The regular meeting of the Auburn City Council convened at 8:00 P.M., in the Auburn
Ci ty Council Chambers.

APPROVAL OF MINUTES

Mayor Kersey introduced Mark Premo -of the Department of Ecology and Ted Mallory of
Metro. He stated that the two gentlemen are in the audience for the purpose of discussing
or answering questions in regard to Resolution No. 653 - the National Pollutant Discharge
Elimination System Permit.
Councilman Flechsig stated that he has no way of telling how strong the Department of
Ecology will be in the elimination of storm water inflow and infiltration and he questioned
if the Department of Ecology is particularly interested in the elimination of storm water,
haw high is that on their priority list. Mr. Premo stated that the priority for the
Ci ty of Auburn is very low because we are tying in wi th the Metro Plant. However, if
there is a lot of infiltration on the streets, the Department of Ecology would look
at the affected area separately.
Councilman Flechsig also stated that six lift stations are listed on page four of
their permit. and he wondered if the City would have any problems because they are all
listed as storm sewers. Mr. Premo said no.
Councilman Craig stated that page 3, section S4, states the prov~s~ons for electrical
power failure. He pointed out that several of the City lift stations are powered
by electricty and he wondered if this might create an open door for someone to come
in and revise the Auburn Sewer System. Mr. Premo stated that they require safeguards
be made to prevent the discharge of untreated or inadequately treated wastes during
an electrical power failure and therefore, an alternate power source needs to be
available for emergency purposes. He pointed out that permittees who do not have
such a back up system, are required to furnish to the Department of Ecology, within
six months after the issuance of a permit, a program including implementation
schedule to cover same.

Pat Nevins stated that if he understands correctly, sometime in the future Metro
will update the Renton Treatment Plant and it would be cost effective at that time
to make infil tration - a.nd inflow improvements in our system. - Nr. Mallory
stated that the City Consultant did a study on our system and because of our capabilities,
it was not cost effective to come into the City and separate our sewer system. However,
as Mr. Nevins stated, when the Renton Plant capacity is used up or other upstream problems
occur, it may then be cost effective to cause separation. The guidelines for cost
effectiveness at this time may not be correct at a later date.
It was moved by Flechsig, seconded by Holman, that Resolution No. 653 entitled "A
RESOLUTION OF THE CITY OF AUBURN, WASHINGTON, AUTHORIZING THE CITY OF AUBURN TO APPROVE
THE NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM PERMIT DRAFT, NO. WA-002399-0,
FROM THE STATE OF WASHINGTON, DEPARTMENT OF ECOWGY." be adopted.

Councilman Flechsig asked Ted Mallory if he could report on the status of our present I
funding and asked if he knew how soon we would get our money back on our inflow study.
Mr. Mallory stated that latest word from the Environmental Protection Agency is that
they are now reviewing the contract plans for the Auburn Interceptor. Metro expected
that they would have completed that by now and they were advised that the City could
expect a grant offer by the end of the month - he pointed out that is not a promise¡
but if we do in fact get a grant offer by the end of the month, ~heywóulà expect
to award a contract about the 1st of December for the interceptor. He stated the _
City would not receive any funds under the grant until Metro receives their first
construction payment on their progress and that would probably be the first quarter
of the year.

Carol Anderson, of 112 "D" Street N.W., stated that she had spoken to the Mayor in
regard to sidewalk repairs being made in her area and she wondered if Federal Funds
were available for the project. Mayor Kersey said no; however, he mentioned that
the project could be completed by one of two methods: (1) a service club could
offer to take over the project or (2) an LID would be formed and the people in the
area would pay for the project. The Mayor mentioned that estimates on the project
indicate the cost to be approximately $1,000 and the cost would be divided according
to the length of sidewalk repaired on each property owners lot. He pointed out that
he is aware that many of the people in that particular area cannot afford the LID,
however, the City and property owners are responsible for the condition of the
sidewalks in the City.

Mrs. Anderson also asked about the property, in front of the medical center, on
Harvey Road and asked what information was available in regard to buildi'ngs with
access to the handicapped. Mayor Kersey stated that after January 1, 1975, all
buildings constructed and open to the public múst have access to the handicapped.
He explained that because of a grandfather clause, buildings constructed prior_to
that date will not have to be altered or changed to meet that requirement.

Bob VanSiclen, representing the Chamber of Commerce, asked to be allowed to speak
in regard to Ordinance No. 2847 (General Licensing Ordinance). He requested that
he be allowed to reserve his comments until later when this item is discussed.
The Council agreed with the request.

Bids were opened October 17, 1974, ll:OO A.M., for Contract No. 74-l, demolition of
three (3) single-family dwellings and accessory buildings which are located at:

It is the recommendation of the Director of Planning & Community Development, George
Schuler, that Contract No. 74-l, demolition of three single-family dwellings and accessory
buildings be awarded to Lloyds of Washington on their total bid, including sales tax,
of $3,106.35.
It was moved by Darling, seconded by Lea, that Contract No. 74-1, demolition of three
single-family dwellings, be awarded to Lloyds of Washington on their low bid of
$3,106.35 and the Mayor and City Clerk be authorized to sign the contract. Upon
signing of the contract, bid bond to be returned to South Acres Bulldozing.

It is the recommendation of the Director of Public Works, Pat-Nevins, that the contract
fo~ Sidewalk Improvement No. 1 be awarded to Klokstad Concrete Construction on their
bid of $2,835.25 since the apparent low bidder, Concrete Contractors, had several
errors and inconsistencies and requested to withdraw their bid.
It was moved by Lea, seconded by Darling, that the contract for Sidewalk Improvement
No.1 be awarded to Klokstad Concrete Construction on their bid of $2,835.25 and the
Mayor and City Clerk be authorized to sign the contract. The bid from Concrete
Contractors is dismissed and bid bonds to be returned to Gary !1erlino Construction
and E. P. & N. Construction and upon signing of the contract, bid bonds to be returned
to Valley Cement Construction and Betz Concrete Finishing.

Mayor Kersey proclaimed October 24, 1974, as United States Day and urged all patriotic

COUNCIL COMMITTEE REPORTS
BUILDING COMMITTEE - CHAIRMAN LAWLER
The Building COmrnŒttee met at 7:30 P.M. on October 14, 1974. Chairman Lawler reported
on the COmrnŒttee Meeting and the Minutes are a matter of Public Record on file in
the City Clerk's Office.
The next Building COmrnŒttee Meeting will be held on November 12, 1974, instead of I
November 11 as regularly scheduled, as November 11 is the day the City of Auburn will
observe the Veteran's Day Holiday.
PUBLIC SAFETY COMMITTEE - CHAIRMAN CRAIG
The Public Safety Committee met at 7:30 P.M. on October 16, 1974. Chairman Craig
reported on the Committee Meeting and ±he Minutes are a matter of Public Record on
file in the Ci ty Clerk's Office.
Chief Larry Scyler spoke to the COmrnŒttee and indicated that he had received a
communication from Len Chapman regarding the playing of bingo by Senior Citizens
in the Senior Citizens Center. Communication has been received from the State Gambling
Commission indicatiñg that senior citizens maÿ play bingo without a license as
long as no money is paìd for prizes and no actual gambling takes place.
It was moved by Craig, seconded by Darling, that Council grant authority to the
Senior Citizens to pläy bingo at the Senior Citizens Hall.

Councilman Flechsig ABSTAINED.

Councilman Darling requested that he and the Street Committee Members receive a
copy of the speed limit survey results for Fourth Street S.E., from Auburn Way South
to "M" Street S.E. and also a copy of Chief Scyler's letter regarding the reduction
of speed limits on Auburn Way South and Auburn Way North.

~ayor Kersey asked Lt. Mulkey if he would see that the_Str~et Committee Members, and
himself, be provided with the above mentioned information and correspondence.
Councilman Craig also mentioned that Carol Anderson had spoken in regard to having
a number of wider parking spaces available in the downtown area. The wider spaces
would allow those persons confined to a wheelchair to find a parking space and
enable them to have enough room to get in and out of their vehicles.
Mayor Kersey announced that there will be a meeting for the handicapped on November
1974, at 7:00 P.M., in the small conference room at the Auburn Public Library and
he invited Mrs. Anderson and a representative of the Chamber of Commerce to be in
attendance.

PLANNING & BEAUTIFICATION COMMITTEE - CHAIRMAN DARLING
The Planning & Beautification Comu.dttee met at 7:30 P.M. on October 15, 1974. Chairman

Chairman Darling announced that the next Planning & Beautification Committee Meeting

ORDINANCE NO. 2847
It was moved by Craig, seconded by Darling, that Ordinance No. 2847 entitled "AN
ORDINANCE CONTAINING ALL GENERAL LICENSING PROVISIONS OF THE CITY OF AUBURN; REQUIRING
COMPLIANCE BY PERSONS REQUIRED TO OBTAIN LICENSES; ESTABLISHING A UNIFORM SYSTEM FOR I
THE ISSUANCE OF LICENSES; SETTING FORTH THE AUTHORITY OF THE CITY LICENSE OFFICER;

Councilman Darling voiced opposition to Ordinance No. 2&47 and stated he will vote
against its passage. He said he concurrs with the fact the Planning Department,
Police Department and Fire Department could use some type of information or aid
in carrying out their duties; however, he feels the Planning Department, Police
Department and Fire Department, together with the Chamber of Commerce, should be
able to work together and accumulate the needed information without passing a
business licènse. He also stated that the City has a directory available which
contains much of the information that is being asked for and other ordinances,
including the zoning ordinance, also provide this information.
Councilman Craig pointed out that this ordinance has been under study for a number of
months and it is not set up for the purpose of bringing in revenue. The fee of $5.00
was set to cover the cost of the paper work involved and he pointed out that the
Planning Department, Police Department and Fire Department do need the information
being requested by this ordinance. The primary purpose of the ordinance is to be
able to locate the owner and or manager of a business in case of an emergency.
Lt. Mulkey, of the Police Department and Btn. Chief Blinn of the Fire Department
spoke in favor of the ordinance and agreed that they needed to know what type of
activity is being conducted on the premises, who could be contacted in case of
an emergency, and if the premises were properly zoned or met the fire code requirements.

George Schuler agreed with the statement made previously in regard to having this
information available and also pointed out that this type of an ordinance could
also help eliminate some hardships caused on persons who buy property for a specific
type of business operation-and then learn they cannot do as they had hoped at that
particular location. The information will also provide us with the number of
working employees in tÌJe Ci t;y of Auburn and that will aid us in our endeavors with
the puget Sound Governmental Conference.
Mayor Kersey agreed that we do have a City Directory; however, not all individuals
or businesses are listed in that directory. He also pointed out that the Chamber of
Commerce does not have this type of information available to them. Also, the City
should not have to send out a building inspector to check every location in town.
He pointed out that the City had at one time required all new businesses tõ come
into City Hall and register, without a fee being charged, but many persons overlooked

this because they did not feel it was a requirement. Therefore, by placing a $5.00 fee,
and setting penalties for those who fail to register, we hope that we will be able to
obtain the required information.

Councilman Lawler stated, as a member of the committee working on this ordinance, that
he wanted to stress the point that the primary concern for creating the ordinance is
the safety of the citizens of Auburn.
Mr. VanSiclen, representing the Chamber of Commerce, stated the Chamber has given this
ordinance a lot of consideration and he stated the Chamber has come out with a resolution
t opposing Ordinance No. 2847. The primary reason; for the opposi tion is that they feel
If the ordinance is redundant because other city ordinances help obtain the same type
of information. He stated the ordinance would not help because those persons who
do not comply with the zoning ordinances would not comply with this ordinance either.
He stated that the Chamber of Commerce would not disagree with the ordinance if they
felt it would benefit the citizens; however, the ordinance seems to be one more
encroachment upon the businessman and they do not feel it is needed.

City Attorney Bereiter addressed the Council as a Department Head, rather than as
the City Attorney, and stated that he has worked with all of the departments involveq
and he is aware of the problems that have arisen because of a lack of information
on the various businesses in town. He pointed out that it is more and more difficult
to send someone down the street for the purpose of obtaining this type of information.
He agreed that some information is available by other means, but the Polk Directory
for example is only µpdated once a year and it does not contain complete and ~p-to-dåte
information that is required by the various departments.

It was moved by Flechsig, seconded by Craig, that Resolution No. 654 entitled "A
RESOLUTION OF THE CITY OF AUBURN, WASHINGTON, AUTHORIZING THE MAYOR AND CITY CLERK
OF THE CITY OF AUBURN, TO ENTER INTO AN AGREEMENT FOR ENGINEERING SERVICES FOR
REVISION AND UPDATING OF COMPREHENSIVE WATER PLAN FOR THE CITY OF AUBURN, WITH
STEVENS, THOMPSON & RUNYAN, INC., CONSULTING ENGINEERS." be adopted.
ROLL CALL VOTE: All Councilmen voting YES.

Mayor Kersey announced that therè would be a Workshop Meeting of the City Council
on Monday, October 28, 1974, at 7:30 P.M.
There beîng no further business to come before the Council, Mayor Kersey adjourned
the meeting at lO:37 P.M.
