Flag Salute ~~ The regular meeting of the City of Auburn Council was called to order by Mayor Bob Roegner at 7:30 p.m. in the City of Auburn Council Chambers. Mayor Roegner led those in attendance in the pledge of allegiance. B. Roll Call Those in attendance included Mayor Bob Roegner, Councilmembers Brothers, Burns, Kurle, Larson, Whittall, and Wisner; staff mem- bers Jack Bereiter, City Attorney; Len Chapman, Parks & Recreation Director; Frank Currie, Public Works Director= Pat Dugan, Finance Director; Jake Evans, Police Chief; Bob Johnson, Fire Chief; Lynn Rued, Acting Planning Director; Gretel Sloan, Personnel Director; and Darlene Cruz, City Clerk. Councilmember Walters was excused. C. Announcements and Appointments 1. Proclamations a. Youth Art Month, March, 1986 Mayor Roegner read the proclamation and proclaimed March Youth Art Month. The proclamation was presented to Gertrude Sprenger, Auburn Arts Commission. The Mayor encouraged the public to view the various winning art being displayed in the City Hall lobby. Leslie Moore, Arts Commission Member, was introduced to the Council. b. National Teacher Day, March 4, 1986. The proclamation was read and March 4, 1986 was proclaimed National Teacher Day. Mary Moore and Cathy Hiroshi (President of Auburn Education Assoc.), classroom teachers, were presented with the proclama- t=on. ` 2. Employee of the Year Award Officer Boti Karnofski was named Employee of the Year. Karnofski has been employed with the City since 1981. He is on the Board for Auburn Youth Resouces, a member of the Auburn Substance Abuse Committee, and is one of two advi- • sors for the Police Explorer's Unit. He is strongly recognized as a major asset to the City and Auburn com- munity, Mayor Roegner announced. The plaque designating all the past "Employees of the Year" was presented to Karnofski along with a well responding applaud. Karnofski's parents, who had traveled from California, were also in the audience.. 3. Auburn Chamber of Commerce Annoucement A proclamation was presented to the President of the Auburn Chamber of Commerce earlier in the week. ' CITIZEN INPUT, PUBLIC HEARINGS 6 CORRESPONDENCE II. A. Public Hearings Annexation on West Valley Highway - 1.77+ acre parcel of property located at the southwest corner of 37th St. N.W. and the West Valley Highway. No one spoke for or against the public hearing. MOTION by, Burns, SECOND by Wisner to close the public hearing. MOTION CARRIED UNANIMOUSLY -1- 158 AUBURN COUNCIL MINUTES PAGE TWO MARCH 3, 1986 II. Public Hearing (continued) MOTION by Burns, SECOND by Wisner to approve the annexation and to instruct the Planning staff to prepare a notice of intention to be forwarded to the King County Boundary Review Soard; and to instruct the City Attorney to prepare the necessary resolu- tion indicating the Council's action. MOTION CARRIED UNANIMOUSLY B. Audience Participation Bob Smythe, attorney for Lloyd, spoke regarding Ordinances 4113 and 4119. Reforestation was his clients main concern. He said it was not necessary to put trees in at this time. There is no provision to remove diseased and dangerous trees. He recommended there be a specific provision to trim trees for the view. The provision would allow continued maintenance by the landscaper. A request was made for consideration by the Council on reopening the pit site prior to the ordinance taking effect. Leon Stucki, 724 Hi-Crest Dr., questioned what would happen if dense housing (condominiums) is permitted and they later become rentals because of default. He felt there should be a provi- sion that would enforce protection against the housing becoming total rental property. Maris Hickson, 523 Aaby Dr., commented on different issues she had concerns on. She felt this fall would be too soon for reforestation, and the trees were too close to the adjoining properties. A request was made for the Council to consider disapproval of a 4-lane arterial because the traffic would not be right. Hickson also voiced her desire for single family housing regarding the area at issue. Bob Smythe spoke regarding the sharing of the signalization ' cost. He said he felt there is a need for the signal, and asked the Council to consider the issue of signalization to be shared by the property owner of impact. C. Correspondence included a letter from Bob Smyth dated 2/27/86. COUNCIL COMMITTEE REPORTS III. A. Municipal Services Chairman Wisner reported the Committee met on 2/27/86. Minutes are of public record. B. Planning b Community Development Chairman Burns reported the Committee met on 2/26/86. Minutes are of public record. C. Public Works Chairman Larson reported the Committee met on 2/20/86, ar.d the meeting on Thursday, February 6, 1986 has been can- celled. Minutes are of public record. D. Finance Chairman Rurle reported the Committee met prior to the ' Council meeting. Minutes will be of public record when they are transcribed. CITIZEN INPUT IV. MOTION by CARSON, SECOND by Wisner to approve Consent Agenda Items A through G. MOTION CARRIED UNANIMOUSLY OLD BUSINESS VI. A. Ordinance 4113 - Repeals Ordinances 3549 and 3550, and provides for a Special Property Use Permit for gravel removal on property located on the east side of 60th Avenue South bet- ween south 320th and 15th Street N.W. 159 Lynn Rued, Acting Planning Director, responding to Stucki's question; said the ordinance has no control on rental or purchased property. In responding to Symthe's letter regarding removal of trees for view - Rued said view of neighbors who ' will look back into the pit is a greater impact than those looking out'. Diseased or dangerous trees may be identified by the landscape architect on the restoration plan which will need the approval of the Planning Director. If approved the trees may be removed. Referring to the Mt. View Terrace site plan - the area in the green. is the same outline as the 1980 site plan which indicates vegetation should remain as is, and Rued referenced the area in red as being the catch points of those not to be disturbed. The buffer area is as it should be, he said. Bob Smythe, in responding to Burns, said the site plan being referenced by Rued was different as to what was suppose to have been removed. He said Lloyd has indicated he would like to have trees trimmed for view purposes. Desire was to cut down trees so the valley and mountain could be viewed after the pit is no longer a pit and is a residential area. It is unusual to require a greenbelt between two single-family residential areas if the gravel pit is no longer in existance, Smythe said. In regards to removal aspect - even though the road grading may not encroach as such on greenbelt, there are many things that will impact the final phases of development. The very sharp drop is not readily visible. Somewhere a retention pond may have to exist, but a retention pond would not be feasible with a greenbelt. When the road is in then the buffer area would be ' more known. The final development of property is unknown and it would not be appropriate for the greenbelt to be brought out at the present time, Smythe concluded. -3- 160 AUBURN COUNCIL MINUTES PAGE FOUR MARCH 3, 1986 VI. OLD BUSINESS (continued) Larson asked about the site plan. Rued said the site plan was submitted in the Conditional Use Permit application. There will' be two large benches in the middle of the pit which will accommodate the attached housing (approximately 300 units). The existing property will be abutting the housing being put in. Hi-Crest Drive will be quite a distance in area and there will be a change in elevation. As far as mining being done it was determined that the greenbelt was important for homes off Aaby Drive than for dividing the areas. Rued responding to Kurle's question regarding building struc- ture said there is no limit on how many units may be built per structure. Each family unit has 6,000 feet for every unit which excludes the public road, but the vertical cliff would be included. There is a change between the site plans (plan being referenced and the plan referenced at the 2/18/86 Council meeting) due to the actual field inspection survey - the south east corner of the property does not indicate a ridge that exists there, Rued informed the Council. Larson questioned the difference in elevation between the benches and Aaby Drive. Rued responded Aaby Drive is signifi- cantly lower than the benches. Larson felt the trees will not be needed after the mining operation is done because the buildings would be in place. Larson inquired if the trees could be restored. Since building permits are needed prior to building, could they be tied on to the permits rather than to this ordinance, he asked. It could be, Rued replied. Larson recommended to go ahead with Ordinance 4113, modifications and reforestation to the site plan so as to allow staff time to review drainage plan. Wisner felt the trees would ultimately have to be cut, and believed it should be done now. She strongly recommended the greenbelt be out of the Council's jurisdiction, and reforesta- tion be done at the earliest time. MOTION by Burns, SECOND by Wisner to introduce and adopt Ordinance 4113. Larson voted no. MOTION CARRIED B. Ordinance 4114 - Provides for a Conditional Use Permit on pro- perty zoned R-2 (Single Family) located on the east side of 60th Avenue South between 320th and 15th Street N.W. Question by Rurle on traffic light was directed to Smythe. Smythe said Section 5 and the conclusions portion of the ordi- nance, did not say anything specific on the signalization funding. Rued informed the Council Lloyd may form an L.I.D. at his option which would make the funding of the signalization shared, otherwise the responsibility would be on Lloyd. Whittall did not agree with Section 2, and MOTIONED to amend Ordinance 4114 by the elimination of Section 2 which authorizes construction of attached residential housing; SECOND by Rurle. Motion did not carry. Rued informed the Council the basic intent for Ordinance 4114 is to authorize attached housing. If just single family housing is desired then Ordinance 4114 is not necessary. -4- ~' 161 AUBURN COUNCIL MINUTES PAGE FIVE MARCH 3, 1986 VI. OLD BUSINESS (continued) Dugan said approval of the Conditional Use Permit may be the only opportunity for the Council to support multi-family deve- lopment to be built without a plat. Single family developments require a plat. Larson asked about the impact on grading requirements from a multi-family to a single-family. Dugan responded continuity with what has been planned has been maintained. If the Comprehensive Use Permit is not approved then a single-family contour where the building would be built will be very inefficient. The road configuration is tied to one place. The interior benches -the upper part has been established, the lower part may have a way to go. Single family would present difficulty on the grades. Whittall felt a multi-family development should not be built just because it was in the 1980 site plan. He believed what the people desired (single-family housing) should take precedence over the site plan. Burns spoke concerning the outcome if Ordinance 4114 failed. He felt Lloyd would not be able to develop single-family housing, and the property would have to be sold since it would not be financially feasible. There should be multi-family on the hillside, which is an appropriate way to develop the area. Citizens would get a road they need, and there would be a buffer, he said. Whittall felt a four-lane arterial up the hill was not warranted, but a'two-lane road would be sufficient. Burns disagreed with Whittall because of the public safety aspect. There is a 14-16 minute delay to get up that hill for emergency aid, he said. MOTION by Burns, SECOND by Wisner to introduce and adopt Ordinance 4114. Whittall and Kurle voted no. MOTION CARRIED VII. NEW BUSINESS A. Ordinance 4115 - Authorizes the Mayor to accept Schedule "A" which relates to the City of Auburn 1986 budget reallocation of funds in various accounts in several funds. MOTION by Rurle, SECOND by Larson to introduce and adopt Ordinance 4115. MOTION CARRIED UNANIMOUSLY B. Ordinance 4116 - Provides for the rezoning of a parcel of land 5.09 acres in size located on the north side of 21st Street S.E. in the 200-300 blocks, within the City of Auburn, changing the zoning classification thereof from M-2 and R-4 to R-3. MOTION by BURNS, SECOND by Wisner to introduce and adopt Ordinance 4115. MOTION CARRIED UNANIMOUSLY C. Ordinance 4117 - Amends Section 17.18.190 and 17.32.050 of Chapter 17 of the Codified Ordinances of the City of Auburn, pertaining to the subdivision ordinance. MOTION by Burns, SECOND by Wisner to introduce and adopt Ordinance 4117. MOTION CARRIED UNANIMOUSLY D. Resolution 1668 - Orders the Finance Director to make segrega- tion on the original Assessment Roll of Local Improvement District No. 318, Assessment No. 28. Resolution 1669 - Orders the Finance Director to make segrega- tion on the original Assessment Roll of Local Improvement District No. 322, Assessment No. 12. MOTION by Kurle, SECOND by Larson to adopt Resolution 1669. MOTION CARRIED UNANIMOUSLY F. Resolution 1671 - Authorizes the Mayor and City Clerk to execute an agreement with Corporate Health Designs to provide health care cost containment consultant services. MOTION by Kurle, SECOND by Whittall to adopt Resolution 1671. MOTION CARRIED UNANIMOUSLY G. Resolution 1672 - Authorizes the Mayor and City Clerk to execute a contract with Rea Annette Bachman for indigent screening services. MOTION by Kurle, SECOND by Whittall to adopt Resolution 1672.
