It was moved by Roegner, seconded by Larson, that the minutes of the August 15 and August 22, 1977, council meetings be approved as mailed. MOTION CARRIED PUBLIC HEARINGS 1. Mayor Kersey declared the public hearing open on the petition of abutting property owners for the vacation of alley right-of-way south of 1st Street S.W. ,be.tween "A" and "B" Street S.W. 2. Mayor Kersey declared the public hearing open on the petition of John W. Kelly for the vacation of street right-of-way situated on Reddington Road directly east of "I" Street N. E., between 35th and 39th Street N. E. The city clerk read a memorandum from George Schuler, Planning Department, requesting that both of these hearings be continued until the next regular council meeting of September 19, 1977, to allow the Street Committee time to review these requests. This request is due to the cancellation of the last Street Committee meeting. Robert Smythe, attorney for the petitioners of the first public hearing, explained that the vacation would allow for a driveway, and th'atthe peti- tioners would be glad to allow the city to maintai.n a utility ,easement for the sewage line which runs beneath the alley. NO spoke f~r.or against the ,request of the second public hearing. It was moved by Craig, seconded by Kitchell, that the public hearing on each of these two petitions be continued to the next regular council meeting of September 19, 1977. MOTION CARRIED 3. Mayor Kersey declared the public hearing open on the ~eques~ of Carl and viola Lemke to am,end an ,existing Special Property Use Permit for apartments for a parcel of land on the south side of 23rd Street S.E. between "D" and "F" Streets S.E. The Planning Commission recommends approval of this regues~because it does conform to our Comprehensive Land Use Plan and will reduce the'number of living units from eighty-four(84) to thirty-two (32) and tllat..the ,following c:onditions be included in the permit: 1) That the units b,e restrictedto;eight (8)sing1e story four-p1ex dwellings; and 2), that ~he plot plans be attached to and become a part of, the ordinance. Kenn~t~ C.A11en. stated that he is present to represent' the Lemkes and to answer any questions council might have. It was moved by Flechsig, seconded by Larson, that the public hearing be closed. MOTION CARRIED It was moved by F1echsig, seconded by Lea, that the request of Carl and Viola Lemke to amend an existing Special Property Use permi t be approved, that the Planning Commission recommendations be concurred with, and the city attorney be instructed to draw up the necessary ordinance. ROLL CALL VOTE: All councilmen voting YES. MOTION CARRIED 4. Mayor Kersey declared the public hearing open on the request of Kenneth C. Allen for approval of a preliminary plat to be known as Lemke's Second Addition located on a parcel of land on the south side of 23rd Street S.E. between "D" and "F" Streets S.E. The Planning Commission recolllllends council approval of this request because it does conform to our Zoning and Subdivision Ordinance relating to the design and size of lots and that the owner and/or developer prepare the necessary plans and specifica- tions for all public improvements and submit to the Public Works Department for their approval. Kenneth C. Allen stated he is present to answer any questions. It was moved by F1echsig, seconded by Craig, that the public hearing be closed. Pat Nevins explained that staff is working with the developer of this property to devise a plan , to accomodate water drainage in the area, but that drainage continues to be a problem in the area. It was moved by Lea, seconded by Flechsig, to approve the preliminary plat to be known Lemke's Second Addition, and that the Planning Commission recommendations' be concurred with. ROLL CALL VOTE: All councilmen voting YES. MOTION CARRIED 5. Mayor Kersey declared the public hearing open on the propotJalfo trade surplus materials at the Auburn sewage treatment lagoon in exchange for Metro's removal of aerators from the lagoon. 'Pat Nevins commented on the items for exchange. It was mo'ved by Craig, seconded by Anderson, that the pUblic hearing be closed. MOTION CARRIED It was moved by Craig, seconded by Anderson, to declare surplus and authorize trade of surplus materials at the Auburn sewage treatment lagoon in exchange for Metro's removal of aerators from the lagoon. ROLL CALL VOTE: All councilmen voting YES. MOTION CARRIED CORRESPONDENCE The ci ty clerk read a petition from abutting property owners for vacation of alley right-of-way situafed east of "B" StreetN.E. in the 300 block (V-4-77), and a petition from abutting property owners for vacation of street right-of-way that portion of "D" Street N.E. adjacent to Auburn Municipal-Airport (V-9-77). It was moved' by Lea, seconded by Craig, to instruct thecitlJ attorney to draw the necessary resolution calling for a public hearing on applica'tions V-9-77 and V-4-77. MOTION CARRIED The city clerk read: 1) A request from the Pace Corporation, Bellewe, Washing- ton, for approval of the preliminary plat to be known as Amber Lane Condominiums at 1803 "M" Street N. E. (P-9-77); 2) A zone change application from Dean A. Chaussee to change from R-2 to R-4 property located on the north side of 8th Street N.E. approximately 200 feet east of Auburn Way North (Application 26-77); 3) A zone change application from Wick Homes, Inc. to change from Unclassified to R-2 property located east of Cameron Village No. 1 and extending to 148th Avenue S.E. (Application 27-77); 4) A ZOne change application from Mastro, Michelotti, Terrana and Mondchien, to change from C-3 to M-l pro- perty located on the west side of West Valley Highway at the intersection or 15th Street S.W'. and the West Valley Highway (Application 28-77). It was moved by Lea, seconded by Flechsig, to refer applications P-9-7?, 26-77, 27-77 and 28-77 to the next meetin!f of the Planning Commission. MOTION CARRIED BID OPENINGS Bids were opened August 31, 1977, at 10:00 a.m. for Contract 77-18; i977 Asphalt Overlay program. 'The following bids were submitted: BIDDER Lakeside Industries, Bel1evue Tucci & Sons,' Inc., Tacoma , 'Assoc1-ated Sarid' & Gravel, Tukwila TOTAL BID $34,301~55 37,806;;50 39,956.00 ' The Department of Public Works recommends that the bid be awarded to Lakeside Industries'on their low bid of $34,301.55. It was moved by Lea, seconded by Craig, that Contract 77-18 for 1977 Asphalt Overlay Program, be awarded to Lakeside Industries on their low bid of $34,301.55, and that'the Mayor and City Clerk be i3.titoorized' to sign 'the contract. ROLL CALL VOTE: All Councilmen vating YES. MOTION CARRIED Bids were --opened August 31" 1977, at 11 :00 a.m. for Contract 77-08, Modifica- tion of DogWood-Lift Station. The one bid submitted was from Omega Contractors -2- ~1:iO AUBURN, WASHtNGTON TUESDAY SEP~E~BER 6, 1977 on their.1ow bid of $5,225.00 plus tax of $282.15 for a total of $5,507.15. It was moved by Craig, seconded by Anderson, that Contract 77-08 for Modifica- tion of the Dogwood Lift Station, be awarded to Omega Contractors on their low bid of $5,225.00 plus tax of $282.15 for a total of $5,507.15. and that the Mayor and City Clerk be authorized to sign the contract. ROLL CALL VOTE: All councilmen voting YES. MOTION CARRIED RECOMMENDATIONS The Department of Parks and Recreation recommends the fOllowing for council approval: I Pay Estimate No. 6 to Coleman-Gilchrist Building Company for work on the ;,.", construction of the Senior Center in the amount of $128,187.91. . Contract Amount $304,013.93 + $16,437.00 tax Earned to Date 278,482.61 (incl. $18,924.13 retainage) It was moved by Larson, seconded by Kitchell, that Pay Estimate No. 6 to Coleman-Gilchrist Building Comapny for $128,187.91 be approved for payment. ROLL CALL VOTE: All councilmen voting YES. MOTION CARRIED The Department of Public Works recommends the following for council approval:' 1. Change Order No. 1 to "C" St. N.W. portion of Contract 77-09, Water Imp. #109, waterline construction liB" St. N.W. area, increase of $305.60 plus tax. Due to existing tee of a different size than that shown on drawings, additional fittings and labor were required to adapt existing tee to material on hand. It was moved by Craig, seconded by'Anderson, that the adoption of Change Order No.1 to Contract:77-09, for an increase of $305.60 plus tax be approved. ROLL CALL VOTE: All councilmen voting YES. Contract Amount $381,152.52 Earned to Date 135,503.37 (incl. $11,710.99 retainage) ~', It was moved by Lea, seconded by F1echsig, that Pay Estimate No.2 to Moss Construction Co. for $102,685.77 be approved for payment. Pay Estimate No.2, final, to Frank Coluccio Construction Co. for Water Imp. 109, Contract 77-09, waterline construction "B" Street N.W. area in the amount of $61,880.71. Contract Amount $249,358.59 (incl. change orders) Earned to Date 237,159.67 (incl. $16,250.46 retng). It was moved by Craig, seconded by Anderson, that the project be accepted as complete and Pay Estimate No.2, final, to Frank Coluccio Construction Co. for $61,880.71 be approved for payment, and the retained percentage amounting to $16,250.46 be paid in thirty days provided no liens or claims are filed and clearance is secured from the Departments of Revenue and Labor and Industries. 4. Pay Estimate No.4, final, Contract 77-07, LID 289, to Moss Construction Co. in the amount of $65,453.45. MOTION CARRIED -3- I ~ ,...... ~ u Cl': w AUBURN"WASHINGTON SEPTEMBER 6, 1977 TUESDAY COUNCIL COMMITTEE REPORTS Municipal Building Committee - Chairman Roegner Roegner reported that the bids received August 23, 1977, for the roofing repair on the library were nearly twice the engineer's estimate. Interbay Roofing bid $12,321.26 and Pacific Sheet Metal, Inc. bid $10,791.95. It was moved by Roegner, seconded by Kitchell, to reject both of the bids received, and authorize the Library Department to make another call for bids. MOTION CARRIED ROLL CALL VOTE: All councilmen voting YES. It was moved by Roegner, seconded by Kitchell, to authorize payment of $2,903.45 to Me1 Streeter, Dermanis and Associates for planning work on the new city hall . MOTION CARRIED It was moved by Roegner, seconded by Kitchell, to authorize payment of $374.19 to Me1 Streeter, Dermanis and Associates for utility relocation planning. for the new city hall. Utility Committee - No report Planning and Community Development Committee - No report Public Safety Committee - Chairman Anderson The minutes of the August 30, 1977, meeting are a matter of public record. 11 Finance Commi ttee - Chairman Flechsig ~ It was moved by F1echsig, seconded by Larson, to approve payment of $1,915.18 to Auburn Youth Resources, as their July, 1977, reimbursement. ROLL CALL VOTE: All councilmen voting YES. MOTION CARRIED It was moved by F lechsi g, seconded by Lea, to approve the voucher expendi tures for the period August 12 thr9ugh August 30, 1977, in the amount of $797,093.33, and of the payroll for the two week period ending August 14, 1977, in the amount of $111,871.37 and for the two week period ending August 28, 1977, in the amount of $108,722.36. ROLL CALL VOTE: All councilmen voting YES. MOTION CARRIED It was moved by F1echsig, seconded by Craig, that the cash adjustment transfers for July, 1977, in the amount of $329,212.63 as shown on the attached appendix be approved. MOTION CARRIED It was moved by F1echsig, seconded by Lea, that an interfund loan from fund 102 Arterial Street to LID fund 789 in the amount of $153,000, to be repaid by December 31, 1977, at an annual interest rate of 6%, be approved as a means of interim financing for LID #289. MOTION CARRIED It was moved by Flechsig, seconded by Lea, to approve payment of $8,306.04 to the Seattle-King County Health Department, the balance of flrhat the city owes for 1976. Engineering Committee - No report Lea asked about the status of the property acquisition negottation$ for the 3rd NE/NW project. Jack Bereiter reported that both parties have agreed to honor the decision of an independent arbitrator regarding the vaJue of the property. Following further discussion, it was determined that the council would hold an executive session at the end of the regular meeting to determine what action to take.
