ROLL CALL COUNCILMEN PRESENT: Councilmen Roegner, Ki tchel1, Craig, Larson, Anderson, F1echsig and Lea. It was moved by Flecllsig, seconded by Kitchell, that the minutes of c~le December 5, 1977, council meeting be approved as mailed, wi th the following correction: Page 6, item #6, the credit to the account of Mario Coronata, #140,47600 should be $19.74 instead of $56.07. MOTION CARRIED CORRESPONDENCE The city clerk read a zone change application from Donald Torcaso and William Lagen, etc. for a change of zoning classification from R-3 to C-2, property located on the west side of "D" St. S. E. in the 100 block, also known as 121 "D" St. S. E. (Application 41,..77). It was moved by Larson, seconded by Lea, that Application 41-77 be referred to the next regular meeting of the Planning Commission. MOTION CARRIED The city clerk read a letter from Dick Brugger, Director of the Auburn Youth Resources, requesting a meeting with the council and mayor January 9, 1978, to the discuss the AYR funding situation. F1echsig commented that January 9, is too early a date, that it would not a1Jow sufficient time for bo~ parties to look for funding. It was moved by F1echsig, seconded by Craig, that council meet with AYR on March 13, 1978, to discuss funding problems, and to recommend that Mr. Brug~er attend the appropriate committee meetings to discuss funding problems. MOTION CARRIED AUDIENCE PARTICIPATION Libby R. Riddle, 1460 32nd S. E., presented a petition of signatures of residents living near the game farm, asking that the zoning of the game farm allow nothing other than a city park or single family homes. RECOMMENDATIONS The Department of Public Works recommends the following for council approval: 1. It is recommended that the bids received for St. Imp. 187, East Main Street project, Contract No. 77-16, be referred to the Street Committee. It was moved by Lea, seconded by Craig, to refer the bids on Contract 77-16 back to the Street Committee. MOTION CARRIED 2. It is recommended that the bid on the M & 0 Building Remodeling be thrown out and the Public Works Department be allowed to negotiate with that bidder for a new reduced contract. It was moved by Craig, seconded by Anderson, to authorize the Public WOrks Department to negotiate for a reduced contract for the M & 0 building remode1ingr and throw out the one bid received. ROLL CALL VOTE: All councilmen voting YES. MOTION CARRIED 3. Approval of the following change orders to St. Imp. 186, 3rd St. N.E.IN.W., UAB Project 8-1-105(15) is requested: 3A Increase of $41,164.55 4A Decrease of $300.00 1B Decrease of $579.70 2B Increase of $1,403.49 2C Increase of $1,296.55 These change orders consist of: relocation of fence, connection of storm sewer line, removing existing storm sewer manhole, elevation problem with a -1- ~....' C. Penney Co., sanitary sewer fabrication installation of larger coupler, temporary connec- tion of sanitary sewer. It was moved by Lea, seconded by Anderson, to approve the change orders, as stated. ROLL CALL VOTE: All councilmen voting YES. MOTION CARRIED I The Planning Department recommends the following for council action: 1. Call for public hearing on the request of Don Kirkman and David Hensel to amend an existing Special Property Use Permit from a retirement center to 10 duplexes on property located on the west side of "M" Street N. E. in the 1900 block (Application 38-77). It was moved by Larson, seconded by Craig, that a public hearing be held January 3, 1978, on Application 38-77. 2. Pay Estimate No. 3 to Merit Construction Co. for the construction phase of the new Auburn City Hall in the amount of $89,054.80. It was moved by Roegner, seconded by Kitchell, that Pay Estimate No. 3 to Merit Construction Co. in the amount of $89,054.80, be approved. ROLL CALL VOTE: All councilmen voting YES. MOTION CARRIED 3. Change Order No. 3 to Merit Company on the Auburn City Hall for an increase of $3,559.00. It was moved by Roegner, seconded by F1echsig, to approve Change Order No.3 to Merit Company for an increase of $3,559.00. ROLL CALL VOTE: All councilmen voting YES. MOTION CARRIED 4. Change Order No.4 to Merit Company on the new Auburn City Hall for a reduction of $1,994.00. It was moved by Roegner, seconde~ by Kitchell, that Change Order No. 4 to Merit Company for an increase of $1,994.00 be approved. ROLL CALL VOTE: All councilmen voting YES. MOTION CARRIED PROCLAMATIONS, APPOINTMENTS AND ANNOUNCEMENTS Mayor Kersey stated he has received another request from the Liquor Control Board for a recommendation on a liquor license application for the Alamo Restaurant. The original application was denied because of a zoning prob1emr but a rezone has recently corrected that problem. Council had no objections to the liquor license and Mayor Kersey indicated he would return the applica- tion with no objection from the city. COUNCIL COMMITTEE REPORTS Municipal Building Committee - Chairman Roegner It was moved by Roegner, seconded by Flechsig, to award the bid on new draperies for the Auburn Library, to American Draperies, on their low bid of $1,789, plus sales tax. ROLL CALL VOTE: All councilmen voting YES. MOTION CARRIED It was moved by Roegner, seconded by F1echsig, to declare surplus that property I. where the old Senior Citizen Center is located, and to use that property as a parking lot, depending on the outcome of the proposed exchange of LID parking lot adjacent to the city hall. ROLL CALL VOTE: All councilmen voting YES. Airport Council Committee - Chairman Kitche1l--- No report Utility Committee - Chairman Craig--- Minutes are public record. Planning and Community Development Committee - Chairman Larson It was moved by Larson, seconded by Lea, to approve a pay estimate to O.R.B. for professional service performed on the new senior center, in the amount of $117.90. ROLL CALL VOTE: All councilmen voting YES. MOTION CARRIED It was moved by Larson, seconded by Roegner, to authorize the Mayor to sign a lease with Metro for the proposed Pea Patch located north of the Park & Ride lot on 15th N. E. ROLL CALL VOTE: All councilmen voting YES. MOTION CARRIED It was moved by Larson, seconded by Lea, to authorize the Mayor to sign a lease agreement for the house at Cedar Lanes Park. ROLL CALL VOTE: All councilmen voting YES. M(/)TION CARRIED It was moved by Larson, seconded by Roegner, that the City's Comprehensive Land Use Plan be amended to change the land use on the Game Farm property to low density single family with the exception of one lot depth along "R" St. S. E. to be medium density single family and except hillsides with slopes of 25% or more, river bed and associated f100dways to be designated as open space. ROLL CALL VOTE: All councilmen voting YES. MOTION CARRIED Public Safety Committee - Chairman Anderson--- No report. Finance Committee - Chairman Flechsig It was moved by F1echsig, seconded by Craig, that the Mayor not sign the health services agreement with Seattle-King County Department of Public Health, and that he be directed to direct a letter to that agency asking those questions as set forth in the Finance Committee minutes. ., MOTION CARRIED It was moved by Flechsig, seconded by Lea, to authorize the Mayor to renew the King County Medical Blue Shield medical and dental program for city employees, at the new prices quoted. ROLL CALL VOTE: All councilmen voting YES. MOTION CARRIED It was moved by Flechsig, seconded by Craig, to approve the voucher expenditures on checks numbered 2985 through 3173 in the amount of $445,641.08, and the payroll for the period ended December 4, 1977, in the amount of $151,902.95. ROLL CALL VOTE: All councilmen voting YES. MOTION CARRIED It was moved by Flechsig, seconded by Lea, that the cash adjustment transfers for November, 1977, be approved, as listed on appendix "A". ROLL CALL VOTE: All councilmen voting YES. MOTION CARRIED It was moved by Flechsig, seconded by Craig, to declare surplus 10 (ten) da~a processing disc packs, and accept the offer by Data-Plus, Inc. to purchase them. ROLL CALL VOTE: All councilmen voting YES. MOTION CARRIED It was moved by F1echsig, seconded by Lea, to authorize a call for bids for the city's legal publications for 1978. MOTION CARRIED -3- :- f" H~) AUBURN, WASHINGTON MON DAY DEDEMBER 19, 1977 Street & Engineering Committee - Chairman Lea Lea expressed concern about the possible city liability in not being able to provide sufficient emergency services to the Hidden Valley Estates, as pointed out ina letter from Fire Marshal Jim Gintz, because of the steep grade of the access road and inadequate water. Lea asked Jack Bereiter to prepare an opinion regarding this question. OLD BUSINESS Ordinance No. 3230 I It was moved by Craig, seconded by Anderson, that Ordinance No. 3230, entitled "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, AMENDING AUBURN CODIFIED CITY ORDINANCES 13.20.480 AND 13.20.520, RELATING TO THE MONTHLY RATES AND CHARGES FOR SEWAGE DISPOSAL SERVICES", be adopted. ROLL CALL VOTE: Councilmen Craig, Larson, Anderson, F1echsig, Lea and KitcheJ1 voting YES. Councilman Roegner voting NO. MOTION CARRIED ORDINANCES AND RESOLUTIONS Ordinance No. 3232 It was moved by Larson, seconded by Roegner, that Ordinance No. 3232, entitled "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR THE REZONING OF A PARCEL OF LAND 11.13 ACRES IN SIZE LYING ON THE SOUTH SIDE OF 29TH STREET N.W. ABUTTING THE WEST SIDE OF THE BURLINGTON NORTHERN RAILROAD RIGHT-OF-WAY, WITHIN THE CITY OF AUBURN, WASHINGTON, CHANGING THE ZONING CLASSIFICATION THEREOF FROM M-2 TO A-1", be introduced and adopted.
