Fla~ Salute Mayor Booth called the meeting to order at 7:30 p.m. and led those in attendance in the pledge of allegiance. B. Roll Call Those in attendance included Mayor Booth and Members of the Auburn City Council as follows: Burns, Wagner, Haugen, Borden, Barber, and Kurle. Member Brothers was excused. Staff members present included Police Chief Dave Purdy, Fire Chief Bob Johnson, Personnel Director Pam Sime, Parks and Recreation Director Len Chapman, Acting Planning Director and Public Works Director Frank Currie, Senior Planner Lynn Rued, Acting City Attorney Mike Reynolds, Assistant City Attorney Judy Ausman, City Clerk Robin Wohlhueter, and Deputy City Clerk Gayle Butcher. C. Announcements and Aooointments 1. Announcements a. Presentation of A ward AI.8 Boy Scouts of America East Side Exploring District Executive and Chief Seattle Council Mr. Rich Martindell presented an Explorer Post Recharter to Chief Purdy and acknowledged the Police Department's ten-year sponsorship to the Auburn Explorer Post. Mr. Martindell expressed pride in presenting Auburn Police Officer Willard Lathrop with the Boy Scouts of America Meritorious Award for his dedicated five-year advisory work with the Auburn Police Explorers, a certificate of his volunteer achievement, and the Boy Scout Overhand Knot patch for his uniform. Mr. Martindell further acknowledged Officer Lathrop's present volunteer duties as a Cub Scout Leader. 2. Aooointments - None D. II. CITIZEN INPUT. PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearings 1. Aoolication No. MISOO 11-93ZC 03.4.2.1.2 Application No. MISOOII-93ZC The request of La Terra Limited Partnership to amend Section 18.34.040 of the Zoning Ordinance to allow "commercial recreation, including animal racetracks" in the M-2, Heavy Industrial zone subject to the issuance of a conditional use permit. Prior to opening the public hearing, Mayor Booth explained to the audience that persons wishing to testify are requested to keep their remarks within the parameters of addressing a text amendment to Section 18.34.040 of the Zoning Ordinance. Mayor Booth also explained the hearing process would include a brief staff presentation and then the public testimony opportunity. Mayor Booth opened the public hearing. Senior Planner Lynn Rued presented page 4 of 18.34.040 which lists uses in an industrial zone and which indicates a proposed additional use to the zoning ordinance to include "Y. He explained this proposed text amendment does not specify a site, but should this text amendment be approved, the applicant would then be able to apply for a conditional use permit. Mr. Rued noted that conditional use permit issues; such as, traffic, noise, landscape requirements, would be resolved under the conditional use hearing process and not under a zoning text amendment process which was before the Council tonight. Mr. Rued added the Planning Commission has recommended the text amendment be added to the list of uses, and if the Council concurs with the Planning Commission recommendation, a conditional use permit could be reviewed by the Hearing Examiner on April 19, 1994. Mr. Rued briefly noted the possibility of the Hearing Examiner's recommendations and associated map amendment and street vacation issues being placed before the Council as early as May 16, 1994. Brent Carson. 1011 Western Avenue. Suite 902. Seattle Mr. Carson stated he was an attorney for Northwest Racing Association, and that the proposed text amendment before the Council this evening amends industrial uses allowed in an M-2 zone of the zoning ordinance. He noted this evening's discussions were not to judge the merits of a racetrack, but rather a necessary step for the applicant to be heard. He noted Northwest Racing Association is trying to save the horse racing industry in this state. By use of a color-coded overhead map, he illustrated a location identified as a proposed site for a race track. Acting City Attorney Mike Reynolds cautioned Mr. Carson that his comments had become site specific, and he advised Mr. Carson in order to continue, his comments needed to be within the parameters of the proposed text amendment. Mr. Carson removed his map overlay and stated the text amendment did not jeopardize loss of industrial land or recreational uses. He noted the text amendment is consistent with the city's comprehensive plan, zoning ordinance, and that an environmental impact statement has been prepared. He feels the key issue for Council consideration is of compatibility of recreational use. Mr. Carson noted there is broad support for the text amendment by nearby businesses and property owners as well as at the Planning Commission level. Ron Crockett. 1820 W. Valley Highwav North Mr. Crockett began his remarks by thanking the Council on behalf of the industry. He noted Auburn was close to the fan base and that he has been familiar with racetracks since boyhood, and that the text amendment would save the industry. Acting City Attorney Mike Reynolds cautioned Mr. Crockett that his comments had become site specific, and he advised Mr. Crockett in order to continue, his comments needed to be within the parameters of the proposed text amendment. AUBURN CITY COUNCIL MINUTES Page No. 4 March 21, 1994 Mr. Crockett ended his comments by requesting to testify should the discussion become site specific. Chris Clifford. 2721 Talbot Road South. Renton Mr. Clifford stated he has attended all hearings with regard to the project, and he expressed his personal appreciation for being a part of a racetrack setting. He believes a text amendment in the M-2 zone is beneficial to the city economically as well as to the environment, specifically identifying uses of opportunity for high school students and 4-H students. He introduced a Mulligan Report with regard to Habitat Island which was located at Longacres. Mr. Clifford urges the council authorize the text amendment. Mike Morrisette. 228 1st Street N.E. Mr. Morrisette stated the Chamber has reviewed the application for a text amendment. The Chamber members believe the request is compatible with M-2 uses, and that the text amendment is a minor change. He stated the text amendment provides protection for commercial uses to be compatible, and that it will not take away other industrial uses. Mr. Morrisette began noting there was considerable open land available in the area. Acting City Attorney Reynolds cautioned Mr. Morrisette his comments with regard to acreage were specific. Mr. Reynolds noted another possible hearing could result from Council's consideration of the text amendment and that both hearings had to be fair. Mr. Morrisette ended his comments by stating a text amendment change would expand the economic base for Auburn. Mike Brest. 1422 Raymond Avenue S.W.. Renton Mr. Brest stated his family's business had been located near Longacres for 25 years. It is his opinion that two types of zoning operated successfully. Raloh Vacca. P. O. Box 88258. Seattle Mr. Vacca is the general manager of a breeders aSSOCIatIon. It is his personal and professional opinion to recommend approval of recreational zoning. He noted his own personal opinion of his own boyhood experiences in going to a race track. Mayor Booth reminded Mr. Vacca his comments needed to address specifically the issue of the text amendment. Mr. Vacca apologized for misunderstanding formalities and stated he hoped for approval of recreational zoning. Bill Kaust. 17656 157th Street S.E. Mr. Kaust stated he was a land investor in Auburn and he believes the zoning amendment request is compatible. ,--- AUBURN CITY COUNCIL MINUTES Page No. 5 March 21, 1994 Marletta Deck. 5214 43rd Ct. S.E.. Lacy 98503 Ms. Deck is with a fair association. She urges a recreational zoning changes noting that without the tax benefits, 4- H activities at fairs could not have survived. Ruth Stewart. 202 29th Street N.W. Ms. Stewart stated she has lived on the site near the railroad tracks, and that the property has been in her family since 1889 when the area was known as Christopher. Acting City Attorney Reynolds cautioned Ms. Stewart from speaking on the background of a specific site, and he indicated further comments needed to address the text amendment proposal. Ms. Stewart is requesting the phrase "including animal racetracks" be deleted or change the word "including" to "excluding". She is also requesting that "commercial recreation" not mean amusement of entertainment that is unwholesome or erotic in nature. Her request to the Council is to vote no on the text amendment. Jeffrey Eustis. 505 Madison. Suite 500. Seattle Mr. Eustis is an attorney representing Citizens for the Protection of Wetlands. He is concerned that a text amendment approach is not an appropriate mechanism; he feels the appropriate approach is the rezone process. He believes land use issues are guided by the comprehensiye plan, which discusses what is appropriate in an industrial zone. He is further concerned with the term "commercial recreation" which is not defined by the zoning code and not clear. He feels commercial recreation examples are golf courses, casinos, bingo halls, etc., which attract lots of people and lots of traffic. He believes this scenario is inconsistent with the comprehensive plan and zoning code which addresses on and off site road improvements. He noted an environmental impact statement has classified Highway 167 at a level "F", which is poor. He pointed out projections of a racetrack would increase traffic approximately 18%, which is inconsistent with the zoning code. Mr. Eustis summarized that a rezone versus a text amendment is a better approach. Mike Bocatch. III H Street S.E.. Auburn Mr. Bocatch expressed concern that site specific statements were not being allowed because he believes the face of the document before the Council is site specific. Mayor Booth noted the information before the Council pertains to the requested zoning amendment. Mr. Bocatch expressed frustration with being unable to understand the hearing process. He further indicated concern with the term "animal racetracks" and believes it should be "horse racetracks". He feels the term ,-- AUBURN CITY COUNCIL MINUTES Page No.6 March 21, 1994 "animal racetracks" opens the option of allowing other types of races; such as, dog or mule races. Mr. Bocatch then began reading from the Planning Commission minutes of March 8, 1994. After reading from many passages of the Planning Commission minutes of March 8, 1994, Mr. Bocatch summarized that the Council denied an application for a vehicle emissions site located near the potential racetrack site about a year ago because of the projected volume of vehicles into the area. He believes the proposed racetrack use is incompatible because the racetrack use would increase traffic near the same intersection of the denied vehicle emissions site. Helen Johnson. 411 South 261st Street. Kent Ms. Johnson expressed her concern with prior hearing processes noting that persons wishing to present an opposing testimony could not be heard due to catcalls, and other types of noises. Ms. Johnson is worried that the text amendment would also allow other uses; such as, nude dancing. She is opposed to the proposed amendment. Mark Kaufman. 1601 2nd Avenue. Seattle Mr. Kaufman supports the proposed text amendment and feels that activities associated with racing are beneficial, specifically, the location would be a point of destination for the community. Mr. Kaufman also believes that many proponents are persons who are employed, enjoy family and community life, and should not be classified with anti-social behaviors. Patti McDonald. 32211 104th Place S.E.. Auburn Ms. McDonald stated she supports the zoning amendment. Mayor Booth asked if there were others in the audience wishing to testify. Mayor Booth noted there were no further requests. Motion by Councilmember Burns, second by Councilmember Barber, to close the public hearing on Application No. MISOO 11-93ZC. MOTION CARRIED UNANIMOUSLY. 6-0. Councilmember Kurle asked Senior Planner Lynn Rued to clear up some of the confusion he heard during the public testimony. He specifically asked why a text amendment for an M-2 zone rather than a rezone process was utilized. Mr. Rued explained that policies in an M-l area were different, but conditional use criteria were the same whether in an M-l or M-2 zone. He noted that seeking a text amendment versus a rezone was the choice of the applicant. Mr. Rued indicated state environmental laws may dictate that an alternative site analysis be done, and the property owner might not want to lose any of the heayy industrial uses in an M-2, which would result from a rezone. Mr. Rued emphasized that the conditional use process is the same for a rezone in an AUBURN CITY COUNCIL MINUTES Page No. 7 March 21, 1994 M-l or a text amendment in an M-2. The application is prepared by the applicant, and the property owner has chosen the least restrictive use in case the development of a racetrack does not occur. Councilmember Borden questioned why the term commercial recreation was used and not specify animal racetracks. Mr. Rued explained during the new zoning code development in 1987, the term was originally included in an M-l site for a proposed development called Auburn Downs. Mr. Rued noted animal racetracks would allow other types of animal racing, and he did not want to exclude that option. Councilmember Borden asked for a confirmation of her understanding that potential traffic impacts would be addressed under the conditional use process. Mr. Rued confirmed her understanding was correct. Councilmember Burns stated prior to making a motion, he wished to make some brief comments. He noted that similar racetrack use proposals have been presented over the years, and he believes the issue before the Council is to consider public policy. He commended Ms. Stewart for her testimonies on her family's history, values, and concern for the industrial valley. Councilmember Burns felt a commercial recreational area would add character and flexibility to an area primarily developed with warehouses. He belieyes it is in the best interests of the community to approve the proposed text amendment. Motion by Councilmember Burns, second by Council member Borden, to introduce and adopt Ordinance No. 4662. MOTION CARRIED UNANIMOUSLY. 6-0. B. Audience Particioation A3.6.4.1 Mayor Booth invited citizens in the audience to make any comments or suggestions they wished to bring to the attention of the City Council. Municioal Services A3.6.4.4 Vice Chair Wagner reported the Municipal Services Committee met this evening and discussed an upgrade to the electronic home detention equipment, and junior and senior high school DARE Program updates. The next Municipal Services meeting will meet on Monday, April 4, 1994 at 4:30 p.m. B. Planning & Community Develooment A3.6.4.4 Chair Burns reported the Planning and Community Development Committee met on March 14, 1994 and the minutes are of public record. He asked for support of those items as they appear in tonight's agenda. The next regularly scheduled A UBURN CITY COUNCIL MINUTES Page No. 9 March 21, 1994 meeting of the Planning and Community Development Committee will be held on March 28, 1994 at 7:30 p.m. C. Public Works A3.6.4.4 Chair Wagner reported the Public Works Committee met today at 5:30 p.m. to discuss several Supermall street right of way vacations and a technical support seryice agreement which appear on tonight's agenda. He also noted there was some discussion with regard to Puget Sound Water Quality and an Auburn Way North LID. The next meeting of the Public Works Committee is scheduled for Monday, March 28, 1994 at 5:30 p.m. D. Finance A.3.6.4.4 Chair Barber reported the Finance Committee met today to discuss Resolution Nos. 2501 and 2502 and claims and payroll. Chair Barber requested support of those items as they appear later in tonight's agenda. The next meeting of the Finance Committee is scheduled for Monday, April 4, 1994 at 7:00 p.m. IV. Ordinances Acting City Attorney Mike Reynolds read the title to Ordinance No. 4658. 1. Ordinance No. 4658 03.10.1 CUP0006-93 An Ordinance of the City of Auburn, Washington, providing for a conditional use permit to allow the construction of a 16 unit multi- family development on property zoned C-3 (heavy commercial) located at 114 21st Street S.E, within the City of Auburn, Washington. Motion by Council member Burns, second by Councilmember Barber, to introduce and adopt Ordinance No. 4658. MOTION CARRIED 5-1 with Councilmember Borden voting no. Acting City Attorney Mike Reynolds noted that while the Council had taken action on Ordinance No. 4662 under Council Agenda Item II.A.l this evening, the ordinance title needed to be read into the record. 2. Ordinance No. 4662 03.4.2.1.2 Application No. MISOOII-ZC An Ordinance of the City of Auburn, Washington, amending City of Auburn Zoning Code Chapter 18.34 to allow commercial recreation including animal racetracks in the M-2 designation, subject to a conditional use permit. Resolution No. 2493 03.5 PL T0002-93 A Resolution of the City Council of the City of Auburn, Washington, approving the preliminary plat of an 18-1ot single-family subdivision to be known as "Velvet Square" located north of 21st Street S.E., east of "M" Street S.E., within the City of Auburn, Washington. Motion by Councilmember Burns, second by Councilmember Borden, to adopt Resolution No. 2493. MOTION CARRIED UNANIMOUSLY. 6-0. 2. Resolution No. 2496 03.9 V -06-93, 03.3.4 A Resolution of the City Council of the City of Auburn, Washington, fixing a time for a Public Hearing on the petition for vacation of a portion of Industry Drive S.W. located north of 15th Street S.W., within the City of Auburn, Washington. Motion by Council member Wagner, second by Councilmember Burns, to introduce and adopt Resolution No. 2496. MOTION CARRIED UNANIMOUSLY. 6-0 3. Resolution No. 2497 03.9 V -04-93, 03.3.4 A Resolution of the City Council of the City of Auburn, Washington, fixing a time for a Public Hearing on the petition for vacation of a portion of "0" Street S.W. located north of 15th Street S.W, within the City of Auburn, Washington. Motion by Councilmember Wagner, second by Councilmember Burns, to introduce and adopt Resolution No. 2497. MOTION CARRIED UNANIMOUSLY. 6-0. 4. Resolution No. 2498 03.9 V -02-94, 03.3.4 A Resolution of the City Council of the City of Auburn, Washington, fixing a time for a Public Hearing on the petition for vacation of the northern portion of 15th Street S.W., between "0" Street S.W. and Industry Drive S.W. within the City of Auburn, Washington. Resolution No. 2499 A4.5.2 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute a Technical Services Agreement between the City of Auburn and Salem Technical ServicesjH.L. Yoh Company to procure temporary staff during the remainder of 1994. Motion by Councilmember Wagner, second by Councilmember Burns, to introduce and adopt Resolution No. 2499. MOTION CARRIED UNANIMOUSLY. 6-0 6. Resolution No. 2500 04.9.1 PR522 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute a Consultant Agreement between the City of Auburn and W & H Pacific, Inc. for Main Street in the Back of Businesses Improvements Project. Motion by Councilmember Wagner, second by Councilmember Burns, to introduce and adopt Resolution No. 2500. MOTION CARRIED UNANIMOUSLY. 6-0. 7. Resolution No. 2501 F4.9.6, Al.4.1 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk of the City of Auburn, to execute a collection service contract between the City and Renton Collections, Inc., to provide a collection service in collecting unpaid penalties, infractions, criminal fines, costs, assessments, judgment and forfeitures related to the Auburn Municipal Court. Motion by Councilmember Barber, second by Councilmember Borden, to introduce and adopt Resolution No. 2501. MOTION CARRIED UNANIMOUSLY. 6-0. 8. Resolution No. 2502 Al.4.1 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk of the City of Auburn to execute a Professional Services Contract for Municipal Court Judge Pro Tern Services between the City and Robert L. Motion by Councilmember Wagner, second by Councilmember Haugen, to introduce and adopt Resolution No. 2504. MOTION CARRIED UNANIMOUSLY. 6-0 VIII. MAYOR'S REPORT City Council Workshoo A3.6.4.4 Councilmember Kurle requested a brief discussion with regard to a possible Council workshop/retreat to be set up for either April 30 or May 7 to discuss goal setting, working relations, etc., and that the workshop/retreat be conducted by a facilitator. Council member Borden agreed to work with Mayor Booth in proposing a location and facilitator and present costs of such a workshop/retreat at the next Council meeting, April 4, 1994. Arts Commission A3.8.2 Councilmember Haugen expressed her appreciation of the Youth Arts Display at City Hall this month. Parks & Recreation Director Len Chapman stated he would be sure the Arts Commission knew of her appreciation. IX.
