The meeting was called to order by Mayor Kersey. Councilmen present: Councilman Kline, Sonnemann, Shaughnessy, Fitzsimmons, Holman, Fiedler and Nickson. APPROVAL OF MINUTES It was moved by Sonnemann, seconded by Shaughnessy, that the Minutes of July 20, 1970 Council Meeting be approved as mailed. MOTION CARRIED PUBLIC HEARINGS Mayor Kersey declared Public Hearing open on request of Earl Harding to rezone from R-4 (Multiple Family Dwellings) to C-l (Light Commercial), a parcel of land on the West side of North Division Street between 2nd and 3rd Streets N. W. (Application No. 12-70) The Planning Commission recommends to the City Council the granting of this request inasmuch as it conforms with the Comprehensive Land Use Plan of the City of Auburn. It was moved by Fiedler, seconded by Sonnemann, that the Public Hearing be closed. MOTION CARRIED It was moved by Sonnemann, seconded by Fiedler, that request of Earl Harding be granted to rezone from R-4 to C-l and that the City Attorney be instructed to draw up necessary ordinance granting rezone. MOTION CARRIED CORRESPQNDENCE City Clerk 1Nilliams read Zone Change application from Archie Meade, dba Valley Sand and Gravel, Inc., property located Auburn Way South and Dogwood Street S.E. It was moved by Fiedler, seconded by Sonnemann, that zone change application from Archie Meade be referred to the Planning Commission. MOTION CARRIED City Clerk Williams read petition for vacation of street right-of-way, property located East of cst. N. E. and North of 30th N. E. It was moved by Sonnemann, seconded by Kline, that the City Attorney be instructed to prepare necessary resolution to call for Public Hearing on petition for vacation of street right-Of-way with hearing to be held September 8, 1970 at 8:00 P.M. MOTION CARRIED City Clerk Williams read letter from John M. Howell, Public Relations Representative of Auburn Academy regarding underground electrical installation. Mayor Kersey requested the letter be referred to the City Attorney. City Clerk williams read letter from Jerry L. Keesee, Lt. Col., CAP CD Coordinator, re- garding Civil Defense Effectiveness Test 1970. Mayor Kersey requested the letter be filed. City Clerk Williams read letter_ from Director of Public Works, requesting approval of segregation of assessment Nos. 26, 27, 28 and 29, LID No. 208A, total assessments in the sum of $12,010.60. It was moved by Kline, seconded by Nickson, that segregation of assessm&~t Nos. 26, 27, 28 and 29, LID No. 208A be approved. MOTION CARRIED City Clerk Williams read letter from John D. 5pellman, regarding Aukeen Justice Court Lease. Mayor Kersey requested the letter be referred to the Finance Committee. AUDIENCE PARTICIPATION Ralph E. Franklin, 2515 Seattle First National Bank Building, representing Spragues, Inc. from audience asked when the Golf Course will be completed. Councilman Fitzsimmons advised the project will be completed this week. 92 AUBURN, WASHINGTON MONDAY AUGUST 3 , 1970 BID OPENINGS Bids were opened on Call for Bids at 11:00 A.M., July 30, 1970 on L.I.D. The Director of Public Works recommends that C. J. Rockey Construction Company be awarded the contract on LIDs 240 and 251 on their low bid of $32,029.31. It was moved by Sonnemann, seconded by Holman, that C. J. Rockey Construction Co. be awarded the contract on LIDs 240 and 251 on their low bid of $32,029.31, and the Mayor and City Clerk be authorized to sign the contract, and that the Bid Bonds of the two highest unsuccessful bidders be returned immediately, and upon signing of the contract the Bid Bonds be returned to Morris Construction Company and Lloyds of 'Washington. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED RECOMMENDATIONS The following items were submitted by the Director of Public Works for approval: Creation of LID 252, electrical underground for West Main Street; estimated cost of improvements $9,678.85. It was moved by Kline, seconded by Nickson, that the City Attorney be instructed to draw up necessary ordinance to create LID 252. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED 1 Request to Call for Bids for Main Street improvements from "B" Street S. W., to West Valley Highway. It was moved by Sonnemann, seconded by Nickson, that the Director of Public Works be authorized to call for bids for Main Street improvements from "B" Street S. W. to West Valley Highway. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Authority for Mayor and City Clerk to sign contract with Redford Engineers for "B" Street S. W. from Main Street to 2nd st. S. W. It was moved by Fiedler, seconded by Sonnemann, that the Mayor and City Clerk be authorized to sign contract with Redford Engineers for "B" St. S. W. from Main Street to 2nd St. S. W. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Final Pay Estimate No. 5 to Cascade Asphalt Paving Co. for st. Imp. 106 Ph II, (37th St. N.E.IN.W. construction) for $2,597.03. It was moved by Sonnemann, seconded by Shaughnessy, that Pay Estimate No.5 (final) to Cascade Asphalt Paving Co. for $2,597.03 be paid, and the City accept the project as complete, and that the retained percentage amounting to $6,530.24 including sales tax, be paid in thirty days provided no liens or claims are filed and clearance is secured I· from the State Tax Commission and the Department of Labor and Industries. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Final Pay Estimate No.2, to Lloyds of Washington for $7,189.53 for Tennis Court Construction (Les Gove Park). It was moved by Fiedler, seconded by Holman, that Final Pay Estimate No. 2 to Lloyds of Washington for $7,189.53 be paid and the City accept the project as complete, and that the retained percentage amounting to $1,398.22 including sales tax, be paid in thirty days provided no liens or claims are filed and clearance is secured from the State Tax Commission and the Department of Labor and Industries. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED 1 1 1 AUBURN, WASHINGTON MONDAY AUGUST 3, 1970 (:t3- t _ Final Pay Estimate No 8 to Spragues, Inc., calling for payment of retainage pending receipt of proper releases for $14,438.97. It was moved by Kline, seconded by Sonnemann, that the contract be accepted as complete, and that Spragues, Inc. be paid the retained percentage pending receipt of proper releases in the amount of $14,438.97, and subject to Golf Course Committee approval. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Authority for Mayor and City Clerk to sign resolution for Agreement No. GC-2757 with State Highway Commission covering relocation of utilities on Valley Freeway from Ellingson Road to 15th St. S. W. It was moved by Holman, seconded by Sonnemann, that the Mayor and City Clerk be authorized to sign resolution for Agreement No. GC-2757 with State Highway Commission, for relocation of utilities on Valley Freeway from Ellingson Road to 15th st. S. W. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Pay Estimate No. 1 (final) to Fox & Nystrom Electric for Airport Runway Lighting for the total of $2,266.70. It was moved by Fitzsimmons, seconded by Shaughnessy, that the project be accepted as complete and Pay Estimate No.1 (final) to Fox & Nystrom Electric for $2,266.70 be paid, and that the retained percentage amounting to $238.60, including sales tax, be paid in thirty days provided no liens or claims are filed and clearance is secured from the State Tax Commission and the Department of Labor and Industries. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Change Order #5 in the amount pf $200.00 for furnishing locks and installation by General Builders at Airport Hangar Buildings. It was moved by Kline, seconded by Holman, that Change Order No. 5 to General Builders in the sum of $200.00 be approved. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Acceptance of Airport Hangar Buildings in the sum of $4,800.00 retained percentage. It was moved by Kline, seconded by Holman, that the City accept the Airport Hangar Buildings project as complete and that the retained percentage of $4,800.00 be paid General Builders. ROLL CALL VOTE: Councilmen Kline, Sonnemann, Shaughnessy, Fitzsimmons, Holman and Nickson, voting YES. Councilman Fiedler voting NO. MOTION CARRIED PROCLAMATIONS, APPOINTMENTS ,AND ANNOUNCEMENTS City Clerk Williams read letter from Ish Suyematsu, Chairman, Bon Festival, of the White River Buddhist Church, being invitation to annual Bon dance on Saturday, Aug. 8, 1970. Mayor Kersey requested the letter be filed. COUNCIL COMMITTEE REPORTS AIRPORT COMMITTEE - KLINE Councilman Kline stated that Public Works Department has called for bids for Airport Hangar Doors. The Airport Committee will meet August 6, 1970 at 7:30 P.M. FINANCE COMMITTEE - KLINE Councilman Kline, reporting for Finance Committee, stated the Committee reviewed the preliminary budget and made tentative approval of same. The Finance Committee will travel to Seattle for the next meeting to observe and evaluate processing data systems and the Councilmen who desire to accompany the Committee are invited. It is expected they will depart from City Hall at 5:30 P.M. It was moved by Kline, seconded by Holman, that the Director of Finance be authorized to invest for a period of 90 days the sum of $300,000.00 in certificates of deposit. ROLL CALL VOTE: Councilman Kline voting NO. All other Councilmen voting YES. MOTION CARRIED 94 AUBURN WASHINGTON MONDAY AUGUST 3 1970 The Park Board has requested the approval to expend the sum of $1,500.00 to obtain appraisals, photographs for the anticipated acquisition of 22 acres north of Cascade Jr. High 'School. It was moved by Kline, seconded by Fiedler, that the Park Board be authorized to expend up to $1,500.00 provided they can find this amount of money in their budget to obtain appraisals and photographs of the property. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED POLICE AND LICENSE COMMITTEE - FIEDLER It was moved by Fiedler, seconded by Sonnemann, that the application for license of Valley Transmission and Towing be approved. I ROLL CALL VOTE: Councilmen Fiedler, Nickson, Sonnemann, Shaughnessy and Holman voting YES. Councilman Kline voting NO. Councilman Fitzsimmons ABSTAINED. MOTION CARRIED Councilman Fiedler stated the Police and License Committee recommend the introduction and adoptiong of Ordinance No. 2482. CODE AND ORDINANCE COMMITTEE - NICKSON Councilman Nickson announced that the Code and Ordinance Committee will meet August 11, 1970 at 7:30 P.M. OLD BUSINESS It was moved by Fiedler, seconded by Kline, that Ordinance No. 2472, tabled July 6, 1970, entitled "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTOO, RELATING TO AND PROVIDING FOR THE CONDEMNATION OF A TRACT OF LAND BY THE CITY OF AUBURN FOR THE PURPOSE OF ACQUISITION OF RIGHT-OF-WAY FOR 4TH STREET NORTHEAST BETWEEN AUBURN WAY NORTH AND "E" STREET NORTH- EAST" be introduced and adopted. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED 1 It was moved by Fitzsimmons, seconded by Shaughnessy, that the Mayor and City Clerk be authorized to sign the original proposal agreement between Algona and Pacific and the City of Auburn for sewer service at the rate of 13-Y~ per hundred cubic feet for the first year and 16-~¢ per hundred cubic feet for the second year, and that the Finance Department notify Algona and Pacific and Jerry Thomas of the Bonding Company. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED NEW BUSINESS City Clerk Williams read proposed annexation petition for Southwest Annexation (Jovita Heights) to the City of Auburn. Councilman Sonnemann announced there would be a Public Meeting on proposed annexation at 7:00 P.M., August 10, 1970 in the Council Chambers, to consider the petition. ORDINANCES AND RESOLUTIONS ORDINANCE NO. 2481 It was moved by Sonnemann, seconded by Fiedler, that Ordinance No. 2481 entitled "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR THE CONSTRUCTION AND INSTALLA- TION OF EXCAVATION, BALLASTING, ASPHALT CONCRETE SURFACING, CURB & GUTTER, AND STORM DRAINAGE ALONG 5TH STREET N..E. BETWEEN THE FIRST ALLEY WEST OF "A" STREET N. E. AND THE WESTERLY BOUNDARY OF THE PLAT OF THE NEW AUBURN ADDITION, NORTH DIVISION STREET 1 BETWEEN 5TH STREET N. E. It was moved by Kline, seconded by Fitzsimmons, that Ordinance No. 2483 be introduced only and that prior to the next Council Meeting that copies of ordinance be furnished to the Councilmen for perusal. It was moved by Fiedler, seconed by Holman, that Ordinance No. 2483 be tabled until August 17, 1970, and that copies of the ordinance be distributed to the Council. MOTION CARRIED ORDINANCE NO. 2484 It was moved by Holman, seconded by Nickson, that Ordinance No. 2484 entitled "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDINGTFOR THE CONSTRUCTION AND INSTALLATION OF UNDERGROUND POWER LINES ALONG WEST MAIN STREET, BETWEEN THE BURLINGTON NORTHERN RAILROAD RIGHT-OF-WAY TO THE WEST VALLEY HIGHWAY, INSIDE THE CORPORATE LIMITS OF THE CITY, CREATIN G AND ESTABLISHING LOCAL IMPROVEMENT DISTRICT NO. 252; PROVIDING THE METHOD OF ASSESSMENT IN SAID DISTRICT AND THE MODE OF PAYMENT THEREOF, AND CREATING A LOCAL IMPROVEMENT FUND THEREFORII be introduced and adopted. MOTION CARRIED RESOLUTION NO. 423 It was moved by Sonnemann, seconded by Fiedler, that Resolution No. 423 entitled "A RESOLUTION OF THE CITY OF AUBURN, WASHINGTON, RELATING TO THE PROPOSED VACATION OF A CERTAIN STREET RIGHT-OF-WAY WITHIN THE CORPORATE LIMITS OF THE CITY OF AUBURNII be introduced and adopted. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED APPROVAL OF VOUCHERS AND TRANSFERS It was moved by Fitzsimmons, seconded by Holman, that voucher approval and department list in the sum of $215,796.01 be approved for payment.(Corrected amount $215~¡84.90) Warrant Nos. 1438 through 1701. Payroll Warrants #2564 through 3026 - Amount $138,455.94. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED MISCELLANEOUS BUSINESS City Clerk Wïlliams read Special Property Use Permit Application from Dr. John B. Carpenter for addition to existing Dental Clinic. It was moved by Kline, seconded by Fiedler, the application be referred to Planning Commission. 96 AUBURN, WASHINGTON MONDAY AUGUST 3 , 1970 City Clerk Williams read letter from Auburn Area Chamber of Commerce regarding loading zone on Main Street in front of the Auburn Globe News office, requesting that loading zone be eliminated and the stalls put back to parking spaces. It waa,~oved by Fiedler, seconded by Holman, that the loading zone be put back into parking stalls. It was moved by Kline, seconded by Shaughnessy, that the motion be amended SUBJECT to approval of the Street Committee. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED It was moved by Kline, seconded by Shaughnessy, there being no further business to come before the Council, the meeting adjourn at 9:45 P.M.
