CALL TO ORDER The regular meeting of the City of Auburn Council was called to order by Mayor Bob Roegner at 7:30 p.m. in the City of Auburn Council Chambers. A. Flag Salute Mayor Roegner led those in attendance in the pledge of allegiance. B. Roll Call Those in attendance included Mayor Bob Roegner and Councilmembers Whittall, Wagner, Burns, Borden, Barber, Brothers, and Kurle. Staff members in attendance included Fire Chief Bob Johnson, Police Chief Jake Evans, Personnel Director Pam Sime, Parks & Recreation Director Len Chapman, Finance Director Pat Dugan, Public Works Director Frank Currie, Planning Director Steve Lancaster, City Attorney Stephen R. Shelton, City Clerk Robin Wohlhueter, and Deputy City Clerk Gayle Butcher. Other staff members in attendance included Police Lieutenant Bob Almy, Library Director Mary Stanton, Senior Planners Lynn Rued and Lois Stark. C. Announcements and ADDointments I. Announcements - None 2. ADDointments A3.8 a. Librarv Board Council to consider the Mayor's appointment of Bob Wiley to the Library Board for a term to expire on December 31, 1996. Motion by Councilmember Kurle, second by Councilmember Burns to confirm the appointment of Bob Wiley to the Library Board for a term to expire on December 31, 1996. MOTION CARRIED UNANIMOUSLY. 7 -0. D. Agenda Modifications Mayor Roegner noted agenda modifications this evening are Item II.C.I. transmitting correspondence from Pearl McElheran, Manager from King County Real Property Division with regard to LID 344 dated February 27, 1992, which is on this evening's agenda as Public Hearing Item II.A.I, and from Fred Meyer, Inc. dated March 2, 1992 regarding the Auburn North Central Business District Plan, which is on this evening's agenda as Old Business Item V.A. CITY OF AUBURN COUNCIL MEETING March 2, 1992 II. CITIZEN INPUT. PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearings 1. Local Imorovement District 344 F2.4.9 LID 344, 04.9.1 St Imp 292 The final assessment roll for Local Improvement District 344 for the construction of new sidewalks, low level pedestrian lighting and related work, along East Main Street from Auburn Way North to Auburn A venue. All persons are encouraged to voice an opinion at this time. Mayor Roegner opened the public hearing and requested public comment. Jack Rucinskv. 10625 Marine View Drive. Seattle. W A 98146 Mr. Rucinsky expressed his concerns on the method used for determining his assessment for LID 344. Mr. Rucinsky felt the assessment should be based upon square footage since lease agreements and property purchases are valued at square footage. Mr. Rucinsky does not feel his assessment is fair and presented examples of other assessment lots within LID 344 which have larger square footage lots than his property and are assessed less. There were no further requests to speak for or against Local Improvement District 344. Motion by Councilmember Whittall, second by Councilmember Burns, to close the public hearing. MOTION CARRIED UNANIMOUSLY. 7-0. Councilmember Whittall inquired how the assessments were determined. Public Works Director Frank Currie responded properties were assessed based on sidewalk frontage, which is a common way to assess local improvement districts. Motion by Councilmember Whittall, second by Councilmember Burns, to introduce and adopt Ordinance No. 4548. MOTION CARRIED UNANIMOUSLY. 7-0. 2. Aoolication No. COM0004-91 03.4.3 COM0004-91, 03.7 Consideration of the adoption of amendments to the Comprehensive Plan to implement policy changes regarding critical areas and resource lands and amendment of the Environmental Review Procedures Ordinance to meet the mandates of the State Growth Management Act. Prior to consideration of Public Hearing Item II.A.2, Mayor Roegner requested Senior Planner Lois Stark present a brief overview. Lois Stark noted the amendments to the Comprehensive Plan and the Environmental Review Procedures Ordinance are mandated by the Growth PAGE 2 CITY OF AUBURN COUNCIL MEETING March 2, 1992 Management Act to assure conservation of resource lands, such as agricultural and mineral lands, and critical areas which are wetlands, geological hazards, fish and wildlife areas, frequently flooded areas, and aquifer recharge areas. The proposed amendments do not require additional staffing. Ms. Stark further noted public meetings and hearings had been held by the Planning & Community Development Committee, and the Planning Commission, and that no significant concerns had been raised. Mayor Roegner opened the public hearing. There were no requests to speak for or against Application No. COM0004-91. Motion by Councilmember Burns, second by Council member Barber, to close the public hearing. MOTION CARRIED UNANIMOUSLY. 7-0 Motion by Council member Burns, second by Councilmember Barber to introduce and adopt Ordinance No. 4544. Councilmember Whitta]] requested a clarification on the how the policy recommendation might impact the Lakeview development. Planning Director Lancaster responded that the primary purpose of designating mineral resource lands is to protect such lands from incompatible new development that could affect the ability to mine. One of the criteria suggested by the State for designating mineral resource lands is that they not lie within areas already characterized by urban levels of development. In Auburn, we have determined that the only area with significant gravel deposits and not already affected by nearby urban development is the south Stuck River area. In response to Councilmember Whitta]]'s question on aquifer recharge areas, Mr. Lancaster stated that an area-wide aquifer management program is currently underway under the leadership of the Seattle/King County Health Department. Staff believes the City should not make significant decisions regarding the city-wide aquifer protection requirements until that study has been completed, and this approach is supported by the State. In response to Mr. Whitta]]'s question regarding the additional definitions to be added to Auburn's Environmental Review Procedures Ordinance, Mr. Lancaster stated the purpose of these definitions is to require that short subdivisions be subject to environmental review procedures if they lie within the defined areas. Currently, short subdivisions are exempt from the SEP A process. MOTION CARRIED UNANIMOUSLY. 7-0. Motion by Councilmember Burns, second by Councilmember Barber, to approve Resolution No. 2281. MOTION CARRIED UNANIMOUSLY. 7-0. B. Audience Particioation Bill Morchin. 1345 East Main ST. Auburn. W A 98002 Mr. Morchin expressed his concerns regarding the lack of city staff communication with the Business Improvement Area members. He stated PAGE 3 CITY OF AUBURN COUNCIL MEETING March 2, 1992 there are errors regarding traffic predictions in the study completed for the Auburn North Business Area Plan, and Mr. Morchin stated city staff withheld information regarding these errors. He recommended this item be continued in order to review impacts on traffic. Steve Cogan. 3800 SE 22nd Av. Portland. OR 97242 Mr. Cogan works for Fred Meyer, Inc. and noted a]] Councilmembers had received a copy of Fred Meyer's letter outlining what Fred Meyer's position is with regard to the Auburn North Business Area Plan. Fred Meyer is requesting the developed store be excluded from the Auburn North Business Planning Area and retain the heavy commercial district zoning designation. Fred Meyer, Inc. believes this is consistent with the store's expectations when they developed the store approximately 4 years ago, and Fred Meyer feels any zoning change would subject them to a competitive disadvantage. Mr. Cogan further stated Fred Meyer wants equal zoning treatment as the Auburn North Shopping area. Mr. Cogan stated Fred Meyer is willing to accept a new classification for their undeveloped site with the exception of Land Use Policy #7 which regulates drive-in facilities. Fred Meyer wants Land Use Policy #7 of the Auburn North Business Area Plan removed. Fred Meyer believes the surrounding area is not pedestrian-friendly, but rather an established drive- in character is already in place. Stan Piha. 4th & Blanchard Building. 2101 4th A V. Suite 2375. There were no further requests for audience participation. C. Corresoondence Under Agenda Modifications of these minutes, Items II.C.I and II.C.2, were transmitted. The letters related to VII.A.5 and V.A. of these minutes. III. COUNCIL COMMITTEE REPORTS A3.6.4.4 A. Municioal Services Chairman Brothers reported that the Municipal Services Committee did not met prior to the Council meeting. The next Municipal Services meeting is Monday, March 16, 1992 at 4:30 p.m. B. Planning & Community Develooment Chairman Burns reported that the Planning & Community Development Committee met on February 25, 1992 and the minutes are of public record. Chairman Burns noted the Auburn North Business Area Plan had been referred back to the Planning & Community Development Committee from the last Council meeting. He further noted comments with regard to the Auburn North Business Area will be expressed under this evening's agenda PAGE 4 CITY OF AUBURN COUNCIL MEETING March 2, 1992 Item V.A. The next meeting of the Planning & Community Development will be Tuesday, March 10, 1992 at 7:30 p.m. C. Public Works Chairman Whitta]] reported that the Public Works Committee met prior to the Council meeting at 5:30 p.m. The next meeting of the Public Works Committee is scheduled for Monday, March 16, 1992 at 5:30 p.m. D. Finance Chairman Barber reported that the Finance Committee met prior to the Council meeting this evening at 7:00 p.m. and discussed Consent Agenda Items. Motion by Councilmember Kurle, second by Council member Burns to approve Consent Agenda Items IV.A. through IV.F.3. MOTION CARRIED UNANIMOUSLY. 7-0. V. OLD BUSINESS A. Aoolication No. COM0003-91 03.4.3 COM0003-91, 03.4.4, 03.4.5, 03.4.2.1 Council to consider an amendment to the Comprehensive Plan text and map, the Zoning map and text for the purpose of adopting and implementing the Auburn North Business Area Plan. Councilmember Burns took note of Mr. Bill Morchin's comments under audience participation as well of Fred Meyer's audience participation concern of maintaining a competitive advantage. Councilmember Burns requested planning staff to comment on the concept of grandfathering the heavy commercial zoning for Fred Meyer, Inc. within the Auburn North Business Area Plan. Senior Planner Lynn Rued explained that Fred Meyer would not become a non-conforming use if zoned C-3 and left in the planning area. Any new addition or parking area would have to comply with the plan policies. If the addition would exceed 50% of the valuation of the existing building, then PAGE 6 CITY OF AUBURN COUNCIL MEETING March 2, 1992 the landscaping policies would be implemented for the entire Fred Meyer site. Mr. Rued also noted the importance of a pedestrian-friendly area that would be accomplished with using "A" Street NE at the south end of Fred Meyer Store. Councilmember Whittall felt that it was not fair to Fred Meyer, Inc. to change zoning requirements at this time. He expressed his concern that this action may indicate an unfriendly attitude toward businesses. Councilmember Whitta]] is supporting Fred Meyer's position. Councilmember Whitta]] asked for a response to Mr. Morchin's comments during audience participation with regard to errors by the traffic consultant. Planning Director Lancaster noted the consultant had redistributed the traffic predictions based upon Mr. Morchin's ideas, but the results did not make a significant difference in analysis. Planning Director noted the information was available at the Planning & Community Development Committee of February 25, 1992 and that this information was not withheld. Mr. Lancaster emphasized that the EIS traffic analysis accurately compared projected year 2000 traffic under existing zoning, with projected traffic under the proposed plan and zoning. The difference is estimated at 479 peak hour trips, which is roughly equivalent to the trips that would be generated by a moderate sized supermarket. Mr. Lancaster also emphasized that the traffic analysis, as part of an area-wide planning process, cannot be as specific and refined as a project-specific analysis. He stated that staff continues to believe the EIS provides a good basis for understanding the impacts of this plan proposal. Planning Director Lancaster also expressed his opinion that the BIA has been involved in the planning process and noted that BIA Director Greg Vine has testified twice to the City Council that the BIA does not object to the Auburn North Planning Area Plan. Mr. Vine was present when this issue was referred to the Planning and Community Development Committee. Mr. Lancaster feels city staff has worked very hard to satisfy Mr. Morchin's concerns. Councilmember Kurle expressed his concern that he is unsure whether Mr. Morchin's comments are his or on behalf of the BIA. Councilmember Kurle is also requesting clarification of the mistake the consultant admitted to regarding traffic predictions for the Auburn North Business Area. Senior Planner Rued explained there were three traffic scenarios within the Environmental Impact Statement. One scenario was existing zoning, the second was the forecast build out scenario, and the third was optimum development. The traffic consultant projected the traffic counts for scenarios one and three. For scenario two, he reduced the traffic counts by the difference of building area between scenarios two and three, which is an incorrect way to estimate traffic counts. Mr. Rued gave examples of the revised traffic counts for the area using the correct method for traffic projection. Councilmember Kurle noted the consultant's mistake Mr. Morchin has expressed concern over does not appear to be too significant. PAGE 7 CITY OF AUBURN COUNCIL MEETING March 2, 1992 Councilmember Kurle respectfu]]y disagreed with Mr. Morchin's comment that he had been ignored by city staff. Councilmember Kurle agreed with Fred Meyer's opinion that drive-in facilities are we]] established in the area. Councilmember Wagner expressed his concern of changing zoning rules on a firm that has made a considerable investment in the area. Council member Wagner is supporting Fred Meyer's position. Councilmember Burns stated he shared concerns of Fred Meyer's investment and time frame involved in changing zoning regulations, and due to these concerns, Councilmember Burns noted his Committee had developed a compromise before the Council this evening. Councilmember Burns explained the Auburn North Business Area Plan was important to create a pedestrian-oriented business community that coexisted with the downtown area. He noted that drive-in facilities effectively divides and discourages pedestrian uses, and Councilmember Burns encouraged those interested persons to view neighborhoods that have drive-in facilities in order to better understand the whole concept of the Auburn North Business Area Plan. Councilmember Burns further noted if the Fred Meyer Store would be destroyed, then conformance would be required. Motion by Councilmember Burns, second by Councilmember Barber, to amend the Comprehensive Plan text and map, the Zoning Map and text for the purpose of adopting and implementing the Auburn North Business Area Plan with heavy commercial zone C-3 for the Fred Meyer Store site. MOTION CARRIED 4-3. Councilmembers Whitta]], Wagner and Kurle voting no. B. Aoolication No. VACOOOI-91 03.9 Application No. V ACOOO 1-91 A petition has been filed for the vacation of a street right-of -way known as 8th St SE between D Street SE and Auburn Way South, within the City of Auburn. Councilmember Whitta]] noted this item was referred to the Public Works Committee at the 2/ I 8/92 Council meeting, and that concerns had been resolved, and Councilmember Whittall was recommending the Council approve the vacation. Noting that a legal instrument was not part of this evening's agenda, City Attorney Shelton advised the Council could approve the vacation and the Legal Department would prepare an ordinance and assign it as Ordinance No. 4550. Motion by Councilmember Whitta]], second by Council member Wagner to introduce and adopt Ordinance No. 4550. MOTION CARRIED UNANIMOUSLY. 7-0. VI. NEW BUSINESS PAGE 8 CITY OF AUBURN COUNCIL MEETING March 2, 1992 A. Aoolication No. ANXOOO 1-92 03.1 Application No. ANXOOOI-92 Council consideration for authorization for the Planning Department to proceed in the preparation of the annexation petition on the request to annex a 5.2 acre parcel of property located on the east City limits of Auburn. Motion by Council member Burns, second by Councilmember Barber, to authorize the preparation and circulation of a petition for annexation. MOTION CARRIED UNANIMOUSLY. 7-0. B. Aoolication No. CUP0006-91 03.1 0.1 CUP0006-91 Council consideration of the request of Stobie & Associates for a Conditional Use Permit to allow construction of 4-duplexes and 2-triplexes on property zoned R-3 (Duplex) and located on the south side of 18th Street N.E. in the 1100 block. Motion by Councilmember Burns, second by Councilmember Borden to approve the Conditional Use Permit based upon the Hearing Examiner's Findings of Fact, Conclusions and Conditions and to instruct the City Attorney to prepare the necessary ordinance. Councilmembers discussed fencing, landscape, and health concerns with regard to CUP0006-92. Due to concerns expressed, Council member Burns withdrew his motion. Motion by Councilmember Burns, second by Councilmember Barber, to ca]] for a public hearing on Application No. CUP0006-92 at the next Council meeting. MOTION CARRIED UNANIMOUSLY. 7-0. C. Aoolication No. CUP0008-91 03.10.1 CUP0008-91 Council consideration on the request of the Church of Jesus Christ of Latter-Day Saints - NW Area for approval of a Conditional Use Permit to a]]ow construction of a building that will be used as a seminary that will operate as a 30-36 desk religious educational classroom for high school students to be located at 331 4th Street N.E. Planning Director Steve Lancaster noted there was a typographical error on page 3, Item 4 of Conclusions of Law, of the Hearing Examiner's Findings and Recommendations. Item 4 reads "The proposal will adversely affect the public infrastructure." Item 4 should read "The proposal will not adversely affect the public infrastructure." Motion by Councilmember Burns, second by Councilmember Borden, to approve the conditional Use Permit based upon the Hearing Examiner's PAGE 9 CITY OF AUBURN COUNCIL MEETING March 2, 1992 Findings of Fact, amended Conclusions and Conditions, and to instruct the City Attorney to prepare the necessary ordinance. Aoolication No. CUP0009-9l 03.10.1 CUP0009-9l Council to consider the request of Cindy Huang for a Conditional Use Permit to a]]ow construction of two 4-plexes on property zoned R-3 (Duplex) and located at 2025 M Street NE. Motion by Councilmember Burns, second by Councilmember Barber, to approve the Conditional Use Permit based upon the Hearing Examiner's Findings of Fact, Conclusions and Conditions and to instruct the City Attorney to prepare the necessary ordinance. MOTION CARRIED UNANIMOUSLY. 7-0. VII. ORDINANCES AND RESOLUTIONS A. Ordinances City Attorney Stephen R. Shelton read the titles to each ordinance which were not approved out of order. I. Ordinance No. 4544 03.7, 03.4.3 COM0004-91 An Ordinance of the City Council of the City of Auburn, Washington, amending Section 16.06.030, which is contained in Chapter 16.06 of the Auburn City Code entitled "Environmental Review Procedures" and adding a new Section 16.06.065 to Chapter 16.06 to meet the requirements of the Growth Management Act (36.70A RCW). Ordinance No. 4544 was approved under Item II.A.2. of these minutes. 2. Ordinance No. 4546 03.8 REZ0003-91 CP An Ordinance of the City of Auburn, Washington, providing for the rezoning of property located on the west side of Dogwood Street S.E. in the 1300-1400 blocks, within the City of Auburn, Washington, changing the zoning classification thereof from R-I (Single Family) to P-I (Public Use District) and Comprehensive Plan Map Amendment from Single Family to Public and Quasi Public. Motion by Councilmember Burns, second by Councilmember Borden, to introduce and adopt Ordinance No. 4546. MOTION CARRIED UNANIMOUSLY. 7-0. 3. Ordinance No. 4547 03.4.4, 03.4.5, 03.4.2.1.2 PAGE 10 CITY OF AUBURN COUNCIL MEETING March 2, 1992 An Ordinance of the City of Auburn, Washington, amending the official Zoning Map and Zoning Ordinance for the City of Auburn, Washington, pursuant to the provisions of R.C.W. Chapter 35A.63 of the laws of the State of Washington and directing that this ordinance be filed with the Auburn City Clerk and be available for public inspection. Councilmember Burns, second by Councilmember Barber, to introduce and adopt Ordinance No. 4547. MOTION CARRIED UNANIMOUSLY. 7-0. 4. Ordinance No. 4548 F2.4.9 LID 344, 04.9.1 St Imp 292 An Ordinance of the City of Auburn, Washington, approving and confirming the assessments and assessment ro]] of Local Improvement District No. 344 for the construction and improvement (Street Improvement No. 292) of East Main Street from Auburn Avenue to Auburn Way North, within the County of King, State of Washington, as provided by Ordinance No. 4499, and levying and assessing the cost and expense thereof against the several lots, tracts, parcels of land and other property as shown on the assessment roll. Ordinance No. 4548 was approved under Item II.A.I. of these minutes. 5. Ordinance No. 4549 04.9.1. Street Improvement No. 287 An Ordinance of the City of Auburn, Washington, authorizing the acquisition of certain property and property rights by eminent domain providing for the payment thereof; authorizing the City Attorney to prepare a petition for condemnation in the Superior Court in and for the County of King and for the prosecution thereof for the acquisition of such property and property rights for roadway purposes (right-of- way on Auburn Way South near Academy Drive S.E. Street Improvement No. 287). Motion by Councilmember Whitta]], second by Councilmember Wagner, to introduce and adopt Ordinance No. 4549. MOTION CARRIED UNANIMOUSLY. 7-0. 6. Ordinance No. 4550 Ordinance No. 4550 was approved under Item V.B of these minutes. B. Resolutions City Attorney Stephen R. Shelton read the titles to each resolution which were not approved out of order. 1. Resolution No. 2281 03.4.3 COM0004-91, 03.7 A Resolution of the City Council of the City of Auburn, Washington, amending the Comprehensive Plan policies of the City of Auburn, PAGE II CITY OF AUBURN COUNCIL MEETING March 2, 1992 Washington to add definitions and policies relating to resource lands and critical areas, and to designate said amendments as guidelines for exercising the City's authority under (SEP A) and directing that this resolution as adopted and approved be filed with the Auburn City Clerk and be available for public inspection. Resolution No. 2281 was approved under Item II.A.2 of these minutes. 2. Resolution No. 2283 03.4.4, 03.4.5, 03.4.2.1.2, 03.4.3 COM0003-91 A Resolution of the City Council of the City of Auburn, Washington, adopting and approving the Auburn North Business Area Plan as an element of the Comprehensive Plan for the City of Auburn, Washington, pursuant to the provisions of RCW Chapter 35A.63 of the laws of the State of Washington, and designating this element as guidelines for exercising the City's authority under SEPA, and directing that this resolution and the element of the Comprehensive Plan it adopts and approves be filed with the Auburn City Clerk and be available for public inspection.
