The regular meeting of the City Council of the City of Auburn convened at 8:00 P.M., in
the Council Chambers of the City Hall.
The meeting was called to order by Mayor Kersey.
Councilmen present: Councilmen Kline, Sonnemann, Shaughnessy, Fïtzsimrnons, Holman,
Fiedler and Nickson.
APPROVAL OF MINUTES
It was moved by Holman, seconded by Fïtzsimrnons, that the Minutes of June 15, 1970
Council Meeting be approved as mailed.

PUBLIC HEARINGS
Mayor Kersey declared Public Hearing open on final assessment roll for LID 237, water
main construction on B St. S. E., between 29th Street S. E. & 31st St. S. E.
It was moved by Fiedler, seconded by Sonnemann, that the Public Hearing be closed.
MOTION CARRIED
It was moved by Fiedler, seconded by Sonnemann, that the Final Assessment Roll for
LID 237 be approved and confirmed and the City Attorney be instructed to prepare
necessary ordinance approving and confirming the assessment and assessment roll.
ROLL CALL VOTE: All Councilmen voting YES.

Mayor Kersey declared Public Hearing open on request of Dr. John D. Carpenter to
construct an addition to the existing dental clinic granted under a S. P. U. located on
a parcel of land in the 600 block on the East side of Harvey Road. (Application No. 7-70)
The Planning Commission recommended to the City Council the granting of this request in
conformance with the Plot Plan on file in the Planning Department and that said plot plan
be attached and made a part of the ordinance.
It was moved by Fïedler, seconded by Sonnemann, that the Public Hearing be closed.

It was moved by Sonnemann, seconded by Holman, that the request of Dr. John D. Carpenter
be granted and that the plot plan be made a part of the ordinance and the City Attorney
be instructed to draft necessary ordinance.

Mayor Kersey declared Public Hearing open on request of Jose Lim and Judy C. Lim, his
wife; Auburn ~bman's Club, Inc.; Amos D. Glad; and western Optical Dispensary, Inc., to
rezone from R-4 (Multiple Family) to C-l (Light Commercial), a parcel of land lying on the
West side of North Division Street in the 200 block. (Application No. 10-70)
The Planning Commission recommended to the City Council the granting of this request inas-
much as it conforms to the Comprehensive Land Use Plan of the City of Auburn.
It was moved by Kline, seconded by Nickson, that the Public Hearing be closed.

It was moved by Kline, seconded by Nickson, that the request of Jose Lim and Judy C. Lim,
his wife; Auburn Woman's Club, Inc.; Amos D. Glad; and Western Optical Dispensary, Inc.,
be granted and the City Attorney be instructed to draft the necessary ordinance.

Mayor Kersey declared Puboic Hearing open on petition of Maria Ida Gagnon, Birginia Allen I
and Arthur E. Anderson and Anna B. Anderson, his wife, for vacation of alley situate
between "D" and "E" Streets N. E., north of 4th :5Jtreet N. E. within the corporate limits
of the City of Auburn.
ATthur E. Anderson,.present in audience, stated the property owners have maintained this
strip of land for several years.
It was moved by Fïedler, seconded by Sonnemann, that the Public Hearing be closed.
MOTION CARRIED
It was moved by Fiedler, seconded by Sonnemann, that action be postponed on this request
until a recommendation is submitted from the Street Committee.

City Clerk Williams read letter from Auburn Globe News and merchants of Auburn requesting
authority to hold an old-fashioned summer sidewalk sale on July 16, 17, and 18, 1970.
It was moved by Fiedler, seconded by Holman, that approval be granted for the merchants
and Auburn Globe News for an old-fashioned sidewalk sale on July 16, 17, and 18, 1970.

regarding LID on 14th Street N. E., opposing same.

Edward George, Mr. and Mrs. E. B. LaRosa, Mr. and Mrs. Fred Warberg, Mr. and Mrs. John
D. Grinstead, Mr. and Mrs. Marion Gunderson, Mr. and Mrs. Art Kilgore, Mr. and Mrs. Gordon.

Discussion followed and statements made in the letter were refuted by the Councilmen and
staff.

OF SANITARY SEWERS ALONG WESTERN A VENUE FROM MAIN STREET TO THE NORTHERN EXTREMITY OF
WESTERN AVENUE, INSIDE THE CORPORATE LIMITS OF THE CITY; CREATING AND ESTABLISHING LOCAL
IMPROVEMENT DISTRICT NO. 245; PROVIDING THE METHOD OF ASSESSMENT IN SAID DISTRICT AND THE
MODE OF PAYMENT THEREOF, AND CREATING A LOCAL IMPROVEMEf:iJT FUND THEREFOR" be introduced
and adopted.
It was moved by Fiedler, seconded by Fitzsimmons, that Ordinance No. 2469 be tabled until
the next regularly scheduled Council Meeting.

Mayor Kersey thanked the property owners regarding their efforts to furnish the necessary
correspondence in favor of or objecting to the local improvement districts Nos. 245, 246
and 247.

Creation of LID 248, Curb and Gutter on 21st St. S. E. between R St. S. E. and a
point 42 feet West of the West mgl line of M st. S. E., S of 21st st. S. E. & 110:fi't.

It was moved by Kline, seconded by Sonnemann, that the City Attorney be directed to
prepare necessary ordinance to create LID 248.

15th street S. W. to West Main St., representing estimated cost to City of $53,006.94.
It was moved by Holman, seconded by Sonnemann, that the Mayor and City Clerk be author-
ized to sign resolution covering Washington Highway Department Agreement No. GC 271l.

ized to submit application for P. L. 660 funds and EDA funds in conjunction with gravity I

tion Co. for increase of $124.20 plus tax be approved.

Pumphouse Construction (Water Improvement #70).
It was moved by Nickson, seconded by Sonnemann, that Pay Estimate No. 6 (Final) to
Venture Construction Co. for $4,528.18 be approved for payment and the City accept the
project as complete, and that the retained percentage amounting to $3,499.76 including
sales tax, be paid in thirty days provided no liens or claims are filed and clearance
is secured from the State Tax Commission and the Department of Labor and Industries.

Authority for Mayor and City Clerk to sign Lease Agreement with Sea-Port Development,

PROCLAMATIONS, APPOINTMENTS AND ANNOUNCEMENTS
Mayor Kersey announced that Everett Effland, William Folkes and Jerry Keesee have
successfully completed, with perfect attendance, an 18 week, 54 hour course in waste
Water Operation from the Tacoma Public Schools, Tacoma Vocational-Technical Institute.
Mayor Kersey called attention to the copies of Washington Cattleman publication
presented to the Councilmen containing an article by Roberta Morley.
Mayor Kersey read copy of letter written to the Editor of the Auburn Globe News
commending Len Chapman for the summer baseball program.
Mayor Kersey asked Len Chapman, Director of Parks and Recreation to explain the Summer
Baseball Program.
Mayor Kersey advised that Mr. .$orensen and Mr. Bunn of Metropolitan Transit Service
have made application to the Washington Utilities and Transportation Commission to
discontinue service to the entire Valley.
It was moved by Nickson, seconded by Fiedler, that the City Attorney be directed to
prepare letter of protest to this action on behalf of the City Council

Mayor Kersey complemented City Attorney Bereiter to his appointment as First Vice-
President of the Washington State Municipal Corporation Attorneys Association.

right-of-way on 4th Street N. E

Councilman Nickson advised the audience that it was just a week ago Monday the Committee
learned from the Urban Arterial Board that it was mandatory the City have 60 foot right-
of-way to be eligible for funds from the Urban Arterial Board.
Adda Jones, 322 4th St. N. E., from audience, stated she did not want the street widened
because her house would then be too close to the street.
Councilman Fitzsimmons stated the second 1/2 feet would not affect the property owners
until the area were to became commercial zone, and that the project must go from M Street
to Auburn Way North, which is arterial to arterial.
The question was raised as to who would pay for bulkheads. The Public Works Director
advised the City would pay for the installation of bulkheads and there would be no cost
to the property owners for bulkheads.
The Council recessed for five minutes.

It was moved by Kline, seconded by Sonnemann, that the contract be awaniâd to Rome Co.
on their bid of $45,776.00, and the bid bonds of the unsuccessful bidders be returned (except 3)
and upon signing the contract the bid bonds of the two remaining low bidders be returned.

Alley Vacation (4th Street N. E., North side between "D" and "E" Streets N. E.)
It was moved by Sonnemann, seconded by Shaughnessy, that the alley vacation be approved
subject to the following conditions:
1. That a utility easement be retained by the City for overhead and underground
public utilities.
2. That the South 5 feet of that portion of the alley being requested for vacation
be retained for the widening of the right-of-way for 4th Street N. E. to a 60-
foot width, and City Attorney be instructed to draw up ordinance.
ROLL CALL VOTE: All Councilmen voting YES.

The question of underground and overhead power on 14th street was considered at this
time and Councilman Shaughnessy stated it was felt that Puget Sound Power and Light
Company should be forced to comply with the City underground overhead ordinance and
the Public Works Department should stop work on 14th Street as far as the overhead
poles that are on location.

Jim Micheuls, 1022 14th Street N. E., was recognized and stated he represented ten
property owners, inquiring as to cost to property owners to underground and what
the costs would be if the City participated. It was brought out that 51% of the
property owners wanted no more taxes or assessments.
After brief discussion it was moved by Kline, seconded by Fitzsimmons, that a variance
to underground ordinance be applied for through the Utility Canmittee and directed
the Department of Public Works to prepare a petition to be circulated by Mr. Micheuls
in the area and presented to the Urility Committee for consideration on the matter
July 15, 1970.
