PUBLIC HEARINGS
1. Mayor Kersey declared the public hearing continued on the proposed vacation
of street right-of-way situated on 23rd and "D" Street N. E., adjacent to
the Auburn Municipal Airport, situated within the corporate limits of the
City of Auburn. No one in the audience spoke for or against the proposal.

be closed.

It was moved by Kitchell, seconded by Larson, to deny that portion of the
vacation request on "D" Street N. E. until the Airport Master Plan is
completed and evaluated, and to grant. the vacation of the 5.25 feet of 23rd
Street N. E. requested and instruct the city attorney to draw up the
necessary ordinance.

Mayor Kersey declared the public hearing open on the proposed allocation
of approximately $210,000 of King County Community Development Block Grant
Funds for 1978-1979. The Human Resources Committee recommendation for
allocation was read. No one in the audience spoke for or against the
proposal. It was moved by Flechsig, seconded by Kitchell, that the
public hearing be closed.

Craig suggested that the sewer replacement program be given a higher
priority because funds for this program as requested in last year's
Block Grant Funds were not granted by King County, and because the
city has a stronger responsibility for maintaining the public utilities
than for maintaining the parks. George Schuler pointed out that the HUD
guidelines for these funds emphasize trying to meet the needs of the
elderly and those with low incomes, and that putting the sewer program
at a higher priority may result in the city getting less funding overall.
He added that the park restoration program was given its priority partly
because the parks have no way of generating income, where the sewer
utility does. Craig added that the sewer replacement program is aimed
at an old section of town where many of the residents who would benefit
are elderly. It was moved by Larson, seconded by Craig, that the
proposal for the allocation of approximately $210,000 of King County
Community Development Block Grant Funds for 1978-1979 be submitted as
follows:

3. Mayor Kersey declared the public hearing open On the request of Clark,
Topinka, Lund and Jullum to rezone from NS (Neighborhood Shopping) to C-l
(Light Commercial) a parcel of land 20,000 sq. ft. in size and located
in the southeast corner of the Villa Shopping Center at the northeast
corner of 22nd and "N" St. N. E. (Application 35-77). The Planning Commission
recommends council approval of this request because the Comprehensive Land
Use Plan does designate this area as a neighborhood retail area and the
site is situated at the intersection of two major collector stt:cd
to serve more than one neighborhood. Also, that if approved the .,...10 (?ilter
into a separate agreement with the city restricting the use of the property
for a restaurant, not including a drive-in restaurant, together with other
uses as outlined in the CN Neighborhood Shopping classification. Dick t
Fiedler, 1915 "u" Street N. E. asked for a definition of drive-in restaurant. '
George Schuler defined it as a restaurant which serves food to customers
to eat in their car. Mr. Fiedler asked how this would be assured in the
rezone, and Jack Berei ter, Ci ty Attorney replied that the agreement that
will be attached to the ordinance and recorded in the county auditor's
office would assure this. Barney Clark, 23230 Marine View Drive S. W.
Seattle, stated he would be glad to answer any questions council might
have on the request. There was no further response from the audience.
It was moved by Larson, seconded by Lea, that the public hearing be closed.
MOTION CARRIBD
Lea asked why this request WIlls not handled as a conditional use permit and
George Schuler answered that the N-S zoning does not allow this type of
conditional use, and that the rezone with the attached agreement as recorded
with the county makes this a stronger grant. Craig asked if this action
would not be condemning the property to a certain use, and Jack Bereiter
answered that this is not considered taking of property Dut granting a
privilege. It was moved by Lea, seconded by Larson, to grant the request
of Clark, Topinka, Lund and Jullum to rezone from NS to C-l property located
at the northeast corner of 22nd and "M" St. N. E. and to instruct the
city attorney to draw up the necessary ordinance to include the recommenda-
tions of the Planning Commission.

4. Mayor Kersey declared the public hearing open on the request of Mastro,
Terrana, Michelotti, and Mondchien to rezone from C-3 (heavy commercial) to
M-l (light industrial) a parcel of land approximately 5.89 acres in size
located on the west side of the West Valley Highway at the intersection of
15th St. S. W. (Application 28-77). The Planning Commission recommends
council approval of this request provided that the legal description is
amended to zone the easterly 450 feet of the site to M-l (light industrial)
and the balance of the slope to S.R. (suburban residential). Albert Terrana
stated that the applicants have no objections to the conditions stated.
It was moved by Lea, seconded by Craig, that the public hearing be closed.

It was moved by Craig, seconded by Larson, that the request of Mastro,
Terrana, Michelotti, and Mondchien to rezone from C-3 to M-l 5.89 acres
on the west side of the West Valley Highway be granted and that the city
attorneY be instructed to draw up the necessary ordinance and that the
Planning Commission recommendations be concurred with.

5. Mayor Kersey declared the public hearing open on the request of John and
Marlene Kingman to rezone from R-2 (single family) to R-3 (duplex) a parcel t
of land 3.79 acres in size lying on the west side of "N" St. S. E. between
llrd and lHh Streets S. E. (Application 31-77). The Planning Commission .
recommends council approval of this request because it will be compatible
with existing developments in the area and will conform to the intent of
our Comprehensive Land Use Plan.

this area would be an asset to the city as well as himself. It was moved
by Larson, seconded by Kitchell, that the public hearing be closed.

Craig cautioned council that there is a possible problem in this area with

It was; moved by Craig, seconded by Larson, to grant the request of John and
Marlene Kingman to rezone from R-2 to R-3 3.79 acres lying on west "M" St.
S. E., and that the city attorney be instructed to draw up the necessary
ordinance.

CORRESPONDENCE
The city clerk read a zone change application from Darrel D. Fowler to rezone from
R-2 to R-4 property located on the east side of "F" St. S.E. between 19th and
2lst Streets S.E. (Application 37-77). It was moved by Lea, seconded by Flechsig
that this application be referred to the next regular meeting of the Planning
Commission.
MOTION CARRIED
The city clerk read a petition for vacation of right-of-way from T. E. Mathews
for right-of-way located between 56th and 58th Avenue South at South 338th.
(V-12-77). It was moved by Craig, seconded by Kitchell, that the city attorney
be instructed to draw up the necessary resolution calling for a public hearing
on this request.

RECOMMENDATIONS
The following items are recommended by Planning and Community Development for
call to public hearing for December 5, 1977:
1. Request of John Versolenko and George McLaughlin to rezone from R-2
(single family) to R-3 (duplex) a parcel of land 48,400 sq. ft. in size
located at the southwest corner of 26th and "I" St. N. E. (Application
32-77) .
2. Request of the Auburn Development Partnership to amend an existing
R-2 Special Property Use Permit on a parcel of land 76,800 sq. ft. in
size located on the south side of 14th St. N.E. midway between Harvey
Road and "N" St. N.E. (Application 33-77).
3. Request of Roderick W. Stewart to rezone from M-2 (heavy Industrial) to
A-l (agriculture) a parcel of land ll.13 acres in size lying on the south
side of 29th St. N.W. abutting the west side of the Burlington Northern
Railroad right-of-way at 304 29th St. N.W. (Application 36-77).
4. Consideration of an amendment to Chapter l8.52.0l0 of the Auburn City
Code allowing exceptions to height restrictions in the various use
districts.
5. Consideration of an amendment to the Comprehensive Land. Use Plan to
change the land use designation of public and quasi-public of ~~e Auburn
Game Farm to conform to the land use on adjacent properties.
It was moved by Larson, seconded by Flechsig, that a public hearing be held
December 5, 1977, 8:00 p.m., before the city council in the Auburn School
District Administration Building Board Room, on each of these five items.

The foll,owing are recommendedby Public Works for council approval:
1. Creation of LID 29l, curb and gutter, storm drainage, excavation,
ballasting, asphalt, concrete surfacing to a width of 44 ft. on 8th
St. S.E. between Auburn Way South and "B" Street S.E. Estimated amount
of improvements is $46,247.9li 74% of total area and 73% of total frontage
of property owners signed the petition. Engineer's certification and
preliminary assessment roll attached. It was rroved by Lea, seconded by
Flechsig, to instruct the city attorney to draw up the necessary ordinance
creating LID 291.

2. Creation of LID 292, 8 inch watermain, fire hydrants and services on
"I" Street N.E. between 22nd and 26th Streets N.E. Estimated amount
of improvements $l5,060.00; 50.36% of property owners of total assessable
square footage, of total frontage and of total area signed the petition.
Engineer's certification and preliminary assessment roll attached. It
was moved by Craig, seconded by Larson, that the city attorney be
instructed to draw up the necessary ordinance creating LID 292,

3. It is recommended by the Street Committee that the $2,500 received from I
the contractor of the Metro Interceptor Sewer for surface treatment of
29th St. N.W. be reserved in the 1978 budget and should there be any
funds remaining after the restoration, the balance of the money is to go
into the Street Division Maintenance Budget.

4. Request for Hal OWens, Engineering Technician in Traffic, to attend a
one-day maintenance school (free of charge to municipalities) in
Beaverton, Oregon. It was moved by Lea, seconded by Kitchell, to authorize
Hal (Mens to attend maintenance school in Beaverton, Oregon.

5. Pay Estimate No.2 to puget Electric Co., Inc. for construction of
Sanitary Sewer Imp. #34, lift station alarm monitoring system, in the
amount of $l5,755.02, Contract 77-04.
Contract amount $58,021.65
Earned to date 29,OlO.82 (incl. $2,752.45 retng)
It was llOved by Craig, seconded by Anderson, that Pay Estimate No. 2 to
puget Electric Co., Inc. for $15,755.02, be approved for payment.

6. Due to a water leak, the account of Earl Johnson, 1725 "M" St. N.E.,
should be adjusted with a credit of $27.90. It was moved by Craig,
seconded by Anderson, to approve credit of $27.90 to the account of
Earl Johnson, #430.34300.

7. Authori ty to call for bids for Street Improvement 187, East Main Street
Project from Auburn Way to "M" Street, UAB Project 8-l-l05(16). Flechsig
asked abount the left turn lane from Auburn Way to East Main and Lea
replied that it would remain according to the project plan. Mayor Kersey
expressed concern about the bulbing of the northeast corner of Main Street,
saying that if the bulbed corner couldn't be swept with the mechanical
sweeper, it should be altered. Lea replied that the project designers
felt the bulbing would be necessary to accomodate the new traffic control
equipment and Pat Nevins added that the Street Committee could look into
the Mayor's question before the bids go out. Roegner asked about the
proposed landscaping in the project, and Lea answered that it would be
an alternate of the bid.
It was moved by Lea, seconded by Larson, to authorize bhe Director of
Public Works to call for bids for the East Main Street Project.

It was moved by Roegner, seconded by Flechsig, that Contract 77-10 be accepted
by the city as complete, and Pay Estimate #3, final, to W. G. Clark Construction
for $1,280..02 be approved for payment, and the retained percentage amounting
to $9,034.33 be paid in thirty days provided no liens or claims are filed and
clearance ,is secured.from the state Departments of Revenue and Labor and
Industries.

It was moved by Roegner, seconded by Kitchell, to accept the bid of Buck & Sons
for a Kubota tractor model L285 for the Cemetery Department at a cost of
$4,974.80r subject to the approval of the city attorney. Also, Lea asked
that the availability of parts for this equipment be ascertained before it
is purchased.

Roegner announced that the committee agenda will be made available in the future
to all councilmen, so they may be aware of the conunittee's upcoming actions.

Utility Committee - Chairman Craig
The committee minutes are a matter of public record. It was moved by Craig,
seconded by Larson, that Ordinance No. 3224, entitled, "AN ORDINANCE OF THE
CITY OF AUBURN, WASHINGTON, PROVIDING FOR THE CONSTRUCTION OF AN 8 INCH CAST
IRON WATER MAIN, FIRE HYDRANTS AND NEW WATER SERVICES ON "I" STREET NORTHEAST
BETWEEN 22NDAND 26TH STREETS NORTHEAST, INSIDE THE CORPORATE LIMITS OF THE CITY

postponed until November 30, 1977r due the Thanksgiving holiday.
Planning and Community Development Committee - Chairman Larson
It was moved by Larson, seconded by Roegner, that the city continue with the King
County Consortium for the planning and distribution of Block Grant Funds and
that a resolution be adopted authorizing the mayor to sing the amended agreement
for the planning and distribution of Block Grant Funds for the years of
1978-1980.

It was moved by Larson, seconded by Roegner, that the council adopt the Three
Year Community Development plan as a guide in order to meet the requirements
of H.U.D. under the Community Development Act of 1974.
