The meeting was called to order by Mayor Kersey. Councilmen present: Councilmen Kline, Sonnemann, Shaughnessy, Darling, Holman, Fiedler and Nickson. APPROVAL OF MINUTES It was moved by Darling, seconded by Fiedler, that the Council Minutes of April 5, 1971 be approved as mailed. I MOTION CARRIED PUBLIC HEARINGS MayoD Kersey declared Public Hearing open on Final Assessment Roll for LID 243 (portion of 4th St. N.E. from Auburn Way North to M St. N.E.) curb and gutter construction. It was moved by Fiedler, seconded by Sonnemann, that the Public Hearing be closed. MOTION CARRIED It was moved by Sonnemann, seconded by Nickson, that the final assessment roll for LID 243 be approved and confirmed and the City Attorney be instructed to prepare necessary ordinance approving and confirming the assessment and assessment roll. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED CORRESPONDENCE City Clerk Williams read letter from Auburn Aerie No. 2298, F.O.E. with regard to Ladies AUKi1iary requesting permission to have a sidewalk sale for benefit of the retarded children. Mayor Kersey requested the letter be referred to the Street Committee. City Clerk Williams read letter from puget Sound Governmental Conference with review certification for Cascade Park. III Mayor Kersey requested the letter be referred to Parks and Recreation Department. RECOMMENDATIONS The following item was submitted by the Planning Director to Call for Public Hearing: The request of the City of Auburn to establish a Comprehensive Land Use Plan for the area annexed to the City of Auburn lying between South 277th Street and South 288th Street. (Comp. 1-71) It was moved by Nickson, seconded by Sonnemann, that Public Hearing be held on May 3, 1971 at 8:00 P.M., on Comprehensive Land Use Plan for the area annexed to the City of Auburn lying between South 277th Street and South 288th Street. (Comp. 1-71) MOTION CARRIED The following item was submitted by the Director of Public Works for Council approval: Pay Estimate No. 4 to Kur1e Construction Co. for $3,605.34, construction of Cemetery Reception Center. It was moved by Shaughnessy, seconded by Sonnemann, that Pay Estimate No. 4 to Kur1e Construction Co., for $3,605.34 be approved for payment. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED I PROCLAMATIONS, APPOINTMENTS AND ANNOUNCEMENTS City Clerk Williams read proclamation proclaiming May 1, 1971 as Loyalty Day in the City of Auburn and the Mayor so proclaimed. City Clerk Williams read proclamation proclaiming May 1,1971 as Law Day, U.S.A., in the City of Auburn and the Mayor so proclaimed. Mayor Kersey announced that annµa1 clean-up in the City of Auburn commenced this week and Clean-up in the State of Washington, and that the Rotary Country Store is having its sale in two weeks and will welcome any items for their sale; that the White River presbyterian Youth Club are having a money making project and ask that all bottles and glass food containers be saved regardless of color and they will be picked up together with any magazines or newspapers; and Thursday is the start of the Junior Livestock Show, with Kiwanis breakfast on Saturday morning commencing at 7:00 A.M., AUBURN, WASHINGTON APRIL 19, 1971 MONDAY and would hope everyone will attend. COUNCIL COMMITTEE REPORTS PUBLIC SAFETY COMMITTEE - SONNEMANN Councilman Sonnemann announced that there would be a Committee Meeting Tuesday night at 7:30 P.M., April 20, 1971. Mayor Kersey at this point of the meeting introduced the Exalted Ruler of the Auburn Elks Lodge 1808, Wilbur Nichols, Cemetery Supervisor. UTILITY COMMITTEE - SHAUGHNESSY Councilman Shaughnessy, reporting for the Utility Committee, stated the Committee had reviewed proposed method of supplying the school property with water and sanitary sewer service for Hazelwood Jr. High School and the Committee ~greed to give consideration to the establishment of appropriate area charges and late comer agreements for the utilities and school representatives indicated they would have Hill, Ingman, Chase & Co. proceed with design and cost estimates on which to base charges and agreements. The Committee considered utilities charges for Shawmyim Village Mobile Home Community on City's Master Plan for installing all utilities South of the Stuck River and an analysis of the various circumstances involved resulted in a decision by the Committee that it would not be economically feasible for the City to determine an acreage or square foot charge for utilities that would safeguard the City against escalation of construction of the systems at some time in the future. The Committee would consider, subject to the legality of the procedure, to have included in plats and in property deeds, a provision that property owners would participate on an equitable basis at some time in the future for the cost of bringing utilities to each area. The Public Works Director was requested to present this proposal to the developer for his approval prior to pursuing it further. The Committee discussed the sanitary sewer crossing of S.R. 167 - North of S.R. 18 involv- ing the construction under the Valley Freeway of a 36-inch sanitary sewer just North of S.R. 18, which is already included in a contract with the State Highway Department but, in view of the changed plans for the Freeway which will no overcross S. R. 18, the cost of the sewer will be increased. The Committee gave tentative approval to construction of the sewer crossing pending establishment of estimated cost by the State Highway Department. The Committee will make some consideration with regard to renewal of the garbage collec- tion contract. The Committee reviewed a letter from the Washington State Highway Commission outlining estimated costs to the City to extend utility crossings under frontage road in. connection wi th S. R. 167 and because of the cost and the fact that the sewer line will not be needed until sometime in the future the extension of the sanitary sewer lines was disapproved. A special Utility Committee Meeting will be held on Tuesday, April 20, 1971 to hear RIBCO presentation. PLANNING, BEAUTIFICATION AND BUILDING CODES COMMITTEE - DARLING Councilman Darling, reporting for the Planning, Beautification and Building Codes Committee, considered the purchase of the Ryan Lane parcel in the vicinity of 19th and Hemlock Streets S.E. and recommend purchase of the parcel and the matter be referred to the Street Committee for further consideration and final action. The Committee considered and discussed the need for a public rest room in the business district as requested by the Chamber of Commerce and the matter will be studied further jointly with the Chamber of Commerce and the Council. The Committee reviewed an income/expense tabulation relating to operations of the Building Division and comparing 1970 Building Permit Fees to the new fee proposals. It was pointed out that under the proposed 1967 UBC fee schedule there is no intention to completely cover the Building Division expenses. The intention is to amend the Auburn fee schedules to a basis compatible with the surrounding municipalities and King County. The Planning and Building staff was directed to compile a summary memo for all councilmen outlining the recent study and findings relative to pending fee proposals and it was the unanimous recom- mendation of the Committee that the Committee come forth with a motion to instruct the City Attorney to prepare an ordinance amending the Building Permit Fees as referred to in memo from George Schuler, dated April 16. It was moved by Darling, seconded by Holman, that the City Attorney be instructed to pre- pare necessary ordinance to amend the specific section of the Building Codes per memo from George Schuler, dated April 16, 1971. Discussion followed pro and con by the Councilmen. MOTION CARRIED YGtN\ 00-'" I ~ I' ':\ Councilman Darling reported the Committee reviewed Mrs. Van's letter of February 22, 1971 with regard to Community Improvements and the Committee welcomed the constructive attitude expressed therein and Chairman Darling will acknowledge same in correspondence outlining current projects and possibilities involving most of Mrs. Van's suggestions. The Committee reviewed the monthly report on Standard Mining's gravel removal operations and same are found to be in accordance with the existing SPU conditions. The Committee requested a May summary report on all SPU permits and conditional zoning permits as to compliance with restrictive conditions. The rebid on Auburn Way North Beautification will be held on April 29, 1971 with bids opened at that time and awarda1 of contract recommendation to be made at the May 3rd Council Meeting. The Committee reviewed application for Unit Permit #1, SPU permit #15A-70 and the Committee unanimously recommend to the City Council that the application of M. A.SEGALE, INC., for unit Permit #1, SPU Permit #15A-70 be approved subject to the appropriate restoration bond and state agency approvals. It was moved by Darling, seconded by Fiedler, that the unit Permit #1, SPU Permit #15A-70A of M. A. Sega1e, Inc., be approved. MOTION CARRIED POLICE AND LICENSE COMMITTEE - FIEDLER Councilman Fiedler reporting for Police and License Committee, stated it was the recom- mendation of the Committee that Section 4, of Ordinance No. 2540 be amended to reflect $15.00 for initial application of Merchant Patrolman and $10.00 for renewal. It was moved by Fiedler, seconded by Shaughnessy, that Section 4 of Ordinance No. 2540 be amended to reflect $15.00 for initial fee for application of Merchant Patrolman License and $10.00 for renewal. MOTION CARRIED It was moved by Fiedler, seconded by Shaughnessy, that Ordinance No. 2540 entitled "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, RELATING TO THE REGULATION AND LICENSING OF MERCHANT PATROL AGENCIES AND/OR DETECTIVE AGENCIES OR BUSINESSES AND ITS EMPLOYEES WITHIN THE CORPORATE LIMITS OF THE CITY OF AUBURN AND PROVIDING FOR VIOLATIONS THEREOF" be adopted. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED The Committee reviewed the insurance requirements for taxicabs and the Committee recommend that Ordinance be amended to reflect property damage insurance in a sum not less than $100,000; for personal liability insurance in a sum not less than $100,000 for the injury of one person, and $300,000 for the injuries resulting from anyone accident. It was moved by Fiedler, seconded by Shaughnessy, that Ordinance No. 2544 entitled "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, AMENDING SECTION 21 OF AUBURN CITY ORDINANCE NO. 2356 PASSED JUNE 16, 1969 (CODIFIED CITY ORDINANCE NO. 5.38.040) RELATING TO INSPECTION OF VEHICLES - INSURANCE" be introduced and adopted. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Councilman Fiedler requested the City Clerk to write a letter to the two taxicab companies notifying them of this Ordinance. STREET AND ENGINEERING COMMITTEE - NICKSON The Committee reviewed the request of Public Works Department to purchase a panel vehicle to replace the Chevrolet Van purchased in 1968. It was moved by Nickson, seconded by Holman, that the Public Works Department be authorized to purchase a panel vehicle from the Public Highway Department Bid and that monies be appropriated from the depreciation reserve fund of the Engineering DivisiDn of the Current Expense Fund for the replacement of this van. ROLL CALL VOTE: Councilmen Nickson, Sonnemann, Shaughnessy, Darling, Holman and Fiedler voting YES. Councilman Kline voting NO. MOTION CARRIED Councilman Kline requested that the record show that this action was taken by open Council. It was moved by Kline, seconded by Darling, that the City Attorney be instructed to draw 202 emergency emergency AUBURN, WASHINGTON MONDAY APRIL 19, 1971 ordinance to authorize the transfer of funds for and authorize the purchase of piece of equipment. ROLL CALL VOTE: Councilman Kline voting YES. All other Councilmen voting NO. MOTION FAILED Councilman Kline requested that the minutes reflect that it was the emergency ordinance motion that failed to pass. -_..~..- It was moved by Nickson, seco~ged by Fiedler, that motion to purchase panel vehicle be reconsidered. MOTION CARRIED It was moved by Nickson, seconded by Holman, that the motion be amended to read that I the Engineering Division of Public Works Department be authorized to purchase a 1971 van from the State of Washington Highway Department Bid in the amount of $2,871.55 plus applicable taxes, to be expended from the Engineering Division portion of the Current Expense Fund. ROLL CALL VOTE: Councilmen Nickson, Sonnemann, Shaughnessy, Darling, Holman, and Fiedler voting YES. Councilman Kline voting NO. MOTION CARRIED NEW BUSINESS It was moved by Sonnemann, seconded by Nickson, that the Street Committee have the power to act on the request of Ladies Auxiliary of Auburn Aerie No. 2298 for a sidewalk sale. MOTION CARRIED It was moved by Sonnemann, seconded by Darling, that the City Attorney be instructed to concur with the Treasurer and draft an ordinance setting up funds and providing for expenditure of same. MOTION CARRIED ORDINANCES AND RESOLUTIONS ORDINANCE NO. 2542 It was moved by Fiedler, seconded by Darling, that Ordinance No. 2542 entitled "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR THE REZONING OF CERTAIN PROPERTY WITHIN THE CITY OF AUBURN, CHANGING THE ZONING CLASSIFICATION THEREOF FROM R-2 TO P-1" (Auburn Park Board - 1603 Fir St. S.E.) be introduced and adopted. I ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED ORDINANCE NO. 2543 It was moved by Holman, seconded by Fiedler, that Ordinance No. 2543 entitled "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, AMENDING SECTION 6 OF AUBURN CITY ORDINANCE NO. 2531 (April 5, 1971) TO CORRECT AN ERRONEOUS LEGAL DESCRIPTION OF REAL PROPERTY ANNEXED TO THE CITY OF AUBURN, WASHINGTON, IN SAID ORDINANCE" (Jovita Heights) be introduced and adopted. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED There being no further business to come before the Council, it was moved by Shaughnessy, seconded by Holman, that the meeting adjourn at 9:40 P.M.
