ROLL CALL COUNCILMEN PRESENT: Councilmen Roegner, Kitchell, Larson, Anderson, Flechsig, and Lea. Councilman Craig excused. It was moved by Flechsig, seconded by Darson, that the minutes of the February 22 and 23, 1977 minutes be approved as mailed. MOTION CARRIED I PUBLIC HEARINGS Mayor Kersey declared the public hearing open on the request of Richard B. DeRemer to rezone from C-l (light commercial) and R-2 (single family) to C-3 (heavy commercial) a parcel of land on the south side of Auburn Way South in the 3200 block. (Application 1-77) The Planning Commission recommends approval of this request because it would bring all the petitioner's property into conformance with the Comprehensive Land Use Plan and it would leave a strip of residential property in excess of 200 feet in depth between the petitioners business and the adjoining property to the south. No one spoke for or against this proposal. It was moved by Larson, seconded bl} KitcheLL, that the public hearing on the request .Qf Richard B. DeRemer, Application 1-77, be closed. MOTION CARRIED It was moved by Lea, seconded by Kitchell, that the request of Richard D. DeRemer to rezone from C-l and R-2 to C-3, be approved, that the Planning Commission recommendations be concurred wi. th and the City Attorney be instructed to draw up the necessary ordinance. MOTION CARRIED Mayor Kersey declared the public hearing open on the request of Charles Jinneman and Richard I Christofferson to rezone from R-3 to C-1 a parcel of land on the east side of Auburn Way South in the 900 block, also known as 936 and 938 Auburn Way South (Application 3-77). Mr. John Ross, 912 9th St., Auburn, asked if the adjacent property owner is protected from increased traffic in the alley and glaring signs being placed nearby. George Schuler replied that there is no control over traffic in any alley, but that the zoning would prec1 ude placing any glaring si gns. It was moved by Anderson, seconded by F1echsig, that the pubLic hearing on thp request of Charles Jinneman and Richard Christofferson, Application 3-77, be closed. MOTION CARRIBD It was moved by Anderson, seconded by Larson, that the request of Charles Jinneman and Richard Christofferson to rezone from R-3 to C-l be approved, that the Planning Commir.;ion recommendations be concurred with, and the City Attorney be instructed to draw up the nec~ssary ordinance. Mr. Bill Peters questioned whether the Surface Construction bid included the manpower and equipment schedule in duplicate, as requested in the bjd specifications, Bnd asked that a check on this be made a part of the motion to award the bid. It was moved by Anderson, seconded by Larson, that Contract 77-01 be awarded to Surface Construction Company on their low bid of $24,927.95 plus sales tax of $1,346.11 for a total of $25,274.06, subject to the Department of Public Works checking the bid proposal for Iy irregularities, specifically whether the bid included the manpower and equipment schedule plicate; and that bid bonds of Renton Construction and Grant Construction be held pending gning of the contract, and the other bid bonds be returned. MOTION CARRIED RECOMMENDATIONS The Department of Parks and Recreation recommends the following for council approval: Pay Estimate No. 5 to ORB for the design of the Auburn Senior Citizens Center in the amount of $4,126.50. It was moved by Larson, seconded by Roegner, that Pay Estimate No.5 to ORB for $4,126.50 be approved for payment. ROLL CALL VOTE: All councilmen voting YES. MOTION CARRTED The Department of Public Works recommends the following for council approval: 1. An adjustment of $180.89 to the sewer bill of H. M. Nirsch1, account no. 000086520, $94.67 Metro portion, $86.22 city portion, due to leak on private property. 907031 2. An adjustment of $241.04 to the sewer bill of Denny's Supply, Inc., account no. $118.17 city portion, $122.87 Metro portion, due to leak on private property. 3. An adjustment of $467.23 to the sewer bill of Rio Verde Mobile Home Park, account no. 000075210, $268.61 Metro portion, $198.62 city portion, due to leak on private property. 4. An adjustment of $165.46 to the sewer bill of Schneider's Country Store, account no. 000000120, $85.99 Metro portion, $79.47 city portion, due to water line leak on private property. Councilman Anderson explained that these proposed adjustments are in accordance with utility policy that there is no charge for water which has not passed through the sewage lines. It was moved by Anderson, seconded by Larson, to approve the preceeding adjustments in utility bills. ROLL CALL VOTE: All councilmen voting YES. MOTION CARRIED 5. Recommend acceptance of the East Main Street Report and the recommended alternates, as prepared by Harstad & Associates. MO'1'TON CA1?RIli'D -3- 2'41 AUBURN, WASHINGTON MON DAY MARCH 7, 1977 PROCLAMATIONS, APPOINTMENTS AND ANNOUNCEMENTS Mayor Kersey announced that Metro will attempt to hold a public hearing locally on improvement of local bus service soon. On March 8,1977,10:00 a. m., there will be a dedication of the Metro interceptor line connecting Auburn to Metro. I week of March 14, _'977, has been proclaimed "National Employ the Older Worker Week" oring those workers eve. the age of 40 who have done so much to help build American business, who are now often finding it difficult to find work again, due to prejudice of their age. Mayor Kersey read an excerpt from a letter from the Washington State Auditor's Office, Chief Examiner, commending the City of Auburn on its many improvements in upgrading the city's financial records management practices. COUNCIL COMMITTEE REPORTS Building Codes Committee - Chairman RoegnEr Chairman Roegner reported several changes made in the lease agreement for the Ron's Cost Less building. The city would agree to pay 35% of the utilities charges, 35% of the taxes, ,,~nd 35% of the liability and fire insurance. The building owner would agree to ~~~w .10 parking ~paces in the front of Ron's for use by ci ty customers. The commi ttee recommends "~eptance bf these changes. ~ ~ was moved by Roegner, seconded by Kitchell, to authorize payment to Mel Streeter and ~rmanis of $4,155.73, for work performed December 1, 1976 through February 28, 1977, for ~il planning with L.E.A.A. and plans and specifications for the sewer relocation project for the new city hall. MOTION CARRIED ,was moved by Roegner, seconded by Kitchell, to authorize payment to Mel Streeter and manis of $10,550.00 for work performed on the schematic design and design development se of the new city hall construction plans. MOTION CARRIED C. Chairman RoegneL <.dnounced that there will a ground breaking ceremony Marcll 18, 1977, at 9:00 a.m., marking the beginning of the new city hall construction. The public is invited. The Secretary of State has sent the City of Auburn a check for $1,450.00 for the purchase of Japanese flowering cherry trees for the new city hall. The Lions Club of Auburn has expressed its wish to place a veteran's memorial in the plaza area of the new city hall. The next committee meeting will be March 14, 1977, 7:00 p.m. -4- 242 AUBURN, WASHINGTON MONDAY MARCH 7, 1977 Airport Council Conmrittee - Chairman Kitchell The next committee meeting will be March 8, 1977, 7:30 p.m. Planning and Community Development Committee - Chairman Larson It was moved by Larson, seconded by Flechsig, to authorize the Mayor to sign an agreement with the Fire Fighters Union, promising to pay them 159 per person for taking a census of the City of Auburn. MOTION CARRIED I The next committee meeting will be March 15, 1977, 7:30 p.m. Utility Committee - Councilman Anderson The committee minutes of the last meeting are a matter of public record. The next meeting will be March 10, 1977, 7:30. Public Safety Committee - Chairman Anderson It was moved by Anderson, seconded by Roegner, to authorize the Police Department to purchase three new patrol cars under state bid. ROLL CALL VOTE: All councilmen voting YES. MOTION CARRIED It was moved by Anderson, seconded by Roegner, to declare five old patrol cars surplus, and authorize their sale by the bid process, when all five cars have been replaced. RO LL CALL VOTE: All councilmen voting YES. MOTION CARRIED It was moved by Anderson, seconded by Roegner, to authorize the Police Department to call for bids on the lease or purchase of a copy machine, bids to be opened March 29, 1977, 11:00 a.m.; the Police Department to make a recommendation to the council. MOTION CARRIED It was moved by Anderson, seconded by Roegner, to authorize Chief Scyler to declare surplus an automatic shotgun and negotiate for a trade for a new shotgun. MOTION CARRIED It was moved by Anderson, seconded by Roegner, for the City of Auburn to participa+:; in the Valley Communications Center for 1977, and to review the concept and make a F7' ther determina- tion of participation prior to July, 1978. Councilman Larson asked if money was already appropriated for 1978. It was determined that money is appropriated only until the end of 1977. Councilman Lea wished to know the operating costs for this period of involvement and expressed his feeling that he could not support the program without knowing these costs. Mayor Kersey quoted the budget figures, but stated that it is difficult to know what the actual costs will be. bel Councilman Ander~'~ry suggested that once the city was in the program for a p~riod, it would possible to determine how the revenue from the cp~~er might offset the cost to the city. Councilman Flechsig expressed the committee's feeling that the program could not be assessed fairly on the basis of only 6 months of operation, and so wished to participate until July 1978. Councilman Larson questioned whether the budgeted amount included the cost of changing over the police radios to the new frequency. Chief Scyler replied that the cost of the new crystals for the radios is included in the budget, and that the old crystals will be reta.ined in case they are needed later. -5- AUBURN, WASHINGTON MONDAY 243 MARCH 7, 1977 Councilman Lea asked for clarification on the status of the City of Auburn's obligation to participate. City Attorney, Jack Bereiter, reported that on the basis of Resolution No. 739, which was adopted by the council in August, 1976, the city is committed until the end of 1977, at least.
