Mayor Kersey called the meeting to order and led the flag salute. ROLL CALL Councilmen Present: Councilmen Lawler, Kitchell, Craig, Larson, Holman, Flechsig, and Lea. APPROVAL OF MINUTES It was moved by Holman and seconded by Kitchell that the Council Minutes of April 21, 1975 be approved as mailed. MOTION CARRIED PUBLIC HEARINGS Mayor Kersey declared Public Heaxing open on the request of Herbert Guenther to rezone from Unclass.zfied to R-T (Mobile Home Residential) a parcel of land lying on the south side of the Stuck River, on both sides of 5tuck River Road, approximately 2 miles easterly of "R" Street S.E. (Application No. 7-75) Wayne Chastain of 409 South Third Avenue, Kent, was present, representing Herbert Guenther, and spoke fo.r the xequest to rezone. The Planning Commission recommended to the City Council approval of this request because the density is in conformance with our Comprehensive Plan with the fo.Zlowing provision, that the zoning be effective upon the approval by ordinance of the Fina.Z Plat (5ubdivision) of the area legally desc.z�ibed in the application. It was moved by Kitchell and seconded by Craig that the Public Hearing be cZosed. MOTION CARRIED It was moved by Holman, seCOnded by Kitchell, that the request of Herbert Guenther to rezone from Unc.Zassif.ied to R-T (Mobile Home Residential) , with the provision that the zoning be effective upon the approval by ordinance of the FinaZ Plat (Subdivision) of the area legally desCZ�ibed in the application, and the City Attorney be instructed to draw up the necessary ordinance. ROLL CALL VOTE: AI1 Councilmen voting YES MOTION CARRIED Mayor Kersey declared Public Hearing open on the request of the Auburn Planning Corranission, on its own motion z�epealing codified Auburn City Code 5ections 11.12.010, 11.15.080, Z1.16.090, 11.16.100, 11..Z6.110 in their entirety, creating new sections under Chapter 11.12 (Establish- ment of Districts) and Chapter 11.16 (Regulations), said sections to be known as 11.12.010 (List of Districts), .ZI.I6.080 (C-1 Light Commercial), 11.16.085 (C-2 Central Business DistrictJ , 11.16.090 (C-3 Heavy Commez�cial) , 11.16.095 (C-4 Wholesa.Ze Commercial) and 11.Z6.100 (CN Nei ghborhood Shopping) . The Planning Commission recommended to the City Council approval of the new CommerciaZ Classifications as outlined by the Planning Directo.z�. A Iengthy discussion was held on this request, with input from George Schuler, Planning Director, Pat Cavanaugh of 26 East Main, representing the Retail Trades Division of the Auburn Chamber of Commerce, who spoke against the request. Mr. Gene Kasper of 257 East Main Street, Mr. Cal Scarff of 2824 S.W. 300th, and Mr. Jim Weese of 202 East Main, aI1 spoke against the recommendation by the Planning Commission. It was moved by Lea, seconded by Craig, that the Public Hearing be closed. ROLL CALL VOTE: All Councilmen voting YES MOTION CARRIED After considerable questions and answers, motion was made by Holman, seconded by Flechsig, to table the matter until the next regular City Council Meeting, to allow for more research into the mafter. MOTION CARRIED CORRESPONDENCE The City Clerk read a request from Auburn East HiZl Development Company, for a Conditional Use Permit Application, p.z�operty located West of 112th Avenue S.E. and South of 5kywa� Lane. It was moved by Flechsig, seconded by Holman, that this request of Auburn East Hill Development Company be referred to the Planning Commission for recommendations. Harkey to rezone from R-2 to R-3, property Zocated at 1.Z41 22nd Street N.E. It was moved by F.Zechsig and seconded by HoZman, that the request of J. J. Harkey be referred to the Planninq Commission for recommendations. MOTION CARRIED BID OPENINGS Bids were opened on April 30, 1975 at 11:00 A.M., on a Call for Bids on Street Striping with bids submitted as fo.Zlows: PHASE I DAHL CONTRACTORS, Gig Harbor, Washinqton $2,859.57 Paint-A-Line, Inc., Seattle, Washington(Dry Paint) 3,980.78 Paint-A-Line, Inc., Seatt,Ze, Washington(Wet Paint) 3,485.5.Z Diamond Quality Traffi c Markings, Black Diamond, Wa. 5,083.30 The above bids were accompanied by Bid Bonds. PHASE II $3,Z02.78 4,164.01 3,675.47 5,635.69 It was the recommendation of the Director of Public Works that the Contract No. 75-09, Street Striping, be awarded to Dahl Contractors on their low bid of Phase I$2,859.57 and Phase II $3,102.78, for a total contract price as per type of striping and distance bid of $5,962.35. It was moved by Lea, seconded by F.Zechsig, that Contract No. 75-09, Street Striping, be awarded to Dah1 Contractors on their ,Zow bid of Phase I$2,859.57 and Phase II $3,Z02.78, for a total � contract priCe as per type of striping and distance bid of $5,962.35, and the Mayor and City CZerk be autho,z�ized to sign the Contract. Upon signing of the contract the the bid bonds be returned. It was moved by Holman, seconded by Flechsig, that Change Order No. 1 to Johnson Drillinq Co. be approved. ROLL CALL VOTE: All CounciZmen voting YES. MOTION CARRIED Pay Estimate No. 1 to Johnson Dril.Zing Go., Contract 75-07, cemetery well, in the amount of $5,146.20 be approved for payment. It was moved by Flechsig, seconded by Kitchell, that Pay Estimate No. I to Johnson DriZling Co., in the amount of $5,146.20 be approved for payment. ROLL CALL VOTE: AZ1 Councilmen voting YES MOTION CARRIED Pay Estimate No. 2, final, to Holert Electric, Inc., Contract 74-03, St. Imp. I62, street lighting and fire signa.l at Aubu.z�n Way South & 7th Street S.E., in the amount of $8,987.00. It was moved by Lea, seconded by Flechsig, that Pay Estimate No. 2, final, to Holert Electric, Inc., in the amount of $8,987.00, be approved for payment and the retained percentage amounting to $I,499.00 be paid in thirty days provided no liens or cZaims are fiZed and clearance is secrued from the Department of Labor and Industries, and project be accepted by the City. It was moved by Lea, seconded by Flechsig, that Pay Estimate No. 1 to Signal Electric, Inc., in the amount of $8,912.16 be approved for payment. ROLL CALL VOTE: A1Z Councilmen voting YES MOTION CARRIED Pay Estimate No. 1, final, to Asphalt Paving and Engineering Co., Contract 75-01, paving of Academy Dri ve, in the amount of $4,008.17. It was moved by Ho.lman, seconded by Lea, that the project be accepted by the City as complete and Pay Estimate No. 1, final, to Asphalt Paving and Engineering Co., in the amount of $4,008.17 be approved for payment and the retained percentage amounting to $445.35 be paid in thirty days provided no liens or claims are filed and clearance is secured from the Department of Labor and Industries. Co., in the amount of $240.72 be approved for payment, ROLL CALL VOTE: A.ZZ Councilmen voting YES MOTION CARRIED PROCLAMATIONS, APPOINTMENTS AND ANNOUNCEMENTS Mayor ICersey announced that via information from Mr. Roger Campbell, the King County BZood Bank wi.11 be at the Auburn Eagles on Thursday, May I5, 1975 from Z:00 P.M. to 7:00 P.M. and is soli ci ting donors . Mayor Kersey announced that there wiZ1 be a Rabies CZinic heZd at the Auburn Fire Station on May 16, 1975 from 6:30 P.M. to 8:30 P.M., pet licenses wi11 also be availabZe at that Zocation. On Wednesday, ApriZ 30, Z975, the Citz� of Auburn was visited by approximately Z20 students from both Auburn FIi gh School and the Auburn Academy. This was Rotary Citi zenship Day for the students and tours of City Hal1 and adjoining faciZities were conducted. A11 those concerned considered it a most successful program and was enjoyed by students, Councilmen and Depa.z�tment Heads alike. Mayor Kersey announced that he had attended the dedication of the new Muckleshoot Community Ha1Z on Apri.Z 26, .Z975; this ha1Z being dedicated six years and one day after the fire which destroyed the old Txibal Ha.11. Mayo.z� Kersey announced that the Parks and Recreation Depaz�tment had received a donation of $1,000.00 from the Auburn Eagles for the purpose of providing health services for the elderly. Mayor Kez�sey stated that an ordinance wi1Z be introduced to set up a fund to administer the money. The City C.Zerk was instructed by the members of the Council and the Mayor to initiate a Ietter of appreciation to the Aubuz�n Eagles for the contribution. COUNCIL COMMITTEE REPORTS MUNIC.ZPAL BUILDING COMMITTEE - CHAIRMAN LAWLER Chairman Lawler announced that the demolition project for the new Municipal Building site had been discussed at their Ap.z�i1 28, 1975 meeting. It was moved by LawZer, seconded by Craig, that the Public Works Department be authorized to caZ1 for bids fo.z� the demolition of the old buildings on the site for the new Municipal BuiZding, on the north side of West Main Street between North Di vision and "A" Street N.W., south of the aZ1ey, and that an alternate be included in the bid for installation of 2 inches of crushed rock in order to use the site for parking untiZ the new Municipal Building is constructed. CounciZman Lawler reported that the minutes of the ApriZ 28, Z975 meeting are a matter of Public Record on file in the City Clerk's Office. PUBLIC SAFETY COMMITTEE - CHAIRMAN CRAIG Chairman Craig announced that the next Public Safety Committee Meeting will be held on May Z4, Z975 at 7:30 P.M., in the Council Chambers. Chai.z�man Craig diz�ected the City Clerk to inform the City Attorney's Secretary that the Book Publishing Company has not received the ordinances passed this year. The Book Publishing Company has requested that they be sent a11 the ordinances of this past year in addition to the Zatest memo from the recodi fi cation on the streets. 47� Auburn Washington Monday May 5, Z975 FINANCE COMMITTEE - CHAIRMAN HOLMAN Chairman Holman announced that a meeting had been held on May 1, 1975 and the minutes are Public Record on file with the City Clerk's Office. It was discussed how the duties would be distributed in the replacing of Councilman Darling by Bud Larson and it was decided that Bud Larson would take Darling's unexpired assignments as they stood when Mr. Da.z�.Iing resigned. It was moved by Holman and seconded by Kitcl�ll that Bud Larson take over the unexpired Committee Assi gnments o.f Mr. Darling as they stood when Mr. Darling resi gned. Councilman Craig voted in opposition. MOTION CARRIED' F STREET AND ENGINEERING COMMITTEE - CHAIRMAN LEA Chairman Lea reported that a meeting was held on April 23, 1975 at 7:30 P.M. The Street Improvement Assessment of Mr. Walter Endersbe, 2400 East Main Street, was discussed and a.11 correspondence .Zeading up to the present was reviewed. It was moved by Lea, seconded by Craig, that the City pay the $36.36 interest .for the year and the penalty charge of $4.24 to Mr. Walter Endersbe, for assessment No. 40, L.I.D. No. 278, interest and pena.lty charge to be paid from the L.I.D. Guarantee Fund. MOTION CARRIED Marv Seab rands, Assistant City Engineer, discussed the surplus vehi cles whi ch the City wishes to dispose of. These vehicles are: 427-50, a 25 �ar old front end loader, vehicle .Z03 and 510. A further transfer of vehicle 104 to the Water Di vision wi th the Water Di vision reimbursing Enginee.z�ing for an appraised value of the vehicle requested. It was moved by Lea, seconded by Lawler that the above vehicles be disposed of as requested and the transfer of .Z04 to the Water Division, with the Water Division reimbursing Engineering for the appraised value of the vehi c1e as requested. MOTION CARRIED Motion was made by Lea, seconded by Holman, to delete Ordinance No. 2888 from this agenda in ordex to secure proper sign placement for the speed limit signs and to re-submit at a later meeting. MOTION CARRIED Chairman Lea reported the next meeting wi1l be held on May 7, 1975 at 7:30 P.M., in the Public Works Department of City HaZ1.
