The regular meeting of the Auburn Ci ty Council convened at 8 :00 P.M., in the Auburn
Ci ty Counci I Chambers.
ROLL CALL
Councilmen Present: Councilman Lawler, Kitchell, Craig, Darling, Holman, Flechsig
and Lea .
APPROVAL OF l1INUTES
It was moved by Holman, seconded by Darling, that the Council Minutes of June 3, 1974,
be approved wi th the following correction: Delete the -ç,lord "Executi ve" on page four,
line one, under Miscellaneous Business.

PUBLIC HEARINGS
The City Clerk read a letter from the Director of Public Works, Pat Nevins, regarding
the final assessment roll for L.I.D. 279.
Mayor Kersey declared Public Hearing open on the Final Assessment Roll for L.I.D. 279,
street and sanitary sewer construction on 16th Street S.E., from "A" Street S.E. to
a point east of "B" Street S.E.
Earl K. Jones, of 111 17th Street S.E., asked what his total assessment for the
project is. Mr. ,Nevins stated that the actual cost is shown on Mr. Jones statement
and he pointed out that the cost is less than the preliminary figure had been.
Mr. Jones stated that there is still a dust problem in the area, as well as flooding
at the end of 16th Street S.E., and the blacktop is creating a bli~tering problem
in the heat. Mr. Nevins stated that the City has helped these problems somewhat;
however, the problems have not been entirely eliminated. Mr. Nevins stated more work is
scheduled in the· future and some funds' hàvebeen 'budgeted; however, he cannot:...:guarantee
when the work will 'begin or'-:ff the work, done in-the future will completely ,eliminate
~1e pÁ~blem. Mr. Nevins stated he would contact the contracfor regarding the problem.

Verne Whiting, of 107 16th Street S.E., stated he has no complaints and he is very
pleased with the work that has been done. ~
H. A. Grilley, of 1512 "A" Street S.E., stated he lives on the corner of "A" Street S.E.
and 16th Street and as mentioned earlier, there is a problem in regard to flooding
at this location. Mr. Grilley stated that when the project was originally begun,
he had been told that the drainage problem would be completely eliminated. Mr. Grilley
also mentioned the dust problem and stat~d he feels these problems should be looked
into.
It was moved by Lea, seconded by Holman, that the Public Hearing be closed.

It was moved by Lea, seconded by Holman, that the Final Assessment Roll for L.I.D.
No. ~79 be confirmed and the City Attorney be directed to draw up the necessary
ordinance approving and confirming the assessments and the assessment roll.
ROLL CALL VOTE: All Councilmen voting YES.

Pat Nevins, Director of Public Works, reported on the Comprehensive Six-Year Street
PliJn and pointed out several important facts in regard to same. He stated that the
City of Auburn must have the Street plan because it is a State Law and the Comprehensive
Street Plan must be developed each year to include the next six years. The reason for
a six year ,plan is to include street projects over a long period of time. Actually
there are many more projects listed in the plan than the City could ever complete;
however, if we were able to do more work and we requested State or Federal Aid for
street improvement, we would not jeopardize our position because the project would
be listed on the Comprehensive Six-Year Street Plan.
Mayor Kersey declared Public Hearing open on the Six Year Comprehensive Street Plan.
Mr. Grilley asked when work would begin on 15th Street S.E. and "A" Street S.E.

date, even if the City goes before the Urban Arterial Board and funds were approved;
however, Mr. Nevins pointed out that chances for getting funds from the Board are
limited and there is no specific time to do the project.

Mayor Kersey stated that because of a severe drop in the use of gasoline, the Urban
Arterial Board is in deep trouble and less funding is available (the Board obtains its
funds through the 1/2¢ Gas Tax). If funds should become available, the City will join
in and tile project will begin.
Mr. Grill?y also stated that he is concerned over further work in this area because
he is already paying on the assessment for L.I.D. 279 and if further work is done there
would be:: another assessment. Mr. Nevins stated that 6':"nce Mr. Grilley lives on a
corner loc, he would not be assessed for the 120 Íeet again - also the Urban ArteriaL
Board Funds would pay for most of the project.
Mr. Earl Jones asked what is being done about the junk yard on 17th Street S.E.
The. Mayor stated we are not encouraging it and the problem would be looked into.
It was moved by Lea, seconded by Craig, that the Public Hearing be closed.

Councilman Lawler asked if the Plan included any studies relative to changing of
traffic signals, such as the plan adopted by other ci ties to prevent car traffic from
charging into pedestrians. Mr. Nevins stated that the plan does not include traffic
signaling at this time; but, he would be willing to talk to Councilman Lawler about
tllis matter. Councilman Lea pointed out that a new concept of signaling was discussed
at a prior Committee Meeting. The signals discussed work on a cam and they keep an
eye on pedestrians and help protect and alleviate auto-pedestrian accidents. It was
pointed out that the signal located on 8th Street N.E. and Harvey Road is the first
of its kind in the City and the second in the State of Washington.
Mr. Jones stated that Armena Vuga had asked him to check witl1 the City and find out
why she had not received copies of her L.I.D. assessment. Pat Nevinp. stated he would
look into this and report later in the meeting.
It was moved by Lea, seconded by Holman, that Resolution No. 638 entitled "A RESOLUTIQN
OF THE CITY OF AUBURN, WASHINGTON, ADOPTING THE 1975-l980 BIENNIAL REVISIONS AND
EXTENSIONS OF THE COMPREHENSIVE STREET PROGRAM OF THE CITY OF AUBURN, PURSUANT TO
R. C. W. CHAPTER 35.77 OF THE LAWS OF THE STATE OF WASHINGTON." be adopted.

AUDIENCE PARTICIPATION
Mrs. Virginia Sheldon, of 1315 24th Street S.E., stated shc is interested in the
Gambling Ordinance and she wonders if it will be up for consideration this evening.
Councilman Craig mentioned that the ordinance has been discussed at length at several
of the Public Safety Committee Meetings in the past and there has been a great deal
of input from the citizens of Auburn. The Public Safety Committee has recommended
adopting all forms of gambling allowed by State Law. and the Commi ttee feels it is
Grirr!ri ng out the wishes of the majori ty of the ci tizens. The Mayor pointed out that
he has been contacted by a number of elderly persons 'whom have indicated their
dC$ires for card games, etc., and it has appeared that the majority of the people
wish to approve gambling in the City. Mrs. Sheldon stated she can understand the
position of the elderlYi however, sl1e feels if gambling is approved, we are giving
it our blessing.' and she personally feels this is a trap.
Mrs. Barbara Campbell, of 415 Western Street, mentioned she had written a letter to
the Mayor regarding a dust problem and drainage problem on Western Street and the
neighboring property. Mayor Kersey stated he had just received the letter today
and stated the problem has been partially solved and Mr. NevinS will look further into
the matter tomorrow morning. Mrs. Campbell indicated that she had contacted the
vlright Compal~y and had been told that an oil surface would be put on, but so far
nothing has been done and the problem is getting worse.
Gary Swanson, of 20 Western Street, said he would like to know what the plan is for
the dust and drainage problem in the area mentioned. Pat Nevins stated that he would
talk ¡1ith the contractor tomorrow. He stated the contractor had indicated that they
would keep the dust down and if an acceptable surface is not put on the road, load
limits will be placed in the area. Mr. Nevins stated that the contractor has shown
good faith in the past and he hopes they will follow through on this problem also.
Mayor Kersey stated he is sure something will be done before this winter because the
contractor will begin work again in about 75 days. The staff has worked with the

l1r. Nevins referred back to the question regarding Mrs. Vuga receiving information on
her L.I.D. assessment. Mr. Nevins stated that our records indicate a certified letter
was mailed to a Mrs. Mary Errigo of Tacoma, who is on record as the property owner,
and tl}.,?, porrna1,,_prQc,,?dures were followed in trying to contact the indi vidual. No
correspondence has been returned or received from the property owner.

RECOMMENDATIONS
The following items were submitted by the Director of Planning and Community Development,
George Schuler, for Council Approval:
Call for Public Hearing on the request for a Preliminary Plat known as "Apple

It was moved by Craig, se~onªed by Lea, that a Public Hearing be held on the Preliminary
Plat known as "Apple Blossom Manor" (Application No. P-1-74) on July 1, 1974, at
8:00 P.M. in the City Council Chambers.

Call for Public Hearing on the request of the Auburn Eagles to rezone from R-4
(Multiple-Family) to a Conditional Use Permit, a piece of property located on
the east side of "M" Street S.E. in the 700 block approximately 500 feet south
of the Tacoma-North Bend Freeway (Sign Route 18). To construct a lodge hall
and related facilities. (Application No. 7-74)
It was moved by Holman, seconded by Lawler, that a Public Hearing be held on the
rezone request of the .AuburnEagles (Application No. 7-74) on July 1, 1974, at
8: 00 P. M. in the Ci ty Co unci I Chambers.

PROCLAMATIONS, APPOINTMENTS AND ANNOUNCEMENTS
Mayor Kersey announced that Dog and Cat Licenses are due on July 1, 1974.
The Mayor also announced that he received a memorandum from Chief Seyler regarding
the Pistol Shoot Competition held on June 8, 1974. The team representing Auburn
consisted of Sgt. Gordon Stephenson and Patrolmen Rex Baker,¡Marion Dukes, James
Monnett, and Ed Wol ters. The men recei ved a trophy for the Ci ty and Mayor Kersey
congratulated them on their shooting competition.

Mayor Kersey announced that a letter was received from George Wannamaker, of the
Soil Conservation Service, asking for a meeting with the City of Auburn to discuss
the Soil Conservation Plan. It appears that there will be a problem in meeting
with all Councilmen present, because of vacations, until August; therefore, the Mayor
suggested that the meeting be held on the second Monday in August. The Mayor also
announced that RIBCO would like to make a presentation to the City of Auburn and
that meeting will be scheduled for the fourth Monday in August. It was pointed out
that if there should be any conflicting meetings or another date should be more
suitable, the meetings scheduled could be changed.
Mayor Kersey announced that fifty drum and bugle corps units will be competing in
the Auburn area during the ~.,eek of June 24 through 30, 1974, and Auburn's famous
Black Watch Drum and Bugle Corps will be participating in a parade in Auburn on
June 28, 1974; therefore, Mayor Kersey proclaimed the week of June 24 through 30,
1974, as "Drum and Bugle Corps Week", in the City of Auburn, Washington, and urged
all our citizens within the Auburn Community to join in said observance and to
enjoy the fine music and entertainment presented by the young ladies and gentlemen.
Competition will be held at the Sumner Football Field on. Saturday, June 29, 1974,
a.t 7:00 P.M.
COUNCIL COMMITTEE REPORTS
AIRPORT COMMITTEE - CHAIRMAN KITCHELL
The Airport Committee met at 7:30 P.M. on June 4, 1974. Chairman 'Kitchell reported
on the meeting and the Committee Minutes are a matter of Public Record, on file in
the City Clerk's Office.
PUBLIC SAFETY COMMITTEE - CHAIRMAN CRAIG
The Public Safety Committee met at 7:30 P.M. on June 12, 1974. Chairman Craig repor-ted
on the meeting and the Committee Minutes are a matter of Public Record on filA in
the Ci ty Clerk's Office.
Chairman Craig reported that the Committee discussed the Gambling Ordinance and after
listening to the input of citizens, the Committee recommends that Ordinance No. 2822
be adopted with one change recommended by the Committee: Section 3, Subsection C,
5% be cha.nged to read 7 1/2%.

ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, AUTHORIZING, WITHIN THE CITY LIMITS
OF AUBURN, ALL GAMBLING ACTIVITIES AUTHORIZED BY THE LAWS OF THE STATE OF WASHINGTON;
REQUIRING REPORTS OF SUCH ACTIVITIES; IMPOSING A TAX THEREON; AND PROVIDING FOR PENALTIES. II

read 7 1/2%.

and the City is following up the desires of the citizens. He termed the ordinance
a good compromise and stated the ordinance designates a City of Auburn Tax on
gambling and sets forth reporting procedures.
Mayor Kersey asked the City Attorney if there would be any problem with the filing
date being set simultaneously with the City of Auburn and the Washington State Gambling
Commission. Mr. Bereiter stated he feels this would simplify the procedure and he does
not anticipate problems; however, if problems do arise, the ordinance can be changed.
The City Attorney suggested that the Council go ahead and try the procedures as
indicated in the ordinance and then improve upon the procedures should it be necessary.
ROLL CALL VOTE: All Councilmen voting YES.
MOTION CARRIED
Councilman Craig reported that Chief Seyler indicated that $16,500 is now available
for replacement of five cars, with five new patrol cars, for the police department -
utilizing Revenue Sharing Funds.
It was moved by Craig, seconded by Holman, that authorization be given to Call for
Bids for five new' Patrol Cars.
ROLL CALL VOTE: All Councilmen voting YES.
MOTION CARRIED
The Committee discussed the dance application submitted by the White River Buddhist
Church. The Bon Odori Folk Dance is to be held on August 3, 1974, and the Committee
recommends approval of the dance application.
It was moved by Craig, seconded by Lawler, that a Public Dance Permit be issued to
the White River Buddhist Church for a Bon Odori Folk Dance on August 3, 1974.

PLANNING AND BEAUTIFICATION COMMITTEE - CHAIRMAN DARLING
The Planning and Beautification Committee met at 7:30 P.M. on June II, 1974. Chairman
Darling reported on the meeting and the Committee Minutes are a matter of Public
Record, on file in the City Clerk's· Office.
FINANCE COMMITTEE - CHAIRMAN HOLMAN
Chairman Holman announced that the next Finance Committee Meeting will be held at
7:30 P.M. on June 27, 1974. Councilman Holman reported that the Association of
Washington Cities Convention was very interesting and informational.
UTILITY COMMITTEE - CHAIRf.:fAN FLECHSIG
The Utility Committee met at 7:30 P.M. on June 6, 1974. Chairman Flechsig reported
on the meeting and the Committee Minutes are a matter of Public Record, on file in
the City Clerk's Office.
Chairman Flechsig reported that the Committee discussed the latest computer printout
regarding the sewer rate increase and asked a number of questions regarding the necessity
for the increase. The Committee re-concurred the need for the increase and the amount
indicated for the initiál year and the fnV?wing years to and including 1979. The
Committee recommends that the City Council hold a Public. Héaringat 7:30 P.M. 'on
July II, 1974, for the purpose of reviewing the proposed sanitary sewer rate increase.
It was moved by Flechsig, seconded by Craig, that a Public Hearing be held at 7:30 P.M.
on July 11, 1974, for the purpose of reviewing the proposed sanitary sewer rate increase.
MOTION CARRIED
The next Utility Committee Meeting will be held at 7:30 P.M. on June 20, 1974.
STREET COMf.:fITTEE - CHAIRMAN LEA
The Street Committee met at 7:30 P.M. on June 5, 1974. Chairman Lea reported on

Chairman Lea announced that the next Street Committee Meeting will be held at
7:30 P.M. on June 19, 1974, in the Public Works Department.
Councilman Lea asked that he be excused from the next Coti.ncil Meeting, as he will
be on vacation. He also stated he is in possession of~ letter from Dave Mooney
in regard to a meeting at the Kent City Hall on June 26, 1974. Since he will

OLD BUSINESS
The City Clerk read the title of Ordinance No. 2820, entitled "AN ORDINANCE OF THE
CITY OF AUBURN, WASHINGTON, CREATING AN AUBURN MUNICIPAL AIRPORT ADVISORY BOARD;
SPECIFYING THE NUMBER OF MEMBERS THEREOF, THE METHOD OF APPOINTMENT THEREOF AND THE
TERMS THEREOF; AND ESTABLISHING THE AREAS PERTAINING TO THE OPERATION OF THE AUBURN
MUNICIPAL AIRPORT THAT SAID BOARD WILL BE CALLED UPON TO COUNSEL AND ADVISE THE CITY
OF AUBURN ABOUT.". Ordinance No. 2820 was introduced only at the Council Meeting,
of June 3, 1974.
It was moved by Flechsig, seconded by Lea, that Ordinance No. 2820 (title listed above)
be adopted.
ROLL CALL VOTE: All Councilmen voting YES.

It was moved by Craig, seconded by Holman, that Ordinance No. 2821 entitled "AN

1.26.050 REGARDING RESTRICTIONS ON LEAVE WITHOUT PAY FOR AUBURN CITY EMPLOYEES."

CITY CLERK, TO SIGN, ON BEHALF OF THE CITY, AN AGREEMENT BE'rrvEEN THE CITY AND LAMBUTH,
SILL AND SPRAGUE, INC., AUTHORIZING THE CITY TO UTILIZE CERTAIN REAL PROPERTY OF
SAID LAMBUTH, SILL AND SPRAGUE, INC." be adopted.

There being no further business to come before the Council, Mayor Kersey adjourned
the meeting at 9:47 P.M.
