CALL TO ORDER The regular meeting of the City of Auburn Council was called to order by Mayor Bob Roegner at 7:30 p.m. in the City of Auburn Council Chambers. A. Flag Salute Mayor Roegner led those in attendance in the pledge of allegiance. B. Roll Call Those in attendance included Mayor Bob Roegner and Councilmembers Weekley, Borden, Barber, Brothers, and Kurle. Council member Burns and Wagner were excused. Staff members in attendance included Police Chief Jake Evans, Fire Chief Bob Johnson, Personnel Director Pam Sime, Parks & Recreation Director Len Chapman, Finance Director Pat Dugan, Assistant Public Works Director Alice Conrad, Planning Director Steve Lancaster, City Attorney Stephen Shelton, and City Clerk Robin Wohlhueter. Other staff in attendance included Police Captain Ray Sherman, and Intergovernmental Affairs Manager Lisa Clausen. ~ C. Announcements and Aooointments 1. Announcements - None. 2. Aooointments - None. D. Agenda Modifications - None. II. CITIZEN INPUT. PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearings 1. County Wide Planning Policies for King County A3.4.1 As part of the 1991 amendments to the State Growth Management Act, the Mayor and City Council request public comments prior to a decision to ratify County Wide Planning Policies for King County as recommended to the King County Council on June 3, 1992. Mayor Roegner opened the public hearing. Mike Bocatch - III H St. SE, Auburn, W A Mr. Bocatch, Auburn resident, expressed a desire to speak at the public hearing with regard to the County Wide Planning Policies for King County, however, he did not feel well enough informed on the issue. He also questioned the administrative recommendation of approval of the policies as it fits into the process. CITY OF AUBURN COUNCIL MEETING October 19, 1992 Motion by Councilmember Barber to close the public hearing. Councilmember Borden seconds the motion. MOTION CARRIED UNANIMOUSLY. 5-0 Mayor Roegner responded to Mr. Bocatch's questions with regard to the administrative recommendation on the County Wide Planning Policies for King County. He said the steps taken are to first receive any public comment on the substance contained in the policies for the City Council. The administrative recommendation is a staff recommendation to the City Council to conduct a public hearing, and if they do not hear anything that they want to add or subtract from the policies themselves, they close the public hearing and move forward in the process. Mayor Roegner recommended Mr. Bocatch contact the Planning staff if he would like to learn more about the process and the issue. Motion by Councilmember Barber, second by Councilmember Borden to approve the County Wide Planning Policies for King County as recommended and to instruct the City Attorney to prepare the necessary resolution. Councilmember Kurle asked if the policies have already been ratified by the required number of cities, and if the issue before the Council tonight is simply saying we agree too? Mayor Roegner answered Councilmember Kurle's question by stating that we agree with the majority of the policies which includes local language added by Auburn. In the event the Council chose not to ratify these policies, Councilmember Brothers wondered if there would be an adverse effect on the proposal as it has been ratified. Mayor Roegner clarified the position Auburn would be in if Auburn chose not to ratify the County Wide Planning Policies for King County especially in addressing future regional issues. He said the adjustments Auburn made to the policies were appropriately referred to the City Council. Mayor Roegner said the remainder of the policy material is appropriate participation by the Auburn City Council in regional policy planning. Mayor Roegner called for a vote. MOTION CARRIED UNANIMOUSLY. 5-0. B. Audience Particioation Mayor Roegner invited citizens in the audience this evening who may want to bring to attention of the City Council something occurring in the community or later in tonight's agenda. There were no requests for recognition. C. Corresoondence 03.3.1 1. Letter to Steve Lancaster, Director of the Planning & Community Development Department for the City of Auburn, from Shelley M. Pankiewicz with regard to traffic analysis for proposed Supermall of the Great Northwest and the Racetrack. PAGE 2 CITY OF AUBURN COUNCIL MEETING October 19, 1992 2. Letter to Ron Anderson, Department of Transportation, from Shelley Pankiewiz expressing concern of traffic impacts with regard to Supermall of the Great Northwest and the Racetrack. 3. Letter to Michael Weekley from Shelley Pankiewicz for consideration of combined impacts to traffic on both proposals of the Supermall of the Great Northwest and the Racetrack. III. COUNCIL COMMITTEE REPORTS A. Municioal Services A3.6.4.4 Chairman Brothers announced that the Municipal Services Committee met at 4:30 p.m. earlier this evening. Items of discussion included Ordinance No. 4588, New Solid Waste Rate Structure, Surplus Bicycles, and a tour of RST Recycling Center. The next meeting of the Municipal Services Committee will be November 2, 1992, at 4:30 p.m. B. Planning & Community Develooment A3.6.4.4 Vice-Chairman Barber reported that the Planning & Community Development Committee met on October 12, 1992 and the minutes are of public record. The next regularly scheduled meeting of the Planning & Community Development Committee is scheduled for Monday, October 26, 1992 at its regular time. As Chairman of the Finance Committee, Councilmember Barber continued her report on the meeting held prior to the Council meeting. It is reported under III.D of these minutes. C. Public Works A3.6.4.4 Mayor Roegner announced the Public Works Committee meeting scheduled to meet prior to the Council meeting this evening was cancelled. Council Committee Member Weekley stated the next meeting of the Public Works Committee is scheduled for November 2, 1992 at 5:30 p.m. D. Finance A3.6.4.4 Chairman Barber reported that the Finance Committee met prior to the Council meeting at 7:00 p.m. Items discussed included claims and payroll on this evening's agenda. The next meeting of the Finance Committee is scheduled for November 2, 1992 at 7:00 p.m. IV. CONSENT AGENDA A. Minutes 1. Minutes of the October 5, 1992 regular Council meeting. B. Motion by Councilmember Kurle, second by Council member Brothers to approve Consent Agenda Items IV.A. through IV.E. 1. MOTION CARRIED UNANIMOUSLY. 5-0. V. OLD BUSINESS - None. VI. NEW BUSINESS A. Aoolication No. MIS0009-92ZC 03.4.2.1.2 Council consideration on certain amendments to the Zoning Ordinance to revise the definition of "group residence facility", Section 18.04.440 Auburn City Code, and to establish related siting criteria. Mayor Roegner noted the appropriate elements of the above referenced application are embodied in Ordinance No. 4590 that are contained in this application. Consideration by the Council is noted under Agenda Item VII.A.2. B. Aoolication No. PL TOOO 1-91 03.5, PLTOOOI-91 The request for Final Plat approval of the "James" subdivision (previously known as J. Rich) which is a 7 -lot single-family subdivision located east of "M" Street S.E. at 33rd Street S.E. Motion by Councilmember Barber, second by Councilmember Borden to approve the Final Plat of the "James" subdivision and to instruct the City Attorney to prepare the necessary Ordinance. MOTION CARRIED UNANIMOUSLY. 5-0. VII. ORDINANCES AND RESOLUTIONS A. Ordinances F4.3, 04.7.2 City Attorney Stephen Shelton read each title to the ordinances out loud. 1. Ordinance No. 4588 An Ordinance of the City Council of the City of Auburn, Washington, amending Section 8.08.230, specifically Section 8.08.230(H), of the Auburn City Code to complete the new Solid Waste Rate Structure approved in December, 1991 which incorporated the January 1, 1992 King County tipping fee increase. Motion by Councilmember Brothers, second by Councilmember Borden to introduce and adopt Ordinance No. 4588. PAGE 5 CITY OF AUBURN COUNCIL MEETING October 19, 1992 MOTION CARRIED UNANIMOUSLY. 5-0. 2. Ordinance No. 4590 03.4.2.1.2 An Ordinance of the City Council of the City of Auburn, Washington, amending City of Auburn Zoning Code Title 18 relating to Work Release and Pre- Release Residential Facilities and other similar facilities which serve as alternatives to imprisonment by amending Sections 18.04.440, 18.30.030 and 18.32.040 and by adding new Sections 18.04.744, 18.04.914 and 18.48.090. Motion by Councilmember Barber to introduce and adopt Ordinance No. 4590 to allow certain amendments to the Zoning Ordinance to revise the definition of "group residence facility", Section 18.04.440 Auburn City Code, and to establish related siting criteria. Second by Councilmember Borden. Under discussion, Councilmember Brothers requested staff review the specific changes proposed. He also asked what type of a facility would be manifested by creation of such a group home, and if a facility such as this would house people overnight. Planning Director Steve Lancaster summarized that the proposed amendment establishes a revision in the definition of a group residence facility. It separates the definition of a work release facility that offers alternatives to imprisonment and imposes restrictions such as size being limited to no more than fifty residents on property zoned C-3, Heavy Commercial or M-I, Light Industrial. Mr. Lancaster stated separation criteria are proposed to ensure that this type of facility is separated from sensitive land uses such as residential uses, daycares, parks and other sensitive uses. Further describing the amendments, Mr. Lancaster said the proposed amendment would treat a work release facility that offers alternatives to imprisonment as a different class of use, not the same as a group residence. He said the amendment would be more restrictive in terms of the location of where that type of facility could operate, size of facility, and conditions under which they could operate. Also, the amendment provides for separation of certain businesses from other sensitive types of land uses. He concluded his remarks by stating operating rules for such work release facilities must be reviewed by the City Attorney and Police Chief. Mayor Roegner called for the vote. MOTION CARRIED UNANIMOUSLY. 5-0. B. Resolutions City Attorney Stephen Shelton read the title of the resolution out loud. 1. Resolution No. 2345 04.4.2 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute an agreement PAGE 6 CITY OF AUBURN COUNCIL MEETING October 19, 1992 between the City of Auburn and Visiting Nurse Services of the Northwest to provide a nursing clinic at the Auburn Senior Center for the purpose of assisting senior citizens in the maintenance of good health practices. Motion by Councilmember Barber to adopt Resolution No. 2345. Second by Councilmember Borden. MOTION CARRIED UNANIMOUSLY. 5-0. VIII. MAYOR'S REPORT Prior to adjournment, Mayor Roegner acknowledged Boy Scout Nathan Rasmussen in the audience this evening working on his Citizenship in the Nation badge.
