The regular meeting of the City Council of the City of Auburn, convened at 8:00 P.M., in
the Auburn City Hall Council Chambers.

The meeting was called to order by Mayor Kersey.
Councilmen present: Councilmen Kline, Sonnemann, Shaughnessy, Darling, Holman, Fiedler
and Nickson.
APPROVAL OF MINUTES
It was moved by Fiedler, Seconded by Holman, that the Council Minutes of June 7, 1971 be
approved as mailed.
PUBLIC HEARINGS

Mr. ElRoy L. Childs, 1005 East Main Street, requested time to review the recommendations
of the Planning Commission which appeared on the agenda and request any action on this
request be postponed.
Mr. Bob Smythe, appearing on behalf of Two "D", Inc., stated that there were no object-
ions voiced or anyone appearing to object to the rezone request, and that the recommen-
dations of the Planning Commission have been available to the public since the first
Public Hearing was held.
It was moved by Nickson, seconded by Fiedler, that the Public Hearing on request of
Two "D", Inc., be recessed until the other Public Hearings are completed.

Mayor Kersey declared Public Hearing open on request of Duncan A. Bonjorni, Charles
A. Burgeson and George Fiori, Jr., to rezone from-A-l to C-l a parcel of property located
at 3206 Auburn Way North. (Application No. 16-71)
The Planning Commission recommends to the City Council the approval of this application
inasmuch as it conforms to the Comprehensive Land Use Plan of the City of Auburn.

Mayor Kersey declared Public Hearing open on request of Myron Massey to rezone from
M-2 to C-3, a parcel of property located between 17th Street S. E. and 21st St. S. E.
on the east side of "A" Street S. E. (Application No. 17-71)
The Planning Commission recommends to the City Council the approval of Application No.
17-71 inasmuch as it conforms to the Comprehensive Land Use Plan of the City and that
consideration be given to entering into an agreement, to run with the land, to be binding
on the petitioner, their heirs, successors and assigns, whereby:
1. The property legally described in the application, except for the west 600
feet of the North 878.80 feet, shall be restricted to places of amusement
and recreation to include such support facilities as restaurants (not including
drive-in restaurants), gift shops, sporting goods sales and service.
2. That prior to any development occurring on the easterly portion of the parcel
of land covered by the agreement, that a 6 foot high cyclone type fence with red-
wood inserts be installed on the east property line adjoining adjacent prop-
erties, said screen fence to extend 100 feet north and/or south of the limits
of the parcel of land being developed by the owner.

3. That all lighting to include yard and parking lot lighting shall be so con-
structed to direct the light away from adjacent properties.
4. The owner shall agree to dedicate, at no cost to the City, any or all of the
westerly 20 feet of the owner's property abutting "A" St. S.E. setting aside
this 20 feet for future street widening, together with an adequate turning
radius at the corner of 17th st and A St. S. E., at such time as the City of
Auburn desires to use same for street purposes. No building and/or signs shall
be constructed on this required setback. The owner shall maintain this strip
in lawn and/or landscaping but shall not be reimbursed for any improvements

lost or destroyed in the event "A" St. s. E. is widened.
5. In conjunction with the dedication of the right-of-way mentioned above, and
in the event the Public Works Department determines that to provide for traffic
safety on "A" St. S. E., a left turn lane should be constructed on"A" Street S.E.
to accommodate the left turn traffic generated by this facility, the owner shall
participate in the construction of said left turn lane in an amount to be determined
by the Public Works Department by Local Improvement District or other means.

William Zimmerman spoke in behalf of the petitioner and developers in favor of the rezone
request and said the soccer fields would not be disturbed at this time and that the lease
now in effect between the City of Auburn and Massey could be terminated by notice being
given of not less than sixty days and that the plans for development would bring employmenÉ
and new business to the area.
Susan Kimmell of 1114 3rd Street S.E., asked what the facilities would be used for.
Mr. Zimmerman explained the plans are primarily for recreational facilities.
It was moved by Fiedler, seconded by Holman, that the Public Hearing be closed.

It was moved by Kline, seconded by Darling, that the request of Myron Massey to rezone from
M-2 to C-3 be granted subject to the recommendations of the Planning Commission and that i~em
4 of the recommendations be modified to insert the verbage concerning the left turn lane in
the facility as appears in item 5.
It was moved by Shaughnessy, seconded by Darling, that there be constructed a 6 foot screen-
ing fence along the North side of Tax Lot 131 and 132 and the East side of Tax Lot 132 if
development becomes closer than 100 feet to those lots and prior to the time those lots are
rezoned. This covenant shall remain as long as property is residentially zoned.

Unclassified (County Permit) to SPU for gravel removal a parcel of property located
East of Oravetz Road and adjacent to and South of SPU Permit No. 15-70 recently granted
to Bonanza Investment Company. (Application No. 11-71)
The Planning Commission recommends to the City Council the approval of the request of Two "D"
Inc.'s Application No. 11-71 with the following conditions to be incorporated into an ordin-
ance approved by the City Council:
1. That the natural vegetation on that portion of the property lying westerly of
the water course as shown on the Reclamation Plan dated April 19, 1971, prepared
by John B. Strander, be left undisturbed and that this Restoration Plan be

attached to and be made a part of any ordinance.
2. That a bench mark be established adjacent to the site being excavated to control
grade elevations to be paid by applicant. Elevations shall be established by
U. S. Coast and Geodetic Mean Sea Level.
3. That a performance bond guaranteeing restoration of the graded area and com-
pliance with the conditions of this permit in the amount of $1,000.00 per acre
be submitted for the area to be excavated. This bond to be submitted prior to
the expiration date of the existing County permit.
4. When mining is completed on the permit area, a survey shall be submitted by
a licensed professional land surveyor showing that the excavation is in conform- I
ance with the profiles as shown on the Comprehensive Grading Plan adopted by
City of Auburn Resolution No. 457, and to be paid for by applicant.
5. Upon completion of mining on the permit area, the required rehabilitation work
shall be commenced as soon as practicable, but in no event later than 120 days
from the completion of the mining.
6. That all haul roads within the permit area or over adjacent property utilized
for truck traffic be surfaced to eliminate dust. Said surfacing to be asphaltic
concrete paving or bituminous surface treatment with crushed rock cover.

engines, be equipped with a muffler. A muffler means a device consisting of
a series of chambers, baffles or other mechanical designs for the purpose of
receiving exhaust gases from an internal combustion engine and effective in
reducing noise resulting therefrom.
9. The Department of Planning and Community Development shall have the right to
make inspections of any property at any reasonable time as deemed necessary
to determine compliance with the permit. The Department shall notify, as
deemed necessary, any operator of a proposed inspection; however, lack of such I
notification shall not be cause for denying the right to inspect. The opera-
tor shall have the option of accompanying the inspector.
Monthly inspections shall be made during the permit year by the Department
inspectors to insure compliance with the operating permit, reclamation plan,
and the plan of surface mining. Any and all deficiencies shall be immediately
brought to the attention of the operator. The operator shall commence action
within thirty (30) days to rectify these deficiencies and shall diligently
proceed until the deficiencies are corrected: PROVIDED, that deficiencies
that also violate other laws that require earlier rectification shall be cor-
rected in accordance with the applicable time provisions of such laws, or shall
immediately commence action to rectify deficiencies that involve health,
safety and water pollution, if those deficiencies are not regulated by such laws.
10. That trucks when used to haul material from the area of this permit shall not
be permitted the use of "R" Street S. E. or Howard Road entering out on to
Auburn Way South until such time as the extension of "R" Street S.E. to 17th
Street S.E. and 17th Street S.E. from "R" Street S.E. to Auburn Way South is
available of use by vehicular traffic. This shall pertain to other than local
deliveries or deliveries Easterly where the trucks must use Auburn Way South,
east of Howard Road and "R" Street S.E. The term "Loca1 Deliveries" shall mean
all deliveries made within the corporate limits of the City of Auburn. Provided,
that where the local delivery shall be within a distance of one (1) mile from
access to the Valley Freeway, the Valley Freeway shall be utilized in lieu of
"R" Street S. E. Provided further, that the above restrictions shall not I
become applicable until the Valley Freeway extensions have been completed so
that Northbound access to the freeway can be had from the 15th Street S.W. on-
ramp. Provided further, that any such truck traffic restrictions shall be
subject to any future comprehensive truck travel route program adopted by the
ci ty of Auburn.
11. Industrial performance standards shall be in conformance with those standards
established by the Q-M classification of King County, approved as of this date
and any amendments thereto.
12. This permit shall be for the removal of natural resources (sand and gravel)
with no processing of material by mechanical means allowed on the site.
13. This permit and the privileges granted herein will expire, unless earlier

modified or terminated, twenty (20) years from the date of the granting of
the permit by City Ordinance.
14. That prior to removal of any materials from the site, approvals from the State
of Washington pertaining to air, water and noise pollution and land restoration
shall be submitted to the Planning Department of the City of Auburn.
Mr. Bob Smythe, 29 I Street NE, presented his case in favor of rezone request and set
forth all the recommendations set forth by the Planning Commission and stated consideration
should be favorable by the Council, pointing out the problem of the trucks will be solved
as soon as 15th Street is completed.
Mr. George Sagaser, 1814 35th Place S.E., set forth objections to the rezone request
primarily the truck traffic, noise, dust and speed of gravel trucks. Mr. Sagaser stated
the group he represented felt the Council owe the citizens of the City of Auburn a yard-
stick to measure the truck traffic and that this application not be granted at this time.
Mr. A. L. Childs, 1005 M St. N. E., Stated he did not want to jockey around these trucks
and trailers six days and would prefer they not run up and down the streets.
Mr. Robert E. East1ing, 203 M Street, stated he had lived here for the past 21 years and
didn't care to see another truck the rest of his life; he had one day counted trucks
and within an hour period of time there were 96 trucks traveling on M Street and he asked
the Council to get these trucks off the residential streets.
Mr. Keith Thorson, 1032 10th St. N.E., stated the biggest objection he had to the gravel
removal is the trucks--the early hour of starting, and spillage.
Mr. George Pittman, 201 M Street S.E., stated he has put up with this for twenty-four
hours a day during the past year and extended an invitation to anyone to come into his
home and sit and listen to the noise of the vehicles.
Mr. Gary Gray, 522 M Street S.E., stated he has the opportunity to get up in the air and
see the ecology problem and expressed concern for the welfare and safety of his children
and the neighborhood children with the possibility of rocks flying and hitting them as
they play in their yards, and the possibility of one of them darting out and being struck
by the fast-moving gravel trucks.
Mr. Rex Wells, 1514 35th S. E. stated there should be no more trucks on R Street when 15th
Street opens, and limit the hours they start at the gravel pit.
Susan Kimmel asked Mr. Smythe about the other property owners in the area and if they
will come in the future and request gravel removal permits.
Mr. Smythe replied "yes".
Mrs. Alice Parslow, 930 M Street N. E., objected to the 35 miles per hour speed limit in
the residential area.
Mr. Jerry Heim, 310 M Street S.E., agreed with all complaints presented and in addition
requested some police action in the area.
Mrs. Martha Rosendahl complained of the noise of the trucks and that they are so loUd and
heavy they are causing the nails to come out of her house.
Mr. Smythe stated that this permit will not increase the amount of gravel trucks, -- the
pit is an existing pit in its fifth or tenth year. He continued that the petitioner request
favorable consideration for this permit.
It was moved by Fiedler, seconded by Sonnemann, that the Public Hearing be closed.
Mayor Kersey read letter from Mrs. Mayme G. Hopkins, 1117 8th Street S.E., objecting to
the truck travel, the noise and the hazard of safety in trying to cross the highway.

Police Chief Darby stated the Police Department have spent many hours with radar and that
the trucks did not exceed the thirty-five mile per hour speed limit, and are not over-
loaded and felt the truckers are doing a reasonable job.
It was pointed out by the Council that R Street and Main Street are Arterial Streets
and that granting gravel removal permits was an assurance that the land be restored to
useab1e property.
It was moved by Fiedler, seconded by Shaughnessy, that the request of Two "D", Inc., be
approved with the conditions as set forth by the Planning Commission except item 2 and 4

shall read that "same shall be paid for by the applicant".

CORRESPONDENCE
City Clerk Williams read letter from Mrs. Olive A. Clark, advising of desire to donate a
flag, flag pole, spot light and marker as a memorial to her late husband, Harold L. Clark,
former Mayor of Auburn. Mayor Kersey referred the letter to the Park Board for acceptance.
AUDIENCE PARTICIPATION

Mr. Larry Coffman, 1820 K Street N.E., from puget Sound Governmental Conference with
regard to Metro Transportation System and the possible participation of the City of
Auburn, presented brief history and facts with regard to this matter and provided mater-
ial for the Council to study in the ensuing two week period and if requested will return
to the next Council meeting.
RECOMMENDATIONS
The following items were presented by the Director of Public Works for Council approval:
Pay Estimate No.1 to C. J. Rockey Co., Inc.,for construction of St. Imp. 123,
(29th St. S.E. "A" to "R") in the amount of $27,573.97.
It was moved by Nickson, seconded by Sonnemann, that Pay Estimate No.1 to C. J. Rockey
Co., Inc., for $27,573.97 be approved for payment.

Pay Estimate No.6 to Tri-State Construction, Inc., for construction of St. Impr.
122 (West Main Street, street portion) in the amount of $51,237.38.

Construction, Inc., for $51,237.38 be approved for payment.

Impr. 124 (B St. S. W. - Main to 3rd), for $932.99.
It was moved by Nickson, seconded by Fiedler, that Pay Estimate No. 4 (final) to K10kstad
Cement Contractors for $932.99 be approved for payment, and the City accept the contract
as complete, and that the retained percentage amounting to $4,110.76 be paid in thirty
days provided no liens or claims are filed and clearance is secured from the State Tax
Commission and the Department of Labor and Industries.

Mayor Kersey announced that June 29th will be observed as Diane SèhuurDay who has
a record just released on Shasta Label available at Stolz Music Center.
Mayor Kersey announced that June 20 to 26 will be observed as Auburn Nursing Home Week.
Mayor Kersey read a letter addressed to Wilbur Mills, Chairman of the Ways and Means Comm-
ittee, united States House of Representatives, Washington, D.C., requesting support of a
concept of revenue sharing. Mayor Kersey signed the letter and asked the Councilmen to
also sign the letter if they wished.

COUNCIL COMMITTEE REPORTS
FINANCE COMMITTEE - COUNCILMAN KLINE
Councilman Kline, reporting for Finance Committee, stated that the Finance Director sub-
mitted that property tax collections for 1970 and 1971 varied by only 1/10th of one percent
for the two years.
It was moved by Kline, seconded by Sonnemann, that the Park Department be authorized to
expend the sum of not to exceed $7,000.00 for paving the road and parking areas at Isaac
Evans Park and the Park Department be authorized to call for quotes for the project.
ROLL CALL VOTE: All Councilmen voting YES.

It was moved by Kline, seconded by Darling, that the Parks and Recreation Department be
authorized to expend the sum not to exceed $3000.00 for fencing at Rotary Park.

be authorized to purchase a mimeograph machine.

authorized to purchase from the Airport a Datsun Pickup for the sum of $1,600.00.

sickle bar mower and utilize funds from sale of Datsun Pickup and purchase a rotary

Glen o. Vig and Margaret Vig, for a planting area easement on Auburn Way North.

MISCELLANEOUS BUSINESS
City Clerk Williams read special property use permit application from Roland A. Crabtree,
for regrading and earth removal, property located South of the Stuck River.
It was moved by Fiedler, seconded by Darling, that special property use permit application
from Roland A. Crabtree be referred to the Planning Commission.
