Flag Salute Mayor Booth called the meeting to order at 7:30 p.m. and led those in attendance in the pledge of allegiance. B. Roll Call Those in attendance included Mayor Booth and Members of the Auburn City Council as follows: Burns, Wagner, Haugen, Borden, Barber, Brothers, and Kurle. Staff members present included Acting Police Chief Ray Sherman, Fire Chief Bob Johnson, Personnel Director Pam Sime, Parks and Recreation Director Len Chapman, Deputy Finance Director Arlene Mempa, Acting Planning Director and Public Works Director Frank Currie, Senior Planner Lynn Rued, Acting City Attorney Mike Reynolds, Assistant City Attorney Judy Ausman, and City Clerk Robin Wohlhueter. Mavor Pro- Tem A3.6.7 City Council consideration to elect Councilmember Don Kurle of the City Council to act as Mayor Pro- Tem for the 1994 year. c. Police Chief A4.5.2 City Council to confirm the appointment of David W. Purdy as the new Police Chief for the city of Auburn. It was moved by Councilmember K urle, second by Councilmember Burns to confirm the appointments as presented under I.C.2.a, I.C.2.b, and LC.2.c. MOTION CARRIED UNANIMOUSL Y. 7-0. D. Agenda Modifications The agenda modification withdraws Agenda Item VILA.l, Ordinance No. 4656 for consideration. Ordinance No. 4656 relates to an amendment to Auburn City Code Chapter 10. I 4 entitled "Driving or Control of a Motor Vehicle While Under the infJ uence". 11. CITIZEN INPlJT. PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearings - None. B. Audience Participation A3.6.4.1 Mayor Booth invited citizens in the audience to make any comments or suggestions they wished to bring to the attention of the City Council. There were no requests for recognition. C. Correspondence Mayor Booth called attention to a thank you received from Dani Daskam thanking Members of the Auburn City Council and Mayor for their thoughtful expression of sympathy. III. COUNCIL COMMITTEE REPORTS AUBURN ClTY COUNCIL MINUTES Page NO.3 January 18, 1994 A. Municipal Services A3.6.4.4 Chair Brothers reported the Municipal Services Committee did not meet today, but will meet on Monday, February 7, 1994 at 4:30 p.m. B. Planning & Community Development A3.6.4.4 Chair Burns reported the Planning and Community Development Committee met on January 10, 1994 and the minutes are of public record. He asked for support of those items as they appear in tonight's agenda. The next regularly scheduled meeting of the Planning and Community Development Committee will be held on January 24, 1994 at 7:30 p.m. C. Public Works A3.6.4.4 Chair Wagner reported the Public Works Committee met today at 5:30 p.m. to discuss Ordinance No. 4657 and a Street Delay Agreement. He requested support of those items as they appear later in tonight's agenda. The next meeting of the Public Works Committee is scheduled for Monday, January 31, 1994 at 5:30 p.m. Chair Wagner announced that the Public Works Committee meeting will meet on the 2nd and 4th Monday of each month at 5:30 p.m. rather than as reflected in the Council packet under Resolution No. 2464. D. Finance A.3.6.4.4 Chair Barber reported the Finance Committee met today to discuss Resolution Nos. 2460, 246 I. 2462, and 2463 and claims and payroll. Chair Barber requested support of those items as they appear later in tonight's agenda. The next meeting of the Finance Committee is scheduled for Monday, February 7, 1994 at 7:00 p.m. E. Council Committee on Committee Councilmember Kurle reported the Committee on Committees met on Wednesday, January 5, 1994 to discuss standing committee assignments of the Council for 1994. As a result of that meeting, it was the consensus of the Committee to retain the existing committee structure as it is presented in Resolution No. 2464 that appears later in ton igh t's agenda. IV. CONSENT AGENDA A. Minutes I. Minutes of the January 3, ] 994 regular Council meeting. B. Vouchers F4.9.2, F4.9.5 I. Payroll check numbers ] 99722 through 200215 for the pay period covering December 30, 1993 to December 31, 1993 are approved for payment in the amount of $841.608.19 this 18th day of January, 1994. Payroll check numbers 200216 to 200299 for the pay period covering January 3, 1994 to January 10, 1994 are approved for payment in the amount of $34,326.25 this 18th day of January, 1994. C. Contract Administration 1. Street Delav Agreement A3.13.7.2 Grant the Mayor the authority to execute a Street Delay Agreement with James Cox and Jeffery B. Woodward for a portion of 8th Street S.E. & 'B' Street S.E. Before proceeding, Mayor Booth asked if Councilmembers had any questions with regard to the Consent Agenda. It was moved by Councilmember K urle, second by Councilmember Burns to approve Consent Agenda Items IV.A.l through IV.C.1. Under discussion, Councilmember Borden requested Consent Agenda Item IV.C.l be pulled for discussion. Councilmember K urle amended his motion to approve Consent Agenda Items IV.A.l through IV.B.2. Councilmember Burns accepted the amendment to the motion. 1\10TION CARRIED UNANIMOUSLY. 7-0. Consent Agenda Item IV .C.I, Contract Administration for a Street Delay Agreement with James Cox and Jeffery B. Woodward for a portion of 8th Street S.E. & "B" Street S.E. Councilmember Borden requested more information with regard to the Street Delay Agreement. Frank Currie responded that Mr. Cox and Mr. Woodward are building a duplex, and have requested deferral of street improvements because it is such a small portion of an unimproved street. Moved by Councilmember Wagner, second by Councilmember Kurle to approved Consent Agenda Item IV.C.\. MOTION CARRIED 6- I with Councilmember Haugen voting no. V. UNFINISHED BUSINESS - None. VI. NEW BUSINESS - None. VII. ORDINANCES AND RESOLUTIONS AUBURN CITY COUNCIL MINUTES Page NO.5 January 18, 1994 A. Ordinances Acting City Attorney Mike Reynolds read the title to Ordinance No. 4657. 1. Ordinance No. 4656 01.5,01.8, A3.5.5.10 An Ordinance of the City Council of the City of Auburn, Washington, amending Auburn City Code Chapter 10.14 entitled "Driving or Control of a Motor Vehicle While Under the Influence" by adopting a time limitation on the analyses of blood and breath alcohol. Ordinance No. 4656 was withdrawn for consideration at this time under Agenda Item I.D., Agenda Modifications. See Agenda Item VIlLA under Executive Session for action on this ordinance. 2. Ordinance No. 4657 F4.3, 04.6.2 An Ordinance of the City of Auburn, Washington, amending Auburn City Code 13.20.440 pertaining to city of Auburn sewer rates. For consistency in the pass through Metro increases, it was moved by Councilmember Wagner for the introduction and adoption of Ordinance No. 4657 amended to read in Chapter 13.20.440 of the Auburn City Code under Fees and Charges, for a Single Family residence outside the City limits to read $22.80 instead of $20.60. Second by Councilmember Burns. Under discussion, Councilmember Brothers questioned the use of the word "sewer availability" as referred to in the Ordinance for single family residential areas. Frank Currie said it means that the sewer is available to hook up to a residential piece of property and the property owners have selected to not hook up. The availability charge is the maintenance cost to maintain the line whether they are hooked up to sewer or not. MOTION CARRIED UNANIMOUSLY. 7-0. B. Resolutions Mike Reynolds read the titles to each resolution out loud. I. Resolution No. 2459 05.4 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to enter into an InterJocal Agreement between King County and the City of Auburn to accept funds from the 1993 Regional Conservation Futures Acquisition Program. It was moved by Council member Burns, and second by Councilmember Borden to adopt Resolution No. 2459. MOTION CARRIED UNANTMOUSL Y. 7-0. AUBURN CITY COUNCIL MINUTES Page No.6 January 18, 1994 Prior to reading the titles of Resolution Nos. 2460, 2461, 2462, Acting City Attorney Mike Reynolds briefed the Council on the legality of the term of a Judge Pro Tem. He said the Judge Pro Tem appointment terminates with the outgoing Mayor, therefore, the incoming Mayor is required to reappoint all Judge Pro Tems in our court system. 2. Resolution No. 2460 A3.l6.10, A 1.4.1 A Resolution of the City Council of the City of Auburn, Washington authorizing the Mayor and City Clerk of the City of Auburn to execute a Professional Services Contract for Municipal Court Judge Pro Tem Services between the City and Duncan Charles Wilson. 3. Resolution No. 2461 A3.l6.10, Al.4.1 A Resolution of the City Council of the City of Auburn, Washington authorizing the Mayor and City Clerk of the City of Auburn to execute a Professional Services Contract for Municipal Court Judge Pro Tem services between the City and David Paul Tracy. 4. Resolution No. 2462 A3.I6.l0, A1.4.1 A Resolution of the City Council of the City of Auburn, Washington authorizing the Mayor and City Clerk of the City of Auburn to execute a Professional Services Contract for Municipal Court Judge Pro Tem services between the City and John Feutz. Motion by Councilmem ber Barber to adopt Resolution Nos. 2460, 2461, 2462. Second by Councilmember Brothers. MOTION CARRIED UNANIOUSLY. 7-0 5. Resolution No. 2463 A4.5.2 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor to appoint Michael J. Reynolds as Acting City Attorney for the City of Auburn. After reading the title to Resolution No. 2463, Mr. Reynolds pointed out there is a provision in the Auburn City Code that provides for an Acting City Attorney, and explained that under the acting capacity the City Attorney is authorized in the private practice of law to represent someone other than the City of Auburn. He said the appointed City Attorney is exclusive to the City of Auburn. It was moved by Councilmember Barber to approve Resolution No. 2463. Second by Councilmember Borden. AUBURN CITY COUNCfL MINUTES Page No.7 January 18, 1994 Under discussion, Councilmember Brothers requested from Personnel Director Pam Sime whether or not Mr. Reynolds would receive benefits as Acting City Attorney, and how the City is paying him. Ms. Sime responded that Mr. Reynolds is considered a contract employee and does not receive benefits since he maintains a primary office elsewhere. She explained the contractual agreement as it relates to time worked. Having a motion on the floor, Mayor Booth called for a vote on the motion before the Council. MOTION CARRIED UNANIMOUSLY. 7-0. 6. Resolution No. 2464 A3.7.1 A Resolution of the City Council of the City of Auburn, Washington, repealing Resolution No. 2444 passed November 15, 1993, and designating the members, powers, duties and meeting times and days of all standing committees of the City Council of the City of Auburn. Motion by Council member Kurle to amend Resolution No. 2464 to establish that the Public Works Committee will meet on the second and fourth Mondays of each month at 5:30 p.m. except for this month they will meet on the fifth Monday of the month. The City Clerk clarified the motion by reading it back into the record. Second by Councilmember Burns. MOTION CARRIED UNANIMOUSLY. 7-0. VIII. MAYOR'S REPORT Mayor Booth requested an Executive Session for approximately 30 minutes to discuss legal issues, pending litigation, and matters of personnel. He anticipated that the Council will need to take action as a result of the Executive Session. Observance of Martin Luther King Dav Prior to the recess, Councilmember Haugen complimented the Library staff in honoring Martin Luther King Day by staying open on Monday, January 17th. Councilmember Haugen encouraged her colleagues' support of this event for next year. A. Executive Session The Council meeting recessed at 7:58 p.m. The meeting reconvened at 9: 15 p.m. Even though a motion to approve Ordinance No. 4656 was unanimously passed by the Council, Acting City Attorney Mike Reynolds suggested reading the title of the Ordinance prior to official action by the City Council. Mr. Reynolds read the title to Ordinance No. 4656 as presented under VII.A.I of these minutes. AUBURN CITY COUNCIL MINUTES Page No.8 January 18, 1994 It was moved by Council member Brothers to introduce and adopt Ordinance No. 4656. Second by Councilmember Borden. MOTION CARRIED UNANIMOUSLY. 7-0. IX.
