M., in the Council Chambers of the City Hall. The meeting was called to order by Mayor Kersey. Councilmen present: Kline, Sonnemann, Shaughnessy, Fitzsimmons, Holman, Fiedler and Nickson. APPROVAL OF MThrUTES It was moved by Fiedler, seconded by Holman, that the Council Minutes of March 16, 1970 Council Meeting be approved as mailed. MOTION CARRIED PUBLIC HEARINGS Mayor Kersey declared Public Hearing open on Final Assessment Roll on LID 230, Sanitary Sewer construction in Lea Hill area. City Clerk Williams read letter of objection to the amount of the assessment from T. J. Bastrom, John E. Leno, 31005 124th Ave. S. E., William A. Graham, 11022 Bellevue Way S. E., Bellevue, Washington, objecting to the LID; William H. Washburn and Vida R. Washburn, objecting to the assessment; Harry L. Baardson, Route 3, Box 928, Enumclaw, Washington, objecting to LID assessment; Ralph Anderson, objecting to assessment; Beulah O. Christen- sen, 31015 124th Ave. S. E., Auburn, Wash., objecting to assessment and manner of install- ation; Terrence K. Gilseth, 31025 124th s. E., Auburn, Wash. objecting to amount of assess- ment; and Carl Fletten, objecting to charges of assessment. It was moved by Fiedler, seconded by Sonnemann, that Public Hearing be closed. MOTION CARRIED It was moved by Fitzsimmons, seconded by Kline, that the Final Assessment Roll for LID 230 be approved and confirmed and the City Attorney be instructed to draw up the necessary ordinance approving and confirming the assessment and assessment roll. MOTION CARRIED Mayor Kersey declared Public Hearing open on Final Assessment Roll on LID 234, water mains on Garden Avenue between 320th Street S. E. and the Green River. City Clerk Williams read letter from James Welsh, objecting to the assessment. It was moved by Fiedler, seconded by Holman, that Public Hearing be closed. MOTION CARRIED It was moved by Fitzsimmons, seconded by Shaughnessy, that the Final Assessment Roll for LID 234 be approved and confirmed and the City Attorney be instructed to draw up the necessary ordinance approving and confirming the assessment and assessment roll. ROLL CALL VOTE: All Councilmen voting YES. MOT ION CARRIED Mayor Kersey declared Public Hearing open on request of st. Vincent de Paul, Corporation of the Catholic Archbishop of Seattle to rezone from R-2 (Single Family Dwelling) to C-l (Light Commercial) a parcel of land on the South side of lOth Street N. E. approximately 100 feet East of Auburn Way North. (Application No. 5-70) The Planning Commission recommend to the City Council the granting of this request in that it conforms to the Comprehensive Land Use Plan and with consideration being given to the dedication of the North 5 feet adjacent to lOth Street N. E.for street purposes. It was moved by Fiedler, seconded by Sonnemann, that the Public Hearing be closed. MOTION CARRIED It was moved by Sonnemann, seconded by Nickson, that the Planning Commission recommenda- tions be concurred with and grant the rezone request of st. Vincent de Paul from R-2 to C-l, with consideration being given to dedication of the North 5 feet adjacent to lOth Street N. E. for street purposes, and the City Attorney be instructed to prepare the necessary ordinance granting rez one. Mayor Kersey declared Public Hearing open on request of James W. Warren to rezone from A-l (Agricultural) to M-l (Light Industrial), a parcel of land on the East side of the proposed extension of "1" Street N. E. in the 3400 block. (Application No. 6-70) The Planning Commission recommend to the City Council the granting of this request in that it conforms to the Comprehensive Land Use Plan of Auburn. It was moved by Fiedler, seconded by Sonnemann, that the Public Hearing be closed. MOTION CARRIED 40 AUBURN, WASHThrGTON MONDAY APRIL 6, 1970 It was moved by Nickson, seconded by Fiedler, that the Planning Commission recommendations be concurred with and the rezone request be granted from A-l to M-l and the City Attorpey be instructed to prepare necessary ordinance granting rezone. Mayor Kersey declared Public Hearing open on request of Johnny and Juanita Vicente to rezone from A-l (Agricultural) to M-l (Light Industrial), a parcel of land on the East side of the proposed extension of "I" street N. E. in the 3100 block. (Application No. 4-70) The Planning Commission recommend to the City Council the granting of this request with the following conditions: 1. That the West 30 feet be dedicated to the City of Auburn for the future dev- elopment of "I" street N. E. 2. That a 50 foot setback from the East property line be allotted to be used for landscaping upon the development of the property. I Mr. Jack Hawkins, in appearance for petitioners, in audience, explained map and plans for requested zone change. It was moved by Fiedler, secon ded by Holman, that the Public Hearing be closed. MOTION CARRIED It was moved by Kline, seconded by Nickson, that discussion be held with five minute limitation. MOTION CARRIED Approximately fifteen minutes of discussion was held by Councilmen, Planning Director and Pat Nevins. It was moved by Fiedler, seconded by Nickson, that the rezone request of Johnny and Juanita Vicente be tabled for two weeks. MOTION CARRIED CORRESPONDENCE City Clerk Williams read letter from A. R. Dammkoehler, Air Pollution Control Officer. I Mayor Kersey requested the letter be filed. City Clerk Williams read rezone request from Mobil Oil Corporation, C. S. McConnehey and Robert C. Thornton, to rezone from R-3 and R-3 with SPU for Service Station to C-3 (Heavy Commercial), property located at 1216 East Main and 21 M st. N. E. It was moved by Fiedler, seconded by Nickson, that rezone request from Mobil Oil Corporation be referred to the Planning Commission. MOTION CARRIED City Clerk Williams read letter from City Historian from Kasuga-cho, Sister City to Auburn, with greetings from Sakai Ichinoki. Mayor Kersey requested the letter be filed. AUQIENCE PARTICIPATION Mr. Ron Swift, from the Senior High Drama Club, Auburn, with members of the Drama Club, presented a brief scene from "The Miracle Worker 11 which the Drama Club will pre- sent at the Auburn Senior High School, April lOth and 11th. Mayor Kersey thanked the Group from the Drama Club and Mr. Swift. Mr. Al Perella, from General Builders, from audience requested the City furnish Certificate of Insurance for Hangars at the Auburn Municipal Airport. I RECOMMENDAT IONS The following items were submitted by Pat Nevins, Director of Public Works for Council approval: Segregation of assessments for LID No. 211. It was moved by Nickson, seconded by Sonnemann, that segregation of assessments for LID No. 211 be approved. MOTION CARRIED Segregation of assessments for LID No. 220. Authority for the City Attorney to draw up a resolution authorizing payment of late-comer charges to the U-Haul Company for future connections to a sanitary sewer constructed and paid for by that company, contract to be signed by Mayor and City Clerk. It was moved by Fitzsimmons, seconded by Sonnemann, that the City Attorney be authorized to prepare resolution authorizing payment of late-comer charges to the U-Haul Company for future connections to a sanitary sewer constructed and paid for by that company, and the contract to be signed by the Mayor and City Clerk. MOTION CARRIED Authority for the City Attorney to draw up a resolution authorizing payment of late-comer charges to Valley Building Center future connections to a sanitary sewer constructed and paid for by that company, sewer constructed on easement to Auburn Way North at approximately 32nd Street, contract to be signed by the Mayor and City Clerk. It was moved by Fiedler, seconded by Fitzsimmons, that the City Attorney be instructed to prepare resolution authorizing payment of late-comer charges to Valley Building Center future connections to a sanitary sewer constructed and paid for by that company, sewer constructed on easement to Auburn Way North at approximately 32nd Street, and contract to be signed by the Mayor and City Clerk. MOTION CARRIED Pay Estimate No. One to Bigstone Corporation for LID 237 for $2,539.62. It was moved by Sonnemann, seconded by Kline, that Pay Estimate No. One to Bigstone Corporation for LID 237 in the sum of $2,539.62 be paid. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Pay Estimate No. 10 (final) to Spragues' Inc. for Golf Course Landscaping for $10,850.75, subject to Golf Course Committee approval. It was moved by Fitzsimmons, seconded by Holman, that Pay Estimate No. 10 (final) to Spragues' Inc. for Golf Course Landscaping for $10,850.75 be paid and the project be accepted by the City as completed and that the retained percentage amount to $15,407.75 including sales tax, be paid in thirty days provided no liens or claims are filed and clearance is secured from the State Tax Commission and the Department of Labor and Industries. MOTION CARRIED Authority for the City Attorney to draw up resolution authorizing the Mayor and City Clerk to sign Agreement No. 2711 with the State Highway Commission for utility crossings of SR 167 (Valley Freeway) from 15th st. S. W. to Main st., the. City's portion of cost to be estimated at $130,710.25. It was moved by Fitzsimmons, seconded by Shaughnessy, that the City Attorney be authorized to draw up resolution authorizing the Mayor and City Clerk to sign Agreement No. 2711 with the State Highway Commission for utility crossings of SR 167 (Valley Freeway) from 15th st. MOTION CARRIED PROCLAMATIONS, APPOINTMENTS AND ANNOUNCEMENTS City Clerk Williams read proclamation declaring April 12 to April 18, 1970 as National Library Week in the City of Auburn. City Clerk Williams read proclamation declaring April 15 through April 22, 1970 as Ecology Week in the City of Auburn. City Clerk~lliams read proclamation declaring Sunday, April 12,1970 as Washington Honey '$unday. Mayor Kersey announced the VFW Hall will hold open house from 2 to 5 P.M. Sunday, April 12 and urged the Council and citizens to attend. Mayor Kersey announced the Auburn Washington Historical Society will dedicate its /) building April 12, 1970. ( 42 AUBURN, WASHINGTON MONDAY .APRIL 6, 1970 COUNCIL COMMITTEE REPORTS AIRPORT COMMITTEE - KLINE Councilman Kline, reporting for Airport Committee, stated the Committee discussed lease terms with Pete Blood of Aviation General for lease of hangar spaces numbered 20, 21 and 22 for the purpose of maintenance facility and that the City would install suitable lighting and tiedown for two aircraft and the City Attorney would draft the necessary lease at rental rate of $150.00 per month with rental to commence approxi- mately April 15, 1970. The Committee had discussed with Duane Pfaff of General Builders regarding retainage held by the City for uncompleted and unsatisfactory work on the Hangar Contract and there were a total of men items to be corrected before the retainage could be paid. I The new lease reservation forms, deposit forms and diagrams for the proposed construc- tion of light and executive-engined hangars were reviewed and approved and the City will proceed with the installation of partitions and the construction program as rapidly as possible. FINANCE COMMITTEE - KLThrE The Committee discussed the proposed insurance program of the City of Auburn and the Insurance Counselor and the Committee recommend the basic policy for $300,000.00 liability be procured. It was moved by Kline, seconded by Nickson, that the Airport Liability Policy be increased from $300,000.00 to $1,000,000.00. ROLL CALL VOTE: All Councilmen voting YES. MOT ION CARRIED It was moved by Kline, seconded by Holman, that the basic insurance for liability in the sum of $300,000.00 be procured. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Councilman Kline reported the Committee had discussed the request of the Public Works Department to purchase a vibratory tamper for the approximate sum of $3,500.00. I It was moved by Kline, seconded by Fitzsimmons, that the Public Works Department be authorized to call for bids for a vibratory tamper and to purchase same provided the net cost does not exceed the sum of $3,500.00. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED The Committee discussed the request of the Park Department to develop Tennis Courts as budgeted in the amount of $20,000.00. It was moved by Kline, seconded by Nickson, that the Park Department be authorized to call for bids to develop tennis courts as budgeted from the Park Department Budget. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Councilman Kline reported the Finance Committee will invite Blythe & Co. to attend the next meeting with City Attorney John Bereiter to be invited to attend. The Committee discussed the request for financial assistance for the White River Historical Society and Mr. Kelly, Finance Director, will discuss this request further with the Historical Society. It was moved by Kline, seconded by Fitzsimmons, that the City Attorney be authorized to draft lease between Aviation General and the City. MOTION CARRIED I GOLF COURSE COMMITTEE - FITZSIMMONS Councilman Fitzsimmons, reporting for the Golf Course Committee, stated the Dity is still planning to open eighteen holes on June 6, 1970. BUILDThrG COMMITTEE - HOLMAN Councilman Holman announced the Building Committee will meet on April 14, 1970 at 7:30 A.M., at the Rainbow Cafe. POLICE AND LICENSE COMMITTEE - FIEDLER Councilman Fiedler, reporting for License Committee, stated the Committee recommends approval of IIFor Hire Driver's Licenses" for Lyle Edward Criscione and John 1. MOTION CARRIED NEW BUSINESS It was moved by Fitzsimmons, seconded by Holman, that the three electrical transformers be declared surplus and the Public Works Director be authorized to call for bids for the sale of three electrical transformers, with bids to be opened at 11':00 A.M., April 17, 1970. MOTION CARRIED The City Attorney requested permission to execute an agreed order on behalf of the City of Auburn in the Matter of City of Auburn, Petitioner vs. Northern Pacific Railway Company, Respondent, for the widening of 37th Street N. W. and the installation of Railroad Crossing signals. It was moved by Kline, seconded by Fitzsimmons, that the City Attorney be authorized to execute agreed order on behalf of the City of Auburn in the matter of City of Auburn, vs. Northern Pacific Railway Company for the widening of 37th Street N. W. and the installation of Railroad Crossing signals, and present to Council Meeting April 20, 1970. MOTION CARRIED The City Attorney requested permission for the Mayor and City Clerk to sign, on behalf of the City, a memorandum of agreement in the matter of the City of Auburn, vs. M. A. Segale, Inc. I It was moved by Sonnemann, seconded by Shaughnessy, that the Mayor and City Clerk be authorized to sign, on behalf of the City, a memorandum of agreement in the matter of City of Auburn vs. M. A. Segale, Inc. It was moved by Nickson, seconded by Kline, that the memorandum of agreement in the matter of City of Auburn vs. M. A. Segale, Inc. be tabled. It was moved by Kline, seconded by Nickson, to suspend the rules of order to allow for discussion. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Discussion followed regarding gravel situation. ROLL CALL VOTE ON MOTION TO TABLE: Councilman Kline, Fitzsimmons, and Nickson voting YES. Councilmen Shaughnessy, Sonnemann, Holman and Fiedler voting NO. MOTION FAILED It was moved by Kline, seconded by Nickson, that the memorandum of agreement be amended to IIconduct operations on the Indian lands during the hours of 7:00 A.M. to 10:00 P.M., Monday through Saturday except for routine maintenance of facilities and equipment" . MOTION CARRIED I Vote on motion for Mayor and City Clerk to sign memorandum of agreement in the matter of City of Auburn vs. M. A. Segale, Inc., favorable. MOTION CARRIED APPROVAL OF VOUCHERS AND TRANSFERS It was moved by Kline, seconded by Holman, that voucher approval and department trans- fer list in the sum of $291,531.92 be approved for payment. Claims Warrants #406 through #692. Payroll Warrants #855 through #1255. Total Payroll $130,861.33. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED It was moved by Holman, seconded by Kline, that the Council Meeting be continued until 7:30 P.M., April 13, 1970 for the purpose of considering the bids on two dump trucks. 10:37 P.M. MOTION CARRIED The continued meeting of the City Council of the City of Auburn, convened at 7:30 P.M. in the Council Chambers of the City Hall April 13, 1970. The meeting was called to order by Mayor Kersey. Councilmen present: Kline, Sonnemann, Shaughnessy, Fitzsimmons, Holman, Fiedler and Nickson. BID OPENINGS Bids were opened at 11:00 A. M., on April 7, 1970, on Call for Bids for two dump trucks with bids submitted as follows: BIDDER TOTAL BID (Less Trade-in) SCARFF MOTORS BOTHELL BROS. VALLEY MOTORS $14,416.92 13,688.95 13,433.01 All bids were accompanied by Bid Bonds; the above bids did include sales tax. It was moved by Sonnemann, seconded by Fiedler, that the bid of Bothell Chevrolet be accepted in the sum of $13,688.95, and the Mayor and City Clerk be authorized to sign the contract. MOTION CARRIED It was moved by Sonnemann, seconded by Fiedler, that the bids, after being awarded to Bothell Chevrolet be referred to the Finance Committee Meeting April 16, 1970 for a recommendation on the best way to pay for the trucks within the Street Department Funds. MOTION CARRIED It was moved by Sonnemann, seconded by Fitzsimmons, that after the contracts are signed by Bothell Chevrolet that the remaining bid bonds be returned to the unsuccessful bidders. MOTION CARRIED OTHER BUSINESS It was moved by Kline, seconded by Fitzsimmons, that the memorandum of agreement in the matter of the City of Auburn vs. M. A. Segale, Inc., be çorrected (as per the Council wishes of the previous week) and the City Attorney be instructed to delete the following from Paragraph 3: IIprovided, that in the event M. A. Segale, Inc. believes that it is absolutely necessary to operate on the Indian Lands after the hour of 10:00 P.M., then M. A. Segale, Inc. will give the City of Auburn at least two weeks notice of its intent to act after the hour of 10 :00 P.M. II MOTION CARRIED It was moved by Shaughnessy, seconded by Holman, that there being no further business to come before the Council the meeting adjourn at 9:52 P.M.
