CALL TO ORDER The regular meeting of the City of Auburn Council was called to order by Mayor Bob Roegner at 7:30 p.m. in the City of Auburn Council Chambers. A. Flag Salute Mayor Roegner led those in attendance in the pledge of allegiance. B. Roll Call Those in attendance included Mayor Bob Roegner and Councilmembers Weekley, Wagner, Burns, Borden, Barber, Brothers and Kurle. Staff members in attendance included Fire Chief Bob Johnson, Personnel Director Pam Sime, Finance Director Pat Dugan, Public Works Director Frank Currie, City Attorney Stephen Shelton, and Deputy City Clerk Gayle Butcher. Other staff in attendance included Assistant Parks & Recreation Director Dick Deal, Police Captain Bill Pitzl, Senior Planner Lynn Rued, Deputy City Clerk Dani Daskam, Traffic Engineer Steve Mullen, Project Engineer Jack Locke, and Senior Planner Al Hicks. C. Announcements and Aooointments 1. Announcements a. Lakeland Hills A3.6.4.3 Mayor Roegner encouraged all Councilmembers to attend the Lakeland Hills ground breaking ceremony to be held Tuesday, April 6, 1993 if their schedules permitted. Mayor Roegner provided the ground breaking invitation for Councilmember's review. b. Proclamations A1.8 Earthauake Awareness Month Mayor Roegner presented a proclamation to Fire Chief Johnson proclaiming April 18, through 24, 1993 as "Earthquake Awareness Week". Mayor Roegner also commended Chief Johnson and his staff for their emergency preparedness efforts. 2. Aooointments - None. A UBURN CITY COUNCIL MINUTES Page NO.2 April 5, 1993 D. II. CITIZEN INPUT. PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearings 1. Local Imorovement District No. 341 F2A.9 LID 341 The Auburn City Council has declared its intention to order the construction of street, curbs and gutters, sidewalks, storm drainage system, street illumination system, undergrounding of electrical power system and necessary appurtenances as required on 37th Street S.E. from "A" Street S.E. to "M" Street S.E. within the City of Auburn, County of King, State of Washington; All citizens who desire to object to the improvement and/or LID to appear and present their objections at this time. Mayor Roegner opened the hearing and requested those wishing to testify to please appear before the Council. Steve McGovern. 2201 North 30th Street. Tacoma. W A 98403 Mr. McGovern is an attorney speaking on behalf of N. A. Magnuson and Southend Auto Wrecking, Inc. Mr. McGovern presented written objections to LID 341 with Councilmembers. Mr. McGovern summarized the written objections presented by alleging that not all properties which receive benefit from the proposed LID are being assessed. He also spoke of traffic patterns in the area to provide examples of what he feels represents that fair share assessments are not being met as statutes require. Virginia Haugen 2503 R St. S.E.. Auburn. W A 98002 Ms. Haugen noted that for the safety of Auburn's children and senior citizens, sidewalks are a necessity, but she is concerned about economic impacts to the property owners. Bill Anglin. 602 37th St. S.E.. Auburn. W A 98002 Mr. Anglin spoke of his concern that a 3-lane street will result in raising the speed limit from 25 mph. He feels higher speed limits have potential safety issues for the children who attend the two schools in the area. He feels a bicycle path rather than a turn lane would be of greater benefit. He further expressed concern for the assessment costs. AUBURN CITY COUNCIL MINUTES Page No. 3 April 5, 1993 Beverely Soringer. Auburn Manor Mobile Home Park. 210 37th Street S.E.. Auburn. W A 98002 Ms. Springer expressed concern that the many senior citizens living in her mobile home park would be severely impacted by the property owner passing on the LID assessment through monthly rental increases. She feels many senior citizens will be forced to move. Roy Richardson. 3710 A St. S.E.. Auburn. W A Mr. Richardson felt that the assessment is of very little benefit to the senior citizens, and he also spoke of the financial burdens the LID would bring to the senior citizens. Michelle Morris. 3523 Olymoic St. S.E.. Auburn. W A Ms. Morris noted concerns about cars travelling beyond the 25 mph speed limit. She is concerned about potential traffic accidents that may involve young pedestrians as well as lack of traffic safety in the area at the present time. She feels sidewalks are needed. Jim West. 3501 Olymoic St. S.E.. Auburn. W A Mr. West states he has been a resident for 20 years and that he is representing the Gildo Rey PT A and the Cascade Cycle Club. He noted that through these associations he has been involved in requesting the City upgrade the area with sidewalks, bicycle trail and park access connections and other amenities which might increase safety for children attending school as well as recreational bicycling. Dave Watson. 603 37th St. S.E.. Auburn. W A Mr. Watson stated he has been a resident for 18 years. He expressed concerns with a local improvement district several years ago. With this proposed LID, he questions how the LID may impact his landscaping, i.e., will some of his property be condemned, and how much of his property will be taken for easement. There were no further requests for recognition. Motion by Councilmember Wagner, second by Councilmember Burns to close the public hearing. MOTION CARRIED UNANIMOUSLY. 7-0. Mayor Roegner requested Public Works Director Frank Currie provide a brief presentation with regard to the proposed Local Improvement District. Mr. Currie responded to concerns raised during public testimony. In response to Mr. McGovern, Mr. Currie explained that "M" Street S. E. was not part of the LID due to extensive storm drainage needs, and that by not including this portion in the LID, the average costs of the project would be less. AUBURN CITY COUNCIL MINUTES Page No. 4 April 5, 1993 He further noted that there is very little need for on-street parking and with one common driveway serving multiple residents, the left turn lane is extremely important. The sidewalks are planned to be 7.5 feet in width which should provide pedestrian and bicycle uses. Mr. Currie acknowledged during a neighborhood meeting a right of way error had been made on a particular parcel. He said it does not appear that any right-of -way is being required with the new configuration for the parcel. Mr. Currie explained that monies derived from the State Gas Tax provides approximately $350,000 for all needed city street improvements. Also, Mr. Curried indicated that any needed right of way would be acquired at a fair market value, however, it was his understanding that there should not be any right-of -way needs larger than five feet. Mr. Currie provided a brief 20-year history of how the city provided public improvements particularly highlighting the street delay agreement process. With the growth in the area, residents began inquiring about needed pedestrian space. Today, there are approximately 800 children attending Gildo Rey Elementary School or living in the area, and with the building of another junior high in the area, it is necessary to provide sidewalks. Mr. Currie also provided a listing of concerns expressed at the preliminary neighborhood meeting and indicated how the project has been down sized in order to respond to concerns of cost by reducing assessments by 30%, by reducing the project from four lanes to three, which also reduces concerns regarding the taking of right of way and destruction of trees, by increasing the amount of city participation, and better design delineation to reduce the fear of increased speed. Mr. Currie summarized his presentation by noting the timing is right. Councilmember Kurle stated his empathy for residents when they are faced with a local improvement district. He noted sidewalk safety is extremely important and it appeared the city had made efforts to reduce the impact of the LID. Councilmember Brothers inquired whether street improvements will impact the current posted speed limit. Public Works Director Currie explained the formula for determining speed limits on arterials. Mr. Currie further noted most schools are on arterials with arterial speed limits with the school area posted with appropriate school posting limits. Councilmember Borden inquired about potential low-income assistance programs for mobile home park residents. She noted past LID's offered assistance programs for low-income residents. Mr. Currie noted staff had looked for other sources, however, programs are geared to property owners, not renters. He noted that in other LID's the low-income residents were property owners, while in this case, they were renters. Council member Borden further inquired about potential space fee increases to the mobile home park residents. Mr. Currie explained the potential formula for applying assessment percentages to mobile home park space fees. Councilmember Borden noted the need for sidewalks, AUBURN CITY COUNCIL MINUTES Page No. 5 April 5, 1993 however, she was concerned with the cost increases to the mobile home park residents. Councilmember Wagner expressed his concern with the potential posted speed limit increase due to street improvements. Mr. Currie responded that safety and moving traffic are of primary concern and that he does not believe increasing speed limits is an automatic process. Mr. Currie noted exceptions could be considered in an effort to assuage concerns of a higher speed limits for the arterial. Councilmember Wagner also expressed concern if the school district property is not developed as proposed, would there be changes to the boundaries? Mr. Currie noted the assessment is against the property so the boundaries would remain the same. Councilmember Wagner stated he felt there were two issues with the proposed local improvement district; safety and affordability. Due to pedestriàn safety issues, he felt it was necessary to provide better access for school children, bicycles, transportation, etc. Councilmember Wagner further noted the project had been scaled back to lessen financial burdens, but he encouraged the City to look at other methods of financing assistance for the LID to lessen the impact to all residents. He felt financing issues could be addressed during the budget deliberations this summer. Motion by Councilmembers Wagner, second by Councilmember Weekley to introduce and adopt Ordinance No. 4619. MOTION CARRIED. 6-1 with Councilmember Borden voting no. 2. 1993-1994 Community Develooment Block Grant (B urns /Lancaster) 03.11, F5.4.3, 03.4.1.7 The City of Auburn expects to receive $345,000 III Community Development Block Grant Funds for the 1993-1994 program year. The Auburn City Council requests a public hearing to receive citizen input prior to determination of the use of these funds. All persons interested are encouraged to participate in the public hearing at this time. Mayor Roegner opened the hearing and requested those persons wishing to testify to please appear before the Council. Kate Cadoo. 105 A St S.W.. Auburn. W A Ms. Cadoo represents the Community Health Center and she thanked the Council for their many years of support for the city's low-income and uninsured individuals. She pointed out that the Auburn clinic is the busiest health center in King County, and she reiterated her appreciation of Council support. Virginia Haugen. 2503 R St. S.E.. Auburn. W A Ms. Haugen encouraged the Council to appropriate monies to the library, space requirements for City Hall, and needed conference room facilities. AUBURN CITY COUNCIL MINUTES Page No.6 April 5, 1993 Charles Jinneman. 38121 138th S.E.. Auburn. W A Mr. Jinneman is representing the low-income utility assistance program through St. Vincent de Paul. He noted that need has increased 40% during which resulted in the program being overspent by $8,000. He noted how important the block grant monies were. Lawrence Wydro. 1102 J St. S.E.. Auburn. W A Mr. Wydro represents ACAP and thanked the Council for their support. He also invited the Council to attend the dedication of the new facility expansion. He pointed out the monies provide essential relief to Auburn families. Jennifer Franke. 1102 J St. S.E.. Auburn. W A Ms. Franke is also representing ACAP and noted a proposed use of the block grant monies will be to provide a play yard which is in compliance with American with Disabilities Act. She also stressed the need for low- income children having an appropriate play area as many low-income homes do not lend themselves to the physical needs of young children. Dick Brugger. 11244 S. E. 322nd Sf.. Auburn. WA Mr. Brugger is representing Auburn Youth Resources. He presented Council with information on Youth 2000. He stressed the need for a safe place for kids to go to in Auburn, and he thanked the Council for their years of support. There were no additional requests for recognition. Motion by Councilmember Burns, second by Councilmember Borden to close the public hearing. MOTION CARRIED UNANIMOUSLY. 7-0. Motion by Councilmember Burns, second by Council member Barber to introduce and adopt Ordinance No. 4618. MOTION CARRIED UNANIMOUSLY. 7-0. 3. Aoolication No. MIS0002-93 03.5.1 City Council to consider the recommendation of the Hearing Examiner to grant the appeal and deny the issuance of an Administrative Use Permit (ADM0004-92) to allow a vehicle emission inspection station to be located at 4122 "B" Place N.W. Mayor Roegner opened the hearing and requested persons wishing to testify to please appear before the Council. AUBURN CITY COUNCIL MINUTES Page No. 7 April 5, 1993 Charles R. Wolfe. attorney from the firm Schwabe. Williamson. Ferguson & Burdell. 1420 Fifth Avenue. Seattle. WA 89101-2339 Mr. Wolfe requested a 5-minute recess in order to set-up equipment for a short video presentation. Mayor Roegner announced a recess at 8:45 p.m. The City Council meeting reconvened at 8:52 p.m. with Mr. Charles R. Wolfe prepared with testimony for the public hearing on Application No. MIS0002-93. Mr. Wolfe presented to Council an outline of his presentation and correspondence, and he thanked the Council for the public hearing process. He stated the project implementation manager, Mr. Gallagher, and traffic consultant for Transpo Group, Mr. MacIsaac, would also make comments. Mr. Wolfe is requesting the City Council reject the Hearing Examiner's decision. Mike Gallagher. Systems Control. 8656 154th A venue. Redmond. W A Mr. Gallagher presented documentation containing information from the Department of Ecology (DOE), site information regarding the facility, one aerial photograph, a statement with regard to the video footage, and two sets of photographs. Mr. Gallagher spoke of the Seattle-area not meeting air quality standards, and the Department of Ecology has noted one method of reducing air pollution is through vehicle emission testing. He provided a brief history of the DOE's emission program, highlighting the new testing standards, and that they had redesigned of the proposed lanes at testing facilities to comply with the Administrative Use Permit. He further explained how his company determined how many vehicles would be processed at the 4122 B Place N. W. site and testing times for each vehicle. Mr. Gallagher presented a video tape of a peak day at a testing facility in Renton, Washington (noting there would be approximately 40% fewer cars in the Auburn facility). He stressed that all parking will be on the emission testing site, and that there will be no loading or unloading of trucks. He further testified that the site has been redesigned twice to comply with storm drainage and environmental standards and that his firm will benefit Auburn through taxes and jobs. Jim MacIsaac. 14335 NE 24th Street. Bellevue. W A 98445 Mr. MacIsaac presented graph illustrating a month's activity at the Renton emission site. He noted the peak times are at the end of the month and the graph shows the peak day was 250. He noted the highest peak day in Renton was 460 cars, and the video presentation was representative of 424 cars. He explained the 4-lane peak processing rate is one car per five minutes. He believes the maximum number of cars entering and exiting driving activity would be 48 cars which means there is a 1.25 minutes between cars. He indicated he taped "B" Street during peak time 4:00- 5:00 p.m. on February 2, 1993, and showed the video to illustrate what A UBURN CITY COUNCIL MINUTES Page No. 8 April 5, 1993 type of traffic congestion might be realized with approximately 400 cars. Mr. MacIsaac believes the street is adequate, there is no anticipated traffic congestion, and he believes there is no anticipated problems for police and/or fire vehicles. Mr. Charles Wolfe requested to reserve additional time for any questions that may arise, and he testified that he believes the evidence presented this evening establishes compliance in the five areas of findings of fact, with the comprehensive plan, environment and air quality, inter- jurisdiction programs, and in providing an economic base for Auburn. Ken Ingalls. 960 E. Main St.. Auburn. W A Mr. Ingalls is an attorney representing clients in the area where the proposed emissions site may be located, and his clients are opposed to the anticipated development. Mr. Ingalls presented a site plan of the subject property. He stressed he and his clients understand that emission testing is mandated, however, he points out that there are other sites within King County as well as Auburn that are already zoned for such development. Mr. Ingalls noted the government mandate does not mean that the City of Auburn must approve the developer's choice of site. Mr. Ingalls indicated the background video showed signs of major businesses, such as McDonald's and a Chevron which indicated the video area was a well traveled arterial and well-developed arterial; the M-l industrial area does not support such an arterial.. He also noted that opposition was immediate for his clients as soon as they became aware of the proposed use was made known. Mr. Ingalls referred to the zoning code which indicated that some commercial uses may be permitted if the use enhances the area and does not disrupt the continuity of the industrial use. Mr. Ingalls pointed out that all the properties are currently compatible uses within the light industrial use, and that the location is not capable of handling the traffic that will be funnelled into the area. Mr. Ingalls noted the Hearing Examiner's Findings of Fact indicates the emission inspection site is detrimental in this zone. He further noted his clients are served by large trucks, and the deliveries are difficult with the present road configuration and traffic. Mr. Ingalls pointed out an emissions testing facility will be located in south Auburn. Also, since there are no facilities south of Renton, he believes the emissions facilities will also be serving Federal Way, Kent, Covington, etc., and that the traffic impacts will be tremendous. Mr. Ingalls further disputed traffic counts and projections. He also noted that all of his clients provide jobs and contribute to Auburn's tax base. Mr. Ingalls summarized that his clients have a right to use the property in accordance with zoning regulations, the emissions testing site is not consistent with zoning, and noted there are alternative locations within Auburn that would serve an emissions testing site. He presented examples of properties that are properly zoned to show there are other sites available. A UBURN CITY COUNCIL MINUTES Page No.9 April 5, 1993 Mayor Roegner requested that those persons not represented by Mr. Ingalls provide testimony as the Mayor wanted to keep testimony time fair. Mr. Ingalls indicated a couple of his clients did wish to make a couple of points that he did not address. Mayor Roegner requested those persons wishing to testify keep their comments within one to two minutes. John Raeder. 4102 B Place N.W.. Auburn. W A98002 Mr. Raeder indicated on a site map where his business was located. Twelve to 15 vehicles are currently dispatched out of his facility everyday to serve customers. He believes added traffic would use his business location to get out of the complex area and this will impact his business. He pointed out that left turns on 277th are difficult and 37th Street currently presents a visibility problem. Mr. Raider believes increased traffic will guarantee a safety problem for his employees. Bill Ryan. 4164 B Place N.W.. Auburn. W A Mr. Ryan pointed out that you cannot compare the B Place N. W. location with the Renton location because Renton has 4-lanes, left and right turn lanes as well as traffic signals. He is requesting the Council affirm the Hearing Examiner's decision. Ken Wilson. 4132 B Place N. W.. Auburn. WA His business is located adjacent to the proposed subject property and informed the Council as to the nature of his business activity. He is concerned for the health, safety and comfort for his employees. He has a smoke-free environment and feels his employees will be subjected to high levels of auto emissions. He is also concerned for the impact of traffic on his customers. He is requesting the Council uphold the Hearing Examiner's decision. Mr. Wilson presented his written comments. Charles Turbin. a commercial real estate broker out of Bellevue and who is active in the Auburn community and who does work for the develooer. He did not state his comoany name or orovide an address. Mr. Turbin states he was asked by the property owners two questions, (l) are there other available sites for this facility, and he answered in the affirmative, and do they fit the needs of this facility. He indicated he could not answer that, but noted there are properly zoned pieces of property that are the right size in Auburn, three of which are on 15th Street N.W.; and (2) could this facility hinder the ability to sell or lease properties. He stated he could only guess that traffic is always a consideration, which could ultimately hinder property. Steve Warner. 3408 B St. N.W.. Auburn. W A Mr. Warner indicated his business was first located next to the driver's license bureau on Auburn Way North a few years ago, and he sees some similarities between the proposed emission site and the driver's license bureau. He pointed out that a driver's license is also mandated as well as generating activity which also varies from day-to-day. Mr. Warner knows first-hand of employee parking problems and difficulty with truck AUBURN CITY COUNCIL MINUTES Page No. 10 April 5, 1993 deliveries when a business is close to such a use. He does not want to realize again the traffic problems of the past. He further noted traffic is impacted by the railroad crossing now and feels it is a traffic consideration. Ron Lovett. 4150 B Place N.W.. Auburn. W A Mr. Lovett pointed out that at the present time, it only takes five cars in a row to block his driveway from truck deliveries. He further noted the video of the area that was taped between 4-5:00 p.m., was the best time to tape the area since that's when most businesses in the area are shutting down. The proposed business traffic will curtail his business activities. Gary Cocker. 4150 B Place N.W.. Auburn. WA 98002 He pointed out the proposed emissions site will generate traffic that all 21 businesses in the area now generate. He further noted that the present driver's license bureau and license tab sites are off 4-lane streets with turn lanes. Virginia Haugen. 2503 R St. S.E.. Auburn. W A 98002 Ms. Haugen believes she has heard several salesmen trying sell us down the river, and she believes the proposed site will result in an emission problem. There were no further requests for recognition. Mr. Wolfe stated he wished to make further statements. Mayor Roegner noted the public hearing is intended to give both sides the opportunity to present points of view, and that any additional information would need to be presented if members of the Council asked questions. Mr. Wolfe pointed out that there was a discrepancy of time. Mayor Roegner pointed out there was about an 8-minute discrepancy and he did not believe that time frame was meritorious in terms of arguments. Mr. Wolfe felt there were specific points raised that he should speak briefly upon. Mayor Roegner indicated that an opportunity for both sides to present their views had taken place. Motion by Councilmember Burns, second by Councilmember Barber, to close the public hearing. MOTION CARRIED UNANIMOUSLY. 7-0. Councilmember Kurle noted that photographs presented as well as the video presentation was not of the same neighborhood character as the proposed site. Councilmember Kurle noted he had made a personal visit to the area at approximately 2:00 p.m., and he feels there are several traffic problems now. He expressed concern to the appellant with regard to their increased time percentage calculations. Council member Burns noted he is familiar with B Street N.W., noting his concerns that the traffic access to B Place N. W. is only through B Street N.W. which is accessed by intersections of 37th St. N. W. or 277th. Both of these intersections abut a set of railroad tracks. He noted that right now the traffic is considerable and the street is inadequate. He encouraged the applicant to seek a different Auburn location. Motion by Councilmember Burns, second by Councilmember Barber, to affirm the Hearing Examiner's decision and to deny the Administrative Use Permit based upon the Hearing Examiner's Findings of Fact & Conclusions. MOTION CARRIED UNANIMOUSLY. 7-0. B. Audience Particioation Mayor Roegner invited cItIzens in the audience this evening who may want to bring to attention of the City Council something occurring in the community or to comment on an item occurring later in tonight's agenda. Virginia Haugen. 2503 "R" St. S.E.. Auburn Ms. Haugen expressed concern that she had requested employee wages for particular elected and staff positions for the City of Auburn. She feels she was denied this information because she believes she was given an estimate. Mayor Roegner responded that he had reviewed Ms. Haugen's written request for wage information and the city's written response which provided the salary ranges for the requested positions. Mayor Roegner further stated that he was satisfied with the city's response to Ms. Haugen, and that a copy of the response would be provided to Councilmembers if they so desired. C. Corresoondence 1. Suoermall 03.3.1 Mayor Roegner announced that Councilmembers had been polled this last week to determine potential available dates to conduct a special City Council meeting to consider the Supermall issue. There was a brief discussion with regard to Council member schedules and the need for community resolution. Councilmembers were reminded of procedures should the special Council meeting be continued. Motion by Councilmember Burns, second by Councilmember Brothers, to conduct a special City Council meeting to consider the Planning Commission's recommendation with regard to the request of Hapsmith Company for a rezone for the construction of the Supermall to be held on Tuesday, April 27, 1993 at 6:00 p.m. in the Council Chambers of City Hall. MOTION CARRIED 6-1 with Councilmember Brothers voting no.
