HomeMy WebLinkAbout04-06-1992 CITY OF AUBURN COUNCIL MEETING April 6, 1992 Mayor Roegner announced the appeal hearings scheduled for tonight's meeting regarding Miles Sand and Gravel have been postponed indefinitely pursuant to an ex parte Temporary Restraining Order issued Friday, April 3, 1992 at 4:50 p.m. by a King County Superior Court Commissioner upon the request of Mr. Frank Miles and Miles Sand & Gravel. The Summons, Complaint, Motion, and Temporary Restraining Order are included in the Agenda Modifications under Correspondence (II.C.3). The Temporary Restraining Order states in part as follows: ...City of Auburn is restrained from supplying city counsel (sic) members with any written documents that were not before the hearing examiner on the appeal of the Miles Sand and Gravel determination of significance and cease and desist order, including but not limited to an engineer's study by Hart Krauser, and restraining the city counsel (sic) from conducting a public hearing in which further evidence is submitted...! Mayor Roegner further noted the Miles Sand & Gravel appeals of the hearing examiner's decisions cannot be rescheduled until such time as a Court conducts a hearing and determines the scope of the City Council's review in hearing the appeals. Upon such determination, the appeal hearings will be rescheduled in compliance with the appropriate legal notice provisions. 2. ADDointments a. Auburn Arts Commission A3.8.2 City Council to confirm the recommendation of Mayor Roegner to appoint Lynn Norman to the Auburn Arts Commission for a term to expire December 31, 1994. Motion by Councilmember Burns, second by Councilmember Whittall, to confirm the appointment of Lynn Norman to the Auburn Arts Commission for a term to expire December 31, 1994. MOTION CARRIED UNANIMOUSLY. 6-0. D. Agenda Modifications Mayor Roegner noted agenda modifications this evening are: Item II.A.l. withdrawing a Public Hearing with regard to Application No. CAPOOO 1-92; Item II.A.2. withdrawing a Public Hearing with regard to Application No. CAP0002-92; 1. Municioal Services A3.6.4.4 Chairman Brothers reported that the Municipal Services Committee met prior to the Council meeting at 4:30 p.m. and discussed a proposed King County Recycling Ordinance, the Spring Clean-up Program, surplus property, saw a police demonstration of night sights, and toured the proposed Municipal Court building. The next Municipal Services meeting is Monday, April 20, 1992 at 4:30 p.m. in Conference Room #2. B. Planning & Communitv Develooment A3.6.4.4 Chairman Burns reported that the Planning & Community Development Committee met on March 24, 1992 and the minutes are of public record. The next meeting of the Planning & Community Development is scheduled to meet April 13, 1992. C. Public Works A3.6.4.4 Chairman Whittall reported that the Public Works Committee met prior to the Council meeting at 5:30 p.m. Items discussed were Resolution No. 2296 and Resolution 2298 as well as some consent agenda items. The next meeting of the Public Works Committee is scheduled for Monday, April 20, 1992 at 5:30 p.m. D. Finance A3.6.4.4 Chairman Barber reported that the Finance Committee met prior to the Council meeting this evening at 7:00 p.m. and discussed Consent Agenda Items. OLD BUSINESS A. 1992-1996 Comorehensive Housing Affordabilitv Strategv (CHAS) Council to consider the Final Draft of the 1992-1996 Comprehensive Housing Affordability Strategy (CHAS). Motion by Councilmember Burns, second by Councilmember Barber, to introduce and adopt Resolution No. 2304 as corrected. MOTION CARRIED UNANIMOUSLY. 6-0 VI. NEW BUSINESS A. Aoolication No. PL T0009-86 03.5 PL T0009-86 Council to consider the extension of the preliminary plat of "West Beverly Hills" for another additional year. Motion by Councilmember Burns, second by Councilmember Barber, to approve the extension of the preliminary plat of "West Beverly Hill" for another additional year and have the City Attorney prepare the necessary resolution. Councilmember Brothers requested a clarification with regard to finalizing the preliminary plat. Planning Director Lancaster noted prior to finalizing the plat, the road condition needs to be met, and he explained the grading progress. Council member Whittall requested Planning Director Lancaster send him information with regard to the plat's drainage plan. MOTION CARRIED UNANIMOUSLY. 6-0. B. Aoolication No. CUPOOI0-91 03.10.1 CUPOOI0-91 The request of Neighborhood Chapel Church of God for a Conditional Use Permit to permit a 20 car parking lot to be located within an R-2 (Single Family) zone at 201 M Street N.E. Motion by Councilmember Burns, second by Councilmember Barber, to approve the Conditional Use Permit to permit a 20-car parking lot to be constructed based upon the Hearing Examiner's Findings of Fact, Conclusions and Conditions and to instruct the City Attorney to prepare the necessary ordinance. MOTION CARRIED UNANIMOUSLY. 6-0. VII. ORDINANCES AND RESOLUTIONS A. Ordinances City Attorney Stephen R. Shelton read the titles to each ordinance. Resolution No. 2294 A5.3.31 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute the 1992 Service Agreement between the City of Auburn and the Seattle/King County Economic Development Council. Motion by Councilmember Burns, second by Councilmember Borden, to introduce and adopt Resolution 2294. MOTION CARRIED UNANIMOUSLY. 6-0. 3. Resolution No. 2296 04.9.1 Street Improvement No. 299 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk of the City of Auburn to execute an Agreement for Professional Engineering Services between the City and Sverdrup Corporation for preliminary engineering for the Auburn Way South from 4th Street S.E. to SR 18 project for street improvement and railroad bridge replacement for Street Improvement No. 299. Motion by Council member Whittall, second by Councilmember Wagner, to adopt Resolution No. 2296. MOTION CARRIED UNANIMOUSLY. 6-0. 4. Resolution No. 2298 04.4.9.1.3 A Resolution of the City Council of the City of Auburn, Washington, amending that certain fixed-based lease at Auburn Municipal Airport for Auburn Flight Service, Inc. to extend such lease for twenty years. Motion by Councilmember Whittall, second by Councilmember Wagner, to introduce and adopt Resolution No. 2298. MOTION CARRIED UNANIMOUSLY. 6-0. 5. Resolution No. 2302 05.1 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk of the City of Auburn, to execute a Concessionaire Agreement between the City and Auburn Optimist Club for the concession operation at the Game Farm Park Ballfields. Motion by Councilmember Burns, second by Councilmember Barber, to introduce and adopt Resolution No. 2302. MOTION CARRIED UNANIMOUSLY. 6-0. PAGE 9 CITY OF AUBURN COUNCIL MEETING April 6, 1992 6. Resolution No. 2303 05.1 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk of the City of Auburn, to execute a Concessionaire Agreement between the City and The Kiwanis of Auburn for the concession operation at the Brannan Park Ballfields. Motion by Councilmember Burns, second by Councilmember Borden, to introduce and adopt Resolution No. 2303. MOTION CARRIED UNANIMOUSLY. 6-0. 7. Resolution No. 2304 03.11.3 A Resolution of the City Council of the City of Auburn, Washington, adopting the 1992-1996 Comprehensive Housing Affordability Strategy Program (CHAS). Resolution No. 2304 was approved under Agenda Item V.A of these minutes. VIII. MA YOR'S REPORT Mavor's Reoort The Mayor's report is Agenda Item LC.1.b of these minutes. Executive Session Mayor Roegner announced there would not be an Executive Session. IX.
