HomeMy WebLinkAbout06-15-1970 72 AUBURN WASHINGTON MONDAY JUNE 15 1970 The regular meeting of the City Council of the City of Auburn convened at 8:00 P.M. in the Council Chambers of the City Hall. The meeting was called to order by Mayor Kersey, Cubmaster Sherrill B. Clark, Cub Scout Pack 401, and Cub Scouts N. Marcus, Carl Clark and Mike Voligny, led the flag salute. APPROVAL OF MINUTES Iy was moved by Sonnemann, seconded by Shaughnessy, that the Minutes of the June 1, 1970 Council Meeting be approved as mailed. MOTION CARRIED I PUBLIC HEARIN OS Mayor Kersey declared Public Hearing open on Resolution No. 399 for the creation of local improvement district for the purpose of the construction and installation of sanitary sewers along Western Avenue from Main Street to the Northern extremity of We stern Avenue. City Clerk Williams read petition signed by eleven property owners against forth- coming sewer L.I.D. and also protesting the water line L.I.D. City Clerk Williams read letter submitted by Pat Nevins, Director of Public Works regarding proposed local improvement district. The following persons in audience spoke in protest of the proposed L.I.D.: Harry E. Swanson, 20 Western Ave. N. W.; Barbara Campbell, 415 Western St. N. W.; Mrs. Milton Willard, 410 Western st. N. W.; Mrs. Robert Malek, 320 Western Ave. N. W.; Mrs. Wanda M. Lacey, 29260 59th Avenue South; Mrs. Pauline A. Muttart, 420 Western $to N. W. It was moved by Fiedler, seconded by Nickson, that the Public Hearing be closed. MOTION CARRIED Brief discussion followed by Councilmen and Jerry Keesee, Sewer Supervisor, was questioned with regard to the tests that had been conducted, and Mr. Keesee advised that two dye tests had been conducted. Dr. McLean, Health Officer, was asked for explanation of hazards which could result from the condition existing where installation of the sanitary sewers will be made. I It was moved by Fiedler, seconded by Fitzsimmons, that whereas a health hazard does exist, that the City Attorney be instructed to prepare necessary legislation for the creation of local improvement district for the purpose of the construction and installation of sanitary sewers along Western Avenue from Main Street to the Northern extremity of Western Avenue. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Mayor Kersey declared Public Hearing open on Resolution No. 400 for the creation of local improvement district for the purpose of the construction and installation of water mains along Western Avenue from Main Street to the Northern extremity of Western Avenue. Mr. Bereiter, City Attorney, advised that protests presented in regard to the Public Hearing on Resolution No. 399 be taken into consideration with regard to Public Hearing on Resolution No. 400, and considered a part of Public Hearing on Resolution No. 400. It was moved by Nickson, seconded by Fiedler, that the Public Hearing be closed. MOTION CARRIED It was moved by Fitzsimmons, seconded by Holman, that Resolution No. 400 for the I creation of local improvement district for the purpose of the construction and installa- tion of water mains along Western Avenue from Màin to the Northern extremity of Western Avenue be approved and the City Attorney be instructed to prepare necessary ordinance for the implementation of local improvement district. It was moved by Sonnemann, seconded by Holman, that the motion be amended to provide that within a period of 30 days following passage of the ordinance creating this local improve- ment district that if 50% or more of the affected property owners object in writing as provided by law, the L.I.D. shall become null and void. MOTION CARRIED Mayor Kersey declared Public Hearing open on Resolution No. 401 for the creation of a AUBURN, WASHINGTON MONDAY JUNE 15, 1970 73 local improvement district for the construction and installation of sanitary sewers a- long 8th Street N .E., from "F" to "K" Streets N .E.; "F" Street N .E. from 7th to 8th Streets N.E., "H" Street N.E. from the extension of 6th Street N.E. to 8th Street N .E.; "I" Street N .E. from 8th to 9th Streets N .E.; 9th Street N .E. from "m to "K" Street N.E.; on an easement along the Easterly boundaries of those properties on the Easterly side of Auburn Way North from 8th to 10th Streets N.E.; and for the purpose of the construction and installation of water mains along 8th Street N.E. from "F" Street N.E. to "H" Street N.E. and from "I" Street N.E. to "K" Street N.E., along "F" Street N.E. from 7th to 8th Streets N. E. The following persons appeared in person and protested the creation of local improvement district for the described area above: I Al Busser, 1003 8th Street N.E.; R. W. Knight, 631 H Street N.E.; Gene Colburn, 801 8th St.; Arthur Eaton, 514 8th st. N.E.; Larry Larson, 711 F Street N.E.; George Nickelsen, 512 7th Street N.E.; Harry Laeske, 1017 8th st. N.E.; Harold Creske, Bill Henline, 925 9th St. N. E.; Jim Shaughnessy, 119 M St. N.E.; R. W. Knight, Bill Bernbeck, 1219 SW 126th, Seattle; Mr. and Mrs. Fred Kludsikofsky, 629 8th N. E.; all speaking in objection to the LID. It was moved by Kline, seconded by Sonnemann, that the Public Hearing be closed. MOT ION CARRIED It was moved by Kline, seconded by Fiedler, that Resolution 401 for the creation of local improvement district be approved and the City Attorney be directed to prepare necessary ordinance for the implementation of such LID and upon receipt of protests of 51% of the property owners affected the LID be declared invalid. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED It was moved by Fiedler, seconded by Kline, that the Plannin g Director be instructed to notify the property owners of their right to protest in writing within thirty days to the LID. MOTION CARRIED Mayor Kersey.declared Public Hearing open on City of Auburn Six Year Street Plan. I Mr. Nevins, Public Works Director, explained the plan to the Council. It was moved by Fiedler, seconded by Holman, that the Public Hearing be closed. MOTION CARRIED It was moved by Sonnemann, seconded by Nickson, that the City of puburn Six Year Street Plan be adopted as proposed and accompanying maps and 1/2¢ gas tax map. ROLL CALL VOTE: All Councilmen voting YES. MOT ION CARRIED CORRESPONDENCE City Clerk Williams read letter of request from John L. Holmes, Library Director, for approval to attend annual American Library Association Convention in Detroit, Michigan, June 28 to July 4, 1970. It was moved by Sonnemann, seconded by Fiedler, that approval be granted for John L. Holmes, to attend the annual American Library Association Convention in Detroit, Michigan, June 28 to July 4, 1970. MOTION CARRIED I City Clerk WIDlliams read notice in Condemnation and for Trial Setting in the matter of the State of Washington vs. Wells B. McCurdy, Trustee, City of Auburn, L.I.D. No. 191, City of Auburn, and Harold R. Iverson and Jane Doe Iverson, his wife. Mayor Kersey advised this was for information and that the material be filed. City Clerk Williams read praecipe for Transcript from N. R. Hebert and L. Kenneth Schoenfeld vs. City of Auburn, together with Notice of Appeal in regard to LID No. 229. Mayor Kersey advised this was for information purposes. PLANNING DEPARTMENT RECOMMENDATIONS The following items were submitted to Call for Public Hearing by Planning Director: 1. Request of John D. Carpenter to construct an addition to the existing dental clinic granted under a S.P.U. located on a parcel of land in the 600 block on the East side of Harvey Road. (Application No. 7-70) 74 AUBURN, WASHINGTON MONDAY JULY 6, 1970 2. Request of Jose Lim and Jucy C. Lim, his wife,; Auburn woman's Club, Inc.; Amos D. Glad; and Western Optical Dispensary, Inc., to rezone from R-4 to C-l, a parcel of land lying on the West side of North Division Street in the 200 block. (Application No. 10-70) It was moved by Kline, seconded by Nickson, that Public Hearing be held on items 1 and 2 above at 8:00 P.M., July 6, 1970. MOTION CARRIED EN GINEERIN G RECOMMENDATIONS The following items were submitted for approval by Pat Nevins, Director of Public Works: Pay Estimate No.1 (final) to General Builders, Inc., for $6,300.00 covering total I supplemental contract on Airport Hangar Buildings covering flood coat and roof graveling. It was moved by Kline, seconded by $bnnemann, that Pay Estimate No. 1 (final) to General Builders, Inc., for $6,300.00 be approved for payment and the City accept the project as complete, and provided no liens or claims are filed and clearance is secured from the State Tax Commission and the Department of Labor and Industries, this amount be paid. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Pay Estimate No.1 to Morris Construction Co., Inc., for LID 238 for $38,832.60. It was moved by Sonnemann, seconded by Fiedler, that Pay Estimate No.1 to Morris Constr- uction Co., Inc., for LID 238 for $38,832.60 be paid. ROLL CALL VOTE: All Councilmen voting YES. MOT ION CARRIED Authorization for Mayor and City Clerk to sign the parking lot lease with Will Andre. It was moved by Holman, seconded by Nickson, that the Mayor and City Clerk be authorized to sign parking lot lease with will Andre. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Authorization to call for bids on the following; I 1. 21st St. S.E. from A to R St. & M st. S.E. from approximately 20th to 22nd S.E. 2. 17th St. S.E. from Auburn Way South to R St. S.E.; R st. S.E. from 17th St. S.E. to 21st st. S.E. It was moved by Sonnemann, seconded by Fitzsimmons, that Public Works Director be author- ized to call for bids on items 1 and 2 above. ROLL CALL VOTE: Councilmen Sonnemann, Shaughnessy, Fitzsimmons, Holman, Nickson and Kline, voting YES. Councilman Fiedler voting NO. MOTION CARRIED Authorization to call for bids for construction of two airport hangar buildings. It was moved by Kline, seconded by Holman, that Public Works Director be authorized to call for bids for construction of two airport hangar buildings. ROLL CALL VOTE: Councilmen Kline, Sonnemann, Shaughnessy, Fitzsimmons, Holman and Nickson voting YES. Councilman Fiedler voting NO. MOT ION CARRIED COUNCIL COMMITTEE REPORTS POLICE AND LICENSE COMMITTEE - Fiedler I It was moved by Fiedler, seconded by Nickson, that the application for "For-Hire Driver's License" from William Elliot Buck be approved. MOTION CARRIED It was moved by Fiedler, seconded by Sonnemann, that the application for "For-Hire Driver's" License from Tommy Alexander Burden be approved. MOTION CARRIED It was moved by Fiedler, seconded by Sonnemann, that Ordinance No. 2468 entitled "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, AMENDING SECTION 14 OF AUBURN CITY ORDINANCE NO. 2463, DEFINING EXEMPTIONS FROM THE CITY OF AUBURN SOLICITOR'S LICENSE REQUIREMENTS" be introduced and adopted. ROLL CALL VOTE: Councilmen Fiedler, Nickson, Kline, Sonnemann, Fitzsimmons and Holman voting YES. Councilman Shaughnessy voting NO. MOTION CARRIED I I I AUBURN, WASHINGTON JUNE 15, 1970 75 MONDAY CODE AND ORDINANCE COMMITTEE - NICKSON Councilman Nickson reported that changes had been made in Ordinance No. 2456 and it was the recommendation of the Committee the ordinance be introduced and adopted at this time. It was moved by Nickson, seconded by Holman, that Ordinance No. 2456 entitled "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, RELATING TO PUBLIC SAFETY AND MORALS AND THE DISSEMINATION OF INDECENT MATERIAL TO JUVENILES WITHIN THE CORPORATE LIMITS OF THE CITY OF AUBURN AND PROVIDING PENALTIES FOR THE VIOLATIONS THEREOF" be introduced and adopted. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED ORDINANCES AND RESOLUTIONS ORDINANCE NO. 2466 It was move~ by Sonnemann, seconded by Holman, that Ordinance No. 2466 entitled "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTCN, PROVIDING FOR THE REZONING OF CERTAIN PROPERTY IN THE CITY OF AUBURN, CHANGING THE ZONING CLASSIFICATION THEREOF FROM R- 3 TO C-3" be introduced and adopted. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED ORDINANCE NO. 2467 It was moved by Holman, seconded by Sonnemann, that Ordinance No. 2467 entitled "AN ORDllJANCE OF THE CITY OF AUBURN, WASHINGTCN, RELATING TO AND PROVIDING FOR THE CONDEMNA- TION OF A TRACT OF LAND BY THE CITY OF AUBURN FOR RIGHT-OF-WAY NEEDED FOR THE CONSTRUCTION OF 15TH STREET NORTHEAST AND NORTHWEST" be introduced and adopted. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED RESOLUTION NO. 415 It was moved by Sonnemann, seconded by Shaughnessy, that Resolution No. 415 entitled "A RESOLUTION OF THE CITY OF AUBURN, WASHINGTON, AUTHORIZING THE MAYOR AND CITY CLERK TO SIGN AN EASEMENT WHICH SUPERSEDES AND CANCELS A PREVIOUS EASEMENT GRANTED BY THE CITY OF AUBURN TO PACIFIC NORTHWEST BELL TELEPHONE COMPANY AS AUTHORIZED BY AUBURN CITY RESOLUTION NO. 391" be introduced and adopted. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED RESOLUTION NO. 416 It was moved by Sonnemann, seconded by Fiedler, that Resolution No. 416 entitled "A RESOLUTION OF THE CITY OF AUBURN, WASHINGTON, ADOPTING THE 1971-1976 BIENNIAL REVISIONS REVISIONS AND EXTENSIONS OF THE COMPREHENSIVE STREET PROGRAM OF THE CITY OF AUBURN PUR- SUANT TO CHAPTER 195, SECTION 2 OF THE LAWS OF THE STATE OF WASHINGTON FOR THE YEAR 1961" be introduced and adopted. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED MISCELLANEOUS BUSINESS City Clerk Williams read Zone Change Application from Earl Harding for change of zoning from R-4 to C-l, property located at 219 No. Division. It was moved by Nickson, seconded by Kline, that Zone Change Application be referred to the Planning Commission. MOTION CARRIED City Clerk Williams read application for Pet Store License from Karl Martinson. It was moved by Nickson, seconded by Kline, that application be referred to the Police and License Committee. MOTION CARRIED It was moved by Kline, seconded by Sonnemann, that the Council meeting be recessed until 11:00 A.M., June 16, 1970. MOTION CARRIED JUNE 16, 1970 - COUNCIL MINUTES The recessed Council Meeting reconvened at 11: A.M., June 16, 1970, with all Councilmen present. Bids were opened on a Call for Bids for sale of $1,000,000.00 par value General Obligation 76 AUBURN , WASHINGTON MONDAY JUNE 16, 1970 Bonds with bids submitted as follows: United California Bank National Bank of Commerce John Nuveen & Co., Inc. United Municipal Investment Corporation Seattle First National Bank 7.3069% 7.3252% 7.3843% 7.39054% 7.470637% All bids were accompanied by Bid Bonds. Mr. Sims, Bond Consultant, recommended the Bid of United California Bank was the best bid received and recommended it be accepted and good faith checks returned to unsuccessful bidders. It was moved by Holman, seconded by Sonnemann, that the bid of United California Bank be accepted and the bid bonds of the unsuccessful bidders be returned. MOTION CARRIED , It was moved by Sonnemann seconded by Shaughnessy, that Mayor Kersey, Councilman Kline, and Councilman Nickson be voting delegates at the Association of washington Cities Conven- tion. MOTION CARRIED It was moved by Kline, seconded by Fiedler, that the meeting be recessed until 7:30 P.M., June 18, 1970, in the Council Chambers. MOTION CARRIED JUNE 18, 1970 - COUNCIL MINUTES The recessed Council Meeting was called to order by Mayor Kersey at 7:30 P.M. with all Councilmen present. Bids were opened at 11: A.M., June 18, 1970 on Call for Bids for L.I.D. It was moved by Kline, seconded by Sonnemann, that contract be awarded to Cascade Asphalt Co. on the low bid of $242,649.75 including sales tax and upon the signing of the contract, subject to the approval of H.U.D. 1/2¢ gas tax, the bid bonds be returned of the unsuccessful bidders. MOTION CARRIED Bids were opened on Call for Bids at 11:06 A.M., June 18, 1970 for Airport Lighting installation, with bids submitted as follows: FOX AND NYSTROM, Kent, Wash. TYEE CONSTRUCTION CO., Bellevue, Wash. APPLIED ENGINEERING, Renton, Wash. WEST COAST ELECTRIC, Kent, Wash. $2,505.30 5,117.70 5,874.75 12,839.40 I The above bids include sales tax; all bids were accompanied by bid bonds. It is the recommendation of the Director of Public Works that the contract for installa- tion of airport runway lighting be awarded to Fox and Nystrom Electric, Kent, Washington, on their low bid of $2,505.30. It was moved by Kline, seconded by Nickson, that the contract for installation of airport runway lighting be awarded to Fox and Nystrom Electric, Kent, Washington, on their low bid of $2,505.30 including sales tax.
