Flag Salute Mayor Roegner called the meeting to order at 7:30 p.m. and led those in attendance in the pledge of allegiance. B. Roll Call Those in attendance included Mayor Roegner and Councilmembers Weekley, Wagner, Burns, Borden, Barber, Brothers, and Kurle. Staff members present included Police Captain Ray Sherman, Fire Chief Bob Johnson, Personnel Director Pam Sime, Parks and Recreation Director Len Chapman, Finance Director Pat Dugan, Public Works Director Frank Currie, Planning Director Steve Lancaster, City Attorney Stephen R. Shelton, and City Clerk Robin Wohlhueter. C. Announcements and Appointments I. Announcements - None. 2. Appointments - None. D. Agenda Modifications F2.4.9 LID 345 x 2, Agenda modifications this evening were transmitted for agenda item VII.A.3, Ordinance No. 4643. Ordinance No. 4643 relates to a bond ordinance for LID 345. This modification transmits the final copy of Ordinance No. 4643 which posts the principal, bond numbers and interest rates. Also transmitted is the "Bond Purchase Contract" submitted by Seattle-First National Bank to purchase the bonds. II. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearings 1. Application No. V -01-93 03.9 Application No. V -01-93 At the September 20, 1993 Council meeting the Auburn City Council called for a public hearing on the petition for vacation of a street right of way on a portion of County Road 67, located between West Margin of Academy Drive and approximately 100 feet west, within the city of Auburn. Mayor Roegner opened the public hearing. No one in the audience requested to speak for or against Application No. V -01-93. There being no requests for recognition, Mayor Roegner requested a motion to close the public hearing. AUBURN CITY COUNCIL MINUTES Page No. 2 October 18, 1993 Motion by Councilmember Wagner, second by Councilmember Burns to close the public hearing. MOTION CARRIED UNANIMOUSLY. 7-0. Action on Ordinance No. 4642 will be taken under Agenda Item VII.A.2. 2. Application No. REZ0003-93 Application No. MISOOIO-93 03.8 REZ0003-93, A3.23.1 MISOOIO-93, 03.4.3 The request of John W. Brekke to rezone 1.643 acres of a 2.715 acre parcel from M-I, Light Industrial, to C-3, Heavy Commercial, together with a Comprehensive Plan Map Amendment from Light Industrial to Heavy Commercial, property located at 3702 West Valley Highway North. Mayor Roegner opened the public hearing. John W. Brekke - 8592 Hunts Point Lane, Bellevue, W A 98004 Mr. Brekke introduced himself to the Council. He wanted the Mayor and Council to know that he is available to answer any questions. Mr. Brekke is the owner of property considered for the public hearing on Application No. REZ0003-93 and MISOOIO-93. There being no further requests for public comment, Mayor Roegner asked for a motion to close the public hearing. Motion by Councilmember Burns to close the public hearing. Second by Councilmember Barber. MOTION CARRIED UNANIMOUSLY. 7-0. Staff clarified the status of the food broker/wholesaler business that currently exists on the property proposed for a rezone. Mr. Lancaster stated this business would become a legal nonconforming use should the rezone be approved. Motion by Councilmember Burns, second by Councilmember Barber to approve the rezone request and Comprehensive Map amendment based upon the Planning Commission's Findings of Fact and Conclusions; and to instruct the City Attorney to prepare the necessary ordinances. MOTION CARRIED UNANIMOUSLY. 7-0. B. Audience Participation Mayor Roegner invited citizens in the audience to make any comments they desired be brought before the Council. COUNCIL COMMITTEE REPORTS A. Municipal Services A3.6.4.4 Chairman Brothers reported the Municipal Services Committee did not meet today, and previous minutes of the Committee are of public record. The next meeting of the Municipal Services Committee will be Monday, November I, 1993 at 4:30 p.m. B. Planning & Communitv Development A3.6.4.4 Chairman Burns reported the Planning and Community Development Committee has not met since the last Council meeting. The next meeting of the Planning & Community Development Committee will be Monday, October 25, 1993 at 5:30 p.m. C. Public Works A3.6.4.4 Chairman Wagner reported the Public Works Committee met this evening at 5:30 p.m. to discuss several items appearing later in tonights agenda. He asked for support of those items as they come before the Council. The next meeting of the Public Works Committee will be Monday, November I, 1993 at 5:30 p.m. D. Finance A.3.6.4.4 Chair Barber reported the Finance Committee met at 7:00 p.m. prior to the Council meeting this evening to discuss claims and payroll numbers, and an Ordinance No. 4643 with regard to selling bonds for LID 345. The next meeting of the Finance Committee will be Monday, November I, 1993 at 7:00 p.m. IV. CONSENT AGENDA A. Minutes I. Minutes of the October 4, 1993 regular Council meeting. B. Vouchers F4.9.2, F4.9.5 1. Claim numbers 86663 through 87013 in the amount of $1,095,618.05 and dated October 18, 1993. 2. Payroll numbers 196641 through 197166 in the amount of $830,984.15 covering the period October I, 1993 through October 8, 1993. C. Utility Bill Ad iustment F4.5.2 I. Recommend approval of utility adjustment to account 2.60.5480 in the amount of $1,374.48. · AUBURN CITY COUNCIL MINUTES Page No.4 October 18, 1993 2. Recommend approval of utility adjustment to account 3.61.1080 in the amount of $1,454.16.* Motion by Council member Kurle, second by Councilmember Burns to approve Consent Agenda Items IV.A.I through IV.C.2. MOTION CARRIED UNANIMOUSLY. 7-0. V. OLD BUSINESS - None VI. NEW BUSINESS - None. VII. ORDINANCES AND RESOLUTIONS A. Ordinances Stephen Shelton read the titles to each ordinance prior to the City Council taking action. 1. Ordinance No. 4641 03.10.1 Application No. CUP0005-93 An Ordinance of the city of Auburn, Washington, providing for a Conditional Use Permit to allow shredding of wood waste on property zoned M-2 (Heavy Industrial) and situated at 655 and 657 Second Street N.W. within the city of Auburn, Washington. Motion by Councilmember Burns, second by Councilmember Borden to introduce and adopt Ordinance No. 4641. MOTION CARRIED UNANIMOUSLY. 7-0. 2. Ordinance No. 4642 03.9 Application No. V -01-93 An Ordinance of the City Council of the city of Auburn, Washington, approving the vacation for a portion of County Road No. 67, located between west margin of Academy Drive and approximately 100 feet west, within the city of Auburn, Washington. Motion by Councilmember Wagner, second by Councilmember Weekley to introduce and adopt Ordinance No. 4642. MOTION CARRIED UNANIMOUSLY. 7-0. 3. Ordinance No. 4643 F2.4.9 LID 345, An Ordinance relating to Local Improvement District No. 345; fixing the amount, form, date, interest rates, maturity and denominations of the Local Improvement District No. 345 Bonds; providing for the sale and delivery thereof to Seattle- First National Bank in Seattle, Washington; and fixing the interest rate on Local Improvement District No. 345 assessment installments. Resolutions Prior to Council action, Stephen Shelton read the titles to each Resolution out loud. I. Resolution No. 2439 03.5 PL T0006-89 A Resolution of the City Council of the city of Auburn, Washington, approving the preliminary plat of a 6-10t industrial subdivision to be known as "Park 277 East" located south of 277th South, within the city of Auburn. Motion by Councilmember Burns, second by Councilmember Barber to introduce and adopt Resolution No. 2439. MOTION CARRIED UNANIMOUSLY. 7-0. 2. Resolution No. 2440 A4.5.2 A Resolution of the City Council of the city of Auburn, Washington authorizing the Mayor and City Clerk to execute a Technical Services Agreement between the City of Auburn and Techstaff, Inc., to procure temporary design and construction-inspection staff during the remainder of 1993 and through the end of 1994. Motion by Councilmember Wagner, second by Councilmember Weekley to introduce and adopt Resolution No. 2440. MOTION CARRIED UNANIMOUSLY. 7-0. VIII. MAYOR'S REPORT - None. A. Executive Session - None.
