreed on two matters--we need the building but didn't know when it would
be placed on the ballot again.
ORDINANCE, LEGISLATIVE, CONFIRMATION AND POLICY COMMITTEE - NICKSON
Councilman Nickson reported the committee had discussed the obscenity ordinance and
the committee is waiting for the City Attorney to check with the Association of
Washington Cities before proceeding with such an ordinance.
OLD BUSINESS
Purchase Order for street patching to Cascade Aspþa1t Paving Co. from the Engineering
Department and the final statement for street patching in the sum of $6,222.56 was
discussed.
It was moved by Kline, seconded by Fitzsimmons, that the Purchasing Agent be
authorized to issue a purchase order to Cascade Asphalt Paving Company for $6,222.56
for payment of final pavement street patching.

Mayor Kersey reported he had had a letter from the Chinook Elementary PTA with regard
to safe walking law.

CLASSIFICATION THEREOF FROM A-I TO M-l." (Walter Schlumpf Rezone - N.W. corner of
30th st. and Auburn Way North)
It was moved by Nickson, seconded by Fiedler, that Ordinance No. 2441 be introduced
and adopted.

ORDINARY SESSION OF THE STATE OF WASHINGTON AS OF APRIL 1, 1970 AND INSTRUCTING THE
MAYOR AND CITY CLERK TO ENTER INTO A CONTRACT FOR THE COLLECTION OF SAID TAX WITH THE
WASHINGTON DEPARTMENT OF REVENUE AND SETTING FORTH PENALTIES FOR THE VIOLATION OF THE

It was moved by Kline, seconded by Nickson, that the segregation be approved.

Colburn for zGneichange from R-3 to C-3, property located between 13th and 14th S.E.

seconded by Holman, that the meeting be adjourned at 10:40 P.M.
