The meeting was called to order by Mayor Kersey. Councilmen present: nine~ Sonnemann~ Shaughnessy~ Fitzsimmons~ Holman~ Fiedler and Nickson. APPROVAL OF MINUTES It was moved by Holman, seconded by Sonnemann~ that the minutes of the May 4~ 1970 Council meeting be approved as mailed. City Clerk Williams read letter of objection to L.I.D. 224 from Charles S. Everhart~ 820 12th N.E.~ Auburn~ Washington. The following people in the audience voiced objections to the costs of the final assess- ment for L.I.D. 224: Charles S. Everhart~ 822 - 12th St. N. E., Al Stovner, 925 I st. N. It was moved by Nickson, seconded by Holman~ that Public Hearing be closed MOTION CARRIED Councilman Nickson asked the Public works Director, Pat Nevins, to give an explanation of the L.I.D. costs and what the costs of the L.I.D. the City of Auburn is paying to accom- plish this project. I Bill Mitchell, 1008 lOth N.E.~ from audience, requested the installation of underground cable be done at the same time L.I.D. work is being accomplished. J. V. Fairchild, 804 lOth st. N.E. complained about not getting fill dirt and the digging up again for underground cable. It was moved by Nickson, seconded by Fiedler~ that the Final Assessment Roll for L.I.D. 224, streets on 11111 Street N .E. from 8th Street N .E. to Harvey Road, lOth Street N .E. from Auburn Way North to Harvey Road, and 9th Street N .E. from III" Street N. E. to a point 275 feet East of III" Street N.E., be approved and confirmed and the City Attorney be instructed to prepare necessary ordinance approving and confirming the assessment and assessment roll. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED It was moved by Kline~ seconded by Shaughnessy~ that the Public Works Department be in- structed to correct the existing deficiencies on these projects and report back to the Council on the action taken. MOTION CARRIED Mayor Kersey declared Public Hearing open on Final Assessment Roll for L.I.D. 229 (street and water construction on Pike Street N.E. from 8th Street N. E. to 12th Street N. E.). I City Clerk Williams read letter of objection from Kenneth Schoenfeld and N. R. Hebert to L.I.D. 229. City Clerk Williams read letter of objection to L.I.D. NO. 229 from Raymond D. Torbenson. Assistant City Ehgineer~ Warren Gray~ read letter in reply to objections to L.I.D. 229. Kenneth Schoenfeld spoke from audience against the LID~ reiterating points brought out in the letter objecting from himself and N. R. Hebert; and N. R. Hebert voiced his objection with Kenneth Schoenfeld. It was moved by Shaughnessy, secondad by Fiedler, that the Public Hearing be closed. MOTION CARRIED It was moved by Fiedler, seconded by Nickson, that the Final Assessment Roll for LID 229 58 AUBURN, WASHIN GT(]i[ MONDAY MAY 18 ~ 1970 be approved and confirmed and the City Attorney be instructed to draw up the necessary ord- inance approving and confirming the assessment and assessment roll. It was moved by Kline, seconded by Shaughnessy, that the motion be amended to reduce the assessment on the Schoenfeld and Hebert property in the sum of $1.62 per square foot and the City absorb the costs. MOTION CARRIED I CORRESPONDENCE City Clerk Williams read letter from General Builders regarding Airport. Al Perella~ President, General Builderrs~ Inc. in audience, requested Board of Arbitration to attempt to resolve this matter. Mayor Kersey advised Mr. Perella that he would be notified right away with regard to Board of Arbitration. City Clerk Williams read letter from Alva C. Long relative to arrest, trial and/or bail forfeiture under certain circumstances. Mayor Kersey requested the letter be referred to the Police Committee and the City Attorney. City Clerk ~ílliams read petition signed by 136 signatures requesting the City of Auburn make available facilities in a near down-town location for Senior Citizen activities. Mayor Kersey advised the City will take care of this request as well as we can and would hope for some help from Forward Thrust, and more information will be brought up under Miscellaneous Business. City Clerk Williams read letter of recommendation from Leonard C. Chapman~ recommending I the contract be awarded for the construction of three (3) tennis courts to Lloyds of Washington on their low bid of $13,982.20 plus sales tax $699.11, for total $14,681.31. That the bid be awarded for the construction of tennis court fencing, including the alternate of colored fabric~ to San Jose Steel Company on their low bid of $4,181.00 plus sales tax $209.05, for total $4,390.05. It was moved by Holman, seconded by Kline, that the contract for the construction of three tennis courts be awarded to Lloyds of Washington on their low bid of $13~982.20 plus sales tax~ $699.11~ for a total bid of $14~681.31. MOTION CARRIED It was moved by Sonnemann, seconded by Holman, that the contract for the construction of I I I AUBURN ~ WASHINGTON MAY 18~ 1970 5H- MONDAY tennis court fencing, including the alternate of colored fabric~ be awarded to San Jose Steel Company on their bid of $4,181.00, plus sales tax $209.05~ for a total of $4,390.05. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED It was moved by Sonnemann, seconded by Fiedler, that upon signing of contract with Lloyds of Washington for construction of three tennis courts, and San Jose Steel Company for construction of tennis court fencing, the bid bonds of the unsuccessful bidders be returned. MOTION CARRIED RECOMMENDA TIONS PLANNING COMMISSION RECOMMENDATIONS The following items were submitted to call for Public Hearing from the Planning Commission: The request of Francis E. Ballard and Gene Colburn to rezone from R-3 to C-3, a parcel of land lying between 13th and 14th Streets S. E. abutting the East line of IIAII Street S. E. (Application 8-70) The request of Mobil Oil Company~ C. S. McConnehey and R. C. Thornton to rezone from R-3 with a S.P.U. for a gas station to C-3, a parcel of land lying at the Southwest corner of the intersection of East Main Street and 11M" Street S .E. (Application No. 9-70) It was moved by Nickson~ seconded by Fitzsimmons~ that Public Hearing be held at 8:00 P.M., June l~ 1970, on the request of Francis E. Ballard and GeneColburn~ application #8-70, and request of Mobil Oil Company, C. S. McConnehey and R. C. Thornton~ application #9-70. MOTION CARRIED ENGINEERING DEPARTMENT RECOMMENDATIONS The following items were submitted for approval by the Director of Public Works: Pay Estimate No. 1 (final) to North Coast Electric Co. for materials for airport lighting of runways for $4~421.97. It was moved by Kline, seconded by Holman, that Pay Estimate No. 1 (final) to North Coast Electric Co. for materials for airport lighting of runways for $4,421.97 be approved for payment and the City accept the project as complete, and that the retained percentage amounting to $467.93 including sales tax~ be paid in thirty days provided no liens or claims are filed and clearance is secured from the State Tax Commission and the Department of Labor and Industries. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Pay Estimate No. 9 to Dale M. Madden Construction Co. for St. Imp. 104~ Ph. I, R Street Bridge/Enumclaw Highway for $12,206.25. It was moved by Nickson, seconded by Sonnemann, that Pay Estimate No. 9 to Dale M. Madden Construction Co. for $12,206.25 be paid. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Pay Estimate No.1 (final) to Lone Bros. Construction Co. for Dog Kennel Addition for $3,310.75. It was moved by Kline, seconded by Holman~ that Pay Estimate No.1 (final) to Lone Bros. Construction Co. for $3,310.75 be paid and the City accept the project as complete, and that the retained percentage amounting to $348.50 including sales tax, be paid in thirty days provided no liens or claims are filed and clearance is secured from the State Tax Commission and the Department of Labor and Industries. It was moved by Fitzsimmons, seconded by Holman, that Change Order No. 2 for increase of $150.00 + tax to Venture Construction Co. be approved. ROLL CALL VOTE: All Councilmen voting YES. MOT ION CARRIED Request authorization for ~r and City Clerk to sign agreement for Hud Grant No.1. 60 .!UBURN ~ WASHINGTON MONDAY MAY 18, 1970 It was moved by Holman~ seconded by Fitzsimmons, that the Mayor and City Clerk be author-- ized to sign agreement for Hud Grant No. 1 ROLL CALL VOTE: All CouncilrnBn voting YES. MOTION CARRIED Request authorization for Mayor and City Clerk to sign consulting engineering agreement with Stevens, Thompson & Runyan for projects involving the HUD grant. It was moved by Fitzsimmons, seconded by Holman~ that the Mayor and City Clerk be authorized to sign consulting engineering agreement with Stevens, Thompson & Runyan for projects involving the HUD grant. It was moved by Nickson~ seconded by Fiedler, that the City Attorney be instructed to draw up necessary litigation creating L.I.D. 242. ROLL CALL VOTE: Councilmen Nickson, Sonnemann~ Shaughnessy, Fitzsimmons, Holman, Fiedler voting YES. Councilman Kline voting NO. MOTION CARRIED Segregation of assessment for LID No. 182, Assessment No.3, $8,160.48 total assessment. It was moved by Nickson, seconded by Holman, that segregation of assessment for LID No. 182, Assessment No.3, be approved. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED PROCLAMATIONS ~ APPOINTMENTS AND ANNOUNCEMENTS City Clerk Williams read proclamation for the Auburn Jaycees for outstanding young men Distinguished Service Award and Auburn Jaycee Auxiliary outstanding young women Distinguished Service Award, and the Mayor proclaimed Monday, May 25, 1970 as Auburn Jaycees Distinguished Service Awards Day in the City of Auburn. I Devere Lindh, President of the Auburn Jaycees invited all to attend the banquet and awards ceremonies and pay tribute to the outstanding young men and women. Mayor Kersey announced to the Council that an interim meeting will not be held on May 25~ 1970~ in order to permit all those who could attend to attend the banquet and ceremonies ~ and advised the Council they will meet at 6 :45 P .M. ~ June 1, for executive session prior to the Council Meeting. Mayor Kersey explained the Forward Thrust Bond Issue and explained the issues and urged people to vote. COUNCIL COMMITTEE REPORTS FINANCE COMMITTEE - KLINE Councilman Kline~ :xeporting for the Finance Committee, stated the Committee met with the Cemetery Board on a selection of an architect for the purpose of design and proceed toward bid for a new building for use at the cemetery as an office and maintenance of small equipment, at a cost not to exceed $25,000.00 It was moved by Kline, seconded by Holman~ that the Cemetery Board be authorized to secure an architect and come to bid for the construction of an office and maintenance building not to exceed $25~000.00. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED I Councilman Kline reported that the City Attorney has reported regarding negotiations with the County property management Manager relative to the costs the City will share in the new courthouse presently under construction. It was moved by Kline, seconded by Holman, that the City Attorney be authorized to negotiate in their behalf with the King County Property Agent with regard to the Court and report back to the Council. MOTION CARRIED Councilman Kline reported on a letter received from Jack L. Sprenger with regard to the three-year umbrella liability policy for the City of Auburn and the anticipated pro rata premium will be $12,284.00 and the recommendation the coverage for False Arrest policy including special policemen be increased for the balance of the policy period at the AUBURN ~ WASHINGTON rate of $251.00. MONDAY MAY 18~ 1970 6.1- It was moved by Kline, seconded by Sonnemann, that the city obtain the umbrella liability policy in the sum of $12,284.00 premium and that coverage for false arrest policy include special policemen, at the additional cost of $251.00 for the balance of the policy period. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED The Committee discussed the Golf Course insurance and the golf course lease and it was moved by Kline, seconded by Sonnemann~ that the City Attorney be authorized and instructed to revise the golf course lease to reflect the new liability and that the Mayor and City Clerk be authorized to sign the revised Golf Course Lease. I MOTION CARRIED AIRPORT COMMITTEE - KLINE Councilman Kline~ reporting for the Airport Committee~ stated the runway lighting project is proceeding. Councilman Kline reported that Civil Air Patrol have tentatively scheduled the 27th day of June, 1970 for Civil Defense exercises. The Airport Committee is working toward keeping the Airport open during the hours of 9:00 A.M., to 1/2 hour after official sunset, and further inf~rmation will be forthcoming on this matter. The next meeting of the Airport Committee will be held in the Airport office on May 20~ 1970 at 7:30 P.M. STREET, ENGINEERING, PLANNING & EQUIPMENT RENTAL COMMITTEE - SONNEMANN Councilman Sonnemann stated the Committee recommends approval of the resolution regarding agreement with State Highway Department. The Committee will discuss further the charge for excavation inspection, at future meeting. The Street Committee will meet May 20~ 1970 at 7:30 P.M. I UTILITY COMMITTEE - FITZSIMMONS Councilman Fitzsimmons announced that BUD Grant in the amount of $394,200.00 has been approved for additional water projects. Councilman Fitzsimmons announced that plans are progressing well for the dedication of the Golf Course on June 6, 1970. ORDINANCE, LEGISLATIVE~ CONFIRMATION AND POLICY COMMITTEE - NICKSON Councilman Nickson reported that the Police Department would like to review Ordinance No. 2456 listed on the agenda and it would be the desire of the committee to table this ordinance for revision. It was moved by Holman~ seconded by Nickson, that Ordinance No. 2456 be tabled. MOTION CARRIED The Committee recommend introduction and adoption of Ordinance No. 2457~ on outdoor musical entertainment. MOTION CARRIED I RESOLUTION NO. 410 It was moved by Sonnemann, seconded by Fiedler, that Resolution No. 410 entitled "A RESOLUTION OF THE CITY OF AUBURN, WASHINGTON, AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE, ON BEHALF OF THE CITY, AN AGREEMENT TO PARTICIPATE WITH THE DEPARTMENT OF HIGHWAYS OF THE STATE OF WASHINGTON IN APPLYING FOR FEDERAL FUNDS FOR THE IMPROVEMENT OF SR 167 WEST MAIN STREET TO SOUTH 277TH STREET II be introduced and adopted. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED RECONSIDERATION OF THE MODIFICATION OF MEMORANDUM OF AGREEMENT WITH M. A. SEGA.LE~ INC. It was moved by Kline, seconded by Sonnemann, that the Mayor and City Clerk be authorized to sign the modification of memorandum of agreement with M. A. SEGA.LE~ the terms of which are: "7. The City Council agrees to take under consideration at the next regularly scheduled meeting, any written request by M. A. Segale~ Incorporated, for temporary extension fo working hours due to unusual circumstances~ providing such request is received at least ten (10) days prior to said meeting. II It was moved by Kline~ seconded by Sonnemann~ that the motion be amended to amend Paragraph 3 of the agreement after Saturdayll, except for the maintenance of equipment and facilities. ORDINANCE NO. 2460 Ordinance No. 2460 entitled IIAN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR THE ACQUISITION OF A SITE FOR A MUNICIPAL AIRPORT AND CONSTRUCTING THEREON A HANGAR AND OTHER AIRPORT BUILDINGS ~ EXTENDING AIRPORT RUNWAY, INSTALLING LIGHrING, REMOVING POWER LINES AND MAKING OTHER AIRPORT IMPROVEMENTS AND PROVIDING FOR THE REPAYMENT TO VARIOUS CITY FUNDS OF TEMPORARY LOANS HERETOFORE MADE FROM SUCH FUNDS TO PAY FOR THE ACQUISITION OF LAND AND THE DEVELOPMENT OF THE MUNICIPAL GOLF COURSE FACILITIES; DECLARING THE ESTIMATED COST THEREOF AS NEAR AS MAY BE; PROVIDING FOR THE ISSUANCE AND SALE OF $1~000,000.00 PAR VALUE OF IIGENERAL OBLIGATION BONDS, 1970~" OF THE CITY; SPECIFYING THE MATURITIES AND FIXING THE FORM AND MAXIMUM EFFECTIVE INTEREST RATE OF SUCH BONDS; ESTABLISHING A IIGENERAL OBLIGATION BOND FUND, 1970"; AND PROVIDING FOR THE SALE OF SUCH B(]i[DS. It was moved by Sonnemann, seconded by Holman, that the City Attorney be instructed to draw up necessary resolution for public hearing on L.I.D. for curb and gutter on 4th Street N. E. between a point 97.59 feet West of "J" Street N. E. and "Mil Street N. E. ROLL CALL VOTE: All Councilmen voting YES.
