HomeMy WebLinkAbout12-20-1971 302 AUBURN, WASHINGTON MONDAY DECEMBER 20, 1971 The regular meeting of the City Council of the City of Auburn convened at 8:00 P.M., in the Auburn City Council Chambers. The meeting was called to order by Mayor Kersey. Councilmen present: Councilmen Kline, Sonnemann, Shaughnessy, Darling, Holman, and Fiedler; Councilman Nickson was excused. APPROVAL OF MINUTES It was moved by Kline, seconded by Shaughnessy, that Page 5, first and second lines, third paragraph, figure should read $67,319 of the December 6, 1971 Council Minutes. MOTION CARRIED It was moved by Kline, seconded by Shaughnessy, that the December 6, 1971 Council Minutes be approved as amended. MOTION CARRIED - PUBLIC HEARINGS City Clerk Williams read letter from Mr. and Mrs. Willard requesting that no license be issued to dog owners until their property is fenced to confine their dog to their own property at all times. City Clerk Williams read letter from T. J. Inkster in favor of tighter animal control laws. Mayor Kersey declared Public Hearing open on cat and dog licenses. Mr. Ralph Beers, 1123 4th N.E., Auburn, spoke in favor of tighter animal control laws. Robert Major, 1509 30th N.E., representing the Letter Carriers, stated the ordinance for animal control is not strong enough. Mr. Major presented photographs of his injuries re- sulting from being attacked by a dog and bitten, which required stitches and loss of work for three days because of same, and respectfully requesting stronger control of dogs. Mrs. Ida Potter, 112 G Street S.E., stated that cats and dogs can be controlled, that it is up to the owner to do so, and that people should be fined for letting their dogs run loose. Mrs. Potter stated that Margaret Dowd expresses the same views. dogs and some control should I Jens Anderson, 1111 3rd st. N.E., stated this area is overrun by be enforced with regard to this. Kenneth Muse, 1031 17th N.E., stated that putting a high price on dog and cat licenses would not be the answer, what is needed is prosecution of offenders and regulations that can be enforced. Mr. Muse advised that his thirteen year old son was badly chewwed up and required hospitalization. All that has been done is that the dog is in quarantine for a week. Diane Berthon, 2705 Alpine St. S.E., stated she would not tie her dogs up until she was forced to. She feels the dogs are protection to her children and would not think of letting her children go to the park unless accompanied by the dogs. Mr. Ben Morse, 1302 11th St. N. E., stated we should have a law the police can use and do something about animal control. Mrs. Ronald Brooke, 1011 17th St. N.E., suggested that cats be tattooed on the ear for marking. Dale Gavey, 411 4th St. N. E., suggested that owners be fined certain amounts--one, two, three or four times and then put the animal to sleep. Gus Rathsman, 1216 K Street, stated he liked dogs but wants people to take care of them and felt there are too many dogs in Auburn. I John Lea, 1240 25th S. E., urged the Council to act on this matter now and not table it. Leona Muse, asked if there is any protection for the paper boys since the dog that bit her son would be out of quarantine in a couple of days. Mr. Bereiter, City Attorney, requested that Mr. and Mrs. Muse contact him on Tuesday to go over this matter with him. It was moved by Fiedler, seconded by Holman, that the Public Hearing be closed. MOTION CARRIED Councilman Fiedler thanked the public for attending and offering their suggestions and ideas with regard to this problem. MOTION CARRIED It was moved by Fiedler, seconded by Shaughnessy, that the present license for dogs be extended for six months, the due date being July 1, of every year and the City Attorney amend necessary ordinance to reflect the new expiration date. MOTION CARRIED CORRESPONDENCE City Clerk Williams read letter from Pautzke Plumbing and Heating Inc., 1018 Main Street, Sumner, Washington, with regard to Master P1umber·s License and expiration of same on December 31, 1971. I Mayor Kersey requested the letter be referred to the Planning, Beautification and Building Codes Committee. City Clerk Williams read zone change application from Paul R. Luke, requesting zone change from R-3 to C-1, property located North side of East Main Street between J & K Street. It was moved by Sonnemann, seconded by Fiedler, that the zone change application from Paul R. Luke be referred to the Planning Commission. MOTION CARRIED Mayor Kersey read letter from John Lea requesting no action be taken on the expenditures at the Airport until a Citizen's Committee is appointed by the Mayor. Councilman Lea was advised the letter will be given due consideration at the proper time. AUDIENCE PARTICIPATION Hal Millen, 506 21st S. E., asked if the Director of Parks and Recreation had been notified of matching funds for funding Cascade Park. Len Chapman advised that he had this date received a phone call advising that 75% matching funds have been approved for Cascade Park in the sum of $69,300.00. BID OPENINGS I Bids were opened at 11:00 A.M., December 15, 1971 for legal publications for the year 1972, the following bid was submitted by Auburn Globe News: 8 Point Type $2.12 per column inch for the first publication. $.235 cents per line for the first publication. $1.91 per column inch for additional publications. $.19 cents per line for additional publications. 6 Point Type $2.62 per column inch for the first publication. $.22 cents per line for the first publication. $2.36 per column inch for additional publications. $.20 cents per line for additional publications. It was moved by Kline, seconded by Holman, that the bid be awarded to Valley Publishing Company on their 8 point type bid, and the Mayor and City Clerk be authorized to sign agreement for legal publications for the year 1972. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Bids were opened at 11:00 A.M., December 16, 1971 on Call for Bids for Street Improvement No. 142, with bids submitted as follows: I BIDDER ASSOCIATED SAND AND GRAVEL WASHINGTON ASPHALT WOODWORTH & CO. TOTAL BID $64,489.10 67,627.10 77,537.35 The above bids included sales tax; the above bids were accompanied by Bid Bonds. It is the recommendation of the Director of Public Works that the contract be awarded to Associated Sand and Gravel Co., on their low bid of $64,4?9.10 including sales tax. It was moved by Sonnemann, seconded by Holman, that bid be awarded to Associated Sand and Gravel Co. on their low bid of $64,489.10 including sales tax. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED It was moved by Sonnemann, seconded by Shaughnessy, that upon signing of the contract the bid bonds of the two remaining bidders be returned. MOTION CARRIED 304 AUBURN, WASHINGTON MONDAY DECEMBER 20, 1971 Bids were opened at 11:30 A.M., December 16, 1971 on Call for Bids for Sanitary Sewer No. 18, with bids submitted as follows: BIDDER TOTAL BID C. It is the recommendation of the Director of Public Works that the contract be awarded to C. J. Rockey Co., on their low bid of $11,178.04 including sales tax. It was moved by Shaughnessy, seconded by Darling, that the bid for Sanitary Sewer No. 18 be awarded to C. J. Rockey and that the bid bonds of all but the three lowest bidders be returned. It was moved by Kline, seconded by Darling, that the motion be amended to include that "upon signing of the contract the remaining bid bonds be returned." ROLL CALL VOTE ON MOTION AS AMENDED: All Councilmen voting YES. MOTION CARRIED MOTION CARRIED RECOMMENDATIONS The following item was submitted by the Planning Director to Call for Public Hearing: The application of Karl Keller, to rezone from Unclassified to Heavy Commercial (c-3), a parcel of land located at the Northeast corner of the intersection of "A" Street S.E. and Ellingson Road (2836 "A" Street S.E.). It was moved by Fiedler, seconded by Sonnemann, that Public Hearing be held January 3, 1972 on application of Karl Keller, at 8:00 P.M. MOTION CARRIED I The following items were submitted for approval by the Director of Public Works: Change Order No.4 to C. J. Rockey Co., Inc., for increase of $985.68 for construction of st. Imp. 120, 12th St. S. E. This reflects changes to traffic signal at 12th S.E. and Auburn Way South made after construction started and a more detailed study was made. It was moved by Sonnemann, seconded by Darling, that Change Order No. 4 to C. J. Rockey Co., Inc., for increase of $985.68 be approved. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Pay Estimate No.8 to C. J. Rockey Construction Co. for $42,788.50 for St. Imp. 120, construction of 12th Street S.E. It was moved by Sonnemann, seconded by Shaughnessy, that Pay Estimate No.8 to C. J. ROCKEY CO., INC. for $42,788.50 be approved for payment. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Pay Estimate No. 9 to Tri-State Construction Co. for $10,263.23 for St. Imp. 122, construction of West Main Street. It was moved by Sonnemann, seconded by Holman, that Pay Estimate No. 9 to Tri-State Construction Co., for $10,263.23 be approved for payment. I ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Pay Estimate No. 3 to Coulee Construction Co. for $36,069.45 for st. Imp. 104, Phase II, 17th St. S.E. & "R" st. S.E. construction. It was moved by Holman, seconded by Sonnemann, that Pay Estimate No. 3 to Coulee Construc- tion Co. for $36,069.45 for construction be approved for payment. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Pay Estimate No.1 to M.A. Sega1e for $5,272.50 for Schedule II (Water) of St. Imp. 101, 15th St. N.E./N.W. construction. It was moved by Shaughnessy, seconded by Sonnemann, that Pay Estimate No. 1 to M. A. AUBURN, WASHINGTON MONDAY DECEMBER 20, 1971 3 () t) Sega1e for $5,272.50 be approved for payment. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Authority to hold public hearing on final assessment roll of L.I.D. 252 (West Main Street undergrounding) on January 17, 1972. It was moved by Sonnemann, seconded by Shaughnessy, that Public Hearing on Final Assessment Roll of L.I.D. 252 be held January 17, 1972 at 8:00 P.M. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED I Creation of L.I.D. 266, underground power L.I.D. on 12th Street N. E. between Auburn Way North and Harvey Road. It was moved by Kline, seconded by Shaughnessy, that the City Attorney be instructed to prepare necessary ordinance to implement L.I.D. 266. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Change Order No. 1 for decrease of $2,416.05 to multi-purpose building at Les Gove Park, Lone Bros. Construction, contractor. Changes to heating plant, plumbing and ventilation, City to do trenching. It was moved by Darling, seconded by Fiedler, that Change Order No. 1 for decrease of $2,416.05 be approved. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED PROCLAMATIONS, APPOINTMENTS AND ANNOUNCEMENTS Mayor Kersey announced that the Library Board meeting scheduled for December 22 would be held on December 29th instead. Mayor Kersey announced the new Councilmen will be seated at January 10, 1972 Council Workshop Meeting. Judge Murray McLeod will administer the oath to the Councilmen Elect. I COUNCIL COMMITTEE REPORTS AIRPORT COMMITTEE - KLINE Councilman Kline reviewed the Airport Committee Minutes which are of public record. It was moved by Kline, seconded by Shaughnessy, that invoice of McCool-McDonald for hangar construction in the sum of $1,079.60 be approved for payment. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED It was moved by Kline, seconded by Holman, that the invoice of McCool McDonald for architectural services for preliminary design of the airport restaurante be approved in the amount of $8,250.00 for payment. ROLL CALL VOTE: Councilmen Kline, Sonnemann, Sbaughnessy, Darling, Holman voting YES. Councilman Fiedler voting NO. MOTION CARRIED It was moved by Kline, seconded by Darling, that the invoice from McCool-McDonald for architectural services in design of flight services building in the sum of $1,415.00 be approved for payment. I ROLL CALL VOTE: Councilmen Kline, Sonnemann, Shaughnessy, Darling and Holman voting YES. Councilman Fiedler voting NO. MOTION CARRIED It was moved by Kline, seconded by Shaughnessy, that the City Attorney be instructed to prepare lease for the trailer for use at the airport in accordance with the stipulations set forth in the Airport Committee Minutes of December 9, 1971. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED It was moved by Kline, seconded by Holman, that the price of gasoline be 48.8 for 80 octane gasoline and 53.8 for 100 octane gasoline at the airport and oil be at the rate of 75¢ a quart commencing January 1, 1972. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED 306 AUBURN, WASHINGTON MONDAY DECEMBER 20, 1971 FINANCE COMMITTEE - KLINE It was moved by Kline, seconded by Holman, that the City Treasurer be authorized to rein- vest $200,000.00 in Airport Construction Fund Money and $100,000.00 Street Fund money. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED It was moved by Kline, seconded by Holman, that the City Clerk be authorized to call for bids on the Flight Service Center Building at the Airport, said construction to be paid from unexpended airport construction bond funds. ROLL CALL VOTE: Councilman Kline, Sonnemann, Shaughnessy, Darling, and Holman voting YES. Councilman Fiedler voting NO. MOTION CARRIED I PUBLIC SAFETY COMMITTEE-SONNEMANN Councilman Sonnemann advised that the Committee on Committees will meet Wednesday, December 29, 1971 at 7:30 P.M. It was moved by Sonnemann, seconded by Fiedler, that the City Clerk be authorized to call for bids for four police cars for delivery after the first of the year for the Police Department. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED UTILITY COMMITTEE - SHAUGHNESSY Councilman Shaughnessy reported the Utility Committee will meet December 29, 7:30 P.M. NEW BUSINESS It was moved by Kline, seconded by Holman, that the Mayor and City Clerk be authorized to sign agreement with the Fire Fighters. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED ORDINANCES AND RESOLUTIONS ORDINANCE NO. 2604 I It was moved by Holman, seconded by Shaughnessy, that Ordinance No. 2604 entitled "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, APPROVING AND CONFIRMING THE ASSESSMENTS AND ASSESSMENT ROLL OF LOCAL IMPROVEMENT DISTRICT NO. 261, WHICH DISTRICT HAS BEEN CREATED AND ESTABLISHED FOR THE CONSTRUCTION AND INSTALLATION OF TEN (10) INCH AND TWELVE (12) INCH SANITARY SEWERS, SIDE SEWERS AND APPURTENANCES, AS PROVIDED BY ORDINANCE NO. 2558 OF THE CITY OF AUBURN, AND LEVYING AND ASSESSING THE AMOUNT THEREOF AGAINST THE SEVERAL LOTS, TRACTS, PARCELS OF LAND AND OTHER PROPERTY ðJPON SAID ROLL" be intro- duced and adopted. MOTION CARRIED ORDINANCE NO. 2605 It was moved by Sonnemann, seconded by Fiedler, that Ordinance No. 2605 entitled "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, RELATING TO AND PROVIDING FOR THE ANNEX- ATION TO THE CITY OF AUBURN OF A CONTIGUOUS AREA OF LAND LYING ADJACENT TO THE WESTERLY MARGINAL LINE OF THE EXISTING CITY LIMITS OF THE CITY OF AUBURN, WHICH LAND IS DESCRIBED IN A PETITION DULY FILED WITH THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON" (MEREDITH ROAD ANNEXATION) be introduced and adopted. MOTION CARRIED ORDINANCE NO. 2607 It was moved by Shaughnessy, seconded by Sonnemann, that Ordinance No. 2607 entitled "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR THE CONSTRUCTION AND INSTALL- ATION OF UNDERGROUND POWER LINES TO BENEFIT THE PRIVATE PROPERTY ABUTTING 12TH STREET N. E. MOTION CARRIED RESOLUTION NO. 494 I It was moved by Fiedler, seconded by Holman, that Resolution No. 494 entitled "A RESOLUTION OF THE CITY OF AUBURN, WASHINGTON, AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO SIGN, ON BEHALF OF THE CITY, AN AGREEMENT BETWEEN THE CHICAGO, MILWAUKEE, ST. PAUL AND PACIFIC RAILROAD; THE OREGON-WASHINGTON RAILROAD AND NAVIGATION COMPANY AND ITS LESSEE, THE UNION PACIFIC RAILROAD COMPANY AND THE CITY OF AUBURN PROVIDING FOR THE IMPROVEMENT AND UPGRADING OF THE EXISTING AUTOMATIC SIGNALS (CANTILEVER SIGNALS) AT WEST MAIN STREET, AUBURN, WASHINGTON" be introduced and adopted. MOTION CARRIED RESOLUTION NO. 495 It was moved by Holman, seconded by Fiedler, that Resolution No. 495 entitled "A RESOLUTION OF THE CITY OF AUBURN, WASHINGTON, AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE, ON BEHALF OF THE CITY, AN AGREEMENT WITH KING COUNTY, WASHINGTON AND THE CITY OF AUBURN, WASHINGTON PERTAINING TO THE CONSTRUCTION OF THE LEA HILL OR PORTER BRIDGE ACROSS THE GREEN RIVER" be introduced and adopted. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED RESOLUTION NO. 496 It was moved by Darling, seconded by Holman, that Resolution No. 496 entitled "A RESOLUTION OF THE CITY OF AUBURN, WASHINGTON, ADDRESSED TO THE HONORABLE DANIEL J. EVANS, GOVERNOR OF THE STATE OF WASHINGTON, PURSUANT TO THE PROVISIONS OF SECTION 4, CHAPTER 109, LAWS OF 1971, EXTRAORDINARY SESSION, (ENVIRONMENTAL POLICY ACT OF 1971) PROPOSING MEASURES AS MAY BE NECESSARY TO BRING THE AUTHORITY AND POLICIES OF THE CITY OF AUBURN, WASHINGTON IN CON- FORMITY WITH THE INTENT, PURPOSES AND PROCEDURES SET FORTH IN SAID ACT" be introduced and adopted. MOTION CARRIED RESOLUTION NO. 497 It was moved by Kline, seconded by Fiedler, that Resolution No. 497 entitled "A RESOLUTION OF THE CITY OF AUBURN, WASHINGTON, AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO SIGN, ON BEHALF OF THE CITY, A COLLECTIVE BARGAINING AGREEMENT FOR THE CALENDAR YEAR 1972 WITH AUBURN FIRE FIGHTER LOCAL UNION NO. 135:2, ACCORDING TO THE CONTRACT TERMS AGREED UPON BY THE CITY COUNCIL AT THEIR REGULAR MEETING THE EVENING OF DECEMBER 20, 1971" be introduced and adopted. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED MISCELLANEOUS BUSINESS Mayor Kersey extended season's greetings to the Council and public. There being no further business to come before the Council the Mayor adjourned the meeting at 10:15 P.M. APPROVED THIS 21ST DAY OF DECEMBER, 1971.
