ROLL CALL COUNCILMEN PRESENT: Councilmen Roegner, Kitchell, Craig, Larson, Andc'1;'soJl.._ Flechsig, and Lea. If these streets are retained at this width, no on-street parking wou.! d ]1, allowed. Therefore, addi t.ional guest off-street parki.ng space will hd.ve be provided. Also, if approved, it should be made subject to the requirements as outlined the Department of Public Works, dated March 16, 1977. E., east of "I" St. N. E. and authorize the Mayor and City Clerk to sign the face of the plat upon receipt from the Public Works Department of certification that the public improvements have been insta.Ued and/or the necessary performance bond or other form of assurance has been fiJed. ROLL CALL VOTE: All councilmen voting YES. MOTION CARRIED I Mayor Kersey dec.lared the public hear'ing open on the request of 10 property owners for the vacation of a portion "B" St. S. E. between East Main and 2nd St. s. E. together with two dead end aJleys lying on the north side of 2nd St. between "B" st. S.E. and Auburn Way South (Application V-]-77). The Planning Department recommends approval of this vacation request w.i th the following provisions: 1. Assurance from Safeway that they intend to purchase all the land adjacent to the portion of the street and alley requesting vacation. 2. Assurance from Safeway that they will provide the necessary easements and will relocate the public utilities including water, sewer, natural gas, etc., around that portion of street and/or alley that will be built upon. 3. That a site development plan is submitted showing the location of all proposed building and parking areas in order to determine if sufficient alternate routes are provided to allow ingress and egress from the City's off-street parki.ng lots. Together wi th assurance that Safeway will grant an easement to the city, if necessary, to insure ingress and egress from the city's parking lots to 2nd street in lieu of "B" St. S. .E. 4. That Safeway consider the dedication of the southerly 8 feet of their existing site for the future widening of Cross Street in exchange for the vacation of "B" St. S. E. and the two alleys. Mr. Bill Kaufmann, 762 North 56th, Seattle, stated that he was available to answer any questions on the behalf of the developer. Also he mentioned that item 4 of the Planning Department recommended provisions could not be acted upon, because the property may be in the ownership of investors other than Safeway at some future time. I Mr. Gerald Lusk, 540 Aaby Drive, Auburn, spoke in favor of the request. Mr. Don Rott1e, 9ll 5th N. E., Auburn, spoke in favor of the request on behalf of the Downtown Development Committee, which feels that the new Safeway will clean up that area, attract new business, and contribute to the development of the downtown core area. It was moved by Lea, seconded by Kitchell, to close the public hearing. MOTION CARRIED -2- 262 AUBURN '. WASHINGTON MONDAY _______APRIL 1~. 1977 Councilman Lea expressed his concern about the area becorrling land locked, lack of access to the area, iflnd probable insurance problems with auto accidents in the parking lot which the Auburn police would not respond to because of it being a pri vate lot. He was also concerned about the effect this vacation and proposed use would have on traffic patterns on Auburn Way South. It was moved by Lea, seconded by Kitchell, that th.is proposed vacation be referred back to the 8trc'3t Committee for further discussion. At the request of Councilman Roegner, Chief Larx:y ,Scyler informed the coutlci1 that the Auburn Police Department respond to any accident where there is an injury or damage of $100 or more, w.wther it occurs on private property or not. Councilman Craig stated he too was concerned about problems of access and traEfic flow in the area, but that he didn't wish to hold back the developer's entire plan by putting too many obstacles in his way. He suggested letting the developer follow through with his initial plans, which would be further studied before being approved. The Mayor called a vote on Lea's motion to refer the vacation request back to the Street Committee. Councilman Lea voting YES. Councilmen Roegner, Kitchell, Craig, Larson, Anderson, Flechsig, voting NO. MOTION FAILED It was moved by Craig, seconded by Larson, to approw~ the request pf lO prop(Jrty owners for vacation of a portion of "B" St. S. E. between East Ma,in and 2nd 8t. S. MOTION CARR.IED CORRESPONDENCE The Ci ty clerk read a zone change application from !lazel Elder and Fred Foe (Application l5-77), and an application for preliminary plat approval for Forest Ridge Townhouse Unit #2 (Application P-4-77). It was moved by Larson, seconded by Anderson, to refer Application 15-77 and Application P-4-77 to the next meeting of the Planning Commission. MOTION CARRIED BID OPENINGS Bids were received April 8, 1977, for Contract 77-04, Sanitary Sewer Improvement #34, Lift Station Alarm Monitoring System. The request of Will Andre to rezone from R-3 (duplex) to R-4 (multi-family) a parcel of land on the south side of l2th St. S. E. in the 100 block (Appli- cation l2-77). 2. The request of James Person to rezone from R-3 (duplex) to R-4 (multi-family) a parcel of land at the northeast corner of 6th and "F" Streets S. E. (Application 13 -77) . 3. The request of Norval Latimer for the approval of a Preliminary Plat to b~ known as Auburn Park of Industry located on a parcel of land 26 acres in size lying at the south west corner of 15th st. N. W. and the West Valley Highway (Application P-1-77) . 4. The request of R. A. It was moved by Lea, seconded by Flechsig, that a Public Hearing be held May 2, 1977, at 8:00 p.m. in the Board Room of the Auburn School Administra- tion Building, on Applications l2-77, 13-77, P-1-77, P-2-77 and P-3-77. MOTION CARRIED The Department of Public Works recommends the following for council approval: 1. Authority to call for bids on Contract 77-08, Sanitary Sewer Imp. #32, Dogwood Lift Station Modification. It was moved by Craig, seconded by Larson, to authorize Public Works to call for bids on Contract 77-08. ROLL CALL VOTE: All councilmen voting YES. MOTION CARRIED 2. Authority to submit one-half cent gas tax prospectuses for St. Imp'. #186, 3rd St. NE/NW and for LID 289 "M" st.. NQ E.; $150,000 for each. It was moved by Lea, seconded by Flechsig, to authorize Public Works to submit prospectuses for one-half cent gas tax monies for St. Imp. #186 and LID 289, $l50,000 each. It was moved by Lea, seconded by Anderson, to authorize Public Works to hire an appraiser for right-of-way obtainment for St. Imp. #186. ROLL CALL VOTE: All councilmen voting YES. MOTION CARRIED 4. Authority to call for bids for demolition of the Senior Citizens' Center in conjunction with St. Imp. #l86, 3rd NE/NW construction. It was moved by Lea, seconded by Larson, to authorize Public Works to call for bids for the demoli tion of the Senior ci tizens' Center. I ROLL CALL VO'rE: All councilmen voting YES. PROCLAMATIONS, APPO.INTMENTS AND ANNOUNCEMENTS Mayor Kersey read a couple proclamations:, one for "Youth Week", the week of May 1,1977, and one for"Law Day U.S.A.", May 1. , 1977, and for ~lAubu;rn Rotary Ci tizenship Day", May 11, 1977. He also announced that Congressman Norm Dicks will be at the Library April 23, 1977, from 9:00 a.m. to noon, to meet the publicr and that tax exemptions on home improvements are still available through the King County Assessor, but that homeowners must file for the exemption before doing the buila~ng, not after. COUNCIL COMMITTEE REPORTS I Municipal Building Committee - Chairman Roegner It was moved by Roegner, seconded by F1echsig, Dermanis & Associ ates, for $804.27, for work utility relocation, be approved for payment. ROLL CALL VOTE: All councilmen voting that a pay estimate to Mel Streeter, performed on jail planning and YES. MOTION CARRIED It was moved by Roegner, seconded by Kitchell, that a pay estimate to Mel Streeter Dermanis & Associates for $40,439.45 for work performed on the schematic design, construction plan, space planning, acoustics and landscaping for the new city hall, be approved for payment. ROLL CALL VOTE: All councilmen voting YES. MOTION CARRIED It was moved by Roegner, seconded by Kitchell, to authorize the Mayor to enter a contract with Pacific Northwest Bell Telephone for relocation of the overhead and underground telephone cables for the new city hall, at a cost of $39,900. ROLL CALL VOTE: Councilmen Roegner, Ki tchell, Craig, Larson, Anderson and Flechsig voting YES. Councilman Lea ABSTAINING. MOTION CARRIED I Airport Council Committe~ - Chairman Kitchell The rcinutes of the committee meeting are a matter of public record. Utility Committee - Chairman Craig Chairman Craig reported the action taken on resolving the lease between the Airport and utilities Committees for property near the airport. I I Councilman Lea questioned the legality of this type of intracommittee purchase and Jack Bereiter, City Attorney, answered that the process itself was entirely legal, but that the original instrument for lease/purchase was questionable. It was moved by Larson, seconded by Kitchell, that Pay Estimate No. 7 for $2,173.76 to O.R.B. be approved Lo1. payment. ROLL CALL VOTE: All councilmen voting YES. MOTION CARRIED Public Safety Committee - Chairman Anderson The committee will begin meeting at the Police Department, at their regularly scheduled time. Finance Committee - Chairman Flechsig It was moved by Flechsig, seconded by Craig, that the voucher approval list for the period April 1 through April l4, 1977, in the amount of $888,6l2.7l, and the payroll expendi ture for the period March 28 through April 10, in the amount of $l32,085.35, be approved. ROLL CALL VOTE: All councilmen voting YES. MOTION CARRIED Bids received on the sale of the Honeywell computer equipment were too low, and the committee rejected them, and moved to place the computer in storage. , Bids on the new fire engine were reviewed by the commi ttee, and the fire chief was asked to attend the May 12 committee meeting and present alternatives to purchase of a new engine. It was moved by Flechsag, seconded by Craig, to authorize the Finance Director , to send two finance department employees to ADS System Consultants, Inc. in Portland,Oregon for the period of May 9 through May 13, for training on the computer-software. MOTION CARRIED It was moved by Flechsig, seconded by Lea, to authorize leave with pay for the 'Acting Finance Director for the period May 22 through May 28, 1977, for admini- strative leave. MOTION CARRIED Street and Engineering Committee - Chairman Lea The committee is asking the Police, Fire, Engineering and Attorney Departments to indicate their interest in budgeting monies next year for the adoption of ~ Model Traffic Ordinance for the city. ~he U.A.B. will make a decision on the funding of the Main Street ~roject this Thursday, April ~l, in Olympia. Councilman Roegner added that the Municipal Building Committee meeting is continued to April 21, 1977, at 3:00 p.m., in the Mayor's office. Councilman Craig recommended that Lea, Flechsig and the Mayor be named the voting members for the upcoming Association of Washington Cities conference. 'The entire council concurred. George Schuler, Planning Director, clarified the content of a conditional use permit for Councilman Lea, and added that conditions imposed by such permits have been of questionable legality in the past, but that the city is presently within the 1aw,on conditional use permits granted by them.
