Flag Salute Mayor Roegner called the meeting to order at 7:30 p.m. and led those in attendance in the pledge of allegiance. B. Roll Call Those in attendance included Mayor Roegner and Councilmembers Burns, Wagner, Haugen, Borden, Barber, Brothers, and Kurle. Staff members present included Police Chief Jake Evans, Police Lieutenant Marion Dukes, Assistant Fire Chief Steve Shropshire, Personnel Analyst Shelley Werner, Parks and Recreation Director Len Chapman, Finance Director Pat Dugan, Acting Planning Director and Public Works Director Frank Currie, Senior Planner Lynn Rued, City Attorney Stephen R. Shelton, Mayor-Elect Charles Booth, and City Clerk Robin Wohlhueter. C. Announcements and ADDointments 1. Announcements Roegner Park Mayor Roegner briefly commented on Resolution No. 2449 renaming White River Park to Roegner Park which is being circulated to Councilmembers for signature. He said a shorter version will also be presented to Councilmembers for signature next week for him to keep. Citizen Recognition Even though there are hundreds of cItIzens and perhaps thousands throughout our community that give of themselves without expecting reward, Mayor Roegner honored four citizens who, he felt, have shown up everywhere ill our community. A key to the city was presented to each honored citizen. Mayor Roegner honored George Osborne who has chaired about everything in Auburn, been active in civic clubs, and particularly for his activities at Auburn Youth Resources (A YR) over the last number of years. Mayor Roegner named his numerous contributions to the community. George Osborne thanked Mayor Roegner's administration on behalf of the A YR Board, staff, and for the thousands of young people that have benefited from A YR's program. Mayor Roegner acknowledged Koji Norikane who has volunteered hours beautifying the entrance to Auburn City Hall and other areas in the community by planting flowers. Mr. Norikane accepted the Key to the City as Mayor Roegner thanked him for his support over the years. ~ AUBURN CITY COUNCIL MINUTES Page No. 2 December 20, 1993 Not in attendance this evening, Mary Caldwell was also honored by Mayor Roegner for her many years of service as Chair and member of the Park Board. As one of Mayor Roegner's mentors years ago, Mayor Roegner praised Barbara and Jim Cooksey for their contributions made to the community. He said they have done an exceptional job in helping the poor and infirm people in our community. Mayor Pro Tern Kurle read Resolution No. 2456 honoring and thanking Bob Roegner for his eighteen years of service to the City of Auburn, and on behalf of the citizens of the city of Auburn extended its grateful appreciation and gratitude to Mayor Bob Roegner for his eighteen years of dedicated, faithful and outstanding service to the City of Auburn as Mayor and City Councilmember. Motion by Councilmember Kurle, second by Councilmember Burns to adopt Resolution No. 2456. MOTION CARRIED UNANIMOUSLY. 7-0. 2. Aooointments - None. D. Agenda Modifications Agenda modifications are noted for Council Agenda items II.A.l and VII.B.2. Agenda modification II.A.l transmits two maps pertaining to Application No. V-01-90. One map is a site map and the other map presents the parcel to the be vacated by proposed vacation dated December 14, 1993. Agenda modification VII.B.2 transmits Exhibit A of Resolution No. 2452 which is an Interlocal Agreement with King County for animal control services. II. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearings 1. Aoolication No. V-01-90 03.9 A public hearing on a petition requesting the vacation of the street right-of-way known as the portion of 16th and "D" Street N.E. After opening the public hearing, Mayor Roegner stated the staff report with regard to Application No. V -01-90 was distributed to Councilmembers prior to the public hearing this evening. Frank Currie briefly stated all legal requirements have been met with regard to Application No. V -01-90 in preparation for the public hearing tonight. He said the Council needs to make a determination that the right-of -way is no longer needed for public purpose. In review of the property Mr. Currie noted there are a number of potential uses for that portion of the street which include future ~..~ AUBURN CITY COUNCIL MINUTES Page No. 3 December 20, 1993 access to the Airport property and installation of potential traffic safety devices. He said for these reasons, staff is recommending denial of the street vacation. Jim Reese - 1521 D Street N.E., Auburn, WA Jim Reese represents the Pony Solider Motor Inn. He said the proposed property is adjacent to the Pony Solider. Mr. Reese reviewed events that occurred since 1987 on the two slivers of land. He said the city solicited the Pony Solider Motor Inn to acquire the property as it was declared surplus to the Airport and surplus to the Street Department. In 1989, he said, the legal description was finalized, and in 1990 the City requested the street be vacated for both parcels together. Mr. Reese said a formal application was submitted to include both parcels of land. Later the city stated in a letter that the south parcel of the property may be finalized, the north needs an appraisal and can be purchased. Mr. Reese stated that even though the property was such a small portion of land, they were able to secure a professional appraiser for $750.00 which was rejected by the City in 1993. Now the city wishes to divide the pieces of property. Mr. Reese asked the Council to put the property on the tax rolls. There are innumerable accesses to the Airport. Motion by Councilmember Wagner second by Councilmember Burns to close the public hearing. MOTION CARRIED UNANIMOUSLY. 7-0. Frank Currie responded to Councilmember Brothers request with regard to Mr. Reese's remarks made on the street vacation. Mr. Currie stated he has no knowledge of the city approaching the Pony Solider Motor Inn in vacating this property. Councilmember Brothers directed attention to the procedure relating to the street vacation. Motion by Councilmember Wagner to refer Application No. V -01-90 to the Public Works Committee for consideration at its January 3, 1994 meeting for recommendation to the City Council at its January 3rd meeting. The motion was seconded by Councilmember Burns. MOTION CARRIED UNANIMOUSLY. 7-0. Councilmember Kurle asked Mr. Reese to submit his comments to the City Clerk who will make them available to the departments and Councilmembers. 2. Aoolication No. ANXOOO 1-93 03.1 ANXOOOI-93, 03.8 REZ0004-93 A petition has been filed by the property owner of a 1.17 acre parcel located at the southeast corner of 29th and "A" Street S.E. for annexation into the city of Auburn. John Devon - 2904 A Street SE Auburn, W A John Devon represents Mr. Rennemo who is the owner of the property proposed for annexation. Mr. Devon testified in favor of the annexation and rezone. Motion by Councilmember Burns, second by Councilmember Barber to approve the annexation and to instruct the City Attorney to prepare the necessary resolution, and to authorize the Planning Department to prepare a "Note of Intention" to be forwarded to the King County Boundary Review Board. MOTION CARRIED UNANIMOUSLY. 7-0. 3. Aoolication No. REZ0004-93 03.8 Application No. REZ0004-93, 03.1 ANXOOOI-93 The request of Ralph E. Rennemo to rezone 1.17 acres, located at the S.E. corner of 29th and "A" Street S.E. to C-3, Heavy Commercial. This request is in conjunction with the previous public hearing for annexation. Mayor Roegner opened the public hearing. John Devon - 2904 A Street S.E., Auburn W A Mr. John Devon introduced himself as a representative for Mr. Ralph E. Rennemo, the applicant for the rezone. Mr. John Devon testified in favor of the rezone. Motion by Councilmember Burns, second by Councilmember Borden to close the public hearing. MOTION CARRIED UNANIMOUSLY. 7-0. Motion by Council member Burns, second by Councilmember Barber to approve the rezone based upon the Hearing Examiner's Findings of Facts and Conclusions and to instruct the City Attorney to prepare the necessary ordinance. MOTION CARRIED UNANIMOUSLY. 7-0. B. Audience Particioation Mayor Roegner invited citizens in the audience to make any comments they desired to be brought before the Council. There were no requests for recognition. C. Corresoondence Mayor Pro Tem Kurle read a Christmas card he received from Betty Chambers, Auburn Community Suppers, thanking Councilmembers for monthly funding of the Auburn Community Suppers program. III. COUNCIL COMMITTEE REPORTS , /' AUBURN CITY COUNCIL MINUTES Page No.5 December 20, 1993 A. Municioal Services A3.6.4.4 Chair Brothers reported the Municipal Services Committee met prior to the meeting tonight to discuss a Cable TV item and the drug abatement activity in the Police Department. Chair Brothers recommended Council approval of Resolution No. 2450 for jail nurse services, Resolution No. 2452 for animal control services, and Ordinance No. 4654 pertaining to alcohol levels. The next meeting of the Municipal Services Committee will be Monday, January 3, 1994 at 4:30 p.m. B. Planning & Community Develooment A3.6.4.4 Chair Burns reported the Planning and Community Development Committee has not met since the last Council meeting. The next regular meeting of the Planning & Community Development Committee scheduled for December 27, 1993 is cancelled. C. Public Works A3.6.4.4 Chair Wagner reported the Public Works Committee met this evening at 5:30 p.m. to discuss engineering services contract for improvements around the Burlington Northern bridge replacement on Auburn Way South, a professional service contract for aright-of- way negotiator, and bid advertisement for Signal Interconnect Program. Chair Wagner requested support of those items as they appear later in tonight's agenda. The next meeting of the Public Works Committee will be Monday, January 3, 1994 at 5:30 p.m. D. Finance A.3.6.4.4 Chair Barber reported the Finance Committee met at 7:00 p.m. prior to the Council meeting this evening to discuss adding an additional holiday for City employees commemorating Martin Luther King, Jr., a 1993 budget amendment and adoption of claims and payroll. Chair Barber asked for support of those items as they appear later in tonight's agenda. In closing, Chair Barber welcomed Councilmember Trish Borden as a member of the Finance Committee. The next meeting of the Finance Committee will be Monday, January 3, 1994 at 7:00 p.m. IV. CONSENT AGENDA A. Minutes 1. Minutes of the December 6, 1993 regular Council meeting. B. MOTION CARRIED UNANIMOUSLY. 7-0. V. OLD BUSINESS - None. VI. NEW BUSINESS - None. VII. ORDINANCES AND RESOLUTIONS A. Ordinance No. 4651 A3.4.1, F5.2 An Ordinance of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk of the City of Auburn to execute a Service Agreement with King County for the distribution and administration of certain Washington Department of Community Development Grant Funds in 1993-1995 in accordance with the State of Washington Growth Management Act of 1990. Motion by Councilmember Burns second by Councilmember Barber to introduce and adopt Ordinance No. 4651. MOTION CARRIED UNANIMOUSLY. 7-0. 2. Ordinance No. 4652 A3.5.5.2 An Ordinance of the City Council of the City of Auburn, Washington, amending Auburn City Code Section 2.63.010 to include an additional legal holiday to commemorate Martin Luther King, Jr. Motion by Councilmember Barber second by Councilmember Borden to introduce and adopt Ordinance No. 4652. MOTION CARRIED. 5-2 with Councilmembers Brothers and Haugen voting no. 3. Ordinance No. 4653 F3.7, 1993 Budget An Ordinance of the City Council of the City of Auburn, Washington, authorizing the Mayor to accept Schedule "A" which relates to the City of Auburn 1993 Budget Reallocation of funds in various accounts in several funds pursuant to RCW 35A.33.120. Motion by Councilmember Barber second by Councilmember Brothers to introduce and adopt Ordinance No. 4653. MOTION CARRIED UNANIMOUSLY. 7-0. 4. Ordinance No. 4654 01.5, 01.8, A3.5.5.10 An Ordinance of the City Council of the City of Auburn, Washington, amending Auburn City Code Chapter 10.04 entitled "Model Traffic Ordinance Adopted By Reference"; adding a new Chapter 10.14 to the Auburn City Code entitled "Driving or Control of a Motor Vehicle While Under the Influence"; reducing the maximum permissible blood and breath alcohol levels for driving motor vehicles or being in physical control of motor vehicles inside the city limits of the city of Auburn, Washington; defining persons under the influence of intoxicating liquor or drugs; defining the evidence, test and information applicable in DWI and physical control cases; and allowing the admissibility of blood or breath refusals in DWI and physical control cases. AUBURN CITY COUNCIL MINUTES Page No. 8 December 20, 1993 Motion by Councilmember Brothers second by Councilmember Haugen to introduce and adopt Ordinance No. 4654. City Attorney Shelton provided a brief background of the proposed ordinance which he said is taken directly from State law except for the change from .1 to .08 grams or more of alcohol as shown by analysis. Mr. Shelton explained sections of the ordinance that provide for driving while under influence of intoxicating liquor or drug based on tests and actual physical control of a motor vehicle while under the influence of liquor or drug. MOTION CARRIED UNANMIOUSL Y. 7-0. B. Resolutions Prior to Council action, Stephen Shelton read the titles to each Resolution out loud. 1. Resolution No. 2450 01.7 A Resolution of the City Council of the City of Auburn, Washington, authorizing the City of Auburn Finance Director to pay seventy-five dollars per visit once a week to Annie McDonald, R.N., to provide medical screening of prisoners at the Auburn City Jail effective January 1, 1994. Motion by Council member Brothers second by Councilmember Wagner to adopt Resolution No. 2450. MOTION CARRIED UNANIMOUSLY. 7-0. 2. Resolution No. 2452 Ol.l A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk of the City of Auburn to execute an interlocal agreement with King County for animal control services. Motion by Councilmember Brothers second by Councilmember Wagner to adopt Resolution No. 2452. MOTION CARRIED UNANIMOUSLY. 7-0. 3. Resolution No. 2453 A4.5.2 A Resolution of the City Council of the City of Auburn, Washington, authorizing the City of Auburn to enter into an annual professional service contract with a professional right-of-way negotiator for 1994. Motion by Councilmember Wagner second by Councilmember Burns to adopt Resolution No. 2453. MOTION CARRIED UNANIMOUSLY. 7-0. AUBURN CITY COUNCIL MINUTES Page No.9 December 20, 1993 4. Resolution No. 2454 04.9.1, Project No. 507, 04.5.1 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute Amendment No. 4 to an Agreement for Professional Services between the City of Auburn and Sverdrup Corporation for final design work and construction engineering services for Project No. 507, Auburn Way South from 4th Street S.E. to SR 18, Burlington Northern Railroad bridge replacement. Motion by Councilmember Wagner second by Councilmember Kurle to adopt Resolution No. 2454. MOTION CARRIED UNANIMOUSLY. 7-0. 5. Resolution No. 2455 A3.4 A Resolution of the City Council of the City of Auburn, Washington, adopting the 1994 Legislative Package and requesting the Mayor of the City of Auburn to transmit said package to the Washington State Legislature. Motion by Councilmember Kurle second by Councilmember Burns to adopt Resolution No. 2455. Council member Kurle requested clarification with regard to the 1994 Legislative Agenda pertaining to the Growth Management. Mayor Roegner responded that there are proposals currently being made to be placed before the legislative session. Mayor Roegner explained that due to daily changes made to proposals, the 1994 Legislative Agenda for the City of Auburn is stated as a general policy statement. Councilmember Borden proposed rewording of the Firearms SafetylPenalties presented on page two of the 1994 Legislative Agenda. Councilmember Borden read her proposal into the record. She stated "Auburn supports legislation to tighten gun purchasing statutes, increase firearm safety around children and in public places, set minimum age requirements for their possession, increase penalties for illegal use or possession of firearms, and allow cities to prohibit possession of firearms on City property". Further discussion to clarify allowing Cities discretionary choice to prohibit firearms on any City property including buildings. Councilmember Brothers expressed concern of prohibiting firearms on any City property. Addressing Councilmember Brothers concern, Councilmember Borden agreed to strike "prohibit possession of firearms on City property" back to "to prohibit possession of firearms in council chambers" and keeping "set minimum age requirements for their possession" as part of the 1994 Legislative Package. Councilmember Borden read the recommended changes into the record. She said "Auburn supports legislation to tighten gun purchasing statutes, increase firearm education, increase firearm safety around children and in public places, set minimum age requirements for gun possession, increase penalties for illegal use or possession of firearms, and allow cities to prohibit possession of firearms AUBURN CITY COUNCIL MINUTES Page No. 10 December 20, 1993 in council chambers". The maker of the motion and the seconder of the motion accepted this substitution language. MOTION CARRIED UNANIMOUSLY. 7-0. 6. Resolution No. 2456 A Resolution of the City Council of the City of Auburn, Washington, honoring and thanking Mayor Bob Roegner for his eighteen years of service to the city of Auburn. This resolution was adopted by the Auburn City Council under I.C.1. of these minutes. VIII. MA VOR'S REPORT A. Executive Session Mayor Roegner announced there would be an Executive Session for approximately 10 minutes discuss personnel. The meeting 'recessed to at 8:25 p.m. The meeting reconvened at 8:50. Motion by Councilmember Barber to approve an average of 4.5% raise consistent with the Mayor's recommendation for Department Heads. Councilmember Brothers seconded the motion. MOTION CARRIED UNANIMOUSLY. 7-0. Mayor Roegner presented the gavel to Mayor-Elect Chuck Booth. Mayor Roegner noted he has accepted Pat Dugan's resignation as Finance Director. A reception will be held on Tuesday, December 28th in the afternoon honoring Pat Dugan's service to the city of Auburn. IX.
