HomeMy WebLinkAbout09-08-1970 102 AUBURN, WASHINGTON TUESDAY SEPTEMBER 8, 1970 The regular meeting of the City Council of the City of Auburn convened at 8:00 P.M. in the Council Chambers of the City Hall. The meeting was called to order by Mayor Kersey. Councilmen present: Councilman Kline, Sonnemann, Shaughnessy, Fitzsimmons, Holman, Fiedler and Nickson. APPROVAL OF MINUTES It was moved by Holman, seconded by Fiedler, that the Minutes of August 17, lQ70 Council Meeting be approved as mailed. MOTION CARRIED PUBLIC HEARINGS Mayor Kersey declared Public Hearing open on request of Mark A. Hedman (Hedman Construction Company) to rezone from R-4 (Multiple Family Dwellings) to Special Property Use for professional offices, a parcel of land located at 1214 "G" Street S.E. (Application No. 14-70) The Planning Commission recommended denial of this request. The following persons appeared in person to voice objections to the proposed rezone request: Charles L. Ludwig, 1303 G St. S.E., P. F. Morgan, 1407 G St. S.E., John S. Atkinson, 1509 G St. S.E., FrankO. Brown, 1508 G St. S.E., William Wilcox, 1404 G St. S.E., Daniel G. Erickson, 1213 G St. S.E., Robert W. Payne, 1403 G St. S.E. It was moved by Fiedler, seconded by Holman, that the Public Hearing be closed. MOTION CARRIED It was moved by Kline, seconded by Holman, that the request to rezone from Mark A. Hedman be denied. MOTIQN. .CARRIED Mayor Kersey declared Public Hearing open on Amendment to Comprehensive Land Use PlaA revising the City of Auburn for that area legally described as follows: Land area lying East of Auburn Way North; North of an extended line of 30th Street N. E.; West of an extended 1 i ne of "M" Street N. E.; and South of the North boundary of the existing City Limits. The Planning Commission recommend to the City Council the following changes to the City of Auburn Comprehensive Land Use Plan for their approval. 1. That the West line of the proposed land use change for industrial purposes be established along "1" Street N.E. and "1" Street extended on its present alignment. 2. That the North line of said landuse change be established on the North line of Section 6, Township 21 North, Range 5 East, W.M. (288th Street). 3. That the South line of said land use change be established on the extended alignment of 30th Street N.E. extended Easterly. 4. That the East line of said land use change be established 300 feet West of the extended alignment of "M" Street N.E. projected North in a straight line from its present terminus at 26th Street N.E. 5. That the area lying adjacent to the West line of "M" Street N.E. extended and the East line of the proposed land use change, as outlined in Item I, be reclassified to Multi-Family dewllings with a density not to exceed twenty- five (25) units per acre. 6. That the new industrial area be restricted to industrial park purposes and that no rezoning be considered until an industrial park classification has been incorporated into our zoning ordinance. Councilman Fiedler asked George Schuler, Planning Director, to explain the changes on the map. It was moved by Kline, seconded by Fiedler, that the Public Hearing be closed. MOTION CARRI ED It was moved by Shaughnessy, seconded by Kl i ne, that acti on by the Council on Amendment to Comprehensive Land Use Plan revising the City of Auburn be tabled until September 21, 1970 Council Meeting. MOTION CARRI ED Mayor Kersey declared Public Hearing open on request of Kenneth Thompson and George Belden relating to proposed vacation of certain Street right-of-way situate West of Auburn Way North, East of "C" Street N.W. and North of 30th Street N.E. It was moved by Sonnemann, seconded by Nickson, that the Public Hearing be closed. MOTION CARRIED It was moved by Kline, seconded by Nickson, that the request for vacation of street submitted by Kenneth Thompson and George Belden be referred to the Street Committee for report back. MOTION CARRI ED CORRESPONDENCE City Clerk Williams read request for approval of segregation of assessment for No. 27 on L.I.D. 228 in the sum of $4,851.57 from the Department of Public Works. It was moved by Nickson, seconded by Kline, that segregation of assessment No. 27 be approved. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED City Clerk ~il1iams read request for approval of segregation of assessment No. 27 on L.I.D. 227 in the sum of $3,159.99 from the Department of Public Works. It was moved by Nickson, seconded by Sonnemann, that segregation of assessment No. 27 be approved. ROLL CALL VOTE: All Councilmen voting YES. MOTION. CARRIED City Clerk Wl11iams read letter from residents near intersection of Main and M Streets with regard to traffic signals. Mayor Kersey requested the letter be referred to the Street Committee. City Clerk Williams read letter from Department of Health, State of Washington, regarding approval of plans and specification for Main Street Improvements, schedule No.2, Water Mains. Mayor Kersey requested the letter be filed with copy to Public Works Department. City Clerk Williams read request to circulate petition from Lawrence K. Smith, Jr. and David L. Smith, and Marilyn S. Gamble. Mayor Kersey requested the request be referred to the Annexation and Housing Committee. City Clerk Williams read letter from Postmaster Ben Morse regarding rr grade crossings. Mayor Kersey requested the letter be filed. BID OPENINGS Bids were opened at 11 :00 A.M., on Call for Bids for Street Improvement 122, (street improvements and water main construction on West Main Street, A St. S.E. to West Valley Highway) with bids submitted as follows: BIDDER SCHEDULE I, IB, IC, IE AND SCHEDULE 2 TRI-STATE R. It is the recommendation of the Public Works Dept. that cont~act be awarded to the low bidder, Tri-State Construction, for their low bid of $336,449.54 including applicable sales tax. It was moved by Sonnemann, seconded by Fiedler, that the bid of Cascade Asphalt Paving Co. be rejected for the reason it was incomplete. motion carried It was moved by Sonnemann, seconded by Fiedler, that contract be awarded to Tri-State for the sum of $336,449.54 including sales tax, subject to approval from HUD. I It was moved by Kline, seconded by Sonnemann, that the motion be amended to waive any informalities in the bid of Tri-State. ROLL CALL VOTE ON AMENDMENT: All Councilmen Voting YES. MOTION CARRI ED It was moved by Sonnemann, seconded by Fitzsimmons, that the Bid Bonds of all but the three lowest bidders be returned, and upon signing contract the Bid Bonds of the unsuccessful bidders be returned. MOTION CARRIED Bids were opened at 11 :00 A.M., Sept. 8,1970 on Call for Bids on LID 249 (sanitary sewer construction on 12th St. S.e. from W of "F11 Street to E of "G" Street S.E.) with bids submitted as follows: BIDDER C. It is the recommendation of the Public Works Dept. that LID 249 contract be awarded to C. J. Rockey Construction Company on their low bid of $7,690.31 including sales tax. MOTION CARRIED It was moved by Fitzsimmons, seconded by Kline, that the bid bonds of the two highest bidders be returned, and that upon signing of contract bid bonds of the two remaining bidders be returned. MOTION CARRIED RECOMMENDATIONS The followin g items were submitted by the Director of Public Works for Council approval: Change Order No.1 to Campbell Construction Co. for Sanitary Sewer Imp. #11 for increase of $88.05 covering installation of side sewers to coinside with elevation of new sewer line (alley between E & F Sts. S.E., between 2nd & 4th) It was moved by Fitzsimmons, seconded by Shaughnessy, that Change Order No.1 to Campbell Construction Co., be approved. ROLL CALL VOTE: All Councilmen voting YES. I MOTION CARRIED Pay Estimate No.1 (final) to Campbell Const. Co. for sanitary sewer Imp. #11 (replacement of old sewer main alley between E & F Sts. S.E. between 2nd & 4th) for $4,499.44. It was moved by Shaughnessy, seconded by Fitzsimmons, that Pay Estimate No.1 (final) to Campbell Const. Co. for $4,499.44 be paid and the project be accepted as complete and that the retained percentage ~ounting to $473.63 including sales tax be paid in thirty days provided no liens or claims are filed and clearance is secured from the State Tax CommissiQn qnq the Department of Labor and Industries. MOTION CARRIED Pay Estimate No.1 to Cl J. Rockey Co., Inc. for St. Imp. 121 (21st St. S.E. "A" to "R" Sts. S.E.) for $1,562.28. It was moved by Nickson, seconded by Sonnemann, that Pay Estimate No.1 to C.J. Rockey Co., Inc. for $1,562.28 be paid. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Pay Estimate No.1 to Cascade Asphalt Paving Co. for St. Imp. 115, L.I.D. 243, HUD #98, (4th St. N.E. from AWN to M St. N.E.) for $12,495.52. MOTION CARRIE.'D Authority for Mayor and City Clerk to sign resolution adopting GSA Sewage Disposal Contract. It was moved by Fitzsimmons, seconded by Holman that the Mayor and City Clerk be authorized to sign resolution adopting GSA Sewage Disposal contract. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRI ED Permission to call for Bids on Sanitary Sewer Imp. #12 (relocation of sanitary sewer in vicinity of new swimming pool). It was moved by Nickson, seconded by Holman, that the Department of Public Works be authorized to call for Bids on Sanitary Sewer Imp. #12. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Authority to call for Bids on Sanitary Sewer Improvement No. 13 (replacement of sanitary sewer betweelT "D" and "H" Sts. on 2nd St. N. W. It was moved by Holman, seconded by Fitzsimmons, that the Public Works be authorized to call for bids on Sanitary Sewer Improvement No. 12. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED. PROCLAMATIONS, APPOINTMENTS AND ANNOUNCEMENTS City Clerk Williams read letter from R. K. Calkins, Chief of the Auburn Fire Dept. thanking personnel in the Police Dept., Park Dept. and Street Deot., for help during the crisis created by gas main break on August 26. Mayor Kersey requested the letter be filed with copies to the deoartments. COUNCIL COMMITTEE REPORTS FINANCE COMMITTEE - KLINE Councilman Kline, reporting for the Finance Committee, stated the committee will have some recommendations in the area of up-dating the accounting system for the City of Auburn. Councilman Kline reported the committee has studied the matter of the Aukeen District Court and the committee recommends that the City of Auburn withdraw from the Aukeen Court as far as Municipal Court cases and participation in the budget of the Municipal Court. ~ AUBURN, WASHINGTON TUESDAY SEPTEMBER 8, 1970 It was moved by Kline, seconded by Sonnemann, that the City Attorney be authorized to prepare a letter stating the intent of the City of Auburn to use the Filing Fee procedure in 1971 for court costs to become effective February 1, 1971. MOTION CARRIED AIRPORT COMMITTEE - KLINE Councilman Kline, reporting for the Airport Committee, stated that Pat Nevins has reported to the Committee that Cressy Doors Company does not have I.C.B.O. aoproval on their product required by the Uniform Building Code. It is the recommendation of the Airport Committee that the bid be reconsidered and the contract be awarded to the second low bidder, R. L. Kuss and Co. STREET, ENGINEERING, PLANNING AND EQUIPMENT MAINTENANCE COMMITTEE - SONNEMANN . Councilman Sonnemann, reporting for the Street Committee, stated it was the recommenda- tion of the Committee that Ordinance No. 2489 be introduced and adopted with corrections being made under Item #10 and #28. It was moved by Sonnemann, seconded by Fitzsimmons, that Ordinance No. 2489 entitled "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, REPEALING AUBURN CODIFIED CITY ORDINANCE 9.04.170 (a) AND ADDING A NEW AUBURN CODIFIED CITY ORDINANCE 9.04.170 RELATING TO AND REGULATING SPEED LIMITS UPON THE PUBLIC STREETS AND OTHER WAYS OPEN TO THE PUBLIC WITHIN THE CORPORATE LIMITS OF THE CITY OF AUBURN. II be introduced and adopted. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED I Councilman Sonnemann advised the Street Committee will meet September 9, 1970. POLICE AND LICENSE COMMITTEE - FIEDLER Councilman Fiedler ævised the Committee recommend revising the Taxicab Ordinance to reflect that all applications will be approved by application to the City Clerk, approved by the Chief of Police and providing for appeal to the Police and License Committee. It was moved by Fiedler, seconded by Sonnemann, that the aty Attorney be instructed to draft resolution for the City of Auburn ~otesting the limits of Federal Way to extend to East of Interstate 5. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED OLD BUSINESS It was moved by Kline, seconded by Sonnemann, that the award of bid to Cressy Door Co., be brought back to the floor to be reconsidered. mOTION CARRIED It was moved by Kline, seconded by Fitzsimmons, that the bid for Airoort Hangar Doors I be awarded to R. L. Kuss Co., Inc. on their bid ~f $26,145.00, subject to approval of the shop drawings by the ~rector of Public Works for the reason that Cressy Door Company does not have I.C.B.O. approval on their product required by the Uniform Building Code. MOTI ON CARR lED APPROVAL OF VOUCHERS AND TRANSFERS It was moved by Fitzsimmons, seconded by Holman, that voucher approval and department list in the sum of $150,315.37 be approved for payment. Claims Warrants 1702 through 1918--corrected amount $197,216.33. Payroll warrants #3027 through 3459 in the amount of $136,507.26. ROLLCALL VOTE: All Councilmen voting YES. MOTION CARRIED MISCELLANEOUS BUSINESS City Clerk Williams read letter from Department of Health regarding Street Improvement No. 115, Water Main Construction, approving plans for project. Mayor Kersey requested the letter be filed with copy to Public Works. There being no further business to come before the Council, it was moved by Fiedler, seconded by Fitzsimmons, that the meeting adjourn at 10:04 P.M.
