CALL TO ORDER The regular meeting of the City of Auburn Council was called to order by Mayor Bob Roegner at 7:30 p.m. in the City of Auburn Council Chambers. A. Flag Salute Mayor Roegner led those in attendance in the pledge of allegiance. B. Roll Call Those in attendance included Mayor Bob Roegner and Councilmembers Weekley, Wagner, Burns, Borden, Barber, and Kurle. Councilmember Brothers was excused from the meeting. Staff members in attendance included Police Chief Jake Evans, Fire Chief Bob Johnson, Personnel Director Pam Sime, Parks and Recreation Director Len Chapman, Finance Director Pat Dugan, Public Works Director Frank Currie, Planning Director Steve Lancaster, City Attorney Stephen Shelton, and City Clerk Robin Wohlhueter. Other staff in attendance included Police Captain Bill Pitzl and Deputy City Clerk Dani Daskam. C. Announcements and ADDointments 1. Announcements a. Horse Racing Community Meeting 03.3.4 Mayor Roegner announced that the Horse Racing Commission will be utilizing the City of Auburn Council Chambers on March 23, 1993 at 6:30 p.m. for the purpose of conducting one of three community meetings to be held in Auburn, Fife and Lacey. Mayor Roegner stated the purpose of the Commission's meeting is to assess community interest in horse racing within the community and within the State. Anyone desiring more information about the meeting should contact the Planning Department or the City Clerk. b. Dare Program 01.8 Mayor Roegner displayed one of the new "Drug Free Zone" signs which are being posted in the City. Mayor Roegner announced the next issue of the Auburn Update will contain an article on Drug Free Zones. AUBURN CITY COUNCIL MINUTES Page No. 2 March 15, 1993 c. Personnel A4.2 Mayor Roegner introduced Deputy City Clerk Dani Daskam to the City Council and explained that she will be assisting with the work from the Mayor's office. 2. Aooointments a. Arts Commission A3.8.2 Council to confirm the appointment of Reverend Dennis J. Shinseki to the Auburn Arts Commission filling an unexpired term of Susan Lockner to expire on December 31, 1995. Motion by Councilmember Kurle, second by Councilmember Burns to confirm the Mayor's appointment of Reverend Dennis J. Shinseki to the Auburn Arts Commission to fill the unexpired term of Susan Lockner to expire on December 31, 1995. MOTION CARRIED UNANIMOUSLY. 6-0. D. Agenda Modifications - None. II. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearings - None. B. Audience Particioation 1. Charles R. Wolfe. Attornev from the firm Schwabe. Williamson. Ferguson & Burdell. 1420 Fifth Avenue. Seattle. WA. 98101-2339. A3.23.1 MIS0002-93; 03.10.4 ADM0004-92 Mr. Wolfe, attorney representing Wells Development Corporation and Vehicle Test Technology, Inc./Systems Control, Inc., requested the City Council schedule a public hearing on Application No. MIS0002-93 found under item V.A of these minutes. Mr. Wolfe explained the applicants wish to have the highest level of City government conduct a public hearing and make a determination on the application for the proposed vehicle emission testing facility. 2. Mike Gallagher. 21902 44th Ave. West. Mountlake Terrace. WA A3.23.1 MIS0002-93; 03.10.4 ADM0004-92 Mr. Gallagher explained that he is the Project Implementation Manager for Systems Control, Inc. Mr. Gallagher further explained that Systems Control tests cars for emissions standards. He requested that the Auburn City Council conduct a public hearing on Application No. MIS0002-93. Main St.. Auburn. WA. A3.23.1 MIS0002-93; 03.10.4 ADM0004-92 Mr. West spoke in favor of the Hearing Examiner's decision with regard to Application No. MIS0002-93. He stated the Hearing Examiner conducted a very thorough hearing on Application No. MIS0002-93, and requested the Auburn City Council affirm the Hearing Examiner's decision. 4. Bill Anglin. 602 37th St. SE. Auburn. W A. F2.4.9 LID 341 Mr. Anglin spoke against the formation of LID 341 because of the cost and said he believed other options existed. He also proposed that a bike path be constructed on 37th Street SE rather than a center turning lane because of the schools located or to be located on 37th Street SE and the high number of bicyclists using 37th Street. Mr. Anglin also suggested that application be made to the State for funds under a neighborhood improvement program to offset the cost of the LID to the property owners. 5. Gerald McBreen, 3702 Auburn Way South, Aoartment 1. Auburn. WA. 01.8 Mr. McBreen spoke to the Council regarding a personal child custody experience. He also updated the Council on his previous correspondence to the Council. He stated police officers need additional education in handling child custody complaints. 6. Municioal Services A3.6.4.4 Vice Chair Wagner reported the Municipal Services Committee met today at 4:30 p.m. and discussed solid waste disposal issues. The next meeting of the Municipal Services Committee will be Monday, April 5, 1993 at 4:30 p.m. As Chairman of the Public Works Committee, Councilmember Wagner continued his report under III.C. B. Planning & Community Develooment A.3.6.4.4 Chairman Burns reported the Planning and Community Development Committee met on Monday, March 8, 1993 at 5:30 p.m. and the minutes are of public record. Chairman Burns requested the Council support of the Planning and Community Development issues presented as part of tonight's Council agenda. Public Works A.3.6.4.4 Chairman Wagner reported the Public Works Committee met at 5:30 p.m. today and discussed commercial and passenger loading zones and contract administration issues appearing on the agenda. Chairman Wagner requested Council support of the Public Works Committee issues presented as part of tonight's Council agenda. The next meeting of the Public Works Committee will be Monday, AprilS, 1993 at 5:30 p.m. C. Planning & Community Develooment A.3.6.4.4 Chairman Burns reported the Planning and Community Development Committee met on Monday, March 8, 1993 at 5:30 p.m. and the minutes are of public record. Chairman Burns requested the Council support of the Planning and Community Development issues presented as part of tonight's Council agenda. The next meeting of the Planning and Community Development Committee will be Monday, March 22, 1993 at 5:30 p.m. D. Finance A.3.6.4.4 Chair Barber reported the Finance Committee met this evening at 7:00 p.m. The Committee discussed vouchers and payroll, and Chair Barber requested Council approval of the vouchers and payroll. The Committee also discussed proposed LEOFF I and LEOFF II State legislation. The next meeting of the Finance Committee will be Monday, AprilS, 1993 at 7:00 p.m. IV. CONSENT AGENDA A. D. 1993-1994 Community Develooment Block Grant 03.11, F5.4.3 City Council to call for public hearing to be held at their meeting of April 5, 1993, regarding the use of $345,000 in 1993-1994 Community Development Block Grant Funds. Motion by Councilmember Kurle, second by Councilmember Burns to approve Consent Agenda Items IV.A through IV.D. MOTION CARRIED UNANIMOUSLY. 6-0. V. OLD BUSINESS A. Aoolication No. MIS0002-93 A3.23.l MIS0002-93, 03.10.4 ADM0004-92 Administrative Use Permit to allow the construction of a vehicle emission inspection facility to be located at 4122 B Place NW as requested under Application No. ADM0004-92. Motion by Councilmember Burns, second by Council member Borden to call for a public hearing on Application No. MIS0002-93 for the April 5, 1993 regular Council meeting. MOTION CARRIED UNANIMOUSLY. 6-0. VI. NEW BUSINESS - None VII. ORDINANCES AND RESOLUTIONS A. Ordinances 1. Ordinance No 4613 04.7.3, A3.5.5.8 An Ordinance of the City Council of the City of Auburn, Washington, amending Chapter 8.08 of the Auburn City Code entitled "Solid Waste", specifically Auburn City Code Section 8.08.160 entitled "Collection - Yard Waste Disposal" and Section 8.08.230 entitled "Collection Charges - Residential and Commercial Collections." Ordinance No. 4614 03.8 REZ0005-92 An Ordinance of the City of Auburn, Washington, providing for the rezoning of property located at 12 and 18 "D" Street S.W., within the City of Auburn, Washington, changing the zoning classification thereof from R-4 (Multi-Family Residential) to C-3 (Heavy Commercial). Motion by Councilmember Burns, second by Council member Borden to introduce and adopt Ordinance No. 4614. MOTION CARRIED UNANIMOUSLY. 6-0 3. Ordinance No. 4615 03.10.1 Application No. CUP0008-92 An Ordinance of the City of Auburn, Washington, denying request for a Conditional Use Permit to allow for an arcade building at 620 Auburn Way South, Suite I, in a C-3 <Heavy Commercial) zone, within the City of Auburn, Washington. Motion by Councilmember Burns, second by Councilmember Barber to introduce and adopt Ordinance No. 4615. MOTION CARRIED UNANIMOUSLY. 6-0. 4. Ordinance No. 4616 01.2 An Ordinance of the City of Auburn, Washington, amending Auburn City Code Chapter 10.36 by adding a new sub-section to commercial loading zones within the City. Motion by Councilmember Wagner, second by Councilmember Weekley to introduce and adopt Ordinance No. 4616. MOTION CARRIED UNANIMOUSLY. 6-0 5. Ordinance No. 4617 01.2 An Ordinance of the City of Auburn, Washington, amending Auburn City Code Chapter 10.36 by adding a new sub-section to passenger loading zones within the City. Resolutions 1. Resolution No. 2380 04.7.5 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute a Solid Waste Disposal Agreement between the City of Auburn, the Boeing Company and R.S.T. Disposal, Inc. Motion by Councilmember Wagner, second by Councilmember Borden to adopt Resolution No. 2380. MOTION CARRIED UNANIMOUSLY. 6-0. 2. Resolution No. 2390 05.1 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk of the City of Auburn, to execute a Concessionaire Agreement between the City and the Kiwanis of Auburn for the concession operation at the Brannan Park ballfields. Motion by Councilmember Burns, second by Councilmember Barber to adopt Resolution No. 2390. MOTION CARRIED UNANIMOUSLY. 6-0. 3. Resolution No. 2391 05.1 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk of the City of Auburn, to execute a Concessionaire Agreement between the City and the Auburn Optimist Club for the concession operation at the Game Farm Park ballfields. Motion by Councilmember Burns, second by Councilmember Borden to adopt Resolution No. 2391. MOTION CARRIED UNANIMOUSLY. 6-0. VIII. MAYOR'S REPORT A. Executive Session - None. B. Seattle Times A3.6.4.2 Mayor Roegner introduced Helen Jung who is the city hall reporter from the Seattle Times now that Jill Leovy has taken a position with the Los Angeles Times. Suoermall 03.3.1 Mayor Roegner announced that the Hearing Examiner sustained the decision of the Responsible Official and denied the appeal on the Environmental Impact Statement for the proposed Supermall of the Great Northwest. The Planning Commission will hear the rezone application for the proposed project on March 30, 1993. Mayor Roegner advised the Council to anticipate the issue being on the Council's May 3, 1993 agenda. IX.
