The meeting was called to order by Mayor Kersey. Councilmen present: Councilman Kline, Sonnemann, Shaughnessy, Darling, Holman, Fiedler and Nickson. APPROVAL OF MINUTES Mayor Kersey reported that the Bids for Mt. View Cemetery Reception were reported in the October 19, 1970 Council Minutes as "including sales tax" and the minutes should be amended to delete "the above bids did include sales tax". It was moved by Nickson, seconded by Holman, that the Minutes of October 19, 1970 be amended to read "the above bids did not include sales tax". MOTION CARRIED It was moved by Fiedler, seconded by Nickson, that the October 19, 1970 Council Minutes be approved as amended. MOTION CARRIED CORRESPONDENCE City Clerk Williams read petition for annexation of property in Southwest Auburn area. It was moved by Sonnemann, seconded by Shaughnessy, that a Public Hearing be held on petition for annexation of property in Southwest Auburn area, at 8:00 P.M., November 16, 1970. RECOMMENDATIONS The following items were submitted for approval by the Council from the Director of Public Works: Change Order No.1 to Cascade Asphalt Paving Co. for St. Imp. 115 for increase of $45.00, installation of bend and additional concrete pipe and gravel. It was moved by Nickson, seconded by HOlman, that Change Order No. 1 to Cascade Asphalt Paving Co. for increase of $45.00 be approved. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Authority to hold Public Hearing on assessment roll for LID 249, public hearing to be held December 21, 1970. It was moved by Holman, seconded by Nickson, that Public Hearing be held on assessment roll for LID 249 at 8:00 P.M., December 21, 1970. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Permission to call for bids on improvements on the following intersections; a. Auburn Avenue and 1st St. N. E. b. East Main and M Streets c. Dogwood Street and Auburn Way South. It was moved by Nickson, seconded by Darling, that the Public Works Director be author- ized to call for bids on improvements on the following intersections: a. Auburn Avenue and 1st st. N. E. b. East Main and M Streets. c. Dogwood Street and Auburn Way South. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Change Order No.1 to C. J. Rockey Co., Inc., for LID 249 (12th St. S.E.) for increase of $179.99 installation of 4-inch cast iron pipe to maintain necessary slope for side sewer. It was moved by Nickson, seconded by Fiedler, that Change Order No.1 to C. J. Rockey Co., Inc. for increase of $179.99 be approved. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Pay Estimate No.2 (final) to C. J. Rockey Co., Inc. for LID 249 (Sanitary Sewer on 12th st. S. E.) for $2,410.85. It was moved by Shaughnessy, seconded bYJNickson, that Pay Estimate No.2 (final) to C. J. Rockey Co., Inc. for $2,410.85 be approved for payment and the city accept the 128 AUBURN, WASHINGTON MONDAY NOVEMBER 2, 1970 project as complete, and that the retained percentage amounting to $758.76, including sales tax, be paid in t~rty days provided no liens or claims are filed and clearance is secured from the State Tax Commission and the Department of Labor and Industries. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Pay Estimate No.3 to C. J. Rockey Co., Inc. for St. Imp. 121, 21st st. S. E. construction, for $14,287.40. It was moved by Nickson, seconded by Darling, that Pay Estimate No.3 to C. J. Rockey Co., Inc. for $14,287.40 be approved for payment. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED I Pay Estimate No.2 to C. J. Rockey Co., Inc. for LID 251 (street construction on 5th St. N. E. & Division st. No.) for $434.97. It was moved by Nickson, seconded by Darling, that Pay Estimate No.2 to C. J. Rockey Co., Inc., for $434.97 be approvêd for payment. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Pay Estimate No.1 to C. J. Rockey Co., Inc. for LID 240 (water main & sanitary sewer construction on Hemlock st. S. E. & 21st St. S. E.) for $10,261.74. It was moved Thy Shaughnessy, seconded by '$onnemann, that Pay Estimate No. 1 to C. J. Rockey Co., Inc. for $10,261.74 be approved for payment. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Pay Estimate No. 3 and Nö..4 HUDportion to Cascade Asphalt Paving Co. for St. Improvement No. 115 (4th St. N. E.) for $43,379.78, HUD portion $2,598.25. It was moved by Darling, seconded by Nickson, that Pay Estimate No. 3 and No. 4 HUD portion to Cascade Asphalt Paving Co. for $43,379.78, HUD portion $2,598.25 be approved for payment. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED I Pay Estimate No. 4 to Cascade Asphalt Paving Co. for LID 236 (14th st. N.E. construction) for $22,542.77. It was moved by Nickson, seconded by Holman, that Pay Estimate No. 4 to Cascade Asphalt Paving Co. for $22,542.77 be approved. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED COUNCIL COMMITTEE REPORTS AIRPORT COMMITTEE - KLINE Councilman Kline, reporting for Airport Committee, stated the Airport Committee met on October 22, 1970 and discussed the proposals received by the Department of Public Works to perform work on the Airport Service Road Extension and it was the decision of iihe Committee to authorize M. A. Segale to perform the work providing that they are willing to do the work for a unit price amount within 2% of the Engineer's estimate. Councilman Kline reported the Committee also decided to have M. A. Segale install pit run, crushed rock and asphalt paving approximately 12 feet by 400 feet area north of Building H-S, providing they are willing to do this for approximately the same unit cost that they are to receive for the service road. FINANCE, BUDGET AND CITY EFFICIENCY COMMITTEE - KLINE I Councilman Kline reported the Committee met on October 2 9 and had reviewed progress report from Price Waterhouse and IBM and that progress is on schedule. Preliminary Budget was reviewed and certain recommendations were made, the sum of $7,710.00 in Planning and Community Development Division for the third building inspector to be deleted and funds transferred to the Police Department for the hiring of a Juvenile Officer to work with young adults, being a female officer, to work to a better relation- ship and greater in-depth understanding in the area with the young adults in our community. The Finance Committee recommends the position of Traffic Engineer be deleted along with the salary and equipment budgeted funds be deleted. Mr. Dray, Chairman of the Park Board Committee, Len Chapman, Director of Parks and Recreation, and Roger Masuda, Price Waterhouse are requested to be present at the next Finance, Budget and City Efficiency Committee meeting. I I I AID3URN, WASHINGTON UTILITY COMMITTEE - SHAUGHNESSY MONDAY NOVEMBER 2, 1970 12H Councilman Shaughnessy, reporting for Utility Committee, stated the Committee had re- viewed the utility cost study being conducted by Northwest American regarding cost equitability between developers and the city, and shortly, costs (both immediately and in the futurecfor development program) will be available. The request from Puget Power for variance to underground electrical ordinance was disapproved. The Committee did approve relocation of overhead power line on "M" Street S. E. between Auburn Way South and approximately 19th Street S. E. The Committee approved a delay for under grounding of Cor-Tec's electrical service on West Main of one year or until issuance of a building permit for pl~ expansion. PLANNING, BEAUTIFICATION AND BUILDING CODES COMMITTEE - DARLING Councilman Darling, reporting for Planning, Beautification and Building Codes Committee, stated that King County Design Commission ÌRs approved hiring Sprout Engineers and Associates, Inc. as consulting landscape architect for the beautification program and further information will be forthcoming with regard to Step #l. The next meeting will be held November 12, 1970 at 7:30 P.M. LICENSE COMMITTEE - FIEDLER Councilman Fiedler reported the License Committee will meet November 5, 1970 at 7:30 P.M. ORDINANCES AND RESOLUTIONS ORDINANCE NO. 2499 It was moved by Sonnemann, seconded by Fiedler, that Ordinance No. 2499 entitled "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, RELATING TO AND PROVIDING FOR THE ANNEXATION TO THE CITY OF AUBURN OF A CONTIGUOUS AREA OF LAND LYING ADJACENT TO THE NORTHERLY MARGINAL LINE OF THE EXISTING CITY LIMITS OF THE CITY OF AUBURN, WHICH LAND IS DESCRIBED IN A PETITION DULY FILED WITH THE CITY COUNCIL OF THE CITY OF AUBURN." be introduced and adopted. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED ORDINANCE NO. 2500 It was moved by Sonnemann, seconded by Fiedler, that Ordinance No. 2500 entitled "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, GRANTING A SPECIAL PERMIT FOR THE USE OF CERTAIN PROPERTY SITUATE WITHIN THE CORPORATE LIMITS OF THE CITY OF AUBURN, FOR AN,\ ADDITION TO EXISTING DENTAL CLINIC, AND REPEALING AUBURN CITY ORDINANCE NO. 2477 PASSED JULY 20, 1970" be introduced and adopted. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED ORDINANCE NO. 2501 It was moved by Holman, seconded by Darling, that Ordinance No. 2501 entitled "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, AMENDING AUBURN CODIFIED CITY ORDINANCE 1.23.020 PERTAINING TO REIMBURSEMENT OF CITY EMPLOYEES AUTHORIZED TRAVEL EXPENSES BY ADDING A PROVISO THERETO LIMITING THE AMOUNT OF REIMBURSEMENT FOR SUCH TRAVEL TO THE COST OF "COACH" AIR LINE FARE" be introduced and adopted. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED ORDINANCE NO. 2502 It was moved by Nickson, seconded by furling, that Ordinance No. 2502 entitled "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, ADDING A SECTION TO AUBURN CODIFIED CITY ORDINANCE 9.22.260 DESIGNATING AND ADDITIONAL COMMERCIAL LOADING ZONE ON SECOND STREET SOUTHEAST" be introduced and adopted. MOTION CARRIED ORDINANCE NO. 2503 It was moved by Darling, seconded by Fiedler, that Ordinance No. 2503 entitled "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, AMENDING AUBURN CODIFIED CITY ORDINANCE 2.0l.020 BY ADDING A FOURTH PARAGRAPH TO SECTION 1108, UNIFORM BUILDING CODE, 1967 EDITION, VOLUME I, PERTAINING TO EXCEPTIONS REGARDING HEARING EQUIPMENT IN GROUP F-l OR F-3 OCCUPANCIES" be introduced and adopted. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED 130 AUBURN, WASHINGTON MONDAY NOVEMBER 2, 1970 RESOLUTION NO. 435 It was moved by Holman, seconded by Nickson, that Resolution No. 435 entitled "A RESOLUTION OF THE CITY OF AUBURN, WASHINGTON, AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO SIGN, ON BEHALF OF THE CITY, AN AGREEMENT BETWEEN THE CITY AND KING COUNTY FOR FORWARD THRUST FUNDS FOR STREET LIGHTING ON WEST MAIN STREET." (STREET IMPROVEMENT NO. 122) be introduced and adopted. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED RESOLUTION NO. 436 It was moved by Fiedler, seconded by Nickson, that Resolution No. 436 entitled "A I RESOLUTION OF THE CITY OF AUBURN, WASHINGTON, AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE, ON BEHALF OF THE CITY, AN AGREEMENT BETWEEN THE CITY AND THE CHICAGO, MILWAUKEE, ST. PAUL AND PACIFIC RAILROAD COMPANY AND THE OREGON-WASHINGTON RAILROAD AND NAVIGATION COMPANY, GRANTING AN EASEMENT TO THE CITY FOR THE CONSTRUCTION OF AN OVERPASS FOR 15TH STREET NORTHEAST ON RIGHTS-OF-WAY JOINTLY OWNED BY RAILROAD COMPANIES" be introduced and adopted. MOTION CARRIED RESOLUTION NO. 437 It was moved by Shaughnessy, seconded by Holman, that Resolution No. 437 entitled "A RESOLUTION OF THE CITY OF AUBURN, WASHINGTON, AUTHORIZING AND INSTRUCTING THE MAYOR AND THE CITY CLERK OF THE CITY OF AUBURN TO EXEGUTE AMENDMENT NO. 2 TO CONTRACT NO. GS- 10B-C-03529 PERTAINING TO TRASH REMOVAL SERVICES FOR THE GSA FACILITY, AUBURN, WASHINGTON" be introduced and adopted. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED RESOLUTION NO. 438 It was moved by Darling, seconded by Kline, that Resolution No. 438 entitled "A RESOLUTION OF THE CITY OF AUBURN, WASHINGTON, URGING THE PUBLIC TO FULLY CONSIDER THE HARM WHICH CAN BE CREATED THROUGH THE PASSAGE OF INITIATIVE NO. 43 (GIVING THE STATE THE POWER TO REGULATE THE USE OF NAVIGABLE WATERS" be introduced and adopted. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED I APPROVAL OF VOUCHERS AND TRANSFERS It was moved by Kline, secon ded by Nickson, that the Voucher Approval and Department List in the sum of $253)705.79--Claims Warrants No. 2212 through 2455 and HUD Warrants Nos. 2648 and 2649. Payroll Warrants in the amount of $131,446.71--Warrants No. 3888 through No. 4309. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED MISCELLANEOUS BUSINESS City Clerk Williams read letter from W. C. Bogart, District Engineer, Washington State Highway Commission, regarding West Main Street to South 277th St., and the improvement project under Contract 8853. Mayor Kersey requested the letter be filed. City Clerk Williams read petition for vacation of street signed by Charles R. Carter and Edith F. Carter, 2780\11 53rd Street S. E., AUburn, Washington. It was moved by Sonnemann, seconded by Nickson, that the City Attorney prepare necessary I resolution calling for Public Hearing on this matter and the matter be referred to the Street Committee for recommendation. MOTION CARRIED There being no further business to come before the Council, it was moved by Fiedler, seconded by Nickson, that the Council Meeting be adjourned at 9:00 P.M.
