The meeting was called to order by Mayor Kersey. Councilmen present: Councilmen Kline, Sonnemann, Shaughnessy, Darling, Holman, Fiedler and Nickson. APPROVAL OF MINUTES It was moved by Fiedler, seconded by Nickson, that the following correc- tion be made in the Council Minutes of December 1, 1970 Council Meeting: Page 4, Finance Committee Reports, paragraph 4 should read "It was moved by Kline, seconded by Fiedler, that the Park and Recreation Dir- ector be required to submit at least 30 days prior to hiring, a list of summmETreareation leaders to be hired and the recommended wages to be paid, to the Mayor and Council." I MOTION CARRIED It was moved by Darling, seconded by Fiedler, that the Council Minutes of December 1, 1970 Council Meeting be amended unèer Planning, Beauti- fication and Building Committee Report as follows: Page 4, Paragraph 1 should read: "Councilman Darling, reporting for Planning, Beautification and Building Committee, stated the Committee conferred with Sprout Engineers with regard to beautification of Auburn Way North. That the Planning Director, Mitchell Serven, of Sproat En- gineers, Mrs. Jay DOherty, Mrs. Schack, of the Chamber of Commerce Beau- tification Committee, will meet with the King County Design Commission for approval of the Auburn Way North Beautification Plan." That Paragraph 3 under Planning, Beautification and Building Committee Reports should read "Councilman Darling announced that the City Attor- ney is reviewing Ordinance NÖQ 1965 which granted a special use permit for gravel removal to Standard Mining and Development Corporation." MOTION CARRIED I It was moved by Fiedler, seconded by Shaughnessy, that the Council Minutes of December 1, 1970 Council Meeting be approved as mailed and amended above. MOTION CARRIED PUBLIC HEARINGS Mayor Kersey declared Public Hearing open on Final Assessment Roll for Local Improvement District No. 249 providing for sanitary sewer con- struction on 12th St. S.E. between a point W of "F" St. S. E. to "G" St. S. E. It was moved by Kline, seconded by Nickson, that Public Hearing on Final Assessment Roll for Local Improvement District No. 249 be contin- ued until 8:00 P.M., January 4, 1971. MOTION CARRIED Mayor Kersey declared Public Hearing open on proposed vacation of Street right-of-way situate within the corporate limits of the City of Auburn. (Charles R. & Edith F. Carter) (Resolution #439) It was moved by Fiedler, seconded by Sonnemann, that Public Hearing be closed. MOTION CARRIED I It was moved by Fiedler, seconded by Nickson, that the vacation of street right-of-way on Oravetz Road be granted with the agreement that the City retain a right-of-way easement for utility purposes over the entire vacation. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Mayor Kersey declared Public Hearing open on proposed vacation of street right-of-way situate with the corporate limits of the City of Auburn. )Auburn School District #408) (Resolution #440) Margaret Dowd, from audience, inquired of the location of the proposed vacation. She was informed it was the alley between 3rd and 4th Street. It was moved by Fiedler, seconded by Darling, that the Public Hearing be closed. MOTION CARRIED I I I AUBURN, WASHINGTON MONDAY DECEMBER 21, 1970 143- It was moved by Kline, seconded by Sonnemann, that the City Attorney be instructed to prepare necessary ordinance to implement the vacation of street right-of-way. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Mayor Kersey declared Public Hearing open on extension of Fire Zone 1 approximately North 1 block and to the South 1 block. It was moved by Fiedler, seconded by Nickson, that Public Hearing be closed. MOTION CARRIED It was moved by Kline, seconded by Darling, that the City Attorney be instructed to prepare necessary ordinance implementing extension of Fire Zone 1. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Mayor Kersey declared Public Hearing open on request of Seattle Cascade Land Corporation to rezone from R-3 to C-l, a parcel of land located at 932 Auburn Way South, South of 9th Street S. E. (Application No. 19-70) The Planning Commission recommend to the City Council the granting of this request inasmuch as it conforms to the Comprehensive Land Use Plan of the City of Auburn and that consideration be given to the dedication of the West 5 feet for street purposes. Also, that ingress and egress be approv- ed by the Public Works Department prior to issuance of a building permit.. Larry Wilson, 6710 S.E. 30th, Mercer Island, appearing in behalf of the request for rezone. It was moved by Fiedler, seconded by Darling, that Public Hearing be closed. MOTION CARRIED It was moved by Kline, seconded by Shaughnessy, that the City Attorney be instructed to draw up necessary ordinance granting rezone request of Seattle Cascade Land Corporation to rezone from R-3 to C-l subject to the dedication of the West 5 feet for street purposes and that ingress and egress be approved by the Public Works Department prior to issuance of a building permit and that no alcoholic beverages be served on the property. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Mayor Kersey declared Public Hearing open on request of the City of Auburn for a Special Property Use Permit for fill material removal on property lying North of 15th St. N.W. approximately 1300 feet West of the West Valley Highway. (Application No. 23-70) The Planning Commission recommend to the City Council the granting of this application, submitted by the City of Auburn for removal of gravel mater- ial from the location as described, inasmuch as the City is in need of this gravel for the building and maintenance of its City streets, that granting this application is in the best interest of the health and welfare of the citizens of the City of Auburn and is in agreement with good planning practices and the Comprehensive Land Use Plan of the City of Auburn and that this application be granted with the following conditions: 1. That a permit be granted for the removal of material only with no processing by mechanical means allowed on the site. 2. That the excavation conform to the grades established in the plans showing excavation contours and cross sections filed with this application. 3. That the City join with the other property owners and develop a Comprehensive Grading and Restoration Plan covering those pro- perties presently under permit and others, and upon approval of said plan by the Planning Commission and City Council, that these cross sections and restoration plans supersede the plans filed with this application. 4. That not more than 20 acres shall be opened at one time for gravel removal. 5. That clearing of vegetation and trees be restricted to the 20 acres opened. 6. That individual permits be issued by the City Council for each 144 AUBURN, WASHINGTON 20 acres opened. 7. That permits for additional 20 acres openings be subject to the following: MONDAY DECEMBER 21, 1970 a. Evidence that land restoration in conformance with the Restoration Plan has been started on the previous 20 acres. b. A survey is submitted by a licensed professional Land Sur- veyor or Engineer showing that the excavation is in conform- ance with the profiles as shown on the Comprehensive Grad- ing Plan. 8. That restoration of the graded areas be guaranteed by the City I Council. 9. That all haul roads within the permit area or over adjacent property utilized for truck traffic be surfaced to eliminate dust. Said surfacing to be asphaltic concrete paving or bitum- inous surface treatment with crushed rock cover. 10. The hours of operation shall be limited to - from 7:00 A.M. ~o 7:00 P.M. six days a week. No material shall be removed from the site on Sunday or legal holidays. II. Prior to the issuance of the initial permit, the owner shall file with the City Council a map showing the initial point of excavation together with a legal description of the area to be excavated. Said boundaries to be staked and marked so as to be visible. 12. That methods of preventing silt or contaminants from reaching Mill Creek through the surface drainage by a retention pond or as approved by the Washington State Department of Ecology. Margaret Dowd, appearing on behalf of the Citizens Group for Comprehen- sive Plan, stated the Citizens Group on Comprehensive Plan do not oppose this permit and that the City should put forth the effort to put out a I good gravel operation and set a good example for the rest of the gravel operators in the City. It was moved by Nickson, seconded by Fiedler, that the Public Hearing on request of the City of Auburn be closed. MOTION CARRIED CORRESPONDENCE City Clerk Williams read application for License for 1971 from A & B Tavern, Inc. for cabaret license. Councilman Fiedler advised this matter would be brought up under Committee Reports. RECOMMENDATIONS The following items were submitted by George Schuler, Planning Director, to Call for Public Hearing: Request of Green River Baptist Church to revise an existing SPU ~o allow additional temporary church classroom units at 2407 "M" S~. S.E. (Application No. 21-70) It was moved by Shaughnessy, seconded by Holman, that Public Hearing be held at 8:00 P.M., January 4, 1971 on request of Green River Baptist Church. MOTION CARRIED Request of Frank and Stephen Lone to rezone from M-l to M-2 Industria to C-3 Commercial on a land parcel located at the NW corner of 15th St. N.E. and Auburn Way North. (Application No. 22-70) It was moved by Fiedler, seconded by Holman, that Public Hearing be held at 8:00 P.M., January 4, 1971 on request of Frank and S~ephen Lone to rezone from M-I to M-2 Industrial to C-3 Commercial. MOTION CARRIED The following items were submitted for approval by Pat Nevins, Director of Public Works: Change Order No.2 to C. J. Rockey Co. for LID 251, street construc- tion on 5th St. N.E. & Division for increase of $960.63, special ballast needed for more stable surface on yielding subgrade and adjusting of existing manhole to grade. It was moved by Nickson, seconded by Holman, that Change Order No. 2 to C. J. Rockey Co. for LID 251, for increase of $960.63 be approved. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Change Order No. I to C. J. Rockey Co. for LID 240, street construc- tion 2lst S. E. & Hemlock for increase of $267.44 correcting slope of driveway to correspond with new street grade and raise existing cleanout. It was moved by Nickson, seconded by Darling, that Change Order No. I to C. J. Rockey Co. for LID 240 for increase of $267.44 be approved. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Pay Estimate No. 4 (final) to Rome Company for construction of hangar buildings at Auburn Municipal Airport for $3,483.93. It was moved by Kline, seconded by Nickson, that Pay Estimate No. 4 (final to Rome Company be approved for payment and the City accept the project as completed and upon successful completion of the deficiencies being accomplished and that the reatined percentage amounting to $6,838.70 in- cluding sales tax, be paid in thirty days provided no liens or claims are filed and clearance is secured from the State Tax Commission and the State Department of Labor and Industries. 146 AUBURN, WASHINGTON ROLL CALL VOTE: All Councilmen voting YES. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Award of contract for demolition of GSA Reservoir to R. W. Rhine, Inc Tacoma, Washington, for $4,186.88 including sales tax. It was moved by Kline, seconded by Holman, that contract be awarded to R. W. Rhine, Inc., for demolition of GSA Reservoir for $4,186.88 includ- ing $199.38 sales tax, and the Mayor and City Clerk be authorized to sign contract; that the bid bonds of all but the three lowest bidders be returned, and upon signing of the contract the bid bonds of the two re- maining low bidders be returned. MOTION CARRIED COUNCIL COMMITTEE REPORTS FINANCE COMMITTEE - KLINE Councilman Kline reporting for Finance Committee stated the Committee had met with Park Board Chairman and Director of Parks and Recreation and reviewed plans relative to acquisition of park site for park purposes and reviewed the new six year park plan and the Finance Committee would like to have the entire Council look over the six-year park plan. The Committee discussed the new agreement with the Bonneville Power Administration in connection with the municipal airport. PUBLIC SAFETY COMMITTEE - SONNEMANN Councilman Sonnemann, reporting for Public Safety Committee, stated the Committee discussed the Alcohol Safety Action Program and the committee recommends the Council authorize the Mayor to sign an agreement with the Department of Motor Vehicles for the Alcohol Safety Action Program. It was moved by Sonnemann, seconded by Fiedler, that the Mayor sign agree- ment with the Department of Motor Vehicles for the Alcohol Safety Action Program. MOTION CARRIED PLANNING, BEAUTIFICATION & BUILDING CODES COMMITTEE - DARLING Councilman Darling reported the Committee received a letter request of Jack Jenkins, President Qf Standard Mining requesting an extension of time to submit plans for restoration of property in question with regard to gravel removal and that a meeting will be held at 7:30 P.M., December 29, 1970 to review such plans. The Committee recommends Council authorization for Phase Two õ£ the Auburn Way North Beautification Proposal limited to $4300.00. The Committee recommends calling for bids for the perimeter tree ring planters so that required quantities may be produced and available when required. The tree rings are to be a separate contract item and to call for approximately 180 units. Design specifications will be prepared by S E & A ~h cœhjunction with the pending Phase Two Design Contract. The Committee reviewed the Park Department Six-Year Capital Improvement Program and it is recommended this matter be discussed at an interim Council Meeting. It was moved by Darling, seconded by Holman, that the Mayor be authorized to enter into an agreement with S E & A, Inc. to proceed with Phase Two of the Auburn Way North Beautification Proposal in the maximum amount of $4,300.00 on an hourly rate basis. MOTION CARRIED It was moved by Darling, seconded by Nickson, that the City Clerk be authorized to Call for Bids on the perimeter tree ring planter, to be a separate contract item, said contract to call for approximately 180 units. MOTION CARRIED LICENSE COMMITTEE - FIEDLER Councilman Fiedler, reporting for License Committee, stated the Committee 148 AUBURN, WASHINGTON MONDAY DECEMBER 21, 1970 had discussed the taxi situation and recommend amendment to Ordinance No. 2356 to reflect that a master license for unlimited number of cabs be issued to any qualified comp~ny for a license fee of $250.00 per year. The Committee recommend amending the For Hire Driver's License to be issued at a fe of $15.00 with renewal at $5.00. The Committee reviewed application for 1971 license from A & B Tavern, Inc., for cabaret license. It was moved by Fiedler, seconded by Nickson, that A & B Tavern, Inc. cabaret license for 1971 be approved. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED I The Committee discussed the proposed changes to the tow truck ordinance and recommend the amendments be passed by the Council. NEW BUSINESS It was moved by Kline, seconded by Nickson, that the City Clerk be auth- orized to Call for Bids for legal publications for the year 1971, for January 4, 1971, with bids to be opened at 11:00 A.M. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED It was moved by Kline, seconded by Nickson, that the Mayor and City Clerk be authorized to sign amended agreement with Bonneville Power Administra- tion, Trust Agreement Contract 14-03-99615, Supplement #2 as amended and that the City Finance Officer be authorized to disburse funds for the Municipal Airport as authorized by the agreement. ROLL CALL VOTE: Councilmen Kline, Sonnemann, Shaughnessy, Darling, Holman and Nickson, voting YES. Councilman Fiedler voting NO. MOTION CARRIED ORDINANCES AND RESOLUTIONS ORDINANCE NO. 2510 I It was moved by Shaughnessy, seconded by Fiedler, that Ordinance No. 2510 entitled "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, REPEALING AUBURN CODIFIED CITY ORDINANCE NO. 2.01.030 WHICH ESTABLISHES FIRE ZONES FOR THE CITY OF AUBURN AND FURTHER REPLACING SAID REPEALED CODIFIED ORDINANCE WITH A NEW CODIFIED ORDINANCE SECTION 2.01.030 REESTABLISHING FIRE ZONES WITHIN THE CITY LIMITS OF THE CITY OF AUBURN" be introduced and adopted. MOTION CARRIED RESOLUTION NO. 443 It was moved by Kline, seconded by Sonnemann, that Resolution NO. 443 entitled "A RESOLUTION OF THE CITY OF AUBURN, WASHINGTON, DIRECTING THE MAYOR OF THE CITY OF AUBURN, WASHINGTON, TO ADVISE ALL APPROPRIATE STATE, COUNTY AND MUNICIPAL AGENCIES OF THE OPPOSITION OF THE CITY OF AUBURN, WASHINGTON TO ANY CHANGE IN STATE LAW WHICH WOULD MANDATE A SYSTEM OF REGIONAL LIBRARIES THROUGHOUT THE STATE OF WASHINGTON THAT WOULD JEOPARDIZE AND TAKE AWAY THE JURISDICTION AND CONTROL OF MUNICIPAL LIBRARY SYSTEMS FROM VARIOUS CITIES THROUGHOUT THE STATE" be introduced and adopted. MOTION CARRIED MISCELLANEOUS BUSINESS It was moved by Kline, seconded by Sonnemann, that the Mayor and City Clerk be authorized to sign agreement with Teamster's Local 910. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED City Clerk Williams read letter from J. M. Shaughnessy, regarding "squirrel crossing". Mayor Kersey requested the letter be referred to the Street Committee with copy to Mayor. There being no further business to come before the Council the meeting adjourned at 9:30 P.M.
