Agenda Modifications Mayor Roegner noted agenda modifications this evening are Item VII.B.13 which adds Resolution No. 2301 regarding the Regional Justice Center to the Council agenda. II. CITIZEN INPUT. PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearings 1. 1992-93 Communitv Develooment Block Grant 03.11 1992-93 Block Grant, F5.4.3 7 The City of Auburn expects to receive $278,000 in Community Development Block Grant Funds for the 1992-1993 program year. The Auburn City Council requests a public hearing be held in order to receive citizen input prior to a determination of the use of these funds. Mayor Roegner opened the public hearing. Dick Brugger - 11234 S.E. 332nd Street, Auburn, WA Dick Brugger is the Director of Auburn Youth Resources. Mr. Brugger commented favorably on the Council's recommendation for funding to Auburn Youth Resources. He said additional funding would assist in their expansion of the administrative offices, increase shelter care, and services for transitional youth. Mr. Brugger thanked the Council for their continued support of this program. Linda Snow - 1822 22nd Way N.E., Auburn, WA Linda Snow thanked the Council on behalf of the YWCA of South King County for the continued support of their program. Ms. Snow cited statistics from last year, and again thanked the council for their support of the homeless. Lawrence Wvdro 1102 J Street S.E., Auburn, W A Lawrence Wydro is the Executive Director of ACAP Daycare. ACAP Daycare provides low income families with daycare services in Auburn. Mr. Wydro commented favorably on the 1992-93 recommendation for funding, and thanked the Council for continued support of this program. Motion by Councilmember Burns, second by Councilmember Barber, to close the public hearing. MOTION CARRIED UNANIMOUSLY. 7-0. Motion by Councilmember Burns, second by Councilmember Barber, to approve recommendations of the Human Resources Committee for the use of $278,000 in 1992-1993 City of Auburn Community Development Block Grant Funds. Aoolication No. CUP0006-9l 03.10.1 Application No. CUP0006-9l The request of the Stobie & Associates for a Conditional Use Permit to allow construction of 4-duplexes and 2-triplexes on property zoned R- 3 (Duplex) and located on the south side of 18th Street N.E. in the 1100 block. Mayor Roegner opened the public hearing. No one spoke for or against Application No. CUP0006-91. Motion by Councilmember Burns, second by Councilmember Barber, to close the public hearing. MOTION CARRIED UNANIMOUSLY. 7-0. Motion by Councilmember Burns, second by Councilmember Barber, to amend the Hearing Examiner's decision and adopt Ordinance No. 4553 as prepared by the City Attorney. Under discussion, Councilmember Brothers requested clarification of the requirement of a fence. Planning Director Steve Lancaster responded that the Hearing Examiner's decision has been amended to include the requirement of the fence. MOTION CARRIED UNANIMOUSLY. 7-0. B. Audience Particioation Mayor Roegner encouraged citizens of the community to make comments at this time with regard what is occurring within the community or something that appears later in tonight's agenda. Mayor Roegner announced Resolution No. 2301 is before the Council this evening. Even though this is not a scheduled public hearing, Mayor Roegner encouraged citizens to briefly comment upon the Regional Justice Center during this portion of tonight's agenda. Mike Morrisette - 228 1st Street N.E., Auburn, W A Mike Morrisette represents the Auburn Area Chamber of Commerce. Mr. Morrisette called attention to the notice received with regard to the Regional Justice Center. Mr. Morrisette referred to the Chamber of Commerce response to the draft Environmental Impact Statement. He said the Chamber's position on the Regional Justice Center is that they feel the preferred site for the Regional Justice Center is located north of 15th Street N.E. due to the availability of land, accessibility for other King County residents, and more importantly, the positive economic impact it would have on Auburn. Mr. Morrisette finalized his comments by stating the business community welcomes the Regional Justice Center in Auburn. PAGE 3 CITY OF AUBURN COUNCIL MEETING March 16, 1992 Don Lisko - 25 16th Street N.E., Auburn, WA Don Lisko introduced himself as Chairman of the Chamber Committee working on a response to the Regional Justice Center draft Environmental Impact Statement. Mr. Lisko discussed the approach and impression so far received from King County with regard to locating this facility in Auburn, and he urged the Council to express their support to the County in the sense that it is the most economical site for the County. He said Auburn needs to consider how we can attract corporations to locate their headquarters in Auburn. Mr. Lisko considered the administration's handling of other proposed development in Auburn in comparison with the Regional Justice Center which would have more of an economic benefit to Auburn due to off shoot industries and commercial development around the center. Mr. Lisko finalized his comments by submitting Certificates of Support signed by individual citizens from King County, mostly from Auburn, and business owners in support of the Regional Justice Center being located in Auburn, and urged the Council to consider the wide base support that this project has. Wavne Heisserman - 20 B Street N.E., Auburn, WA Mr. Heisserman is president of the Auburn Chamber of Commerce and a resident of the city of Auburn. Mr. Heisserman strongly encouraged support of Resolution No. 2301. The Chamber of Commerce has taken a strong and active position in researching the opportunity to have a regional justice center located in Auburn to better serve the people who have a need for the facility. Ed Howard - 1706 33rd Street S.E., Auburn, W A Ed Howard is a resident of the city of Auburn. Mr. Howard expressed concern of locating the Regional Justice Center in Auburn due to the criminal element of people that would be required to visit and patronize Auburn. He said the Regional Justice Center is a good name for courts and jails. Mr. Howard felt locating the Regional Justice Center in Kent would better serve the people of South King County. Cyril Van Selus - 20 Riverview Drive S.E., Auburn, WA Mr. Van Selus stated he was born and raised in Wenatchee where a Regional Justice Center has been in operation for many years. Mr. Van Selus does not recall any incident or problems created by the regional justice center. He also referred to his business location in Bellingham where a Regional Justice Center exists without problems. He said both cities have enjoyed economic benefits from the Regional Justice Center, and it has also provided good service to the citizens of the community. Mike Weekly - 809 11 th Street N.E., Auburn, W A Mr. Weekly opposes locating the Regional Justice Center in Auburn. He questioned the economic benefits the new development would have. Mr. Weekly cited from the draft Environmental Impact Statement that locating the Regional Justice Center in Auburn would have moderate potential for leading new development. Therefore, there is no major impact predicted by the County. Mr. Weekly expressed concern of a tax exempt County facility locating in Auburn where accessibility, health costs, employment, and PAGE 4 CITY OF AUBURN COUNCIL MEETING March 16, 1992 housing will become a concern of the city as well as the quality of life. He said any economic gain would be offset by traffic, taxes, and the degradation of our city. Tim Edwards - Tim Edwards favors locating the Regional Justice Center in South King County. He stated regardless of the fears, the Regional Justice Center is a function of government that South King County residents have been disinfranchised with. He said he is talking about of the civil aspects of law that this community needs. Currently one-half million resident live in the South King County area, and only one Superior Court judge lives in this area. He contradicted concerns raised with regard to health care and police protection in and around the Center. Health care would be handled internally, and police security would be enhanced due to officers serving the courts. Mr. Edwards said what we see near the Courthouse in Seattle is a result of a courthouse being located in a metropolitian area. Mr. Edwards finalized his comments by encouraging the Council to support locating the Regional Justice Center in Auburn. Henry Higley - 812 12th Street N.E., Auburn, WA Mr. Higley stated he does not feel Auburn wants the Regional Justice Center because he does not want the criminal element here. Pam Maury-Weekly Ms. Weekly stated she does not want the Regional Justice Center located in Auburn. She felt if it was a rehabilitation center she might feel differently. Ms. Weekly expressed concern of the location of the schools and the interaction the children of the community would have with the criminal element that the Regional Justice Center would attract. She finalized her comments by stating the Regional Justice Center would be located on a wetland. Arlis Holman - 11603 S.E. 322nd Street, Auburn, W A Ms. Holman is excited about the prospect of the Center being located in Auburn. She felt there would be good economic benefits, and educationally would benefit the kids and the people of Auburn. Mayor Roegner requested Council consideration of Resolution No. 2301 which endorses the siting of the King County Regional Justice Center within the City of Auburn. Under discussion, some of the Councilmembers were reluctant to endorse the Regional Justice Center in Auburn because they felt they had not received enough information with regard to the County's position based on the information provided so far. Concerns centered around policy issues with regard to negotiations with King County, the City's response to the draft Environmental Impact Statement, and the perception Auburn is giving to King County in whether or not Auburn wants the Regional Justice Center located in Auburn. Lobbying efforts made by staff members from the Cities of Kent and SeaTac raised concerns among some of the Councilmembers. PAGE 5 CITY OF AUBURN COUNCIL MEETING March 16, 1992 Steve Lancaster responded to the concerns raised by the Council. He said the draft Environmental Impact Statement (EIS) was issued and staff responded appropriately. When staff discussions with the County are complete, the information will be presented to all elected officials when available. At that time staff would review the EIS, and if Auburn is the selected site, a public hearing would be scheduled. Mr. Lancaster also pointed out when the site is selected, the Council would have an opportunity to discuss this proposal under a Conditional Use Permit process. Councilmembers Whittall and Kurle asserted a desire to conduct a public hearing with regard to the Regional Justice Center in order to obtain further information from staff. They argued that if Auburn does not express a desire now to locate the Regional Justice Center in Auburn, that we may never have an opportunity to express our comments under a Conditional Use Permit because the County will have chosen a location other than Auburn. Councilmember Burns felt it was not appropriate to hold public hearing at this time, and summarized the main issues of the staff's response to the EIS. He mentioned that the draft EIS indicates there are significant traffic issues on 15th Street N.W., Auburn Way North, and Highway 167, an issue concerning what the economic benefit is to the Auburn community, and what the effect the Regional Justice Center is going to have on public safety. Councilmember Burns urged the Council to proceed with the process and hearing. Motion by Councilmember Whittall, second by Councilmember Kurle to continue tonight's meeting to tomorrrow night at 5:30 p.m. in order to receive further information with regard to the Regional Justice Center. MOTION CARRIED. 4-3 with Councilmembers Burns, Barber, and Brothers voting no. Mayor Roegner clarified continuing the meeting to tomorrrow night at 5:30 p.m. is for the purpose of reviewing Resolution No. 2301 only. C. Corresoondence - None. III. COUNCIL COMMITTEE REPORTS A3.6.4.4 A. Municioal Services Chairman Brothers reported that the Municipal Services Committee met prior to the Council meeting this evening to review Ordinance No. 4545 with regard to the hazardous waste program and current procedures for firefighter training. The next Municipal Services meeting is Monday, April 6, 1992 at 4:30 p.m. B. Planning & Communitv Develooment Chairman Burns reported that the Planning & Community Development Committee met on March 10, 1992 and the minutes are of public record. Chairman Burns requested Council support of those items appearing on PAGE 6 CITY OF AUBURN COUNCIL MEETING March 16, 1992 tonight's agenda. The next meeting of the Planning & Community Development will be Tuesday, March 24, 1992 at 7:30 p.m. C. Public Works Chairman Whittall reported that the Public Works Committee met prior to the Council meeting at 5:30 p.m. Chairman Whittall noted Resolutions 2296 and 2298 are being held in committee. The next meeting of the Public Works Committee is scheduled for Monday, April 6, 1992 at 5:30 p.m. D. Finance Chairman Barber reported that the Finance Committee met prior to the Council meeting this evening at 7:00 p.m. to review payroll and claims. The next meeting of the Finance Committee is scheduled for Monday, April 6, 1992 at 7:00 p.m. IV. CONSENT AGENDA A. Minutes A3.6.2 1. Minutes of the March 2, 1992 regular Council meeting. B. Auburn Municioal Airoort 04.4.9.1.2, F5.4.2 Recommend City Council authorize Auburn Municipal Airport to advertise for bids for items under the 1992 Federal Aviation Administration Grant Project #3-53-0003-6. Councilmember Kurle withdrew Item IV.C.l from the Consent Agenda for discussion. MOTION CARRIED UNANIMOUSLY. 7-0. Due to Councilmember Kurle's planned absence during the April 6th meeting, he asked if Consent Agenda Item IV.C.l could be scheduled at a later date. Steve Lancaster responded that the ordinance indicates a hearing must be scheduled at the next available Council meeting. Motion by Councilmember Kurle, second by Councilmember Burns, to approve Consent Agenda Item IV.C.l calling for a public hearing on Application No. CAPOOOl-92 and Application No. CAP0002-92 to be held on April 6, 1992. Ordinance No. 4545 F5.2.7,03.4.1.2l An Ordinance of the City Council of the City of Auburn, Washington, approving an appropriation of funds to provide matching of State of Washington Department of Ecology funds for implementing specified hazardous waste programs and authorizing the Mayor and City Clerk to execute a coordinated prevention grant agreement between the City and the State of Washington Department of Ecology. Motion by Councilmember Brothers, second by Councilmember Borden, to introduce and adopt Ordinance No. 4545. MOTION CARRIED UNANIMOUSLY. 7-0. 2. Ordinance No. 4553 03.10.1 Application No. CUP0006-9l An Ordinance of the City of Auburn, Washington, providing for a Conditional Use Permit to allow the construction of 4 duplexes and 2 triplexes in an R-3 (Two-Family Duplex Residential) zone, located on the South side of 18th Street N.E. in the 1100 block, within the City of Auburn, Washington. This item was approved under II.A.2 of these minutes. 5. Motion by Councilmember Burns, second by Councilmember Barber to adopt Resolution No. 2290. MOTION CARRIED UNANIMOUSLY. 7-0. 5. Resolution No. 2291 04.4.2 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute an agreement between the City and Kent Travel to serve as travel agent for a National Parks Tour package for the City's Senior Center Program. Motion by Councilmember Burns, second by Councilmember Barber, to adopt Resolution No. 2293. MOTION CARRIED UNANIMOUSLY. 7 -0. 7. Resolution No. 2295 04 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute an Agreement for Professional Services for Contour Mapping Program between the City of Auburn and David C. Smith & Associates, Inc. Motion by Council member Whittall, second by Councilmember Wagner, to adopt Resolution No. 2295. MOTION CARRIED UNANIMOUSLY. 7-0. 8. Resolution No. 2296 04.9.1 Street Improvement No. 299 A Resolution of the City Council of the City of Auburn, Washington authorizing the Mayor and City Clerk to execute an Agreement for Professional Services between the City of Auburn and Sverdrup Corporation for preliminary engineering for the Auburn Way South from 4th Street S.E. to SR 18 project for Street Improvement and Railroad Bridge Replacement for Street Improvement No. 299. This Resolution is being held in the Public Works Committee. 9. Resolution No. 2297 04.9.1 Street Improvement No. 288 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk of the City of Auburn to execute Amendment No.1 to Agreement for Professional Services between the City and W & H Pacific, Inc. relating to Auburn Way North, 4th Street N.E. to 15th Street N.E. roadway improvements. Motion by Council member Whittall, second by Councilmember Wagner, to adopt Resolution No. 2297. MOTION CARRIED UNANIMOUSLY. 7-0. PAGE 11 CITY OF AUBURN COUNCIL MEETING March 16, 1992 10. Resolution No. 2298 A3.l7,04.4.9.1.3 A Resolution of the City Council of the City of Auburn, Washington, amending that certain fixed-based lease at Auburn Municipal Airport for Auburn Flight Service, Inc. to extend such lease for twenty years. This resolution is being retained in the Public Works Committee. 11. Resolution No. 2299 01.3 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute an interlocal agreement between King County, the City of Auburn and the City of Kent relating to the Mill Creek Basin Program. Motion by Councilmember Whittall, second by Councilmember Wagner, to adopt Resolution No. 2299. MOTION CARRIED UNANIMOUSLY. 7-0. 12. Resolution No. 2300 01.3 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute an Interlocal Agreement between King County, the Cities of Auburn, Kent, Renton, and Tukwila relating to the Green River Basin Program to update the Green River Management Agreement. Motion by Councilmember Whittall, second by Councilmember Burns, to introduce and adopt Resolution No. 2300. MOTION CARRIED UNANIMOUSLY. 7-0. 13. Resolution No. 2301 A1.3.5 A Resolution of the City Council of the City of Auburn, Washington, endorsing the siting of the King County Regional Justice Center within the City of Auburn, Washington. This Resolution will be considered at the continued meeting to be held on Tuesday, March 17, 1992 at 5:30 p.m. VIII. MA YOR'S REPORT - None. Executive Session - None IX.
