CITY COUNCIL MEETING MINUTES
May 3, 1993 7:30 p.m.
I. CALL TO ORDER
The regular meeting of the City of Auburn Council was called to order by Mayor Bob Roegner
at 7:30 p.m. in the City of Auburn Council Chambers.
A. Flag Salute
Mayor Roegner led those in attendance in the pledge of allegiance.
B. Roll Call
Those in attendance included Mayor Bob Roegner and Councilmembers Weekley,
Wagner, Burns, Borden, Barber, and Brothers. Councilmember Kurle was excused.
Staff members present included Police Chief Jake Evans, Fire Chief Bob Johnson,
Personnel Director Pam Sime, Parks and Recreation Director Len Chapman, Finance
Director Pat Dugan, Public Works Director Frank Currie, Planning Director Steve
Lancaster, City Attorney Stephen Shelton, and City Clerk Robin Wohlhueter. Other
staff present included Police Lieutenant Marion Dukes.

1. National Public Works Week
A proclamation of the Honorable Bob Roegner, Mayor of the City
of Auburn, Washington, proclamining May 16 through May 22,
1993 as "National Public Works Week".
Mayor Roegner read the proclamation honoring "National Public
Works Week". Public Works Director Frank Currie accepted the
proclamation. Mayor Roegner expressed gratitude to staff on
behalf of the Council and Mayor.
2. Senior Center Month
A proclamation of the Honorable Bob Roegner, Mayor of the City
of Auburn, Washington, proclaiming the month of May, 1993 as
"Senior Center Month".
Mayor Roegner introduced and briefed the Council on the many
volunteer and activities undertaken by those Senior Citizens in the
audience this evening. Here to accept a proclamation were
Thelma Serrano, Andy & Jenny Holen, Eugenia Brook, Ray
Dodson, Ida Mae Struve, Forest & Jo MacKenzie, and Billie and
Glen Warrick.

Mayor Roegner read the proclamation honoring the seniors, and
joined with Council and staff in honoring these special people.

II. CITIZEN INPUT. PUBLIC HEARINGS & CORRESPONDENCE
A. Public Hearings

City Council to consider a petition filed for the vacation of a portion of street
right-of-way known as 32nd Street S.E. right-of-way located between "A" Street
S.E. and "B" Street S.E. (85th A venue South), within the City of Auburn,
Washington.
Mayor Roegner opened the public hearing.
Councilmember Weekley disclosed he had contacted the applicant with regard to
the proposed street vacation in an attempt to locate a portion of the street right-
of -way before the Council this evening. Council member Weekley stated he does
not believe the contact he had with the owner would, in any way, impair his
ability to make a fair decision this evening on the street vacation.
Mayor Roegner requested anyone wishing to comment upon the proposed street
vacation may do so at this time. After the third call, Mayor Roegner requested
Council action.
Motion by Councilmember Wagner to close the public hearing. Second by
Councilmember Weekley.
MOTION CARRIED UNANIMOUSLY. 6-0.
Motion by Councilmember Wagner, second by Councilmember Burns to deny the
request of the applicant under Application No. V -01-92.
MOTION CARRIED UNANIMOUSLY. 6-0.
2. Aoolication for CATV Franchise Agreement with TCI

To conduct a public hearing upon the granting of a non-exclusive IS-year
franchise to TCI Cablevision of Washington, Inc. to operate a cable television
system in the City of Auburn.
Mayor Roegner opened the public hearing.

Mike Bocatch - 111 H Street S.E., Auburn, W A
Mike Bocatch, a resident of Auburn, expressed concern for being charged for a
recent fight where pre-programing was interrupted as a result of a problem TCI
was having. He did not feel he should have to pay for the interruption. Mr.
Bocatch referred to a Chicago Tribune article which he filed with the Council
dated April 28, 1993 with regard to Microsoft joining cable TV venture. He also
referred to an article from the News Tribune regarding cable TV services.
Another concern Mr. Bocatch expressed was offering the "MTV" Channel as basic
service given some of the exhibited adult behaviors. Mr. Bocatch requested the
Council reopen the negotiations to include changes proposed federally.
Motion by Councilmember Brothers, second by Councilmember Wagner to close
the public hearing.
MOTION CARRIED UNANIMOUSLY. 6-0.
Councilmember Weekley responded to Mr. Bocatch's remarks by requesting Daniel
Haynes, Customer Operations Manager from TCI Cablevision of Washington, Inc.,
to address the concern. Mr. Haynes explained basic services and that options are
available to residents to obtain a parental control box or to "trap" "MTV". from
coming into your residence without charge.
Motion by Councilmember Brothers, second by Council member Wagner to
introduce and adopt Ordinance No. 4625.
MOTION CARRIED UNANIMOUSLY. 6-0.
Motion by Councilmember Brothers, second by Councilmember Borden to approve
Resolution No. 2409.
MOTION CARRIED UNANIMOUSLY. 6-0.

III. COUNCIL COMMITTEE REPORTS
A. Municioal Services

Chairman Brothers reported the Municipal Services Committee met today at 4:30 p.m. to
discuss items appearing before the Council this evening. He requested support of those
items. The next meeting of the Municipal Services Committee will be Monday, May 17,
1993 at 4:30 p.m.

B. Planning & Community Develooment

Chairman Burns reported the Planning and Community Development Committee met on
Monday, April 26, 1993 at 5:30 p.m. The next meeting of the Planning and Community
Development Committee is scheduled for Monday, May 10, 1993 at 5:30 p.m.
C. Public Works
A3.6.4.4
Chairman Wagner reported the Public Works Committee met at 5:30 p.m. today to
discuss a number of issues. The Committee is requesting Consent Agenda Items IV.E.l
and IV.E.2 to be held in committee for further review. The next meeting of the Public
Works Committee will be Monday, May 17, 1993 at 5:30 p.m.
D. Finance

Chair Barber reported that the Finance Committee met at 7:00 p.m. prior to the Council
meeting. Chair Barber reported that the Committee reviewed an interfund loan for LID
345 and approved claims and payroll vouchers. The next meeting of the Finance
Committee is scheduled for Monday, May 17, 1993 at 7:00 p.m.

the City.

An Ordinance of the City Council of the City of Auburn, Washington, repealing
Auburn City Code Chapter 13.36 entitled "CATV Systems" and enacting a new
Chapter 13.36 of the Auburn City Code entitled "CATV Systems".
This ordinance was already approved under II.A.2 of these minutes.

the vacation for a portion of 32nd Street S.E. right of way located between "A"

the Mayor and City Clerk to execute a release of utility easement to eliminate the
easement as established by document recorded under King County Auditor's File
No. 8810100659 on property located approximately 500 feet west of Lund Road,
just north of SR 18, and more particularly described as the east 15 feet of the
west 22.5 feet of the north 380.0 feet, City of Auburn Short Plat No. SP-5-85 as
recorded under auditors file No. 8507170422, records of King County,
Washington, together with that portion of vacated Lund Road adjoining on the
east within the City of Auburn.
Motion by Councilmember Wagner, second by Councilmember Burns to approve
Resolution No. 2407.

A Resolution of the City Council of the City of Auburn, Washington,
Authorizing the Mayor and City Clerk of the City of Auburn to execute a non-

within the City of Auburn, Washington.
