The meeting was called to order by Mayor Kersey. Councilmen present: Councilman Kline, Sonnemann, Shaughnessy, Darling, Holman, Fiedler and Nickson. APPROVAL OF MINUTES It was moved by Darling, seconded by Holman, that the Council Minutes of May 3, 1971 Council Meeting be approved as mailed. MOTION CARRIED PUBLIC HEARINGS Mayor Kersey declared Public Hearing open on request of Broadway Holding Company to rezone from Unclassified (County) to SPU for grading and gravel removal, a parcel of property located in the vicinity of West Valley South of 15 th Street S.W. (Application No. 12-71) The Planning Commission recommend to the City Council the approval of the request of Broadway Holding Company Application No. 12-71 with the following conditions to be incorporated into any ordinance approved by the City Council: 1. That the Comprehensive Grading Plan shall be attached to and made a part of any ordinance granting a Special Property use Permit for removal of natural resources (sand and gravel). 2. That prior to the removal of any materials from the site, the grades of the proposed streets within shall be approved by the Public Works Department of the City of Auburn. 3. That prior to the removal of any material from the site, a Storm Water Drainage Plan approved by the State of Washington Department of Ecology and the City of Auburn Public Works Department be submitted. Said Drainage Plan shall include but not be limited to location and size of all piping, culverts and ditches and their terminus at existing ditches, storm sewer, etc. 4. A provision shall be included within the ordinance to grant the petitioner permission to remove natural resources from the existing un-improved dedicated right-of-ways as shown on the Comprehensive Grading Plan. 5. That prior to removal of any materials from the sit, approvals from the State of Washington pertaining to air, water and noise pollution and land restoration shall be submitted to the Planning Department of the City of Auburn. 6. That prior to removal of any materials from the site, a performance bond guaranteeing restoration of the graded area and compliance with the conditions of the permit in the amount of $5,000.00 per acre be submitted. Upon completion of mining, the required rehabilitation work shall be commenced as soon as practicable, but in no event later than 120 days from the completion of mining. 7. That all haul roads within the permit area or over adjacent property utilized for truck traffic be surfaced to eliminate dust. Said surfacing to be asphaltic concrete paving or bituminous surface treatment with crushed rock cover. 8. The hours of operation shall be limited to - from 7:00 a.m. to 7:00 p.m. - six days a week. No material shall be removed from the site on Sunday or legal holidays. 9. That all equipment operating within the permit area, using gasoline or diesel engines, be equipped with a muffler. A muffler means a device consisting of a series of chambers, baffles or other mechanical designs for the purpose of receiving exhaust gases from an internal combustion engine and effecive in reducing noise resulting therefrom. 10. The Department of Planning and Community Development shall have the right to make inspections of any property at any reasonable time as deemed necessary to determine compliance with the permit. The Department shall notify, as deemed necessary, any operator of a proposed inspection. However, lack of such notifi- cation shall not be cause for denying the right to inspect. The operator shall have the option of accompanying the inspector. 21 0 AUBURN ,···WASHTN€'fON MONDAY MAY 17, 1971 Monthly inspections shall be made during the permit year by the Department inspectors to insure compliance with the operating permit, reclamation plan, and the plan of surface mining, Any and all deficiencies shall be immediately brought to the attention of the operator, and written notice specifying defi- ciencies shall be given to the operator. The operator shall commence action within thirty (30) days to rectify these deficiencies and shall diligently proceed until the deficiencies are corrected: PROVIDED, that deficiencies that also violate other laws that require earlier rectification shall be corrected in accordance with the applicable time provisions of such laws, or shall immediately commence action to rectify deficiencies that involve health, safety and water pollution, if those deficiencies are not regulated by such laws. The Department shall have grounds to terminate and cancel the operating permit I if the operator does not commence action to rectify ang and all deficiencies, as specified above, or as specified in the permit. The operator and his surety shall be notified of such termination and cancellation, said notice to be mailed to the last known address of the operator and surety. 11. Industrial performance standards shall be in conformance with those standards established by the Q-M classification of King County, approved as of this date and any amendments thereto. 12. No processing of materials by mehcanical means shall be allowed upon the site. 13. The privileges granted by this permit will expire, unless earlier modified or terminated, five (5) years from the date of adoption of an ordinance granting A Special Property use Permit for removal of natural resources (sand and gravel). 14. There have been numerous statements made regarding the ultimate use of the property as a subdivision and that the proposed streets will be graded during the removal of the natural resources from the site. In order to insure the City and the adjacent property owners that the subdivision of the property, after the grading has been completed, will X~ fact be accomplished, a separate agreement shall be drawn whereby the petitioners, their heirs, successors and assigns shall covenant and agree to the following: a. That a replat of the area subdividing the site into individual lots and blocks in accordance with the subdivision Ordinance of the City of Auburn shall be filed with the City of Auburn within 120 days after the completion of the grading as shown on the Comprehensive Grading Plan. I b. Agree to completion of the subdivision in accordance with the requirements of the subdivision ordinance of the City of Auburn. This shall include all engineering necessary to complete the final plat including staking, street and underground utility improvements and the construction of said improvements to the City of Auburn specifications. c. To insure that the above two items are completed, a performance bond in an amount to be determined by the City of Auburn Public Works Department, is to be submitted. Said amount to be sufficient to complete the platting and installation of the improvements listed above. 15. That all material to be removed is to be used on the Auburn 400 site and that if any material is to be sold, for use outside the Auburn 400 site, the petitioner must come back and apply for a SPU to allow the sale of the excess material. 16. Prior to moving any material from the site, the route of travel of earth moving equipment, including methods of traffic control, shall be submitted and approved by the City of Auburn Public Works Department. Mr. Ethan, appearing for Morrison Knudson Company, stated they had worked with Mr. I Schuler on the request and agree with the recommendations and restrictions as submitted by the Planning Commission. It was moved by Fiedler, seconded by Sonnemann, that the Public Hearing be closed. MOTION CARRIED It was moved by Kline, seconded by Fiedler, that the request for SPU of Broadway Holding Company for grading and gravel removal, application No. 12-71, be granted subject to the requirements and recommendations of the Planning Commission as appeared on Council Agenda. It was moved by Shaughnessy, seconded by Kline, that item 14 be amended by removing the word perhaps in Line 5, and to read a separate agreement shall be drawn. MOTION CARRIED I I I AUBURN, WASHINGTON 211 MONDAY MAY 19, 1971 It was moved by Kline, seconded by Fiedler, that Item 6 be amended by striking the $1,000.00 and inserting $5,000.00. MOTION CARRIED Councilman Holman voting NO. It was moved by Kline, seconded by Nickson, that Item 6 be amended by inserting in line 3 after submitted; "That failure of petitioner to meet requirements of Grading Plan within time period prescribed, shall constitute forfeiture of the bond;" that Item 15 be amended by striking words "that if any material is to be sold" beginning with line one, and replace with "except that 500,000 cubic yards of material can be sold for use outside the Auburn 400 site. Strike the sentence commencing with the petitioner must come back. It was moved by Kline, seconded by Darling, that Item 5 be amended to read: "That prior to removal of any materials from the site, the petitioner shall submit and receive the approval of the Planning Department of the minimum requirements for revegetation as prescribed by the State Department of Natural Resources." ROLL CALL VOTE: Councilman Kline, Sonnemann, Shaughnessy, Darling, Holman and Nickson voting YES. Councilman Fiedler voting NO. MOTION CARRIED It was moved by Sonnemann, seconded by Fiedler, for the previous question. ROLL CALL VOTE: Councilman Sonnemann, Shaughnessy, Holman and Fiedler voting YES. MOTION CARRIED It was moved by Sonnemann, seconded by Fiedler, that Application 12-71 be reconsidered. MOTION CARRIED It was moved by Kline, seconded by nickson, that there be a stipulation in the ordinance that the owner shall subdivide the property in accordance with the agreement signed on day of , 1971 and recorded under Auditor's File No. , a copy of which is attached hereto and made a part of the ordinance." MOTION CARRIED It was moved by Kline, seconded by Nickson, that Item 16 be amended by striking the words "Public Works Department" and inserting the "City of Auburn City CounciL" MOTION CARRIED It was moved by Kline, seconded by Nickson, that Item 16 be amended to read: "One month after moving any material from the site, the route of travel of earth moving equipment, including methods of traffic control, shall be submitted and approved by the City of Auburn City Council." Mayor Kersey requested the Letter be referred to the Street Committee. City Clerk Williams read letter from F. Tallmadge Day, Jr., Realtor, Kent, Washing~on, regarding sanitary sewer facilities. Mayor Kersey requested the letter be referred to the Utilities Committee. City Clerk Williams read the following letter from Director of Public Works; "Bids were received for the construction of 29 th Street S.E. From "A" S.E. to "R" S.E. on May 13, 1971. Cascade asphalt paving Company appeared to be the low bidder on Alternate "c" when the bids were read by the City Clerk with an amount of $272,- I 258.75. Their bid bond of 5% was for this amount. If they would have computed Alternate "c" properly, the bid would have been $318,558.43. This means their bid bond, as submitted, would not cover the corrected bid amount. Cascade Asphalt last year worked on three different projects for the City of Auburn. Those were 14th and "I" , 4th Street N. E., and "M" Street between 28th and 29th S. E. At the time of tR~sewpfb3ß~tgoRreOtompletelY finalized. In the last month many good working days went by without any activity by Cascade Asphalt. The firm has been assessed liquid- ated damages because they didn't complete their work on time. Therefore, it is my recommendation after obtaining the concurrence of the City Attorney to award the contract to C.J. Rockey Company in the amount of $323,550.92 as that bid is the lowest and best bid received on this project. This work involves street construction sanitary sewers, sidewalks, street lighting and underground utility trenching." It was moved by Nickson, seconded by Darling, that the bid of Cascade Asphalt be rejected because it did not meet the specifications. Mr. Gerald Hulscher, Attorney at Law, appearing in behalf of Cascade Asphalt, stated the bid was in error because of mathematical calculations and respectfully requested the bid be awarded on the corrected calculation computed on Alternate "c" properly in the amount of $318,558.43, and that Cascade Asphalt would be agreeable to accepting this amount as their bid which is approximately $5,000.00 lower than C. J. Rockey bid. It was moved by Darling, seconded by Shaughnessy, that a five minute recess be held. I MOTION CARRIED Mayor Kersey reconvened the meeting after a five minute recess. ROLL CALL VOTE ON motion: All Councilmen voting YES. MOTION CARRIED It was moved by Nickson, seconded by Fiedler, that the recommendations of the Director of Public Works be concurred with and award the contract for st. Imp 123 to C.J. Rockey in the amount of $323,550.92 as the lowest and best bid received in accordance with the specifications in this project. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED It was moved by Nickson, seconded by Kline, that bid bonds of all but the three lowest bidders be returned, and that the Mayor and City Clerk be authorized to sign contract with C. J. Rockey, and upon signing of contract the bid bonds of the remaining low bidders be returned. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED RECOMMENDATIONS I The following items were submitted by the Director of Planning to call for Public Hearing: The request of Fred L. Brannan to rezone from R-4 to SPU for professional offices, a parcel of property located at the corner of 28th and "I" Sts. N.E. (Application No. 3-71) The request of Josephine Hodges to rezone from Unclassified to C-3, a parcel of prop- erty located at 4420 Auburn Way North. (Application No. 7-71) The request of Flood's 1st Addition (Group Application) ,to rezone from R-2 to C-3 a parcel of property located at 15th St. N.E. and Harvey Road. (Application No. 10-71) It was moved by Kline, Seconded by Shaughnessy, that Public Hearing be held at 8:00 P.M., June 7, 1971 on requests above listed. Segale Co., Inc. for increase of $506.10 on water portion of St. Imp. 101, 15th St. N.E./N.W. construction. It was moved by to M. A. It was moved by Holman, seconded by Nickson, that Change Order·No. 1 (Street portion) to M. A. Segale Co., Inc. for decrease of $195.00 be approved. It was moved by Nickson, seconded by Sonnemann, that the City Attorney be instructed to prepare necessary ordinance creating LID 257. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Creation of L.I.D. 258, crushed rock surface street construction on C. st. N.W., vicinity of 8th st. N.W. to 15th St. N.W. It was moved by Nickson, seconded by Fiedler, that the City Attorney be instructed to prepare necessary ordinance creating L.I.D. 258. It was moved by Kline, seconded by Fiedler, to table this matter and refer to the Street Committee for recommendation. ROLL CALL VOTE: Councilman Kline and Fiedler voting YES. Councilman Sonnemann, Shaughnessy, Darling, Holman and Nickson Voting NO. MOTION FAILED ROLL CALL VOTE ON MOTION: All Councilmen voting YES. MOTION CARRIED Pay estimate No.5 (final) to Kurle Construction Co. for $2,446.25 for construction of Mountain View Cemetery Reception Center. It was moved by Kline, seconded by Holman, that Pay Est:.mate No. 5 (final) to Kurle Construction Co. for $2,446.25 be paid and the City accept the project as complete and that the retained percentage amounting to $3,457.39 be paid in thirty days provided no liens or claims are filed and clearance is secured from the State Tax Commission and the Department of Labor and Industries. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Pay Estimate No.4 to Tri-State Construction, Inc., for $16,455.47 (HUD portion) of West Main Street Water project construction. It was moved by Shaughnessy, seconded by Holman, that Pay estimate No.4 to Tri- State Construction, Inc., for $16,455.47 be approved for payment. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED PROCLAMATIONS, APPOINTMENTS AND ANNOUNCEMENTS Mayor Kersey announced that the Bloodmobile would be at the Presbyterian Church on Thursday, May 20 from 1:00 to 6:00 P.M. and urged participation. 214 AUBURN,_ WASHINGTON MONDAY MAY 17, 1971 Mayor Kersey announced that two unemployed men were engaged in a self-employed program to paint numbers on the curbs in the city of Auburn and thus maintaining their families and doing a worthwhile project. COUNCIL COMMITTEE REPORTS FINANCE COMMITTEE - KLINE Councilman Kline, reporting for Finance Committee, Stated the Committee had reviewed the request of the Mayor for authorization to contract out the use of the mowing machine for use in mowing privately owned areas for a suitable charge, which was approved by the Finance Committee. I It was moved by Kline, seconded by Fiedler, that the Mayor be authorized to contract the use of the mowing machine at a suitable charge to be determined by the Mayor and Administrative Department as to costs. MOTION CARRIED The committee discussed disposing of the NCR billing machine and the Elliott Addressing machine which have become surplus to the needs of the City, and it was the recommendation of the Committee this be accomplished. It was moved by Kline, seconded by Nickson, that the City Clerk be authorized to advertise for bids to dispose of the two pieces of equipment. MOTION CARRIED The Committee discussed the request of the librarian to attend the annual con- ference of the American Library Association, June 19 - 25, in Dallas Texas. It was moved by Kline, seconded by Fiedler, that the Librarian be authorized to attend the annual conference of the American Library Association in Dallas, Texas, June 19-25. MOTION CARRIED ANNEXATION COMMITTEE - SONNEMANN I Councilman Sonnemann announced the Annexation Committee will meet Tuesday, May 18, at 8:00 P.M. UTILITY COMMITTEE - SHAUGHNESSY The Committee reviewed the request of puget Sound Power and Light Company for a variance in the installation of underground wiring to the residence of the Jerry family at 4931 Auburn Way South, and the Committee granted delay to the Jerry family for overhead wiring. It was moved by Shaughnessy, seconded by Kline, that the amendment to the con- tract for garbage collection be approved for the change in the rates as affected the original contract for garbage collection. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED PLANNING, BEAUTIFICATION AND BUILDING CODES COMMITTEE - DARLING Councilman Darling stated the Committee recommend introduction only of Ord- inance No. 2553. MUNICIPAL BUILDING COMMITTEE - HOLMAN Councilman Holman, reporting for Municipal Building Committee, stated the I Committee had met relative to the Equipment Maintenance and Rental Building and it was the recommendation of the Committee that the position of Alan Forgey be replaced as soon as a qualified person can be hired as equipment maintenance man. The committee will meet Tuesday evening to further discuss the Equipment Maintenance and Rental Building. POLICE AND LICENSE COMMITTEE - FIEDLER Councilman Fiedler advised he was working with a sub-committee of the King County Council to arrive at a uniform license requirement for taxicabs and as soon as this is available he will bring it to the Council for approval. AUBURN, WASHINGTON MONDAY MAY 17, 1971 215 STREET AND ENGINEERING COMMITTEE - NICKSON Councilman Nickson, stated the Committee is reviewing the policy on dust and gravel roads and will act on a recommendation at the next meeting. DEPARTMENT HEAD REPORTS Wilbur Nichols, reporting for the Cemetery Department, stated that the staff at the Cemetery had moved into the new office and commented it was an added addition to the cemetery and that a formal opening in the future will be scheduled. I OLD BUSINESS It was moved by Nickson, seconded by Fiedler, that Final Assessment Roll for L. I. D. 236 (street, sanitary sewer and water construction in the 14th St. area) be removed from the table. MOTION CARRIED It was moved by Nickson, seconded by Fiedler, that Final Assessment Roll for L.I.D. 236 be approved and confirmed and the City Attorney be instructed to prepare necessary ordinance approving and confirming the assessment and assessment roll. It was moved by Kline, seconded by Sonnemann, that Pay Estimate No. 4 (final) to Cascade Asphalt Paving Co. for $247.05 be paid and the City accept the project as complete and that the retained percentage amounting to $1,276.94 be paid in thirty days provided no liens or claims are filed and clearance is secured from the State Tax Commission and the Department of Labor and In- dustries.
