HomeMy WebLinkAbout08-15-1977 ~s 20 AUBURN, WASHINGTON MONDAY AUGUST 15, 1977 The regular meeting of the Auburn City Council convened at 8:00 p.m., in the Auburn School District Board Room. ROLL CALL COUNCILMEN PRESENT: Councilmen Roegner, Kitchell, Craig, Larson, Anderson and F 1echsi g. Counci 1man Lea excused. It was moved by F1e9hsig, seconded by Kitchell, that the minutes of the August 1, 1977, council meeting be approved, with the following correction: Page 6, under Finance Committee, first paragraph, third line should read "exc1uding voucher number 10252 for $300 and voucher number 10198 for $259.51". MOTION CARRIED PUBLIC HEARINGS 1. Mayor Kersey declared the pub1ia hearing continued on the request of Leonard Thormod, Joyce Inman and Janice E. Norton to rezone from R-2 (single family) to M-1 (light industrial) property located on the west side of Clay Street N.W. in the 300 block (Application 21-77). The Planning Commission recommends council denial of this r~quest because of the drainage problem and spot zoning in the area. City Attorney Jack Bereiter indicated that because only four councilmen were present to hear the first part of this hearing, and only three of those four are present now, he would advise council, with reservations, that they could continue this hearing by reconstructing the previous portion of the hearing. It was determined that all those who spoke at the first part of the hearing were again present. The council voted unanimously to proceed wi th the hearing. The ci ty clerk read a letter from Ri chard and Sandra Bruce, 402 Western Street N.W. stating their opposition to the rezone. Barbara Campbell, 415 Western Street N. W. Objected to the rezone because of the drainage problem, citing the standing water problem currently being caused by the Frito-Lay warehouse in the area. She also mentioned her opposition to spot zoning, and that she had understood that the city would be helping out by constructing city sewer in the area. Pauline Tarp voiced her opposition, because of the drainage problem, which has become worse since the highway was built. Helen Weber, 314 Western Street N. W., objected because of the swampy conditions already present in the area, which has caused the deterioration of buildings and trees, and has had an adverse effect on private septic systems. Ralph Hamlin, 308 Clay Street N. W. stated his opposition to the proposed development in their residential community, and to the possible pollution it would create. Raymond Williams, 320 Clay Street, presented a photograph to council showing the standing water condition as of May 25, 1977, in the area, and voiced opposition because of those reasons already stated. Leonard Thormod, owner of the property proposed for rezone, explained that he had understood that this area was planned for light industry, that he was told this by both the King County and the city zoning offi- cials, and that he feels that the zoning was misrepresented to him, if it is planned for residential. Donna Willard, 410 Western Avenue, stated that past spot zoning in this area has been disastrous, and that the required fill for construction of the proposed development would make things worse. Frank Ives, 1862 Ives Avenue, Kent, the potential buyer of the property, commented that the only way the area will solve the water and sewer problems is to allow light industrial development that the zoning calls for to help pay for a ~oca1 improvement'district. Restricting this development now will only delay resolution of the problems. Barbara Campbell asked if this hearing was only to consider the rezone and not the development that is put on the property. Mayor Kersey explained that the hearing is for the rezone only, but that the zoning will determine to some ex ten t what type of development can be constructed here. Mr. Thormod stated that spot zoning of industry is already established on Western Avenue, and that industrial development in the area cannot be held up forever if the area is zoned for it. -1- , ::;~, I l~ I , -....:, c;,c' ~ ,...... u 0:; ~ i --1 '::. 1 AUBURN, WASHINGTON MONDAY AUGUST 15, 1977 Helen Weber asked why spot zoning is done. Mayor Kersey replied that if an area which in the past has been residential, is then zoned for potential industry, industry in the area appears as spot zoning, until the potential is fulfilled. Donna Willard asked if there isn't already a great deal of land in the Auburn area zoned for industry which is not being used. George Schuler replied that there is a good deal of industry-zoned property in the area, but that much of it does not have utilities available to it. He added that this request should not be considered spot zoning, because the area is designated in the comprehensive plan as light industrial. Mr. Ives stated that he has looked for a year and a half to find property that is small enough and has utili ties available to sui this needs and verified that industrial property is not easy to find. It was moved by Larson., seconded by Craig, that the public hearing be closed. MOTION CARRIED Craig commented that the comprehensive plan is out of date, that its /designation for the area isn't necessarily right, and that it is this information which the public hearing is,Ilfeant to bring out. Pat Nevins stated that public works has tried to obtain monies from the federal and state governments to construct a sewer system in this area, but has not been successful. It was also pointed out that the ser#{1.ge holding tank which Frito Lay has been allowed to maintain at their warehouse will not be allowed beyond November of this year. It was moved by Craig, seconded by Kitchell, to deng the request of Leonard Thormod, Joyce Inman and Janice E. Norton to rezone from R-2 (single family) to M-l (light industrial) property located on the west side of Clay Street N. W. in the 300 block. ROLL CALL VOTE: All councilmen voting YES. MOTION CARRIED 2. Mayor Kersey declared the public hearing open on the request of the abutting property owners for the vacation of the alley right-of-way south of Main Street between "A" and "B" Streets Southeast. No one spoke for or against the request. It was moved by Flechsig, seconded by Craig, that the public hearing be closed. MOTION CARRIED It was moved by Craig, seconded by Anderson, that the vacation of alley right-of-way be granted to incorporate the condition that the easement for public utilities be maintained, and that the city attorney be instructed to draw up the necessary ordinance. " ROLL CALL VOTE: , All councilmen voting YES. MOTION CARRIED 3. Mayor Kersey declared the public hearing open on the proposa1.to rea.1io':' cate approximately $800,000.00 of Forward Thrust Funds. Public Works Director Pat Nevins explained the proposed reallocations, which are being asked due to a change in plans for traffic circulation in the central business district, and due to the construction of the new city hall.' No one spoke against the proposals . It was moved by. Larson, secondeq by Craig, that the public hearing be closed. MOTION CARRIED It was 'moved by Craig, seconded by Larson, that the proposed realloca- tion of Forward Thrust funds be approved, and that the city attorney be instructed to draw up the necessary resolution. ROLL CALL VOTE: All councilmen voting YES. MOTION CARRIED CORRESPONDENCE The city ,clerk read a Preliminary Plat proposal from Subdivision Management, Inc., for Janssen's 'Addition (P-7-77), and one from Townsend & Associates Inc. for Riverside Manor (P-8-77). It was moved by Craig, seconded by Flechsig that both proposals be referred to the next regular meeting of the P1a.nning Commission. It was moved by Craig, seconded by Flechsig, that the bids be referred back to the Utility Committee, who will report back to council. MOTION CARRIED RECOMMENDATIONS The Department of Planning and Community Development recommends the following for call to public hearing: l. Request of KennethC. Allen for approval of a preliminary plat to be known as Lemke's Second Addition located on a parcel of land on the south side of 23rd Street S.E. between "D" and "F" Streets S. E. (P-6-77). 2. Request 'of Carl and Viola Lemke to amend an existing Special Property Use Permit for apartments for a parcel of land on the south side of 23rd Street s. E. between "D" and "F" Streets S.E. (Application 25-77). It waS moved by F1echsig, seconded by Larson, that a public hearing be held September 6, 1977, 8:00 p.m., in the school district board room, on applications P-6-77 and 25-77. MOTION CARRIED The Department of Public Works recommends the following for council approval: l. It is recommended the Water Division utilize the bid of Badger Meter Co. for providing water meters to Water District No. l24 in their purchases of various size meters under the Intergovernmental Purchasing Agreement. It was moved by Craig, seconded by Larson, that the Water Division be authorized to utilize the bid of the Badger Meter Co. for purchase of water meters. i ROLL CALL VOTE: All councilmen voting YES. MOTION CARRIED 2. The following solid waste adjustments are proposed: a. Auburn General Hospital, lOl 2nd St. N.E., Account #320.49700 be exempt from the minimum charge for solid waste service and a refund be made in ,the amount of $ll.80 provided this charge has been paid. It was moved by Craig, seconded by Larson, that the account of Auburn 'General Hospital be exempt from the minimum charge for solid waste service, and th~t they receive a refund of $ll.80. ROLL CALL VOTE: All councilmen voting YES. MOTION CARRrED b. Recommend that account #l05.02500 at l8l0 37th Way S. E.be refunded $70.20 for the past three years of erroneous garbage billing. It was moved by Craig, seconded by Larson, that $70.20 be refunded to Robert Dickinson, account #105.02500, due to erroneous billing. ROLL CALL VOTE: All councilmen voting YES. MOTION CARRIED I c. Recommend that the account of Wholesale Foam Distributors~ 3402 "c" Street N. E.; Bay l03 be rebil1ed for garbage service for the period January 1977 through the present at the minimum charge of $2.95 per month~ aild that the account be charged the minimum as appropriate, in the future (account #590.04180). Authority to call for public hearing on proposal to trade surplus materials at the sewage treatment lagoon in exchange for Metro's removal of aerators from the lagoon. It was moved by Craig, seconded by Larson, that a public hearing be held September 6,1977, 8:00 p.m. in the school district board room on this proposal. ROLL CALL VOTE: All councilmen voting YES. MOTION CARRIED 4. Change Order No. 1 to Coluccio Construction Company, Inc. for Water Imp. 109, waterline construction on "B" St. N. W. area, increase of $1,500 plus tax (total $1,581) to allow Fire Department to have access to various hydrants along the route and for access north and south along the easement by installing additional culvert. It was moved by Craig, seconded by Larson, that Change Order No. 1 to Coluccio Construction Company for an increase of $1,581.00 be approved. ROLL CALL VOTE: Councilmen Craig, Larson, Anderson, F1echsig and Kitchell voting YES. Councilman Roegner ABSTAINING. MOTION CARRIED 5. Change Order NO. 1 to Moss Construction Company on LID 289, "M" Street from 17th to 22nd Streets N.E., in the amount of $2,880 increase due to reduced sidewalk grade exposing footings for chain link fence resulting in the need for installing retaining wall to strengthen the fence. It was moved by Larson, seconded by Craig, that Change Order No. 1 to Moss Construction Company for an increase of $2,880, be approved. ROLL CALL VOTE: Councilmen Larson, Anderson, F1echsig, Kitchell and Craig voting YES. Councilman Roegner ABSTAINING. MOTION CARRIED 6. Change Order No. 1 to St. Imp. 186, UAB project on 3rd St. N. E/N. W. and Main Street improvements, increase of estimated $5,000. It was originally felt the existing material for storm sewer trench backfill would be adequate~ Upon excavation it was determined the material was unsuitable and bank run gravel had to be put in place of it. Also, it was determined the sign posts should be installed at the same time the concrete sub-base area was being poured to eliminate additional cost of breakout and installa- tion at a later date. It was moved by Craig, seconded by Larson, that Change OrderNd. I to Moss Construction Company for an increase of an estimated $5,000; be 'approved. COUNCIL COMMITTEE REPORTS Municipal Building Codes Committee - Chairman Roegner It was moved by Roegner, seconded by F1echsig, to approve payment to ,Me1 Streeter, Dermanis and Associates for work on the planning of utility relocation for the new city hall,' in the amount of $625.81. MOTION CARRIED It was moved by Roegner, seconded by Kitchell, that the .city Council meeting be continued to Monday, August 22, 1977, 7:30 p.m. at city hall, to consider the bids for the new city hall. MOTION CARRIED t The Building Committee meeting is continued to August 22, 1977, 7 :00 p.m. at city hall to discuss new city hall bids. Public Safety Committee - Vice Chairman Roegner It was moved by Roegner, seconded by F1echsig, that Ordinance No. 3185, entitled "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, AMENDING AUBURN-CODIFIED CITY ORDINANCE 6.04.060 (IJOG LICENSES - FEES) TO PROVIDE FOR A SPECIAL PERMANENT DOG LICENSE FOR THE LIFETIME OF DOGS OWNED BY AUBURN CITY RESIDENTS 65 YE:ARS OF AGE OR OLDER", be introduced and adopted,.. to become effective 30 days after the license tags are available at the city hall. MOTION CARRIED Airport Council Committee - No report Utili ty Commi ttee - Chairman Craig Councilman Roegner asked what plans have been made for city water supply in the. event of continuing dry weather in future years. Councilmen Craig indicated I that the city has plenty of water now, even with this extensive dry period, and that no future problems are expected; but that staff is trying to keep on top _ of the situation and that there are plans for another well in the future. Planning and Community Development Committee - Chairman Larson It was moved by Larson, seconded by Kitchell, to grant a concession permit to the Federal Aviation Administration for a softball tournament at the GSA Park, August 26 and 27, 1977. MOTION CARRIED It was move~.by Larson, seconded by Kitchell, to instruqt the city attorney to draw up an ordinance repealing Ordinance No. 3091 in its enti.rety. This ordinance grants a rezone to Americo10gy Corporation subject to it's filing an environmental impact statement within one year, and this was/not done. ROLL CALL VOTE: All councilmen voting YES. MOTION CARRIED It was moved by Larson, seconded by F1echsig, to approve a pay estimate to O.R.B. in the amount of $412.65, for services performed on the construction phase of the new Senior Center. PROJECT", be adopted. ROLL CALL VOTE: All councilmen voting YES. MOTION CARRIED There being no further business to come before the council, the meeting was continued until 7:30 p.m., August 22, 1977, at the city hall. ROLL CALL COUNCILMEN PRESENT: Councilmen Roegner, Kitchell, Craig, Larson and Anderson. Councilmen Lea and F1echsig excused. It was moved by Roegner, seconded by Kitchell, to authorize the call for bids for construction of new service roads at the Auburn Cemetery and the hiring of a consultant, if necessary, to draft the layout and profile for specs. ROLL CALL VOTE: All councilmen voting YES. MOTION CARRIED It was moved by Roegner, seconded by Larson, that the Merit Company be awarded the bid to construct the new city hall for the amount of $2,719,229.00 plus $146,838.36 state sales tax for a total construction cost of $2,866,067.36. This price includes the cost reduction of bid alternates A3, A6, A8 and A9. ROLL CALL VOTE: All councilmen voting YES. MOTION CARRIED It was moved by Craig, seconded by Larson, that the contract for construction of Water Improvement 112, watermain construction in the Auburn Municipal AirpOrt area, Contract 77-14, be awarded to Bert RObison Construction Co., Inc. for their low bid of $21,190.50 plus $1,144.29 sales tax for a total of $22,334.79. ROLL CALL VOTE: All councilmen voting YES.
