ROLL CALL COUNCILMEN PRESENT: Councilmen Roegner, Kitchell, Craig, Larson, Anderson Flechsig and Lea. It was moved by Flechsig, seconded by Larson, that the minutes of the council meeting of September 19, 1977, be approved as mailed. MOTION CARRIED PUBLIC HEARINGS 1. Mayor Kersey declared the public hearing open on the request of Dean A. Chaussee and William Bernbeck to rezone from R-2 (single family) to R-4 (multiple family) property located on the north side of 8th Street N.E. approximately 200 feet from Auburn Way North (Application 26-77). The Planning Commission recommends council approval of this request because it does conform to the Comprehensive Land Use Plan and will provide a transition from the commercially zoned property to the west and north. Ivy Kludsikofsky stated that she lives next door to the proposed development and is not against it, as long as the apartments are of a family size, and that a fence is constructed at the border of the property. It was moved by Craig, seconded by Larson, that the public hearing be closed. MOTION CARRIED George Schuler informed council of the minimum living space that would be required in the apartments, and that a fence could not be a requirement of the rezone, but could be a recommendation. It was moved by Craig, seconded by Lea that the city attorney be instructed to draw up the necessary ordinance granting the request of Dean A. Chaussee and William Bernbeck to re IDne from R-2 to R-4 property located on the north side of 8th Street N.E. approximately 200 feet from Auburn Way North, and that a recommendation for construction of a fence around the property~ and the recommendation from Marv Seabrands dated September 6, 1977, regarding storm drainage be included in the ordinance. ROLL CALL VOTE: All councilmen voting YES. MOTION CARRIED 2.& 3. Mayor Kersey declared the public hearing open on the requests of Wick Homes, Inc., to rezone from Unclassified to R-2 a parcel of land 38 acres in size located east of the existing subdivision of Cameron Village No.1 (Application 27-77) and of SubdivisionWanagement, Inc. for approval of a preliminary plat to be known as Janssen's Addition located on a parcel of land 38 acres in size located east of Cameron Village No. 1 and extending east to l48th Avenue S.E. (Application P-7-77). The Planning Commission recommends council approval of the rezone request because it rioes conform to the Comprehensive Land Use Plan and will be compatable with existing development in the area. The Planning CommissLon recommends council approval of the plat request and that the owner and/or developer prepare the necessary plans and specifications for the public improvements to be submitted to the Public Works Department for their approval and that consideration be given for a 6 foot board fence to be erected where necessary around the plat property. Douglas Webb, representing Subdivision Management, explained that the developer would be glad to build the suggested fence, that a retention system for drainage has been designed, that they will do their best to keep the construction vehicle traffic under control, and that they will solve the problem of water supply to the upper development before they proceed to develop it. John Rhett, 3501 Lemon Tree Lane stated his opposition to the development proposed because it would wo~sen the area drainage problem, the added construction vehicle traffic would be a safety hazard on the one access street available, and the maintenance of the soccer field would not be guara~teed. Mike Lebow, 3510 Lemon Tree Lane, opposed the request for the same reasons as stated by Mr. Rhett, emphasizing his concern for the safety of the children in the area. Diane Berthon, 2715 Alpine S. E. stated that Wick Homes has done a good job on their past developments and that progress must be allowed in the area. It was moved by Larson, seconded by Craig, that'the public hearing be closed. U co W 1- AUBURN, WASHINGTON MONDAY OCTOBER 3~ 1977 ..,..; ~) Pat Nevins explained that fire flow to the area (Auburn ACademy) is now marginal and that the major, costly improvements needed to solve the problem must be considered along with other necessary improvements in the city. craig suggested that the committees be given an opportunity to resolve these problems before either the rezone or plat be acted upon and Lea concurred and suggested that this would also give the petitioners an opportunity to work with the committees. George Schuler added that maintenance of the soccer field would fall either to the city or to an association of the homeowners in the area. It was moved by Craig, seconded by Anderson, to refer Applications 27-77 and P-7-77 back to the Street and Utility Committees for study and recommendation back to the council, that the public hearing on these reques~be continued, and that the Planning Department be instructed to readvertise the continued public hearing. MOTION CARRIED 4. Mayor Kersey declared the public hearing open on the request of Crestwell Holdings Limited for approval of a preliminary plat to be known as Riverside Manor located on a parcel of land 72 acres in size lying on the south side of the White River approximately 1.5 miles east of "R" Street S.E. (Application P-8-77). The Planning Commission recommends council approval of this request and that the following changes be made prior to submission of the final plat: 1) That all lots provide an average minimum depth of 100 feet; and' 2) That on lots on cul-de-sacs that h~ve less than 60 feet frontage on the street line, the front building shall be established and shown on the face of the plat where a 60 foot minimum frontage can be m~t.The commission recommends further that the owner and/or developer prepare the necessary plans and specifications for all public improvements and submit them to the Public Works and other city departments for their approval. Lowell Townsend, Kent, representing the petitioner, explained that this plat was submitted to and approved by council two years ago~ and is noW being resubmitted. It was moved by Flechsig, seconded by Kitchell, that the public hearing be closed. MOTION CARRIED It was moved by Flechsig, seconded by Lea, to approve the prelimin~ry plat of Crestwell Holdings Limited for the plat to be known as Riverside Manor, and that the recommendations of the planning Commission be concurred with. ROLL CALL VOTE: All councilmen voting YES. MOTION CARRIED 5. Mayor Kersey declared the public hearing open on the request of Feist, Mastro, Michelotti, Mondchien and Terrana for a five (5) year extension to an existing Special Property Use Permit for gravel removal on a parcel of land approximately 10 acres in size lying on the west side of the West Valley Highway (Application 19-77). The Planning Commission recom- mends council approval of a five (5) year extension of the gravel removal permit authorized by City Ordinance No. 2639, provided that the owners enter into an agreement with the City of Auburn containing the following provisions: 1. That the owners and/or operators agree to abide by the provisions of City Ordinance No. 2639 and the agreement attached thereto as Exhibit "A" and recorded under King County Auditor's File No. 7206010430. 2. That the revised grading plan dated August 2, 1977, by William S. Tsao & Co. be attached to and become a part of the permit. 3. That the West Valley Highway in front of the property that was damaged by removal of material from the site be overlayed to the Auburn Public Works Department specification within 90 days after the approval of the permit. 4. That because of the vertical slopes existing on the site a 6 foot high cyclone type fence shall be erected to prohibit public access to the si te. 5. That a new ,performance bond as outlined under Section $-p of the original agreement be submitted to the city. 6. That the sound pressure levels as outlined under Section 4-g of the original agreement be amended to include the noise control regulations attached thereto as Exhibit "A". -2- .-f'i L.!' i:5 'P' 0 AUBURN, WASHINGTON MONDAY OCTOBER 3, 1977 7. That no material shall be excavated from the site until a new segment permit is secured from the Planning & Community Development Committee of the Auburn City Council as outlined under Section 3 of the original agreemen t . William Tsao~ speaking on behalf of the petitioners stated that they will agree to abide by the conditions set forth. It was movsd by Flechsig, seconded by Larson, that the public hearing be closed. MOTION CARRIED It was moved by Larson, seconded by Flechsig, to instruct the city attorney to draw up the necessary ordinance granting extension of a Special Property Use Permit for five (5) years to Feist, Mastro, Michelotti, Mondchien, for 1..11.'- gravel removal on the west side of the West Valley Highway, to include the recommendations of the Planning Commission. ROLL CALL VOTE: All councilmen voting YES. MOTION CARRIED AUDIENCE PARTICIPATION Parks Director Len Chapman introduced Jeff Ackerman to the council, and commended him for his ongoing project of painting the train engine in the Ci ty Park as part of his efforts to earn an Eagle Scout badge. BID OPENINGS Bids were opened at 2:00 p.m.~ September 27, 1977, on a call for bids for the repair/replacement of the Auburn Public Library Roof, Contract 77-23, and the following bids, accompanied by bid bonds, were received: Hord Roofing ~ Auburn Pacific Sheet Metal, Seattle Interbay Roofing, Seattle $8,176.93 11,109.00 13,490.67 It was moved by Roegner, seconded by Kitchell, that Contract 77-23, the repair/replacement of the library roof, be awarded to Hord Roofing on their low bid of $8~176.93, and that the Mayor and City Clerk be authorized to sign the contract. MOTION CARRIED RECOMMENDATIONS The following is submitted by the Director of Parks and Recreation for council approval: Pay Estimate Number 7 to Coleman Gilchrist Building Company for the construc- tion of the Auburn Senior Center in the amount of $26,455.16. Contract Amount $304,013.93 + $16,437 (sales tax) Earned to Date 310,822.67 (incl. $l9~787.00 retainage) It was moved by Larson, seconded by Roegner, that Pay Estimate No. 7 to Coleman Gilchrist Building Company for $26,455.l6 be approved for payment. MOTION CARRIED 6. Call for public hearing on construction of St. Imp. 187, East Main Street construction from Auburn Way to "M" Street; to be held October l7, 1977. It was moved by Lea seconded by Flechsig, that a public hearing be held October 17, 1977, at the Auburn School District Administration Building Board Room, at 8:00 p.m. on the construction of the St. Imp. 187. ROLL CALL VOTE: All councilmen voting YES. MOTION CARRIED 7. The following utility bill adjustments are recommended: a. Lee I. Walster, 2710 "H" St. S. E., account #240.55900 - Due to a large water bill caused by a leak on the property, it is recommended that the customer be given six months in which to pay the entire water bill. It was moved by Craig, seconded by Anderson, to approve this adjust~ent to account #240.55900, and allow the customer six months to pay the bill. ROLL CALL VOTE: All councilmen voting YES. MOTION CARRIED b. Herb Elving, 2417, 2425, 2535, 2543 poplar St. S.E. Accounts #l40.06400, l40.05800, 140.06700 & l40.06l00 - It is recommended that due to delays in obtaining necessary easements causing postponement of use of sanitary sewer, an adjustment of $l13.60 for sewer and $188.80 for solid waste be made on the above accounts. It was moved by Craig, seconded by Anderson, to approve this adjustment of $113.60 for sewer and $188.80 for solid ~aste. ROLL CALL VOTE: All councilmen voting YES. MOTION CARRIED c. Robert Denison, l5l6 Auburn Way North, Accout #430.39900 - Due to water break at the address, it is recommended an adjustment of $62.41 be made to the sewer bill for this account. It was moved by Craig, seconded by Anderson, to approve the adjustment to account #430.39900, a credit to the sewer bill of $62.41. ROLL CALL VOTE: All councilmen voting YES. MOTION CARRIED -4- 348 AUBURN, WASHINGTON MON DAY OCTOBER 3, 1977 PROCLAMATIONS, APPOINTMENTS AND ANNOUNCEMENTS Mayor Kersey noted that Saturday, October 8, 1977, is the last day to register to vote for the November election; however, most p}aces which register voters will not be open Saturday, so October 7, Friday, is the last practical day to register. COUNCIL COMMITTEE REPORTS Municipal Building Codes Committee - Chairman Roegner It was moved by Roegner, seconded by Kitchell, to authorize Pacific Testing Lab to perform the inspection and testing for the concrete work on the new city hall, for a sum not to exceed $6,500.00. AUBURN, WASHINGTON MONDAY OCTOBER 3, 1977 Street & Engineering Committee - Chairman Lea Roegner asked about the committee policy on mid block crossings, reference iten1 4 of the committee minutes. Lea pointed out that midblock crossings would require additional night lighting already present at end of block crossings, and that midblock crossings are felt to present a safety problem. Chief Scyler concurred with Lea's point that they are a safety ~roblem. DEPARTMENT HEAD REPORTS Jack Bereiter asked council direction regarding the avigation easements for the Auburn Municipal Airport. The council had no dispute with the proposed action stated in the special counsel's letter of September 27, 1977. Battalion Chief Henderson explained that there has been damage to the city hydrants in the past due to use of improper tools for opening them, and this ordinance change will hopefully resolve that problem. Resolution No. 831 It was moved by Roegner, seconded by Kitchell, that Resolution No. 831, entitled "A RBSOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AUTHORIZING THE MAYOR AND CITY CILERK OF THE CITY OF AUBURN, TO ENTER INTO AN AGREEMENT WITH PACIFIC NORTHWEST BELL TELEPHONE COMPANY FOR THE LEASE OF A CITY OWNED PARKING LOT FOR THE PERIOD FROM OCTOBER 1, 1977, TO SEPTEMBER~ 1978" ~ be adopted.
